MINUTES OF A REGULAR MEETING OF TEE
CITY COUNCIL OF THE CITY OF VERNON,
HELD TUESDAY, DECEMBER 17, 1940, AT
THE HOUR OF THREE 0' CLOCK P. M., AT
THE CITY HALL, 4305 SANTA FE AVENUE,
VERNON, CALIFORNIA
The meeting was called to order by T. J. Furlong, owing to the absence
of the Mayor, and he asked that a Mayor be elected pro tem.
It was moved by Scheider and seconded by Peralta that Counci~an
Leonis act as Mayor. Motion carried.
Councilman present: Leonis, Scheider, and Peralta.
Councilman absent: Furlong and Levy.
The Mayor pro tem then proceeded with the regular business.
It was moved by Peralta and seconded by Scheider that the reading of
the Minutes of December 3, 1940, be suspended. Motion carried.
Unfinished Business
ORDINANCE NO. 538. An ordinance of the City of Vernon regulating
the dumping of cess-pool pumping originating in the City of Vernon, and
prohibiting all other cess-pool dumping was read for the second reading.
It was moved by Scheider and seconded by Peralta that Ordinance
No. 538 be passed for a second reading. Motion carried.
ORDINANCE NO. 538. An Ordinance of the City of Vernon regulating
the dumping of cess-pool pumping originating in the City of Vernon, and
prohibiting all other cess-pool dumping was read for a third and final
reading.
It was moved by Scheider and seconded by Peralta that Ordinance
No. 538 be adopted. Motion carried by the following vote:
AYES: Leonis, Scheider, and Peralta.
NOES: None.
ABSENT: Furlong and Levy.
New Business
A communication from J. M. Lowery, County Auditor, regarding the
collection of taxes was read.
It was moved by Peralta and seconded by Scheider that the communi-
cation be referred to the City Attorney. Motion carried.
A communication from Mr. B. A. Moeller regarding inspection and
tests at Gilmore Oil Company was read.
It was moved by Scheider and seconded by Peralta that the com-
munication be filed. Motion carried.
A communication from Better Food Markets, Inc., requesting a permit
to operate a warehouse at 4225 North Proeuce Plaza was read.
It was moved by Peralta and seconded by Scheider that the communica-

A communication from Mr. Earl L. Garber requesting a permit to sell
peanuts, popcorn, and pop at auction sales to be held at Hampton Live-
stock Co., 3001 Downey Road. was read.
It was moved by Scheider and seconded by Peralta that the communication
be referred to the Police Department with power to act. Motion carried.
Communications were read from the following firms requesting permission
to haul refuse from the following described premises: W. T. Paddison from
premises of 2305, 2317, 2325 and 2304 East 37th Street; and General Petro-
leum Corporation from premises of 2525 East 37th Street.
It was moved by Peralta and seconded by Scheider that the communications
be filed and permits granted. Motion carried.
A communication from the Southern California Edison Company, submitting
annual passes to Vernon Diese~ Generating Plant was read.
It was moved by Scheider and seconded by Peralta that the communication
be filed. Motion carried.
A communication from the Union Pacific Railroad Company regarding a
pedestrian cross-walk across Soto Street near the Sears-Roebuck & Company
warehouse was ~ead.
It was moved by Peralta and seconded by Scheider that the communication
be referred to the Police Department with power to act. Motion carried.
The following communication from Blythe & Co. Inc. and others was read:

Sirs:
We do hereby offer to rescind the sale and award to
us of bonds in the aggregate face amount of $340,000 of
the City of Vernon Sewer District No. One, dated March 1
1940, and maturing $2,000. on March 1, 1941, $12,000 '
each year from March 1, 1942 to March 1, 1960, inclusive;
$11,000 each year from March 1, 1961 to March 1, 1970,
inclusive, and bearing interest at the rate of 4-1/2 per
cent per annum payable semi-annually on the first day of
September and on the first day of March, which said sale
and award was made by Resolution No. 1022. We do also
offer to dismiss the Petition for Writ of Mandate filed in
the Superior Court of the State of California in and for
the County of Los Angeles by the undersigned, as petitioners,
against F. G. French, Treasurer of the City of Vernon a
Municipal Corporation; and J. J. Furlong, Herman scheider,
Richard Levy, J. B. Leonis, and E..R. Peralta, as and con-
stituting the City Council of the City of Vernon as res-
pondents, being proceeding No. 455,544 in the re~ords of
said court. .
This offer iSA of course, conditioned upon the return
~ us of the sum of w35,000.00 deposited with the City
Treasurer at the time of our original bid.

It was moved by Scheider and seconded by Peralta that the communica-
tion be ~iled and that the City Treasurer be authorized to return to
Blythe &: Co. Inc. and others their check for $35,000.00 now on deposit
with the Treasurer. Motion carried.
RESOLUTION NO. 1029, a Resolution of the City Council of the City
of Vernon, California, rescinding and repealing Resolution No. 1022
adopted June 25, 1940 was read.
It was moved by Peralta and seconded by Scheider that Resolution No.
1029 be adopted. Motion carried.
RESOLUTION NO. 1030, a Resolution of the City of Vernon, California,
amending Resolution No. 993 of the City of Vernon adopted on the 25th day
of JUly, 1939, as amended by Resolution No. 1001 adopted August 17 1939,
relating to the iSSUance of Three Hundred Fifty Thousand Dollars (6350,000)
of bonds of City of Vernon Sewer District No. One, which bonds are desig-
nated as tCity of Vernon Sewer District No. One Bonds, Election 1939', was
read.
It was moved by Peralta and seconded by Scheider that Resolution No.
1030 be adopted. Motion carried.
RESOLUTION NO. 1031, a Resolution o~ the City Council of the City of
Vernon, California, authorizing the sale of bonds in the sum of Three Hun-
dred Fifty Thousand Dollars ($350,000.00) of City of Vernon Sewer District
No. One, designated as 'City. of Vernon Sewer District No. One Bonds, elec-
tion 1939', fixing the time for and the place of the holding of said sale
and the form of Notice of said sale, was read.
It was moved by Peralta and seconded by Scheider that Resolution No.
1031 be adopted. Motion carried.
A report of the Police Department was read.
It was moved by Scheider and seconded by Peralta that the report be
filed.. Motion carried.
The Minutes of the Meeting of the Committee on Light, Power, Water,
Building, and Purchasing of December 3, 1940, were read.
It was moved by Peralta and seconded by Scheider that the same stand
approved as read. Motion carried.
