Background: The Business and Industry Commission consists of seven members including three Business Representatives, one Council Member, one Employee/Labor Representative, and two Real Estate Representatives. Members serve four-years terms, serving no more than two full consecutive terms. Chair Cline was appointed to serve as Chair on January 24, 2019 and re-elected on August 13, 2020, serving two consecutive terms; therefore, he is not eligible to continue to serve as Chair. It is appropriate for the Commission to select its Chair and Vice Chair to serve in each respective capacity through June 30, 2022. This is a presentation only. Background: Vernon Public Utilities (VPU) has undertaken and completed a cost-of-service study and rate design for its Gas Enterprise. A comprehensive analysis was conducted by assessing historical operating expenses and projected future fiscal needs to determine the best course in meeting the revenue requirement. The presentation to the Commission will discuss the cost- of-service study findings while sharing the future rate recommendations to ensure that the Gas utility continues to provide exceptional and reliable service to its customers at very competitive rates. NEW BUSINESS 1.Mandatory Organic Waste Disposal Reduction Ordinance Recommendation: Discuss Senate Bill 1383 (SB 1383) requirements and the City’s Solid Waste Management Program, in consideration of comments and feedback received from the Business and Industry Commission and Green Vernon Commission SB 1383 Waste Hauler Temporary Ad Hoc Committees; and recommend that the City Council adopt a Mandatory Organic Waste Disposal Reduction Ordinance. Health and Environmental Control Director Agyin presented the staff report. In response to Commission questions, Health and Environmental Control Director Agyin explained the timeframe for adopting the ordinance; and clarified the proposed small businesses exemption, impact to residents, proposed education and outreach to businesses, reporting process, hauler route consolidation, and two bin system. BIC Vice Chair Andreoli explained CalRecycle’s plan to measure volume at the landfills, statewide goals and enforcement action. He expressed concern with a third-party camera monitoring his property. The Commissions discussed proposed changes to the ordinance and directed staff to bring back the proposed revisions. MOTION BIC Vice Chair Andreoli moved and GVC Commissioner Morfin seconded a motion to direct staff to bring back a proposed ordinance for the Commissions consideration at a future joint meeting. The Consent Calendar consisted of the following item: 1.Approval of Minutes Recommendation: Approve the June 16, 2021 Joint Special meeting minutes. NEW BUSINESS 2.Mandatory Organic Waste Disposal Reduction Ordinance Recommendation: Recommend that the City Council adopt the Organic Waste Disposal Reduction ordinance. Health and Environmental Control Director Agyin presented the staff report. BIC Chair Cline expressed desire to hear from BIC Vice Chair Andreoli. City Clerk Pope indicated he was going to try to join the meeting but might not be available. Matthew Kotanjian, AA Rubbish, discussed the uniqueness of Vernon regarding organics and difficulty in obtaining information from the customers. He asked if the City would assist in gathering the data to ensure compliance. In response to BIC Chair Cline, Mr. Kotanjian discussed their process and difficulties in obtaining data from customers. He stated that customers were charged per container, not the weight of the container. In response to Commission questions, Health and Environmental Control Director Agyin stated it was necessary for the businesses and haulers to collaborate to keep track of the weight and content of waste. He discussed the franchise and registration requirements for haulers. MOTION GVC Vice Chair Franz moved and GVC Commissioner Perez seconded a motion to recommend that the City Council adopt the Organic Waste Disposal Reduction Ordinance. The question was called and the motion carried 8-3, BIC Commissioner Williams dissenting; BIC Chair Cline and GVC Chair Morfin abstaining; and GVC Commissioners Andreoli and Larios absent. ORAL REPORTS GVC Vice Chair Franz inquired as to the service provider other members utilized for internet and expressed concern about the cost and speed of the City of Vernon service. BIC Commissioners Sachdeva and Williams indicated they utilized BAI.
