Resolution No. SDEEC-7 - A Resolution of the Sustainable Development and Energy Efficiency Commission of the City of Vernon setting the date, time and place for regular meetings. Recommendations (1) Find that adoption of the proposed resolution to amend the Sustainable Development & Energy Efficiency Commission Regular Meeting Schedule is exempt under the California Environmental Quality Act (“CEQA”) in accordance with CEQA Guidelines Section 15061(b)(3), the general rule that CEQA only applies to projects that may have an effect on the environment; and (2) Adopt a resolution to set the SDEEC’s regular meeting schedule to be on the third Wednesday of March, June, September, and December (quarterly) at 3:30 p.m. Regular Sustainable Development and Energy Efficiency Commission Meeting Minutes December 18, 2013 Page 2 of 4 Currently the regular meetings are held bi-monthly, and not every three months, as proposed. Commission Director Leonard Grossberg reported on staff’s recommendation to change the regular meeting schedule from bi- monthly to quarterly meetings. This will reduce the number of meetings per year to four and potentially reduce the need to cancel meetings. In response to Chairperson Garcia’s request for the Commission to address items such as key metrics and their sustainability in conjunction with Eco Telesis, Deputy City Attorney recommended that the request be established as a directive to staff to agendize for a future meeting. It was moved by Gavina and seconded by Villanueva to approve Resolution No. SDEEC-7. Motion carried, 5-0. 2. Resolution No. SDEEC-8 - A Resolution of the Sustainable Development and Energy Efficiency Commission of the City of Vernon repealing Resolution No. SDEEC-3. Recommendations (1) Find that adoption of the proposed resolution to repeal the Sustainable Development & Energy Efficiency Commission Travel and Expense Reimbursement Policy and Procedures is exempt under the California Environmental Quality Act (“CEQA”) in accordance with Section 15061(b)(3), the general rule that CEQA only applies to projects that may have an effect on the environment; and (2) Adopt a resolution to repeal Resolution No. SDEEC-3, which approved a Sustainable Development & Energy Efficiency Commission Travel and Expense Reimbursement Policy and Procedures, in light of an updated citywide Expense Reimbursement Policy recently adopted by the Vernon City Council. This would confirm that the SDEEC is subject to the citywide reimbursement policy as it may be amended from time to time. Commission Director Leonard Grossberg reported that a travel and expense reimbursement policy was previously adopted by the Commission. Since then, the City Council has adopted a revised policy in conformance with best practices and IRS standards. It is their intent that said policy be used by all City agencies and boards including the Sustainable Development and Energy Regular Sustainable Development and Energy Efficiency Commission Meeting Minutes December 18, 2013 Page 3 of 4 Efficiency Commission. Staff is recommending that the previously adopted policy be repealed, and that the Commission accept and confirm the City’s policy. It was moved by Corselli and seconded by Honda to approve Resolution No. SDEEC-8. Motion carried, 5-0. ANNOUNCEMENTS AND ORAL REPORTS 1. Report on the City Council’s decision rendered in response to the Sustainable Development and Energy Efficiency Commission’s recommendations on the Solid Waste Hauler Program. Commission Director Leonard Grossberg reported on the Commission’s recommendation on the Solid Waste Hauler program to the City Council. The recommendation was presented and approved by the City Council on December 3, 2013. Deputy City Attorney Scott Porter further added that procedurally a revised ordinance incorporating the approved elements and some administrative components, housekeeping items, will be proposed to the City Council. Grossberg advised that haulers have had no objection to the housekeeping elements; additionally, these are areas that staff can administratively modify as provided in the current agreement. 2. Brief reports on activities, other brief announcements, and directives to staff. Commission Director Leonard Grossberg reported on the future expiration of three of the Commissioners’ terms: Honda, Villanueva and Gavina. In January, staff will be soliciting applications to fill the vacancies. He advised the three Commissioners that if they are interested in continuing their service on the Commission, to please apply. The new terms will be for four years. It is anticipated that the Council will make the appointments before the next Commission meeting in March 2014, at which the Chairperson and Vice Chairperson will be elected. In response to Commissioner Corselli, Grossberg advised that if there is something the Commission wished to address, they should email staff in order for the matter to get agendized. Election of Chairperson and Vice Chairperson to the Sustainability Development and Energy Efficiency Commission (“SDEEC”) for 2014. Special Sustainable Development and Energy Efficiency Commission Meeting Minutes March 26, 2014 Page 2 of 5 Recommendations (1) Find that the election of Chairperson and Vice Chairperson is exempt from the California Environmental Quality Act (“CEQA”) in accordance with Section 15061(b)(3), the general rule that CEQA only applies to projects that may have an effect on the environment; and (2) The SDEEC elect a Chairperson and Vice Chairperson of the SDEEC to serve a one year term. The Chairperson and Vice Chairperson must be from different appointing categories. Due to term limits, the existing Chairperson, Hector Garcia, cannot be reelected to serve as Chairperson. Commission Director Leonard Grossberg thanked Garcia for serving as Chairperson. He advised that the Commission is to elect a new Chairperson and Vice Chairperson. Grossberg explained the term limit for the Chairperson and the requirement that the elected be from different silos. Commissioner Corselli nominated Honda to serve as the Chairperson. With no other nominations, the motion carried, 5- 0-1, with Honda abstaining. Commissioner Corselli nominated Garcia as the Vice Chairperson. Deputy City Attorney Scott Porter clarified that because Honda and Garcia are representatives from the same category, Garcia was not eligible to service as Vice Chairperson. Commissioner Corselli amended his motion and nominated Gavina to serve as Vice Chairperson. With no other nominations, the motion carried unanimously, 6-0. Honda was elected Chairperson and Gavina was elected Vice Chairperson. 2. Resolution No. SDEEC-9 - A Resolution of the Sustainable Development and Energy Efficiency Commission of the City of Vernon adopting a work plan and budget for fiscal year 2014-2015. Recommendations (1) Find that merely recommending a proposed budget, and a possible scope of action are not final actions subject to the California Environmental Quality Act (“CEQA”), Special Sustainable Development and Energy Efficiency Commission Meeting Minutes March 26, 2014 Page 3 of 5 and that even if they were, they would be exempt from CEQA under Guidelines section 15061(b)(3), the general rule that CEQA only applies to projects that may have an effect on the environment; and (2) Adopt a resolution approving the proposed work plan and request for budget authorization of $20,000 for the Sustainable Development and Energy Efficiency Commission for fiscal year 2014-2015, and direct staff to submit said plan and budget to the City Council for review and approval. Commission Director Leonard Grossberg reported on the proposed work plan and budget. To clarify the Commission’s involvement in conditional use permit and variance review, Deputy City Attorney Scott Porter advised that the Commission will be able to provide input on sustainability and energy efficiency standards. The City Council will ultimately be taking action on proposed projects. Grossberg encouraged the Commission to comment on other proposed items during City Council meetings. In response to Commissioner Corselli, Grossberg confirmed that Commissioners can address the Council as a member of the Sustainable Development and Energy Efficiency Commission or as a member of the public. Grossberg encouraged the Commission to make additions to the work plan if the proposed did not address all components. Commissioner Corselli opined that in addition to developing tools and programs to education Vernon residents and business, the work plan should include the surrounding communities. One of Vernon’s biggest issues is how others perceive it. He recommended an amendment to include the surrounding communities. In response to Chairperson Honda’s inquiry, Commissioner Corselli advised that he is recommending a revision to the work plan in order to clarify language. He is not requesting an amendment to the budget. It was moved by Corselli and seconded by Andreoli to amend the work plan to include surrounding communities as part of the “Develop tools and programs to educate Vernon’s residents and Special Sustainable Development and Energy Efficiency Commission Meeting Minutes March 26, 2014 Page 4 of 5 businesses on sustainability related goals and successes.” Motion carried, 6-0. Grossberg reported on the proposed budget which is the same as in previous years. It was moved by Corselli and seconded by Garcia to approve Resolution No. SDEEC-9 with the amendment. Motion carried, 6-0. ORAL REPORTS 1. Brief reports on activities, other brief announcements, and directives to staff. Commission Director Leonard Grossberg reported on the upcoming proposal to change the Commission’s name to the Green Vernon Commission so that it is more synonymous with the Commission’s goals. Chairperson Honda inquired whether the change would be publicized as this is a positive. Commissioner Garcia is pleased with the proposal. He opined that sustainable development and energy efficiency could be a mission statement. There are many regulations that impact Vernon’s small community, the Commission is a forum to showcase what the City has done and how it will move forward in its efforts to be a model City. Deputy City Attorney Scott Porter clarified that the Ordinance is still in draft format. In addition to the proposed name change, the ordinance will include other proposed revisions. It is anticipated that it will be presented to Council in April or May 2014. Porter additionally announced that in the upcoming months the City is proposing to revise its Zoning Ordinance and General Plan. Public workshops will be held. The Commission’s input will be part of the process. Commissioner Corselli recalled that the Advisory Committee on Business Development provided input on the General Plan and Zoning Ordinance during its last update. He is in agreement that this Commission should provide input. Special Sustainable Development and Energy Efficiency Commission Meeting Minutes March 26, 2014 Page 5 of 5 Commissioner Garcia added that many issues involve the California Environmental Quality Act and other environmental components, this Commission will be able to assist and provide input on those matters. Commission Director Leonard Grossberg announced the groundbreaking on April 25, 2014, for the Vernon Village Park Apartments and the groundbreaking on April 26, 2014, for the artificial turf, soccer field at Salt Lake Park in the City of Huntington Park. He reported on a workshop on April 29, 2014, in Sacramento on alternative technology and energy projects from the Waste Board. He advised the Commission that if any are interested in attending, to please contact him. Background The Political Reform Act requires each local agency to adopt and update its Conflict of lnterest Code ("Code") biennially, if necessary. The Code must enumerate the positions "which involve the making or participation in the making of decisions which may foreseeably have a material effect on any financial interest of that position." The Code must also specifu the categories of financial disclosure that are required for each designated position. Each individual holding a position listed within the Code must file a "Statement of Economic Interest" (the "Form 700") and disclose his or her financial interests in the specified categories. Government Code Section 87306.5 requires the City, and local agencies, boards and commissions to review their conflict of interest codes before October 1't: "87306.5. No later than July I of each even-numbered year, the code reviewing body shall direct every local agency which has adopted a Conflict of Interest Code in accordance with this title to review its Conflict of Interest Code and, if a change in its code is necessitated by changed circumstances, submit an amended Conflict of Interest Code in accordance with subdivision (a) of Section 87302 and Section 87303 to the code reviewing body." Currently the City and all City affiliated agencies, boards, and commissions have their own stand-alone Conflict of lnterest Codes. On June 17, 2014, the City Council directed each board, agency, committee, and commission affrliated with the City to review its Conflict of Interest Code, and to, by October 1,2014, either submit proposed revisions to City Council or recommend that no revisions be made. To improve administration, staff was directed to compile all proposed conflict of interest codes into one Master Conflict of lnterest Code applicable to all City of Vernon agencies, boards, and commissions. To facilitate the review process, the existing Conflict of Interest Code applicable to the Green Vernon Commission, Resolution No. SDEEC-2 is provided. Staff recommends that the Commission approve the attached schedules as part of the proposed revisions to the City Council. The City Council of fte City of Vemon has furtlrer adopted Ordinance No. I 188 which requires the Sustainable Development and Energy Efficiency Commission to adopt a Conllict of Interest Code. The Fair Political Practices Commission has adopted a regulation, 2 Califomia Code of Regulations Section 18730, which contains the terms of a standard conllict of interest code which may be incorporated by reference and which may be amended by the Fair Political Practices Commission after public notice and hearing to conform to amendments of the Political Reform Act. CONFLICT OF INTEREST CODE The Political Reform Act of 1974, as amended (Government Code Sections 81000, et seq.), requires state and local government agencies to adopt conflict of interest codes. The Fair Political Practices Commission has adopted a regulation,2 California Code of Regulations Section 18730, which contains the terms of a standard conflict of interest code which may be incorporated by reference and which may be amended by the Fair Political Practices Commission after public notice and hearing to conform to amendments of the Political Reform Act. The terms of the standard conflict of interest code in 2 California Code of Regulations Section 18730 and any amendments thereto, along with Appendix A and Appendix B in which officials and employees are designated and disclosure categories are established, are hereby incorporated by reference and shall constitute the Conflict of Interest Code. RECOMMENDATION: It is recommended that: 1. The Commission provide comments on a proposed new solid waste ordinance and a related Franchise Agreement. BACKGROUND: The current Solid Waste Ordinance and Franchise Agreement have been in effect since 1998. Several sections of the ordinance require revisions and/or corrections. With the issuance of new five-year franchise agreements, effective January 2015, it would be prudent to update the Ordinance at this time. With the assistance of Patrick Munoz of Rutan & Tucker, LLP, outside legal counsel, the City is working on an ordinance to amend the Vernon Municipal Code to clarify some definitions and conditions, expand on the self-haul permitting requirements, and add recycling requirements for large venues. The ordinance would maintain the existing non-exclusive franchise hauling system, and would not mandate reductions in the number offranchised solid waste haulers. Changes to the current franchise agreement include improvements intended to: facilitate quarterly reportinS, increase insurance requirements, increase the certificate of deposit limits, better protect City finances, and require electronic reporting for quarterly reports.
