19150706 Regular City Council Meeting - Minutes REGULAR MEETING. A regular meeting of the Board of Trustees of the city of VernonJ Oounty of Los Angeles, and State of CaliforniaJ was held on the 6th day of July , 191 5, at 2 0 I olock P. M. of said day at the regular meeting place of said Board in said city of Vernon, which said time and place is the time and place fixed by ordinance for regular meetings of the said Board to be held. There were present at such meeting Trustees, stevens, Durbin, Furlong and Kniffin. There were absent from such meeting Trustee, Leonis. President Trustee Furlong presiding. The minutes of the meeting , held on the 15th day of June, 1915 ll!aaK , we re: read and approved. The request of the Southern Pacific Company for a franchise for a spur track at 48th and Alameda streets was laid over for future action. This being the day upon whioh bids were to be received by the Board for material to be furnished and the work to be per- formed for doing the improvement work on the thirty foot strip making up that portion of Alameda Street between the North line of Lot B in Tract No. 2633 as per map in Map Book No. 27, page 45 Reoords of Los Angeles County to the South line of Lot One (1) of the Martha Tract as per map in Map Book No. 14, page 188 Re- cords of Los Angeles County in said City of Vernon, the Clerk reported that he had received one bid from the L. A. Paving Company. Said bid was in words and figures as follows, to-wit: "City of Vernon, July 6, 1915. To the Honorable Board of Trustees of the City of Vernon: In oompliance with the annexed advertisement we hereby propose and agree to perform the work and furnish materials in aocordanoe with the specifications and to execute the contract therefor, to the satis- faction and under the supervision of the Street Superintendent of . .,.f, said city, at the following prices, Dollars Paving per square foot Curbing, per lineal foot Curb, per lineal foot Gutter, per square foot (Signed) L. " ~1 ..... -."- 7/6/15 -1- The~.unit prices hereon are for purposes of monthly estimate and the bidder agrees to enter into a contract to do all the work as shown on the plans prepared for the work for the total sum as shown hereon, and attaches a certified check in the sum of five per cent bid, as a guarantee that, if successful, he will enter into a contraot satisfac- tory to the said Board of Trustees. The City of Vernon will pay for the said imp~Dvement in cash, pay- ing seventy-five per oent of the a~ount of said cash all on or before the lOth day of each month for so much of the improvement work as has been completed during the preceding month and will pay the remaining twenty-five per cent of said cash by within thirty-six days after the completion of said improvement and the aoceptance thereof 'by the City of Vernon. WHEREAS, I am about to hand in and submit to the Board of Trustees of the City of Vernon the foregoing bid or proposal, accompanied withe a certified check in the sum of $1300.00 for the performance of the work therein mentioned \ which includes the furnishing of necessany and proper materials therefor ), under an invitation of said Board of Trus- tees, contained in the notice or advertisement attached to this bid or proposal. No~ if this bid or proposal shall be accepted, and said work be awarded to me thereupon by said Board of Trustees, and I shall fail or neglect to enter into a contract therefor, and to execute the bond required, ta the satisfaction of the Street Superintendent, with two or more good and sufficient sureties, for the faithful performance of such contract on my part, as required by the act of the Legislature of the state of Calif~nia, entitled "An act to provide for work upon streets, lanes, alleys, courts, places and sidewalks, and the construction of sewer.s in munic ipali ties.", approved the 18th day of l~iarch, 1885; and of the Acts amendatory thereof, then and in that case, I hereby authorize the n:es.ident of the Board .of Trustees of the City of Vernon to present the certified check deposited with him and collect the sum of Thirteen Hundred & No 100 Dollars as LIQ,UIDATED DAMAGES for such failures and neglect, and pay the savne into the City Treasury to the Credit of the fund provided for in said Act. ....", ( CORPORATE SEAL.) 7/6/15 L. Fyler, as sureties are held and firmly bound unto the President of the Board of Trustees of the City of vernon, aforesaid, in the just and full sum of Thirteen Hundred Dollars for the payment whereof we hereby bind ourselves, our- selves, our heirs, exeoutors and administrators, jointly and severally, firmly by these presents. Given under our hands and sealed with our seals, on this 6th d~ of JUly, A. D. 1915. Now the oondition of the foregoing obligation is suoh that whereas the above bounden principal L. A. Paving Company, is about to hand in and submit to the ~oard of Trustees of the City of Vernon, the foregoing bid or proposal, for the performanoe of the work therein mentioned which inoludes the furnishing of all materials in compliance with the specifications therefor, under an invitation of said Board of Trustees, contained in the notioe or advertisement attaohed to said bid or proposal: Now if the bid or proposal of said Principal L. A. Paving Company shaJ.l be aooepted, and the said work awarded to said Prinoipal, L. A. Paving Company thereupon by said Board of Trustees, and if said Principal L. A. Paving Company shall fail or neglect to enter into a contract therefor, and to execute an adequate gond to the satisfaction of the Superintendent of Streets of said City, with, two or more good and sufficient sureties, conditioned for the faith- ful performance of such contract on its part, in such case required by statute, than and in that case the above named Obligors will pay to the said President of the Board of Trustees, of said City, the full sum of Thirteen Hundred Dollars as liquidated damages for such failure and neglect. Thereupon the Board of Trustees duly and regularly awarded the contract for the improvement of the ~hirty foot strip in Alameda Street between the North line of Lot B in Tract No. 2633 to the South line of Lot 1 of the Martha Tract to the L. A. Paving aompany in accordance with its bid for doing said work. Mr. Stevens stated that Ordinance No. 149 regarding the filling of exoavations in the City of Vernon, was erroneous by reason of the tact that the words "non-OGmbustible material" were used therein, which words the Board desireq to avoid in the draft of said ordinanc.. lir. Stevens further .oved that the ordinance be amended so as to eliminate the words unon_oombustible material". Said motion was seconded by Mr. Durbin and carried. Application was made for abuilding permit.by the Button Lath Manutacturing Company for a building to be erected at the corner of Vernon and Boyle Avenues and the same was granted.
