Background:
The Green Vernon Commission consists of seven members including three Vernon Business
Representatives, two labor representatives, and two representatives that engage in the
advancement of environmental/sustainability issues. Members serve four-year terms, serving
no more than two full consecutive terms.
Following appointments by the City Council on July 20, 2021, the current members are as

Municipal Code Section 2.148(a) requires a Chairperson and Vice Chairperson from different
appointing categories and Section 1.248(b) prohibits a member from serving as Chair for more
than two (2) consecutive terms.
Chair Daerr was appointed as Chair on March 20, 2019 and re-elected on September 16,
2020, serving two consecutive terms; therefore, he is not eligible to continue to serve as Chair.
It is appropriate for the Commission to select its Chair and Vice Chair for the coming year.

CalRecycle's 2016-2019 Jurisdiction Review

Receive and file the report.
Background:
Public Resources Code (PRC) Section 41825 specifies a schedule for a review and requires
CalRecycle to make a finding of whether or not each jurisdiction complies with PRC Section
41780 during the review period. Additionally, both Assembly Bill (AB) 341 and AB 1826
specifically authorize CalRecycle to conduct reviews of Mandatory Commercial Recycling
(MCR) programs (PRC Section 42649.3(h)) and/or Mandatory Commercial Organics
Recycling (MORe) programs (PRC Section 42649.82(g)(2)) at any time. These laws require
that a jurisdiction conduct education, outreach, and monitoring activities annually to covered
businesses and multifamily dwellings, and provide an update to CalRecycle each reporting
year. AB 1826 also requires that each jurisdiction address other activities, such as
infrastructure, etc., and report that annually to CalRecycle.
During the Jurisdiction Review process, CalRecycle found the City to be out of compliance
with AB 939 (The California Integrated Waste Management Act) requirements pertaining to the
MCR and MORe program. In response, the City informed CalRecycle regarding its strategy to
address the gaps in the MCR and MORe implementation plan to ensure its alignment with AB
939 requirements. On June 24, 2020, CalRecycle acknowledged the City’s plans and
communicated their intent to monitor implementation to ensure program gaps are fully
addressed. On May 27, 2021, CalRecycle completed the 2016-2019 Jurisdiction Review and
determined that that the City successfully addressed the gaps in the MCR and MORe
implementation plan and is in compliance with AB 939.

We are writing to inform you that CalRecycle’s 2016-2019 Jurisdiction Review has been
finalized. CalRecycle has found that the Jurisdiction is meeting the requirements of AB 939
and is implementing its Source Reduction and Recycling Element (SRRE), Household
Hazardous Waste Element (HWWE), Mandatory Commercial Recycling (MCR) and/or
Mandatory Commercial Organics Recycling (MORe) programs. Note: If a Jurisdiction has
received a rural exemption related to its MORe program, that program element was not
considered as part of this review.
The Request for Approval with the review findings can be found at

We commend the Jurisdiction for continuing to dedicate resources to meeting the requirements
of AB 939. Your efforts are helping to conserve natural resources, strengthen the State’s
economy, and reduce greenhouse gas emissions. In addition, the Jurisdiction should be well-
positioned to implement new requirements under SB 1383 that go into effect January 1, 2022.

Dear Mr. Agyin,
We are writing regarding the status of CalRecycle’s review of whether the City of Vernon (City)
is complying with meeting AB 939 requirements. Public Resources Code (PRC) Section 41825

not each jurisdiction complies with PRC Section 41780 during the review period. Additionally,
both AB 341 and AB 1826 specifically authorize CalRecycle to conduct reviews of mandatory
commercial recycling programs (PRC Section 42649.3(h)) and/or mandatory commercial
organics recycling programs (PRC Section 42649.82(g)(2)) at any time. These laws require
that your Jurisdiction conduct education, outreach, and monitoring activities annually to
covered businesses and multifamily dwellings and provides an update to CalRecycle each
reporting year. AB 1826 also requires that each jurisdiction address other activities, such as
infrastructure, etc., and report that annually to CalRecycle. As a result of this review the City
was found to be deficient in implementing its Mandatory Commercial Recycling (MCR) and
Mandatory Commercial Organics Recycling (MORe) programs.
Since being informed of the program gaps, the City submitted a strategy to adequately address
the gaps as indicated in the Request For Approval dated June 16, 2020.
• Adopt an ordinance that requires covered businesses to participate in MCR and MORe
collection services and includes enforcement provisions. The jurisdiction has provided a
date by which enforcement would be implemented after a period of education and
outreach about the requirements.
CalRecycle staff will begin monitoring implementation based on the jurisdiction’s submitted
plan timeline to ensure that the program gaps are fully addressed. During that time, if the
jurisdiction is not making adequate progress to address the gaps, the City will be notified and
the program will be referred to the Jurisdiction Compliance Unit (JCU) for investigation.
