The minutes of the meeting } held on April 20th and May 1915} were: laid over. 4th, This meeting was held pursuant to Notice duly and regularly given and served upon ea9h member of the Board of Trustees at least three hours prior to the hour of three o'clock P. M. on said May 11th, 1915. Said notice being regular in all respects and signed by the President of the said Board. Said meeting was called for the purpose of considering any business which might come before the meeting in connection with the matters set forth in said notice. Thereupon the President stated that there was still pending the appeal of the Los Angeles Foundry Company in reference to the improve- ment of Twenty-fifth Street from the Westerly line of Santa Fe Avenue to Easterly line of Alameda Street as done by the L. A. Paving Company, on the ground that the work was not performed in aocordance with the specifications. Thereupon the Clerk presented to the Board and read the following notice of hearing appeal, and stated that the same had been duly and regularly served as required by law and that a proper notice had been given to all parties concerned: Said notice is in words and figures as follows, to-wit: ":N~ICE OF HEARING APPEAL. NOTICE IS EEREBY GIVEN that on Tuesday, May 11th, 1915, at three o'clock p. M., in the City Hall at Vernon, California, The Board of Trustees of said city will hear and determine the appeal of the Los Angeles Foundry Company with reference to the improvement of Twenty- fifth Street, from Alameda Street to Santa Fe Avenue, as performed by the L. A. Paving Compa.ny. r'i','3, p." 5/11/15 -1- Said appeal has been taken upon the ground that the work was not performed in accordance with the specifications. (Signed) T. J. Furlong, City Clerk and Ex-Officio Clerk of said Board. Dated: May 1st, 1915." The Clerk further stated that a second protest and appeal had been filed by said Los Angeles Foundry Company on May 8th, 1915, in words and figures as follows, to-wit: "TO TEE HONORABLE BOARD OF TRUSTEES OF THE CITY OF VERNON, Vernon, California: GENTLEMEN: - The appeal of Los Angeles Foundry Company, a corporation, respectfully shows that the appellant is the owner of certain property in the City of Vernon, neing the N. E. corner of Alameda and 25th streets, w~ich property is subject to assessment for the improvement of East 25th street from Alameda street easterly to Santa Fe in the City of Vernon, which work is more particularly dewcribed in a contract entered into between the Superintendent of Streets of the City of Vernon and one E. R. Werdin, and as such property owner the appellant ~ interested in the assessment here- tofore made by the Superintendent of Streets for said work and im- provement. That the appe~lant objects to the correctness of the assess- ment heretofore made in said proceeding by the Superintendent of Streets on the ground that said assessment is erroneously made out in certain particulars and should be corrected; appellant also objects to the determination of the Superintendent of streets that the work provided for in said proceedings had been completed according to specifications for the same on the ground that said contract had not been properly completed, nor its terms complied with, and that the work does not conform to specifications. WHEREFORE, appellant appeals to Your Honorable Body from the said assessment and from the determination of said Superintendent of Streets and requests that you take such steps as are required by law. And that upon said other and further protest and appeal co.ing in, he had caused to be duly and regularly given the following notice: "NOTICE BEARING APPEAL ... NOTICE IS HEREBY GIVEN ha,t on Saturday the 15th day of May, 1915 at 11:30 o'clock A. M., in the City Hall at Vernon, California, the Board of Trustees of said City will hear and determine the appeal of Los Angeles Foundry Compan with reference to the improvement of Twenty-fifth street in said city from Alameda Street to Santa Fe Avenue as performed by the L. A. Paving Company. Said appeal has been taken on the ground that the assessment made by the Superin- tendent of Streets is erroneo s in certain particulars and should be corrected, also upon the furt er ground of Objecting to the deter- mination of the Superintendent of streets that said work has been completed according to the specifications, also on the ground that contract has not been proper1 completed nor its terms complied with. It appearing that the 1 st notice placed the time and date appealing parties were prese as May 15th, 1915 at the regular the hour of 11:30 o'clock A. M.of at which said hearing would meeting place of the Board, said day; and, It further ap earing that none of the protestants or this meeting; and, It further appearing that there was no other business before the Board.
