Background
Although over $100 million of property tax and sales tax revenues are generated in Vernon, the
City of Vernon receives a minimal portion compared to the State of California, County of Los
Angeles, and other agencies. The Finance Department will provide a briefing to the Business
and Industry Commission to convey the inequality of distribution, provide a fiscal outlook, report
recent sales tax and property tax performance, and give a forecast of estimated tax revenues.

2. Public Safety Special Parcel Tax (Continued from May 12, 2022)
City Administrator Fandino, Finance Director Williams, and Chief Sousa presented the
staff report.
In response to Commission questions, Finance Director Williams, Chief Sousa, and
City Administrator Fandino explained the population comparisons; proposed extension
through 2028; and warehouse parcel tax.
MOTION
Commissioner Williams moved and Commissioner Condon seconded a motion to
recommend continuation of the Public Safety Special Parcel Tax. The question was
called and the motion carried unanimously.

4. Warehouse Regulation
Public Works Director Wall presented the staff report.
In response to Commission questions, Public Works Director Wall discussed the
proposed moratorium sunset; parcels impacted by the moratorium; building expansion
and lot mergers; exclusion of cold storage; electrification of truck fleets; and criteria for
development agreements.
John Sandberg suggested that manufacturing created more truck traffic. He asked
about the Fontana Construction and why warehouses had lower property taxes.
Steve Freed asked if permitted uses related only to new warehouses or if it also
included existing warehouses.
Eric Gustafson requested clarification on whether a development agreement was
triggered by increasing square footage.
Ken Jackson commended staff for its forethought. He reminded staff that electrified
trucks need to be charged and Vernon could become a hub.
Jose Cornejo, NAIOP SoCal, expressed concern with the moratorium and development
agreement requirements because it did not allow predictability. He stated the
moratorium would create problems for already struggling supply chain issues.
Jimmy Andreoli II, Baker Commodities, indicated concerns about the moratorium and
requested the City move quickly to determine the outcome. He agreed with concerns
about predictability.
City Administrator Fandino stated the City was and would continue to be business
friendly. He confirmed the City understood concerns about uncertainty and
Administration was committed to serve the public and work with the community.
Public Works Wall explained trigger with 25% expansion of square footage; air pollution
and trucking levels; State control; consultant for environmental analysis; and time to
market.
Commissioner Cline suggested a working group to establish targeted criteria to add
clarity and predictability.
Heather Crossner, Bridge Industrial, asked about preparation of environmental review.

RECESS
Commissioner Cline called a recess at 5:35 p.m. The meeting reconvened at 5:46 p.m.
with all Commissioners present via remote access.
Public Works Director Wall emphasized the City’s goal to be business friendly. He
explained efforts to ensure development did not trigger issues with the State and made
sense for the business community. City Administrator Fandino stated staff would
ensure time to market was the fastest of any City.
MOTION
Commissioner Williams moved and Vice Chair Morfin seconded a motion to
recommend that the City Council adopt changes to Chapter 17 of the Vernon Municipal
Code implementing the regulation of future warehouse development by Development
Agreement and including cargo container storage and cargo container parking in the
definition of “Truck terminal.” The question was called and the motion carried
unanimously.

General Fee Schedule Update for Fiscal Year 2023-24
Recommendation
Receive and file the proposed general fee schedule that will be presented to Council for adoption
on April 4, 2023.
Background
The City provides services for a fee to individuals or businesses at an estimated reasonable cost
of providing such services. The fee calculation considers the cost for efficient and effective
delivery of services by City resources. Fees that do not recover the full cost of service result in a
subsidy which may impact funding and the City's ability to address various community needs.
Examples of City fees include building permits, development permits, and health and
environmental control services.
As part of the annual budget process, the City's General Fee Schedule is reviewed to ensure
that the fees are set in accordance with applicable federal and state laws. City departments
review fees for services and make recommendations to add and/or delete fees, or make changes
to existing fees. In coordination with departments, Finance reviews the changes submitted, and
prepares a draft fee schedule for presentation to the Business Industry Commission (BIC), City
Council, and members of the community. The proposed General Fee Schedule for FY 2023-24
will be presented as part of a public hearing that will be held at the April, 4, 2023 Council Meeting.
Staff is not proposing fee increases for Fiscal Year (FY) 2023-24, as a comprehensive cost
allocation study is needed to determine appropriate fees. Current updates to the schedule consist
of one Government Code Section change and non-substantive administrative edits which are
highlighted in the attachment.
The City last contracted a third-party consultant to conduct a comprehensive cost allocation study
in preparation for the FY 2020-21 General Fee Schedule. The findings of the cost allocation study
were incorporated into a proposed General Fee Schedule for FY 2020-21 and presented to the
BIC, to the community at a town hall meeting, and to the City Council. On May 19, 2020, the City
Council opted to postpone any fee adjustments due to the unpredictable financial impacts
impeding businesses during the COVID-19 state of emergency and directed staff to re-evaluate
possible modifications in FY 2021-22. Now that the COVID-19 state of emergency was ended by
Governor Newsom on February 28, 2023, City staff will begin the selection process of a third-
party consultant for a comprehensive cost allocation study to present to the BIC, community and
City Council for evaluation and possible adoption for FY 2024-25.
Staff’s objective in completing a cost-of-service study is to recover the full cost of service for the
majority of the fee-related services and activities identified on the General Fee Schedule.
Recovering the costs of the provided fee-related services increases the availability of General
Fund revenues to be used for services and activities available to all residents and the business
community, such as public works and public safety services. Additionally, results will help to

revenues to adequately fund the services provided by each department.

The amount of an encroachment permit cash deposit, certified or cashier' s check, surety bond, or letter
