CORRECTED MINUTES OF AN ADJOURNED REGULAR,
MEETING OF THE CITY COUNCIL OF THE CITY
OF VERNON, HELD WEDNESDAY, MARCH 8th.,
1939, AT THE HOUR OF THREE 0 I CLOCK P. M. ,
AT THE CITY, HALL OF THE CITY OF VERNON,

In the absence of the Mayor, the City Clerk called the
meeting to order, and J. B. Leonis was elected Mayor Pro Tem of
the meeting.
Councilmen present: Leonis, Peralta, Scheider, Levy.
Councilmen absent: Furlong.
It was moved by Scheider, seconded by Peralta that the
reading of the Minutes of the previous meeting be dispensed with.
Motion carried.
Councilman Peralta offered Resolution No. 972, which
was read in full.
It was moved by Peralta, seconded by Scheider that
Resolution No. 972 be adopted. Motion carried, by the following
vote:
AYES: Peralta, Scheider, Leonis and Levy.
NOES: None
ABSENT: Furlong
The Clerk thereupon reported that no protests, oral or
written, on. the formation of Vernon Sewer District No. One, or any
other matters as set forth in Ordinance of Intention No. 524, had
been filed with him.
Thereupon, the Mayor asked if any persons were present
who desired to be heard upon the matter before the Council, or who
desired to orally protest against, or object to the formation of
said district, or to its extent, or to the proposed improvement, or
tp t~. acquisition of said rights proposed to be acquired, or to the
cost thereof, or to the inclusion of property in said district, or
against the annual charge, or the amount thereof to be paid by said
district toward the maintenance and operation of the improvement,
and toward the maintenance and operation of the portion of the Los
Angeles Sewers to be used for the flowage of sewage of said district,
or to anyone or more of said matters, and no person present respond-
ed to said invit~tion.
Whereupon the Council proceeded to consider the contents
of its Ordinance of Intention No. 524, and particularly the question
of the proposed boundaries of City of Vernon Sewer District No. One
as set forth in said Ordinance of Intention No. 524, and the bene-
fits, if any, to be derived from said improvement by the property,
and each and every lot, piece or parcel thereof located within the
said proposedboundarles of said City of Vernon Sewer District No.
One.
The Mayor, thereupon, called upon the City Attorney,
Thomas V. Cassidy, for a report to the City Council upon the form-
ation of said City of Vernon Sewer District No. One, the benefits,
if any, to be derived by the properties located within the proposed

boundaries of said District, and to report upon other matters
mentioned in Ordinance of Intention No. 524. The City Attorney,
thereupon, reported orally to the City Council in substance, as
follows:
That the contract of August 10, 1938, between the
City of Vernon and the City of Los Angeles, providing for the
joint construction, maintenance and operation of sewers, outfall
sewers, and other conduits for the ~oint benefit of the two cities,
provides the only means whereby a large portion of the property
located within the City of Vernon can be furnished with sewage
facilities; that said contract of August 10, 1938, provides for
the acceptance by the City of Los Angeles for disposal of sewage
originating within the boundaries of the City of Vernon which can
flow into said Los Angeles Sewer System by gravity, and that the
proposed boundari~s of City of Vernon Sewer District No. One, as
described in Ordinance of Intention 524 contain only lands and
properties which are capable of being served by the Los Angeles
Sewer System under the terms and provisions of said agreement of
August 10, 1938, and that no properties have been included except
such properties as are capable of being served by and the sewage
from which will flow by gravity into the Los Angeles Sewer System;
that each and every piece or parcel of property located within the
proposed boundaries of , said City of Vernon Sewer District No. One
is now being served by the Los Angeles Sewer System, or is capable
of being so served, and that no property of any description has
been included within the boundaries of said City of Vernon Sewer
District No. One which is not or cannot be served by said Los Angeles
Sewer System, and that each of the properties therein located will
be and is directly and immediately benefited by its inclusion in said
City of Vernon Sewer District No. One.
The City Attorney further reported that a large portion
of the City of Vernon cannot be served by the Los Angeles Sewer
System for the reason that its sewage cannot be drained into the
same by gravity, and that those properties have been included in
other sewer districts and are now paying an annual tax for such
service; that in his opinion there was considerable question whe-
ther the City of Vernon could legally or morally assess any portion
of the sewage disposal cost, or the cost of upkeep and maintenance
of the sewer system itself, as provided by said agreement of August
10, 1938, upon any of the properties now located outside of the
proposed boundaries of City of Vernon Sewer District No. One which
could not conceivably be served by the Los Angeles Sewer System.
The City Attorney thereupon recommended that the City Council of
the City of Vernon fix and establish the boundaries of City of Ver-
non Sewer Eistrict No. One as set forth and described at length in
said Ordinance of Intention No. 52~ and that all of the properties
therein contained remain in said City of Vernon Sewer District No.
One for the reason that in his opinion each and every lot, piece, or
parcel of land therein will be and is directly and immediately bene-
fited by the acquisition, construction, operation and maintenance of
the sewers and Sewer System, all as described in said Ordinance of
Intention No. 524.
The City Attorney having completed his report and the City
Council having thereupon given further consideration to all of the
matters contained in said report and contained in said Ordinance of
Intention No. 524, were thereupon of the unanimous opinion that each
and every of the properties located within the proposed boundaries

iately and directly bene~ited by the improvement, and that said
proposed boundaries o~ City o~ Vernon Sewer District No. One
as described in said Ordinance o~ Intention should be ~ixed and
established as the permanent boundaries thereof.
Thereupon Councilman Peralta offered Resolution No.
972i, which was read in full.
It was moved by Peralta, seconded by Scheider that Reso-
lution No. 972i be adopted. Motion carried by the tilowing vote:
AYES: Peralta, Scheider, Leonis and Levy.
NOES: None
ABSENT: Furlong.
An application from the Union Pacific Railroad Company
for two tracks across Boyle Avenue, south of Fruitland Road, was
read.
It was moved by Peralta, seconded by Scheider that same
be referred to the City Engineer. Motion carried.
The following Applications, all having the approval of
the City Engineer, were read:
Application 6271: Southern Cali~ornia Gas Company to
abandon gas service on Alameda Street, 339' north of 48th Street.
Application 6272: Southern California Telephone Co.,
to replace a pole on the North side of 48th Street, 256' east of
Alameda Street.
Application 6273: Southern California Edison Company,
to replace 60' pole on the north side of Pacific Blvd., north of
Leonis Blvd.
It was moved by Scheider, seconded by Peralta that the
applications be filed, and permits granted. Motion-carried.
