Wilson, Fire Chief 4e-' Originator: Adriana Ramos, Administrative Secretary Emergency Proclamation Ratification - Mayvood Fruitland Fire Recommendation It is recommended that the City Council ratify the Emergency Proclamation signed by Mayor William Davis, issued on June 23'd, 2016, to declare the existence of a local emergency in the City of Vemon as a result of the Maywood Fruitland Fire which began on June 146,2016. Backeround On June 1 4tr', 2016, a fire started at Panda Intemational Trading located at 3570 Fruitland Avenue in the City of Maywood. As a result of the fire and the aftermath of conditions of extreme peril to the safety of persons and property within the City of Vemon and surrounding communities, this incident has been deemed as a community disaster. Events caused by the Maywood fire include: Mandatory evacurtion of facilities due to the possibility of health-related issues for constituents; air quality pollution surrounding the areas of the fire; substantial impact and intem:ption to regular services; extraordinary costs for the City of Vemon; increasing number of concemed residents and businesses; the confrrmation of test results showing hazardous levels of heavy metal contamination; and the need for clean-up of said contamination. These happenings are evidence ofa local emergency that has endangered the public. On June 23,2016, pursrurnt to Sections 8.5 and 8.6 of the Vemon Municipal Code, Mayor Davis, Chief Executive Officer of the City, signed a proclamation declaring a local emergency exists throughout the City of Vemon as a result ofthe damaging conditions noted above and caused by the Maywood Fruitland Fire. It is further required that the Council ratiff said proclamation within seven (7) days thereafter or the proclamation shall have no further force or effect. Subsequent to the ratification ofthe Emergency Proclamation, the powers, functions, and duties of the emergency organization of the City will be those prescribed by state law, by ordinances, and resolutions of the City. Page I of2 With conditions likely to be beyond the control of the services, personnel, equipment, and facilities of the City of Vernon, a copy of this proclamation will be forwarded to County and State offrcials, with the request that the Director of the State Office of Emergency Services find it acceptable that the Govemor of Califomia issue a proclamation declaring an emergency in the City of Vemon. Should the Govemor of California take such action, regulations that may hinder response and recovery efforts would be waived, assistance would be made available under the Califomia Disaster Assistance Act, and the State would expedite access to resources and programs to aid in the City of Vemon's rccovery. Page 2 of 2 0f@ EMERGENCY PROCLAMATION WHEREAS, Section 8.6 of the Vernon Municipal Code empowers the Vemon Chief Executive Officer, to proclaim the existence or threatened existence of a local emergency when the City of Vernon is affected or likely to be affected by a public calamity and the City Council is not in session; and WHEREAS, Section 8.5 of the Vemon Municipal Code designates the Mayor as the Chief Executive Officer; and WHEREAS, the Chief Executive Officer of the City of Vemon does hereby find that conditions of extreme peril to the safety of persons and property have arisen within said city, caused by the Ma)A ood Fruitland Fire which began on June 14b, 2016 and that these conditions are or are likely to be beyond the control of the services, personnel, equipment, and facilities of the City of Vernon; and WHEREAS, the fire has resulted in the evacuation of businesses; the possibility of health-related issues for residents, businesses and air quality issues sunounding the areas of the fire; caused substantial impact and interruption to regular services; resulted in extraordinary costs for the City of Vernon; and WHEREAS, The increasing number of concerned residents and businesses, health concems in the community, mandatory evacuations and the confirmation of test results showing hazardous levels of heavy metal contamination, and the need for clean-up has necessitated that the City ofVernon proclaim the existence of a local emergency; NOW, THEREFORE, lT lS HEREBY PROCLAIMED by the City of Vernon Chief Executive Officer that a local emergency now exists throughout the City of Vernon and; lT lS FURTHER PROCLAIMED AND OROERED, that during the existence of said local emergency the powers, functions, and duties of the emergency organization of this City shall be those prescribed by state law, by ordinances, and resolutions of this city; and that this emergency proclamation shall expire seven (7) days after issuance unless confirmed and ratified by the governing body of the City of Vemon. lT lS FURTHER PROCLAIMED AND ORDERED, that a copy of this proclamation be forwarded to the [A County Office of Emergency Management, the State Office of Emergency Services requesting that the Director of the State Office of Emergency Services find it acceptable in accordance with State Law; that the Governor of Califomia, pursuant to the Emergency Services Act, issue a proclamation declaring an emergency in the City of Vemon; that the Governor waive regulations that may hinder response and recovery efforts; that recovery assistance be made available under the Califomia Disaster Assistance Act; and that the State expedite access to County, State and Federal resources and any other appropriate federal disaster relief programs.
