2013-11-05 City Council MinutesMINUTES OF THE REGULAR CITY COUNCIL MEETING OF THE CITY OF VERNON HELD TUESDAY, NOVEMBER 5, 2013, IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA MEMBERS PRESENT: McCormick, Davis, Maisano, and Ybarra MEMBERS ABSENT: Martinez The meeting was called to order at 9:00 a.m. by Mayor McCormick. Councilmember Ybarra led the flag salute. CHANGES TO THE AGENDA Interim City Clerk Dana Reed announced that in addition to the Light and Power Department presentation on its respective pages on the new City website, the presentation will be expanded to include a report on the City website usage. PUBLIC COMMENT Interim City Clerk Dana Reed announced that this was the time allotted for public comment. Mayor McCormick inquired whether anyone in the audience wished to address the City Council. No one responded. PRESENTATIONS 1. Presentations from the Light and Power Department on its respective pages of the new City website and report on the City website usage. Director of Light and Power Carlos Fandino presented the Department’s web pages. He highlighted the Customer Service section which provided extensive information as well as the application for service. He advised that in the future there may be a page dedicated to information on power outages as they occur; including a notification to customers. However, the details are still being vetted. Programmer/Analyst Jared Miller reported on tracked information on visitors to the City’s website. The old website had approximately 900 visits per day; that number has increased 83% to approximately 1,600 per day. Information on the new website is more accessible and open to search engines. Miller reported on the average visit, including the most popular pages, and the location of the visitors by country and general City. He reported on the “contact us” form and other online contact features. In response to Mayor McCormick’s inquiry on Exide Technologies’ (“Exide”) information on the website, Miller reported that there is now an “Exide Update” link featured on the City’s homepage. He reported on the information and resources available. Public Information Officer Fred MacFarlane explained that the rationale behind the “Exide Update” is a result of the influx in request received for information related to Exide. Rather than Regular City Council Meeting Minutes November 5, 2013 Page 2 of 12 have residents and interested parties rely on the media, it is important to compile the information that also provides the City’s analysis as well as links to various resources. The intent is to keep the page updated as things occur. PUBLIC HEARINGS 1. Public hearing on the ordinance amending Chapter 21 of the Vernon Municipal Code, “Sewer and Storm Drains.” Director of Community Services and Water Kevin Wilson reported on the adoption of the Municipal National Pollutant Discharge Elimination System (NPDES) Permit by the California Regional Water Control Board which became effective on December 28, 2012. As such, the City’s Municipal Code needs to be updated in order to conform and provide for enforceable language. Previously, the draft Low Impact Development (“LID”) Ordinance was presented to the City Council. The proposed ordinance amends several sections of the LID and sections of the Municipal Code in order to fully comply with the NPDES Permit. Wilson reported and explained some of the more notable changes, including LID requirements for new development and its applicability to redevelopment projects. Staff is working alongside the Health and Environmental Control Department and Legal Counsel Christina Sansone on developing guidelines for developers. The City of Los Angeles’ Guidelines are being used as a starting point. Wilson reported on the implementation of the LID requirement on two recent projects. At 9:36 a.m., Mayor McCormick opened the public hearing on the ordinance amending Chapter 21 of the Vernon Municipal Code, “Sewer and Storm Drains.” With no public comment, Mayor McCormick closed the public hearing at 9:36 a.m. Ordinance No. 1216 - An Ordinance of the City of Vernon, California, amending certain Sections of Chapter 21 of the Code of the City of Vernon regarding Sewers and Storm Drains to comply with the Municipal National Pollutant Discharge Elimination System (NPDES) Permit (first reading). Recommendation: (1) Finds that this action is exempt under the California Environmental Quality Act (“CEQA”) as follows: (a) The ordinance is exempt from CEQA pursuant to CEQA Guidelines Section 15308 in that the ordinance is an action taken by the City in its role as a regulatory agency authorized by state regulation and is intended to assure the maintenance, restoration, enhancement, or protection of the environment where the regulatory process involves procedures for protection of the environment. No construction activities or relaxation of standards allowing environmental degradation are proposed in conjunction with the adoption of this ordinance; and Regular City Council Meeting Minutes November 5, 2013 Page 3 of 12 (b) The ordinance is covered by the general rule set forth in CEQA Guidelines Section 15061(b)(3) which provides that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. Here, the Ordinance involves procedures for the protection of the environment and has no significant adverse effect on the environment. (2) Hold the first reading of Ordinance No. 1216 amending certain sections of Chapter 21 of the Code of the City of Vernon regarding Sewers and Storm Drains to comply with the municipal National Pollutant Discharge Elimination System (NPDES) Permit. It was moved by Davis and seconded by Maisano to approve the first reading of Ordinance No. 1216. Motion carried, 4-0. CONSENT CALENDAR It was moved by Davis and seconded by Ybarra to approve the matters listed on the Consent Calendar as presented. Motion carried, 4-0. Approval of Amendment No. 2 to the Services Agreement for Refuse Collection, Recycling and Disposal Services between the City of Vernon and Consolidated Disposal Service, LLC. Recommendation: (1) Find the proposed Amendment No. 2 to the Services Agreement for Refuse Collection, Recycling and Disposal Services between the City of Vernon and Consolidated Disposal Service, LLC is exempt under the California Environmental Quality Act (“CEQA”) in accordance with Section 15061(b)(3), the general rule that CEQA only applies to projects that may have an effect on the environment; and (2) Authorize the City Administrator to enter into Amendment No. 2 to the Services Agreement for Refuse Collection, Recycling and Disposal Services between the City of Vernon and Consolidated Disposal Service, LLC by amending Exhibit A (“Scope of Services”) and Exhibit B (“Fees”) to reflect reductions in disposal pickup cycles and various bin sizes. The net result is a cost savings of $783.34 monthly or $9,400.08 annually. 10. Acceptance of Work for Contract No. CS-0369, Citywide Slurry Seal, Phase II. Recommendation: (1) Affirm that accepting the work of Petrochem Manufacturing, Inc. for the Citywide Slurry Seal, Phase II Project, Contract No. CS-0369, is exempt under the California Environmental Quality Act (“CEQA”) in accordance with Section 15301, Existing Facilities, part (c), existing highways and streets, Regular City Council Meeting Minutes November 5, 2013 Page 5 of 12 because the project is merely o repair existing street; and (2) Accept the work by Petrochem Manufacturing Inc., as part of the Citywide Slurry Seal, Phase II Project, Contract No. CS-0369. Fire Department 11. Activity Report for the period of October 1, through October 15, 2013, to be received and filed. Police Department 12. Activity Log and Statistical Summary of Arrest and Activities for the period of October 1, through October 15, 2013, to be received and filed. 13. Authorization to execute the Agreement for the Avoid the 100 DUI Campaign (West) Los Angeles County. Recommendation: (1) Find that the approval of the agreement with the City of Gardena Police Department is exempt under the California Environmental Quality Act (“CEQA”). In accordance with Section 15061(b)(3); the general rule is that CEQA only applies to projects that may have an effect on the environment; and (2) Authorize the City Administrator to execute an agreement between the City of Vernon and the City of Gardena, in substantially the same form as submitted, for continued participation in the Avoid the 100 DUI Campaign (West) Los Angeles County. 14. Approval of WeTip Anonymous Crime Reporting Membership Agreement. Recommendation: (1) Find that the proposed membership agreement with WeTip Inc., for participation in the WeTip anonymous crime reporting program as detailed in the staff report is exempt under the California Environmental Quality Act (“CEQA”). In accordance with Section 15061(b)(3), the general rule is that CEQA only applies to projects that may have an effect on the environment; and (2) Authorize the Police Chief to execute a membership agreement with WeTip Inc., in substantially the same form as submitted herewith, for participation in the anonymous crime reporting program. NEW BUSINESS Community Services and Water Department 1. Resolution No. 2013-92 - A Resolution of the City Council of the City of Vernon supporting the 2013 Third Amended Judgment to the Central Basin Groundwater Adjudication to provide for storage and extraction of groundwater and authorizing the City to conduct all actions necessary or advisable concerning the related litigation. Regular City Council Meeting Minutes November 5, 2013 Page 6 of 12 Recommendation: (1) Find that approval of the proposed 2013 Third Amended Judgment regarding Groundwater Storage in the Central Groundwater Basin, is exempt under the California Environmental Quality Act (“CEQA”) in accordance with Section 15061(b)(3), the general rule that CEQA only applies to projects that may have an effect on the environment; and (2) Approve a Resolution supporting the proposed 2013 Third Amended Judgment regarding Groundwater Storage and Extraction in the Central Water Basin and authorizing the City to review and execute any documents necessary to implement and carry out the purposes of any Court proceedings related to the proposed 2013 Third Amended Judgment; and (3) Approve the City’s execution of the 2013 Third Amended Judgment, in substantially the same form as submitted as Attachment A. Director of Community Services and Water Kevin Wilson advised that the City of Vernon is a party to ongoing litigation regarding groundwater storage. He reported on the history of the judgment. The judgment names who can extract from the Central Basin, but does not reference ground water storage. There is space to store, but the method of doing so is what needs to be resolved. Without a storage plan, the region cannot plan for growth. The consensus among all the agencies is that a well thought-out plan is beneficial. In 2009, attempts to amend the original judgment were made, but several cities objected. Since then, those that objected have met and now reached an agreement. Wilson reported on the proposed amendment to the judgment. It was moved by Maisano and seconded by Ybarra to approve Resolution No. 2013-92. Motion carried, 4-0. Health and Environmental Control Department 2. Approval for Amending the Voluntary Cleanup Agreement with the Department of Toxic Substances Control (DTSC) for the Thermador Site at 5119-5309 District Blvd. and at 4675 52nd Street, by subdividing the property into sections to facilitate the expedited closure of the site. Recommendation: (1) Find that approval of the proposed changes to the Voluntary Cleanup Agreement is exempt under the California Environmental Quality Act (“CEQA”) in accordance with CEQA Guidelines section 15061(b)(3), the general rule that CEQA only applies to projects that may have an effect on the environment, and 15330, because the agreement authorizes minor substance cleanup efforts costing less than $1 million; and (2) Authorize the City Administrator, or his designated staff, to modify the previously approved Voluntary Cleanup Agreement between the City of Vernon and the Department of Toxic Substances Control (DTSC) in order to facilitate the expedited closure of the site, provided that at the time the contract is entered into, DTSC estimates the total cost of DTSC’s Regular City Council Meeting Minutes November 5, 2013 Page 7 of 12 oversight costs relating to the Voluntary Cleanup Agreement will not exceed $100,000. Director of Health and Environmental Control Leonard Grossberg advised that with the redevelopment of the Thermador site, it is recommended that the property be split into three different sections to assist with the process. Additionally, a new Voluntary Cleanup Agreement is proposed. It was moved by Davis and seconded by Maisano to approve the amendment to the Voluntary Cleanup Agreement with the Department of Toxic Substances Control (DTSC) for the Thermador Site at 5119-5309 District Boulevard and at 4675 52nd Street. Motion carried, 4-0. 3. Resolution No. 2013-93 - A Resolution of the City Council of the City of Vernon ratifying the submission of comments by the Mayor of the City of Vernon to the South Coast Air Quality Management District regarding the proposed Amended Rule 1420.1. Recommendation: (1) Find that approval of submission of comments is exempt under the California Environmental Quality Act (“CEQA”) in accordance with CEQA Guidelines sections [a]15061(b)(3), the general rule that CEQA only applies to projects that may have an effect on the environment; and (2) Ratify the submission of a comment letter by the Mayor of Vernon, to the South Coast Air Quality Management District (AQMD) regarding its Proposed “Amended Rule 1420.1”. Interim City Clerk Dana Reed announced that the comments are available for public review and are accessible on the City’s website. Director of Health and Environmental Control Leonard Grossberg reported on the ratification of the comments submitted to AQMD regarding new regulations for lead acid recycling facilities, which are applicable to Exide Technologies (“Exide”). Said comments are posted on AQMD’s website alongside other public comment. AQMD is not scheduled to meet on the issue until early December. The amended Rule, if approved, will not take effect until January 2014 and be final by January 1, 2015. In response to Mayor McCormick, Grossberg advised that with the use of technology, it is possible for Exide to meet the new standards, and that Exide is eager to do so. In further response to Mayor McCormick, Grossberg explained that when there is an exceedance, notification to the public is issued by AQMD. However, when and to whom notification should be given depends on emission levels and other various provisions. There is no requirement to notify the public until these levels have been reached. Furthermore, the City’s Municipal Code does not require that public notification be issued by Exide. In response to Councilmember Ybarra, Grossberg advised that most lead readings meet the amended Rule requirements. He noted that Regular City Council Meeting Minutes November 5, 2013 Page 8 of 12 prior to this year, with the introduction of the proposed amendment, there were no standards for arsenic emissions. In response to Councilmember Maisano, Grossberg explained that there are interim limits for arsenic levels in order to meet the limits set forth by Amended Rule 1420.1. By January 1, 2015, all standards should be met. Mayor McCormick stated that as part of the approval he directs staff to invite officials from the Los Angeles County of Public Health Department to an upcoming City Council meeting for the purpose of receiving a briefing on how and when blood testing will be conducted and further directs staff to assess the City’s capabilities to assist the County and provide locations in Vernon where blood tests can be administered. Grossberg notes the directives and added that staff is working with the Police and Fire Departments to identify locations for the blood testing within Vernon. As information regarding the blood tests becomes available, it will be posted on the City’s website. In response to Councilmember Ybarra’s inquired on the blood tests, Grossberg advised that lead levels will be tested; however, he is unsure whether there is a blood test for arsenic. If significant lead levels are detected, further investigations will be conducted to determine the source. In response to Mayor Pro-Tem Davis’ concerns, Grossberg explained the difficulties and questions posed to AQMD regarding the arsenic testing and monitoring. In response to Councilmember Maisano, Grossberg advised that he is not aware of an incident with high lead blood results in the general public due to Exide. He added that Exide conducts lead blood tests for its employees on a monthly basis. These tests will be a valuable source of information. In response to Independent Reform Monitor John Van de Kamp, Grossberg advised that Exide employees are well protected with respect to lead exposure. Additionally, employees are required to change clothing before and after each shift. Through personal testimony at public hearings, Exide employees have reported no concerns. Councilmember Ybarra inquired whether Exide’s employees’ test results will be used as a baseline for comparing the public’s blood tests. In response, Grossberg advised that the Los Angeles County Health Department will be administering the tests; this will need to be discussed in order to determine what will be used as the control. It was moved by Ybarra and seconded by Davis to approve Resolution No. 2013-93 along with the additional directives to staff as requested by Mayor McCormick. Motion carried, 4-0. Light and Power Department 4. Rejection of Competitive Bids Received for Transformers and Switches, and Authorization of a Rebid. Regular City Council Meeting Minutes November 5, 2013 Page 9 of 12 Recommendation: (1) Find that the approval requested is exempt under the California Environmental Quality Act (“CEQA”) in accordance with Section 15061(b)(3), the general rule that CEQA only applies to projects that may have an effect on the environment; and (2) Reject the bids received for the October 21, 2013, Invitations to Bid for Transformers and Switches as more fully described in the Staff Report and authorize a rebidding on essentially the same terms and conditions as the original bid, with fine tuning of the detailed and technical portions of the specifications. Director of Light and Power Carlos Fandino reported on the completion of the three bid requests process. There were deficiencies in the process. As such, staff recommends that the process be redone, addressing the deficiencies in order to further the good governance reform efforts and ensure a competitive and transparent process. There is no fiscal impact. It was moved by Maisano and seconded by Ybarra to reject the competitive bids received for transformers and switches, and authorize a rebid. Motion carried, 4-0. 5. Request Approval of the Addition of “Operations Manager” Position to the Light and Power Departmental Budget. Recommendation: (1) Find that the approval requested is exempt under the California Environmental Quality Act (“CEQA”) in accordance with Section 15061(b)(3), the general rule that CEQA only applies to projects that may have an effect on the environment; and (2) Approve the addition of “Operations Manager” position to Light & Power departmental budget and authorize the Director of Light & Power to initiate the recruitment process and hire for this role, which is a critical component in the safe and efficient operation of the Transmission and Distribution System. The salary requirement for this position will not exceed $14,137 per month, per the existing City of Vernon Master Salary Schedule. Director of Light and Power Carlos Fandino reported that historically the position existed within the Department, but when he assumed the position of Director of Light and Power, he also assumed the responsibilities of the Operations Manager. The Department was trying to fill the positions with internal candidates; however, there is now a need to open this position to the public, for an open competitive process. The position was not part of the fiscal year’s budget. Fandino reported on the not to exceed salary and the position’s responsibilities. It was moved by Davis and seconded by Maisano to approve the addition of “Operations Manager” position to the Light and Power Department Budget. Motion carried, 4-0. Regular City Council Meeting Minutes November 5, 2013 Page 10 of 12 ORDINANCES 1. Ordinance No. 1215 - An Ordinance of the City Council of the City of Vernon, California, correcting Section 5.22(c)(8) of Article II of Chapter 5 of the Code of the City of Vernon to reduce the rate of the Business License Tax for Catering Vehicle Businesses (“Hot Food Trucks”) (second reading). Recommendation: (1) Find that correcting Section 5.22(c)(8) of the Code of the City of Vernon, which modified the annual Business License Tax for hot food catering vehicles, is exempt under the California Environmental Quality Act (“CEQA”) in accordance with Section 15061(b)(3). The general rule is that CEQA only applies to activities that may have an effect on the environment. Modifying the annual business license tax rates would not be subject to CEQA; and (2) Adopt Ordinance No. 1215, correcting the Annual Business License Tax rate for Catering Vehicle – Hot Food to reduce the rate and mirror the County of Los Angeles at $787.00/yr. This will correct a clerical error which resulted in the rate not being changed at all for hot food trucks. There being no questions to staff, it was moved by Maisano and seconded by Davis to adopt Ordinance No. 1215. A roll call vote was taken: - Councilmember Ybarra, yes - Councilmember Maisano, yes - Mayor Pro-Tem Davis, yes - Mayor McCormick, yes Motion carried, 4-0. ORAL REPORTS Police Chief Daniel Calleros reported on a commercial burglary that occurred on October 21, 2013, in a vacant building wherein copper wire was stolen. On October 28, 2013, over 100 boxes of clothing were stolen from a local business. Although the cargo theft investigation team arrested two suspects for the break-in, the case was rejected pending further investigation. Staff anticipates that evidence collected at the scene of the crime will connect the two suspects to the burglary once it is processed. On November 4, 2013, patrol sergeant stopped a commercial burglary in process during the check of a stopped vehicle in a no parking zone. Based on evidence found at the scene, a male and a female suspect were taken into custody for suspicion of burglary. Calleros announced Movember and the participation of several members of the Police Department, including himself, in the annual charity where men nationwide grow out their moustache to raise funds and awareness for prostate cancer and other male related cancers. Regular City Council Meeting Minutes November 5, 2013 Page 11 of 12 Captain Michel Gillman announced that there was no vandalism to report. Battalion Chief David Lazar announced the upcoming Spark of Love toy drive. He advised that the Haz Mat physicals are nearly completed. Hazardous material training for Area E will be conducted this month. Significant incidents included a response to a smoke alarm that was caused by fumigation, response to a container fire cause by the transport of hazardous materials that spontaneously ignited, and a tanker truck fire on the 710 freeway that was carrying crude oil. Director of Community Services and Water Kevin Wilson reported on a letter received regarding a curve at District Boulevard east of Corona. A study was conducted at said location; staff is working on a solution for this high incident location. He reported on possible solutions. Director of Light and Power Carlos Fandino reported on two power outages that occurred on October 26, 2013, due to a Mylar balloon and on October 29, 2013, caused by a possum. Fandino reported on new utility users and on existing users that are updating their facilities. Agreements for gas service to new customers are in progress; arrangements are being made to connect the customers. Fandino will be providing an update on the renewable portfolio standards at the next Council meeting. Finance Director William Fox advised that at the next City Council meeting he will be presenting the quarterly budget review. The financial audit is still in process; completion is anticipated by mid-December. Once finalized, the financial audit will be available on the City’s website. Director of Health and Environmental Control Leonard Grossberg advised that the Department is working on the California Environmental Reporting System for hazardous material inventories. Grant funds will be used for a part-time employee to assist in the process. The system is anticipated to be online by the end of the year. He announced the cancellation of the Sustainable Development and Energy Efficiency Commission meeting in October. An Agenda item will be scheduled on the Commissions determination on the trash hauler program. Human Resources Director Teresa McAllister reported on the upcoming health and benefits open enrollment. She reported that enrollment in the new plans, effective January 1, 2014, will need to be conducted online or over the phone. Several informational meetings are scheduled. The classification and compensation study continues. Employees’ input on the draft classifications is being reviewed. The compensation data is to be distributed later this month. As part of the efforts to improve employee morale, a successful Halloween event was held. There was a lot of participation. Regular City Council Meeting Minutes November 5, 2013 Page 12 of 12 The next event will include employee recognition and awards in conjunction with a holiday event. City Administrator Mark Whitworth announced that the Vernon Chamber of Commerce along with the Los Angeles Economic Development Corporation will be hosting an Economic Forecast and Industry Update event on Thursday, November 7, 2013. Whitworth thanked McAllister for the morale boosting Halloween event. An Exide Technologies policy working group was formed and has addressed many of the issues. The group worked on getting the information on the City’s website. This ensures that the City’s message is part of the process; reduce exposure and still see businesses be productive and profitable. He reported on the trip to Tehachapi hosted by the Light and Power Department. There are many possibilities for future energy projects. The City will review all possible options in order to address not only possible revenue streams but the needs of the renewable portfolio standards. Grant writers at California Consulting have been working with Cesar Zaldivar-Motts of the Southeast Community Development Corporation which operates the Vernon Mobile Computer Lab and discussing grant opportunities for the project. The mobile computer lab serves the community well and continues to be booked six month in advanced. A meeting between California Consulting and the City of Maywood has been facilitated. Grant opportunities to install solar panels on City owned buildings in Maywood and the needs at Slauson Park are being reviewed. Assistant to City Administrator Alex Kung is attending various conferences, most currently a customer connection conference which address economic development. The City wishes to expand and bring in new customers to Vernon. Whitworth reported on the attendance to the CalPERS Education forum. He advised that the Vernon Housing Commission had cancelled its last meeting but is scheduled to meet on December 11, 2013. He thanked Jared Miller of the IT Department for the presentation on the City’s website. He noted that the Los Angeles County Fire Chief has responded to the request for the evaluation on how the County can provide fire services to Vernon and at what cost. The information will be presented so that an informed decision can be made. With no further business, at 10:32 a.m., it was moved by Maisano and seconded by Davis, to adjourn the meeting.
