Technologies update.
Backeround
Exide Technologies is an inactive battery recycling facility located at 2717 lndiana St.,
Vernon, CA. The facility permanently closed down in April, 2015 and is currently going
through a closure process. The Department of Toxic Substances Control (DTSC) is
overseeing the closure, a process which could take several years to complete.
ln addition, DTSC has been and continues to test soil at areas surrounding the Exide
Technologies facility which may have been contaminated with lead. DTSC estimates
that Exide's contamination may have reached up to 1.7 miles away from the facility and
potentially affected upwards of 10,000 homes. Properties identified as having high
levels of lead will be targeted for clean up by having all contaminated soil removed and
replaced with clean soil. Please see attachments for more information.

What is the Exide Cleanup?
May 2016
The California Department of Toxic Substances Control (DTSC) is testing for lead in soil, which
may have been contaminated by Exide Technologies facility operations in Vernon, California.
DTSC is testing soil at residential properties, schools, daycare centers, and parks in areas of
Boyle Heights, East Los Angeles, Commerce, Huntington Par( Bell, Vernon, and Maywood.
Properties with high levels of lead in soil, and high risk for exposure, will be cleaned up by
removing contaminated soil, backfilling with clean soil, and reJandscaping.
Exide operated a lead-acid battery recycling facility in
the City of Vernon, CA.
Exide is @! currently operating, and DTSC is working to
safely close the facility. When operating, it processed
an average of 120,000 tons of lead per year, or
approximately 11 million batteries per year.
Based on soil testing conducted by DTSC, Exide's
contamination may potentially reach up to 1.7 miles
away from the facility, which includes about 10,000
properties.
What is DTSC's plan to
expedite testing and cleanup?
. Governor Brown proposed a plan to ensure all
residential properties, schools, daycare centers, and
parks within a 1.7 mile radius of Exide are tested.
. DTSC will use these funds to expedite and expand

What to Expect Next
DTSC will contact you within 2 weeks to confirm that your
Access Agreement was received. You will be contacted
separately to schedule a convenient date for soil testing.
The testing crew will take five small samples of soil in your
front and back yard and will also test your outside paint
for lead. You do not need to be home for the testing.
Once the soil test results are confirmed, DTSC will let you
know if your yard will require cleanup.
lf cleanuo is needed. DTsc will schedule a convenient date
for you. lt takes about 3-4 days to remove the contami-
nated soil, replace it with clean soil, and re-landscape.
After the cleanup, DTSC otfers an interior cleaning with a
HEPA vacuum, and other surfaces cleaned to remove
dust.
How can I help protect my family
from exposure to lead?
Sources of lead include battery facilities and other
industrial operations, lead paint and water pipes, and
home renovation and hobby items. Exposure can occur
through eating or breathinB in this metal. To lower the risk
of exposure to lead in soil:
. Cover bare areas of soil in your yard
. When possible, do not let kids play on bare soil
. Take off shoes before coming into your home
. wet mop floors instead of dry sweeping
. Wipe windowsills and other surfaces where dust collect
with a wet cloth
. Wash hands and toys often

How can Iead affect my health?
Eating lead or breathing high levels of lead dust can
cause lead poisonint, which can damage the brain,
kidneys, liver, and other organs.
Children less than 7 years old and pregnant women are
at higher risk.
Lead poisoning can affect children's growth, learnin&
and behavior. Most children with lead poisoning do not
look or act sick.
A blood test can determine if a person has lead
poisoning.

and Safety Code section 25358.3, subdivision (c).

Recommendation
It is recommended that the Housing Commission:
A. Find that the action proposed in this staff report is not a "project" as that term is defined
under the Califomia Environmental Quality Act (CEQA) Guidelines Section 15378 because it is
a purely administrative activity and is therefore exempt from CEQA review; and
B. Receive and file a summary rcport of annual maintenance inspection results for City of
Vemon-owned housing units.

Results of Annual Housins lnspection
In April of 2016, City staff conducted the annual inspection of each of the l8 City-owned housing
units and 8 City-owned apartments in the City of Vemon and compiled a comprehensive list of
items that are in need of repair or replacement. Most of the units were found to be in good
condition needing only minor repairs. However, two units, in particular, have sustained significant
damage to the interior structure and appliances.
A summary of required repair and replacement items, identified during the individual unit
inspections, is listed on the List of20l6 Housing Unit Repairs and Renovatians (List) and attached
herewith.

In addition to the improvements noted on the List, the tenants at 4327 Furlong Place and 3361
Fruitland Avenue have requested disabled access ramps. Staff has identified a prefabricated access
ramp that has the structural characteristics to allow for easy installation. ln addition, the ramps arc
compliant with current disabled access regulations. The City has ordered two of the subject ramps
and City staff will make the installations in the near future.
Pest Control
City staffcontinues its efforts to control the pest populations on all City-owned facilities. The City
has retained Dewey Pest Control (Dewey) to apply pesticides to each facility in order to control
unwanted pests. At the March 9, 2016 Vernon Housing Commission meeting, staff was made
aware of the growing number ofcases requiring pest control and discovered that at the time, Dewey
was only maintaining the 50c Street Apartments. Since then, the City has expanded its pest control
coverage contract to include the housing units located on Furlong Place, Fruitland Avenue, ard
Vemon Avenue.
Measures specifically to control the rodent population are also contracted out to Dewey. The
subject control measures include the placement of placebo bate-stations (non-poisonous bate) in
strategic locations along the front and back yards of each housing unit at Furlong Place. The
placebo stations are used to identify where the rodents are feeding. Once this is determined, the
stations are located at identified feeding areas using a commercially approved bate. ln addition,
the City had Dewey perform an inspection and sanitization of the attics at each housing unit located
on Furlong Place. This process included vacuuming up the droppings from the attics and sanitizing
them using a l-percent bleach solution.

Background
On April 7,2015, the City Council directed staff to rehabilitate the seven non-remodeled units
(two at a time) applying the same standard utilized in the 2007 /2008 remodel, and voted to sell
three of the five City-owned units in Huntington Park and retain the other two units for the
temporary relocation of tenants affected by the remodel.
On June 10, 2015, the Commission conducted a lottery to establish the order in which each unit
would be remodeled. Since that time, some tenants expressed interest in deferring or opting out
of the remodel. In order to be fair, staff recommended that the City Council provide all seven
tenants a one-time, opt-out opportunity, which the Council authorized on August 4,2015.
Ultimately, on October 20,2015 the City Council directed staff to conduct the remodel only on
the vacant unit located at 4323 Furlong Place.

On March 17 , 2016 the Public Works, Water and Development Services Department advertised
the notice inviting sealed, competitive bids for the renovation ofsaid unit. The notice inviting bids
was posted on the City's website and published in the Vemon Sun newspaper, and was also
advertised in the following construction related websites: Bid America, Bidboard Construction
Contract Advertising, McGraw-Hill Constnrction, Reed Construction Data and Bid Clerk. The
specifications included the standard terms and conditions for the contract that was approved by the
City Council. The bids for Contract No. CS-0602, City Housing Improvements, were received and
opened on April 13,2016. The calculated bid results were as follows:

3. Dependable Construction Inc.

Staff recommended to the City Council that the contract be awarded to St. George Groupe, Inc.,
which was authorized at the May 17, 2016 City Council meeting. Construction is scheduled to
begin mid-June and last approximately 2 months.
Fiscal Imoact
$450,000 was budgeted in the Fiscal Year 2015-2016 for the rehabilitation of four single family
dwelling units. 5119,875, plus a contingency in the amount of $20,000 will be utilized for the
current remodel project and is within the budgeted arnount. The three remaining units will be
remodeled at a later time.

Update on the Sales of City of Vernon-Owned Single Family Housing Units

A. Find that the review and development of market rent data and schedules is exempt from
Califomia Environmental Quality Act C'CEQA) review, because the activity, which is

Background
The City of Vemon owned five properties in the City ofHuntington Park, consisting ofthree single
family residences and two tounhome units. The three single-family residential properties on
Stallord Avenue were recently sold. The City of Vemon still owns the two townhome units. Based
on a recommendation by the Vemon Housing Commission and authorization from the Vemon City
Council. the three homes were listed for sale last year. Each home was listed at $398,000, a price
determined through a qualified, independent third party appraisal. The listing agent for all thee
properties, was Luther Sanchez of Century 21 Allstars. Mr. Sanchez was selected through a
competitive Request for Proposal ("MP") process.

The firnds are available for future remodeling and other capital improvements on the existing
housing stock in the City of Vemon. As previously determined, the two existing townhome units
will be used as temporary housing when major renovations displace existing tenants. At the
conclusion of all the planned renovations, a determination will be made on whether to retain or
sell the two Huntinglon Park tormhome units. Staff is currently developing a Long Term Capital
Improvement Program (CIP) for the City's housing stock, which is anticipated to be presented to
City Council in the coming months, and ultimately incorporated into the City's overall CIP.
Fiscal Impact
The net proceeds received from the sales of the three Huntington Park single family homes is
$1,112,670. These funds have been accounted for separately identified in the City's general ledger
in the cunent fiscal year, as was originally anticipated in the City's FY 2015-2016 Budget.

Report on City Housing's Current State of Compliance with the Americans
with Disabilities Act (ADA)
Recommendations
A. Find that discussion of this report is exempt under the Califomia Environmental Quality
Act ("CEQA") because such is not a "project" as that term is defined in the CEQA
Guidelines section 15378, and even if it were a project, it would still be exempt in
accordance with Section 15061(b)(3), the general rule that CEQA only applies to projects
that may have a significant effect on the environment; and
B. Hold a preliminary discussion regarding potential housing improvements with mobility
features established under the Americans with Disabilities Act to all City-owned homes.
Background
The City of Vemon C'City) currently owns 26 housing units within City boundaries and two
housing units within the City of Huntington Park. The Vemon units consist of an 8-unit
apartrnent complex on 506 Street and 18 single family homes: six on Fruitland Avenue, ten on
Furlong Place and two on Vemon Avenue. The Vemon units were constructed between 1940
and 1960. The Huntington Park units consist oftwo condominiums built in the 1980's.
Title II of the Americans with Disabilities Act, adopted in 1990, protects individuals with
disabilities from discrimination on the basis of disability in services, progams and activities
provided by State and local government entities. Moreover, in December of 2013, the City
Council of the City of Vemon approved Ordinance No. 1217-2013, adopting the 2013 Califomia
Building Code (2013 CBC). Section llB-233.3 of the 2013 CBC states that, public housing

facilities with residential dwelli,ng units shall have at least 5 percent, but not fewer than one unit,
of the total number of residential dwelling units provided with mobility features and shall be on
an accessible route. Furthermore, public housing facilities shall be provided with adaptable
residential dwelling units and accessible parking.
More recently, two existing residents have expressed their concem for an accessibility ramp to
be installed in their units due to existing physical restraints. Accordingly, proper clearance ofat
least 36 inches shall be provided for doorways, 44 inches for hallways and a non-obstructive
radius ofat least 60 inches in the bathroom and kitchen. Cunently, none ofthe 28 housing units
owned by the City of Vemon are in compliance with Section 118-231.3 of the 2013 CBC.
However, it should be noted that the ongoing 2016 Housing Remodel Project will bring the City-
owned unit localed at 4323 Furlong Place, into compliance with the code.
The City's Engineering staff is in the process of requesting proposals for the preparation of the
American with Disabilities Act (ADA) Self-Evaluation and Transition Plan for all City facilities
such as fire stations, parking lots, streets and sidewalks. Included in this work effort will be the
evaluation of all City-owned housing. Scope of Services will include an inventory report of
facilities found to be non-compliant and cost estimates for bringing these facilities into
compliance.
In preparation for the two requests submitted and for any future requests for accommodation
from tenants, City staff is proposing all 28 housing units are included as part of the upcoming,
Self-Evaluation and Transition PIan to determine and identifo all improvements and
accommodations required. By doing so, the City is ensuring that its policies and procedures do
not deny individuals with disabilities the opportunity to participate in, or benefit from, nor
otherwise discriminate against individuals with disabilities, on the basis of disability in
connection with the operations of the City's programs, services and activities.
Fiscal Impact
The fiscal impact will be determined by the firm selected based on demonstrated competence to
prepare an ADA Self-Evaluation and Transition Plan.
