19570820 Regular City Council Meeting - Minutes I I MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD AUGUST 20) 1957, AT TWO O'CLOCK P.M. IN THE COUNCIL CHAMBERS OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA. COUNCIL PRESENT: Anderson, Furlong, Mailliard, Halburg, Poxon COUNCIL ABSENT: None The meeting was called to order by Mayor R. J. Furlong. It was moved by Poxon, seconded by Anderson, that the minutes of the meeting of August 6, 1957 be approved as written and submitted. Motion carried. The Clerk announced that this was the time and place for opening of bids submitted for the construction of asphalt concrete pavement resurfacing in Leonis Boulevard from Pacific Boulevard to Downey Road, in the City of Vernon, in accordance with Specifications No. 2l4. It was moved by Poxon, seconded by Malburg, that the Clerk be instructed to open and read the bids submitted. Motion carried. The Clerk opened and read the following bids: G. G. Fisher Paving Co., Inc. Sully-Miller Contracting Company Griffith Company C. O. Sparks, Inc. and Mundo Engineering Company $ 15,928.00 15,090.00 16,180.00 l4,592.00 It was moved by Poxon, seconded by Anderson, that the bids submitted for the construction of asphalt concrete pavement resurfacing in Leonis Boulevard from Pacific Boulevard to Downey Road, in the City of Vernon, in accordance with Specifications No. 2l4, be referred to the Engineering Department and the City Attorney for checking and report. Motion carried. Communication from Harold A. Barnett, Consulting Engineer, submitting tabulation of the bids received for the construction of asphalt concrete pavement resurfacing in Santa Fe Avenue from Pacific Boulevard to the south city boundary in accordance with Specifications No. 213, and recommending that contract be awarded to C. o. Sparks, Inc. and Mundo Engineering Co., a Joint Venture of California Corporations, on the basis of their low bid of $8,480.00, was read. It was moved by Malburg, seconded by Poxon, that the recom- mendation of Consulting Engineer Barnett be approved. Motion carried. Resolution No. 2076 - A Resolution of the City Council of the City of Vernon accepting the bid of C. o. Sparks, Inc. and Mundo Engineering Co., a Joint Venture of California Corporations, for the construction of asphalt concrete pavement resurfacing in Santa Fe Avenue from Pacific Boulevard to the south city boundary, in accordance with Specifications No. 213 of said city, was read. It was moved by Malburg, seconded by Poxon, that Resolution No. 2076 be approved and adopted. Motion carried. It was moved by Anderson, seconded by Poxon, that communi- cation from Chief Deputy City Clerk Ziemer be received and filed. Motion carried. Communication from F. A. Ziemer, Chief Deputy City Clerk, requesting permission to employ Mr. Lon S. Herman,as Public Utilities Accountant Grade 4, effective as soon as he is available, to replace Mr. Scott, was read. It was moved by Anderson, seconded by Poxon, that the request of Chief Deputy City Clerk Ziemer be approved. Motion carried. Communication and report from Carl A. Heinze, Consulting Electrical Engineer, advising that check in the amount of $123,935.l7, submitted by Southern California Edison Company in payment of rental of leased property for the period May 30, 1956 to May 29, 1957 in accordance with lease agreement dated February 23, 1937 and amended July 6, 1937, has been checked and is in agreement with city books, was read. It was moved by Poxon, seconded by Malburg, that communi- cation and report from Consulting Electrical Engineer Heinze be received and filed and that check be deposited. MOtion carried. Communication and report from Carl A. Heinze, Consulting Electrical Engineer, advising that check submitted by Southern California Edison Company in the amount of $159,902.50 for bond principal and interest redemptions for the fiscal year 1957-58 on Vernon Light and Power Bonds has been checked and verified as correct, was read. It was moved by Malburg, seconded by Poxon, that communi- cation and report from Consulting Electrical Engineer Heinze be received and filed and that check be deposited. Motion carried. Communication from R. H. Bockhacker, Police Chief, recom- mending that Mr. John H. Montgomery be granted a permit to operate an employment agency at 2822 Santa Fe Avenue, providing that Mr. Montgomery first secures a State license, was read. It was moved by Anderson, seconded by Poxon, that the recom- mendation of the Police Chief be approved and permit granted to Mr. John H. MOntgomery to operate an employment agency at 2822 Santa Fe Avenue provided that he first secures a State license. Motion carried. Communication from Robert W. Wise requesting a permit to operate a box lunch vehicle (Hugo's Hot Dog Stand) at 2263 E. Vernon Avenue, was read. It was moved by Poxon, seconded by Malburg, that request of Robert W. Wise be referred to the Director of Sanitation with power to act. Motion carried. Vinlove, Police Department, submitting a bid of $1.00 for a surplus wooden chair formerly used by the Police Department in their old offices, was read. It was moved by Poxon, seconded by Anderson, that bid of $1.00 for a surplus wooden chair, by Lt. G. G. Vinlove be accepted. Motion carried. Copy of a communication from County of Los Angeles Health Department, addressed to the City Manager of the City of Glendale, with reference to ordinance requiring the rabies vaccination of dogs, was read. It was moved by Poxon, seconded by Anderson, that copy of communication from County of Los Angeles Health Department addressed to the City Manager of the City of Glendale be referred to the C~ty Attorney for stu<\T and report. Motion carried. Communication from L. R. Burch requesting permission to take annual vacation leave commencing October 7, 1957, was read. It was moved by Malburg, seconded by poxon, that request of L. R. Burch be approved. Motion carried. Notice of Hearing before the Public Utilities Commission of the State of California with reference to Application No. 39223 of Los Angeles Transit Lines, a corporation, and Metropolitan Coach Lines, a corporation, for authority to adjust rates, was read. It was moved by Poxon, seconded by Malburg, that Notice of Hearing before the Public Utilities Commission of the State of California with reference to Application No. 39223 be received and filed. Motion carried. Communication from R. H. Bockhacker, Police Chief, advising that Officer R. C. Post has been suspended without pay for three days (August 6, 7 and 8, 1957) for conduct unbecoming an officer, was read. It was moved by Anderson, seconded by Poxon, that the action taken by the Police Chief be approved and communication filed. Motion carried. Communication from John B. Moore, Administrative Assistant, transmitting material relative to the pending application for an increase in rates by the Pacific Telephone and Telegraph Company, was read. It was moved by Poxon, seconded by Anderson, that material relative to the pending application for increase in rates by the Pacific Telephone and Telegraph Company be received and filed. Motion carried. Communication from Lillian S. Barnett, Consulting Engineer, advising that three street lights have been installed in the vicinity of Fruitland Avenue and Soto Street, and placed in service effective July 31, 1957, was read. It was moved by Poxon, seconded by Malburg, that communi- cation from Consulting Engineer Barnett be received and filed. Motion carried. Communication from Harold A. Barnett, Consulting Engineer, submitting letter from Jack W. Masson, M.D., dated July 19, 1957, advising that Mr. Emilio Valentine, Laborer, will be disabled from any gainful occupation for an indeterminate period of time, was read. (City Council, on March 19, 1957, authorized that Mr. Valentine be paid full salary through August, 1957.) It was moved by Poxon, seconded by Mail1iard, that Mr. Emilio Valentine be removed from the payroll after August 3l, 1957. Motion carried. Communication from Harold A. Barnett, Consulting Engineer, advising that Mr. Thomas E. Thompson, who was employed as Engineer's Aide, Grade 2, effective July 16, 1957, has not reported for work since August 5, 1957 and the position has been declared vacant, was read. It was moved by Poxon, seconded by Malburg, that communi- cation from Consulting Engineer Barnett be received and filed. Motion carried. Report of activities of the Police Department for the period August 1 - 15, 1957, inclusive, was presented. It was moved by Poxon, seconded by Anderson, that report of activities of the Police Department be received and filed. Motion carried. Communication from Los Angeles County Bounda~y Commission advising that the City of Montebello has filed a proposal with the Secretary of the County Boundary Commission for the annexation of territory known as Simons Brickyard Annexation to the City of Montebel1o, was read. It was moved by Malburg, seconded by Poxon, that communication from the Los Angeles County Boundary Commission be received and filed. Motion carried. Communication from League of California Cities acknowledging receipt of Vernon Resolution requesting the League of California Cities to advocate the exemption of cities from sales and use taxes and gasoline taxes, was read. Bockhacker, Police Chief, requesting permission to employ Mr. MichaelA. deRuyter, as Policeman Class 4 effective August 16, 1957, pending the outcome of physical examination and further investigation, was read. Barnett, Consulting Engineer, submitting two prints and two copies of legal description of a proposed easement from Los Angeles and Salt Lake Railroad Company and Union Pacific Railroad Company to City of Vernon for grade crossing now designated as private crossing by the California Public Utilities Commission as No. 3A-3.9, which connects Downey Road, opposite Leonis Boulevard, with District Boulevard, in the Central Manufacturing District, and recommending that the City Council make formal appli- cation for said easement, was read. It was moved by Mailliard, seconded by Malburg, that the matter of making application for an easement from the Los Angeles and Salt Lake Railroad Company and Union Pacific Railroad Company for grade crossing now designated as private crossing by the California Public Uti1itiesCommission as No. 3A-3.9, be referred to the City Attorney for necessary action. Communication and report from Vincent R. poxon, Assistant City Attorney, with reference to meeting that he and Mr. Ross attended in Berkeley on August 8, 1957 for the purpose of obtaining information relative to the possibility of combining State Employees' Retirement System coverage with Federal Old-Age & Survivors' Insurance, was presented. (Copy sent to each member of the City Council.) It was moved by Anderson, seconded by Poxon, that communi- cation and report from Vincent R. Poxon, Assistant City Attorney, be received and filed. Stone, Director of Sanitation, requesting authority for the Health Department to initiate a monthly health news bulletin to be sent to Vernon business and industrial firms, was read. It was moved by Poxon, seconded by Anderson, that the request of the Director of Sanitation for authority to initiate a monthly health news bulletin be approved for one year on a trial basis. Motion carried. Communication from State of California, Department of Public Works, Division of Highways, notifying the City of Vernon of the Department's intention to request the California Highway Commission to relinquish the portion of State highway described in the attached proposed Vote of Relinquishment, was read. It was moved by Poxon, seconded by Malburg, that communication from State of California, Department of Public Works, Division of High- ways be referred to the City Attorney and the Engineering Department for investigation and report. Motion carried. Communication from The Arco Company requesting a permit to conduct a business of warehousing and selling of heavy duty maintenance paints at 2348 E. 38th Street, was read. It was moved by Poxon, seconded by Mailliard, that request of The Arco Company be referred to the Fire Department with power to act. Motion carried. Communication from Consolidated Chemical Industries, Division of Stauffer Chemical Company, requesting a permit to conduct a business of collecting, separating and processing for shipment raw materials consisting of junk bones, green bones, hide trimmings, sheep trimmings, hooves and horns, at the northwest corner of Sierra Pine Avenue and Bandini, on property presently owned by the Stauffer Chemical Company, was read. It was moved by Poxon, seconded by Anderson, that the request of Consolidated Chemical Industries, Division of Stauffer Chemical Company, be referred to the Health Department, Engineering Department, Fire Department and the City Clerk's Office for investi- gation and report. Motion carried. Communication from Carson B. Hubbard, City Attorney, transmitting letter from E. H. Farrar, Sales Manager of Central Manu- facturing District, Inc. proposing the burning of a structure belonging to said Central Manufacturing District and located on the corner of Exchange Avenue and Loma Vista ~as a part of the Vernon Fire Depart- ment's training program, was read. (Letter contains a "save,harmlessll clause satisfactory to the City Attorney.) It was moved by Anderson, seconded by Malburg, that the proposal of E. H. Farrar, Sales Manager of Central Manufacturing District, Inc., be approved provided that Central Manufacturing District, Inc. is willing to assume all liability to adjacent property and persons in connection with the burning of the structure, and will obtain a I I 8/20/57 public liability policy naming the City of Vernon as an additional insured, certificate of said policy to be furnished to City and approved as to form by the City Attorney. Motion carried. Communication from Harold A. Barnett, Consulting Engineer, advising that Mr. F. M. Perez, Laborer Grade 2, has been confined to his bed at home with shingles and hernia since July 25, 1957, and suggesting that authority be granted to carry him on leave of absence with regular pay to close of business August 31, 1957, pending report from his doctor, was read. It was moved by Anderson, seconded by Poxon, that the Engineering Department be granted authority to carry Mr. F. M. Perez, Laborer Grade 2, on leave of absence with regular pay to close of business August 3l, 1957, pending report from his doctor. Motion carried. Communication from John B. Moore, Administrative Assistant, submitting proposal of C. K. Mason, of Mason, Muntz & associates, setting forth his proposal for performing services to the City of Vernon in a consulting capacity, was read. It was moved by Mailliard, seconded by Poxon, that Mr. Mason's proposal be referred to the City Attorney for a recommendation as to the manner in which the present engineering retainer is to be terminated and for the drafting of an agreement if necessary. Motion carried. Copy of a communication from the Metropolitan Water District of Southern California, addressed to Central Basin Municipal Water District, with reference to service connection on the Palos Verdes feeder at Alameda Street and Vernon Avenue, in the City of Vernon, was read. It was moved by Anderson, seconded by Poxon, that copy of the communication from the Metropolitan Water District of Southern California, addressed to Central Basin Municipal Water District, be referred to Mayor Furlong for a report. Motion carried. Communication from Robert S. Stone, Director of Sanitation, requesting a statement of policy in regards to enforcement procedures in our industrial health program, was read. (Copy sent to each member of the City Council.) It was moved by Anderson, seconded by Malburg, that request of the Director of Sanitation be laid over until the next meeting. Motion carried. Stone, Director of Sanitation, reporting on the progress being made .byLeepers Woodturning Company in installing a multiple chamber incinerator, as approved by the Los Angeles Air Pollution Control District, was read. It was moved by Anderson, seconded by Poxon, that communi- cation from the Director of Sanitation be received and filed. Motion carried. Communication from Robert S. Stone, Director of Sanitation, with reference to the mosquito breeding problem in the Los Angeles River, was read. I I 8/20/57 It was moved by Anderson, seconded by Poxon, that the City Clerk be instructed to write a letter for the City Council to the U.S. Army Corps of Engineers requesting them to alleviate conditions causing mosquito breeding in the Los Angeles River channel within the City of Vernon. MOtion carried. Communication from Carl E. Nemethi, M.D., Health Officer, requesting authority to take steps toward an influenza immunization program for city employees and residents, was read. It was moved by Malburg, seconded by Mailliard, that the Health Department be authorized to purchase vaccine to immunize city employees and residents against Asiatic virus influenza at no cost to said employees and residents, and that the Health Department be authorized to immunize the families of city employees at cost. Motion carried. Communication from Harold A. Barnett, Consulting Engineer, requesting authority to employ Dale M. Laird as Junior Civil Engineer, Grade 3, effective September 3, 1957, to work as draftsman to fill position now authorized but vacant, was read. Communication from Skiatron TV, Inc. making an application for the grant of the license, privilege and permit to erect, construct, lay, maintain and operate poles, pipes, conduits, wires or cables open, over, under, in, across or along any street, lane, court, highway, road or other place in the City of Vernon for the purpose of operating and providing a closed circuit system in said city for licensee's customers) was read. It was moved by Poxon, seconded by Mailliard, that the City Clerk be instructed to advise Skiatron TV, Inc. that the City Council will require further specific information before they can give consideration to said application. Barnett, Consulting Engineer, addressed to the City Clerk, suggesting that the City Council direct the City Attorney and the Engineering Department to confer with Moffatt & Nichol, Inc., Consulting Engineers, with a view to submitting to the City Council as soon as possible a form of proposed agreement covering preparation of construction plans and specifications to widen 26th Street Bridge in accordance in general with Scheme I as submitted by Moffatt & Nichol, Inc. in their report of February 6, 1957 to provide new five foot sidewalks on outside of spandrel walls, was read. (Expenditure authorized in 1957-58 Street Department Budget.) It was moved by Anderson, seconded by Malburg, that the suggestion of Consulting Engineer Barnett be approved. Motion carried. Barnett, Consulting Engineer, addressed to the City Clerk, suggesting that the City Council direct the City Attorney and the Engineering Department to contact Mason, Muntz & Associates, with a view to submitting to the City Council as soon as possible a form of proposed agreement covering plans, speci- fications and general administration and supervision of construction work of four new three-bedroom houses on Fruitland Avenue, at Pump Plant No. 3 and one new three-bedroom house and relocation of one two-bedroom house on Vernon Avenue, Pumping Plant No.2, was read. (Expenditure authorized in 1957-58 Water Department Budget.) It was moved by Anderson, seconded by Malburg, that the suggestion of Consulting Engineer Barnett be approved. Motion carried. Memorandum from Harold A. Barnett, Consulting Engineer, addressed to the City Clerk, suggesting that the City Council direct the City Attorney and the Engineering Department to contact Mason, Muntz & Associates with a view to submitting to the City Council as soon as possible a form of agreement covering plans and specifications and general administration and supervision of construction work for the rehabilitation of the exterior of the present old portion of the City Hall Building and Pumping Plant No. 1 Building, with the work segregated in such a way that any charges against work done on the Pump House may be kept separate from the City Hall, was read. (Expenditure authorized in the 1957-58 Water Department Budget and 1957-58 Care of Buildings and Grounds Budget.) Ordinance No. 704 - An Ordinance of the City of Vernon regulating conditions hazardous to life and property from fire and explosion; establishing a Bureau of Fire Prevention, providing officers therefor and prescribing their powers and duties by the adoption by reference of I'Fire Prevention Code, 1956 Editionll, as recommended by the National Board of Fire Underwriters as amended by I I 8/20/57 this Ordinance, and repealing all ordinances or parts of ordinances in conflict herewith, was read for a first reading by title. It was moved by Poxon, seconded by Anderson, that Ordinance No. 704 receive and pass a first reading. Motion carried. Motion carried. "Payroll Warrant Register No.2" covering payroll for the period August 1 - 15, 1957, which includes Warrants Nos. 13 to 18 (both inclusive) drawn on Citizens National Trust & Savings Bank of Los Angeles, and Warrant No. 7 drawn on the First National Bank of Vernon, totaling $41,381.46, was examined and audited. It was moved by Poxon, seconded by Mailliard, that "Payroll Warrant Register No. 211 be approved and payment authorized for Warrants Nos. 13 to 18 inclusive, with no exceptions, drawn on Citizens National Trust & Savings Bank of Los Angeles, and for Warrant No. 7 drawn on the First National Bank of Vernon. Motion carried. "Warrant Register No.4" covering claims and demands presented during the period August: 1 - 15, 1957, which includes Demands Nos. 404 to 485 (both inclusive) totaling $17,475.31 (accounting period August 16 - 31), was examined and audited. It was moved by Poxon, seconded by Mailliard, that "Warrant Register No. 411 be approved and payment authorized for Demands Nos. 404 to 485 inclusive, with no exceptions. Motion carried.
