19571105 Regular City Council Meeting - Minutes I I MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD NOVEMBER 5, 1957, AT TWO 0 I CLOCK P.M. IN THE COUNCIL CHAMBERS OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA. COUNCIL PRESENT: Anderson, Furlong, Mailliard, Malburg, Poxon COUNCIL ABSENT: None The meeting was called to order by Mayor R. J. Furlong. It was moved by Poxon, seconded by Malburg, that minutes of the meeting of October 15, 1957 be approved as written and sub- mitted. Motion carried. Resolution No. 2098 - A Resolution of the City Council of the City of Vernon authorizing the firm of Darling, Shattuck & Edmonds to take such steps as are necessary to protect the interests of the City of Vernon in proceedings before the Public Utilities Commission of the State of California, was read. It was moved by Paxon, seconded by Anderson, that Resolution No. 2098 be approved and adopted. Motion carried. Ayes: Anderson, Furlong, Mailliard, Malburg, Poxon Noes: None Absent: None Resolution No. 2099 - A Resolution of the City Council of the City of Vernon authorizing the City Clerk and the City Attorney to investigate the financing of the generating and/or distributing facilities for supplying the City with electrical energy, was read. It was moved by Anderson, seconded by Malburg, that Resolution No. 2099 be approved and adopted. Motion carried. Heinze, Consulting Electrical Engineer, to prepare preliminary plans and estimates for the construction of the most feasible means of supplying and/or distri- buting electrical energy in the City of Vernon, was read. It was moved by Poxon, seconded by Mailliard, that Resolution No. 2100 be approved and adopted. MOtion carried. Ayes: Anderson, Furlong, Mailliard, Malburg, Poxon Noes: None Absent: None Communication from Mason, Muntz & Associates, Consulting Engineers of the City of Vernon, submitting tabulation of bids received for asphalt concrete pavement resurfacing and appurtenances in Soto Street south of Fruitland Avenue and north of south City boundary in accordance with Specifications No. 207, and recommending that the contract be awarded to George Savala Paving Co., the low bidder, in the amount of $2,589.20, was read. It was moved by Poxon, seconded by Mailliard, that the recommendation of Mason, Muntz & Associates, Consulting Engineers of the City of Vernon, be approved. Motion carried. I I 11/5/57 Resolution No. 2101 - A Resolution of the City Council of the City of Vernon accepting the bid of George Savala Paving Co. for the construction of asphalt concrete pavement resurfacing and appurtenances in Soto Street south of Fruitland Avenue and north of south City boundary in accordance with Specifications No. 207 of said City, was read. It was moved by Paxon, seconded by Mailliard, that Resolution No. 2101 be approved and adopted. Motion carried. Ayes: Anderson, Furlong, Mail liard , Malburg, Poxon Noes: None Absent: None Communication from the State Board of Equalization with reference to City of Vernon Resolution No. 2088 requesting the Board to permit Haskins and Sells, Auditors of the City of Vernon, to inspect the sales and use tax records of said Board pertaining to the sales and use taxes collected for the City of Vernon, advising that an independent contractor, such as Haskins and Sells, does not qualify as a tax collector or his duly authorized deputy or employee, was read. (Laid over at meeting of 10/15/57.) It was moved by Anderson, seconded by Poxon, that F. A. Ziemer and/or L.R. Burch and/or G. G. Skalsky be authorized to examine the sales and use tax records of the State Board of Equalization in Sacramento pertaining to sales and use taxes collected for the City of Vernon, and that necessary expenses involved in said examination be authorized. Motion carried. Resolution No. 2102 - A Resolution of the City Council of the City of Vernon directing F. A. Ziemer and/or L. R. Burch and/or G. G. Skalsky, Deputy Tax Collectors of the City of Vernon, to examine the sales and use tax records of the State Board of Equalization pertaining to sales and use taxes collected for the City of Vernon, was read. It was moved by Poxon, seconded by Malburg, that Resolution No. 2102 be approved and adopted. Motion carried. B-38 Palos Verdes feeder at Vernon Avenue for the City of Vernon, was read. It was moved by Poxon, seconded by Malburg, that copy of a communication from the Metropolitan Water District of Southern ..;.; ! 1 I' ~ 11/5/57 California, addressed to Central Basin Municipal Water District, be received and filed. Motion carried. Communication from G. G. Skalsky, Assistant Director of Civil Defense, advising that $846.00 has been received from the State of California representing one-half of original Project Application covering sirens installed at Fire Station No. 1 and No.2, was read. It was moved by Anderson, seconded by Poxon, that communi- cation from the Assistant Director of Civil Defense be received and filed. Motion carried. Communication from Mason, Muntz & Associates, Consulting Engineers of the City of Vernon, advising that two bulletin boards have been erected for posting of legal notices, was read. It was moved by Anderson, seconded by Mailliard, that communication from Mason, Muntz & Associates, Consulting Engineers of the City of Vernon, be received and filed. Motion carried. Communication from John S. Simpson requesting that an 8~' section of a front room wall of Olympic Cottage No. 3 be moved to the edge of the porch, was read. It was moved by Anderson, seconded by Poxon, that Mr. John S. Simpson be granted permission to do this work, if he so desires, at his own expense, under the supervision of the Building Department. Motion carried. Communication from Mason, Muntz & Associates, Consulting Engineers of the City of Vernon, requesting authority to employ Kermit Bergen as Chainman Grade 1, effective October 22, 1957, was read. (Replaces David L. Schultz who was assigned to other duties.) It was moved by Anderson, seconded by Poxon, that the request of Mason, Muntz & Associates, Consulting Engineers of the City of Vernon, be approved. Motion carried. Claim for damages in the amount of $10,000.00 filed by Robert S. Fernandez in connection with accident involving automobile of claimant and motorcycle registered to the City of Vernon and operated by Uhlen Leroy White, was read. It was moved by Poxon, seconded by Mailliard, that the claim for damages filed by Robert S. Fernandez be rejected. Motion carried. Communication from League of California Cities advising that the League of California Cities and the State Compensation Insurance Fund will again co-sponsor a safety contest for all California cities, and urging the City of Vernon to enroll in the new contest, was read. (Name of person who should receive future safety contest correspondence.) It was moved by Poxon, seconded by Mailliard, that the City of Vernon enroll in the new safety contest and that F. A. Ziemer be named as the person to receive future safety contest correspondence. Motion carried. Communication from the Los Angeles Metropolitan Traffic Association transmitting a resolution which was adopted by the I I 11/5/57 Executive Committee of the Association at its meeting October 8th, petitioning Congress to enact at the 1958 session the necessary legis- lation authorizing the Secretary of Commerce to more equitably apportion funds to the several states for construction and completion of the National System of Interstate and Defense Highways, and urging the City of Vernon to give earnest consideration to the adoption of a similar resolution, was read. It was moved by Poxon, seconded by Malburg, that the City Attorney be instructed to draft a resolution similar to the one adopted by the Executive Committee of the Los Angeles Metropolitan Traf- fic Association at its meeting held October 8, 1957. Motion carried. Communication from National Pipe and Steel, Inc. requesting a permit to operate a steel warehouse at 3132 E. Washington Blvd., was read. It was moved by Poxon, seconded by Anderson, that the request of National Pipe and Steel, Inc. be approved and permit granted. Motion carried. Communication from R. H. Bockhacker, Police Chief, recom- mending that I. L. Brummett be advanced from Patrolman Class 4 to Class 3 effective November 1, 1957, as he will have completed his probationary period on that date, was read. It was moved by Malburg, seconded by Mailliard, that the recommendation of the Police Chief be approved. Motion carried. Assembly Interim Committee Reports Nos. 12 and 13 entitled, "Report of the Subcommittee on Beaches and Parksll and IIReport of the Subcommittee on Highways" transmitted by the California Legislature to the Vernon City Planning Commission, were presented. It was moved by Poxon, seconded by Anderson, that Assembly Interim Committee Reports Nos. 12 and 13 be received and filed. Motion carried. Application before the Public Utilities Commission of the State of California by various firms operating public cold storage facilities, for authority to establish a new accessorial charge for unloading cars in the Counties of Los Angeles, Orange, Riverside, San Diego and San Bernardino in the State of California, was presented. It was moved by Anderson, seconded by Poxon, that Application before the Public Utilities Commission of the State of California by various firms operating public cold storage facilities be received and filed. Motion carried. Communication from Carl A. Heinze, Consulting Electrical Engineer, submitting three bids received for approximately 2,847 pounds of scrap copper and scrap lead cable which has been returned to the City by the Southern California Edison Company in the operation of the Vernon City electric distribution system, and recommending that the bid of Lipsett Steel Products, Inc., the highest bidder, in the amount of $.1359 per pound picked up on the premises, be accepted, was read. It was moved by Poxon, seconded by Malburg, that the recom- mendation of the Consulting Electrical Engineer be approved and that I I 11/5/57 the bid of Lipsett Steel Products, Inc. for scrap copper and scrap lead cable, be accepted. Motion carried. Communication from the State of California, Department of Public Works, Division of Highways, advising that the quarterly allocation of 5/8~ gas tax funds to the City of Vernon for the period ending September 30, 1957, based on a population of 432 is $344.25, was read. It was moved by Poxon, seconded by Mailliard, that communi- cation from the State of California, Department of Public Works, Division of Highways, be received and filed. Motion carried. Communication from J. S. Colton, Building Engineer, recom- mending that E. H. Malkemus be advanced from Assistant Building Engineer and Inspector Grade 2 to Grade 1, effective November 1, 1957, as he will have satisfactorily completed his probationary period on that date, was read. It was moved by Malburg, seconded by Mailliard, that the recommendation of the Building Engineer be approved. Motion carried. Communication from R. H. Bockhacker, Police Chief, advising that Police Chief H. Fertig, of Huntington Park, has requested assistance from the Vernon Police Department in the controlling of traffic on Pacific Blvd. in Huntington Park during the Christmas shopping rush December 2 to December 24, 1957, inclusive, between the hours of 7:00 PM and 9:00 PM daily, was read. (Police Chief requested permission to grant Chief Fertig's request.) It was moved by Anderson, seconded by Poxon, that the request of Chief Bockhacker to grant Chief Fertig's request be approved. Motion carried. Communication from Mason, Muntz & Associates, Consulting Engineers of the City of Vernon, recommending that Vern F. Kyckelhahn, Pumping :Plant Operator, Grade 1, be advanced to Assistant Pumping Plant Foreman, Grade 4, effective November 1, 1957, was read. It was moved by Anderson, seconded by Poxon, that the recom- mendation of Mason, Muntz & Associates, Consulting Engineers of the City of Vernon, be approved. Motion carried. Communication from Mason, Muntz & Associates, Consulting Engineers of the City of Vernon, transmitting letter from Rodding- Cleaning Machines, Inc., dated October 18, 1957, in which they state that they are in the process of making up a brochure describing their equipment and operations in cleaning sanitary sewers, and in which they request that the City of Vernon write them a letter relative to the service they are furnishing the City of Vernon, for inclusion in their brochure, was read. It was moved by Anderson, seconded by Poxon, that the Engineering Department be authorized to write a letter to Rodding- Cleaning Machines, Inc., for inclusion in their brochure, relative to the service they are furnishing the City of Vernon, said letter to be signed by Robert H. King, Sanitary Engineer. Motion carried. Communication from L. C. Husted, Fire Chief, requesting authority to have 250 inserts printed of the recently adopted Fire I I 11/5/57 Prevention Code at an approximate cost of $288.00, was read. It was moved by Poxon, seconded by Mailliard, that the request of the Fire Chief be approved. Motion carried. Communication from L. C. Husted, Fire Chief, advising that on October 29, 1957 the City of Downey returned the pumper which they had leased from the City of Vernon, was read. It was moved by Poxon, seconded by Malburg, that communi- cation from the Fire Chief be received and filed. Motion carried. Communication from L. C. Husted, Fire Chief, requesting authority to purchase six metal chairs for use of Fire Department Station No.1, at an approximate cost of $30.00 per unit, was read. It was moved by Poxon, seconded by Anderson, that the request of the Fire Chief be approved. Motion carried. Communication from L. C. Husted, Fire Chief, requesting permission to advance Arnold J. deBoer, Patrick W. Fulcher and Robert L. Smith from Hosemen Grade 4 to Grade 3, effective November 16, 1957, as these men will have satisfactorily completed their probationary period on that date, was read. It was moved by Malburg, seconded by Mailliard, that the request of the Fire Chief be approved. Motion carried. Notice from the League of California Cities, Los Angeles County Division, of the regular monthly meeting to be held November 21, 1957 at the Silver Saddle Cafe in Downey, was read. It was moved by Malburg, seconded by Mailliard, that notice from the League of California Cities, Los Angeles County Division, be received and filed. Motion carried. Communication from J. Stanley, Chairman of the City of Vernon Employees Credit Union Committee, advising that a majority of the employees are in favor of organizing a Credit Union, and requesting approval for organization of a Credit Union supported by payroll deductions, was read. It was moved by Anderson, seconded by Poxon, that the request of the City of Vernon Employees Credit Union Committee be approved. Motion carried. Communication from Gus Kallas requesting a permit to operate a restaurant at 5214 Santa Fe Avenue, was read. It was moved by Poxon, seconded by Mailliard, that the request of Gus Kallas be referred to the Director of Sanitation with power to act. Motion carried. Communication from Mason, Muntz & Associates, Consulting Engineers, offering their services to prepare a preliminary report of existing storm drain deficiencies within the City of Vernon, at a fixed fee of $6,600.00, was read. It was moved by Anderson, seconded by Poxon, that the offer of Mason, Muntz & Associates, Consulting Engineers, be accepted. Motion carried. I I 11/5/57 Resolution No. 2104 - A Resolution of the City Council of the City of Vernon accepting the offer of Mason, Muntz & Associates to perform certain engineering services, was read. It was moved by Anderson, seconded by Poxon, that Resolution No. 2104 be approved and adopted. Motion carried. Nemethi, M.D., Health Officer, addressed the City Council with reference to a City of Vernon uniform for the Public Health Nurse. It was moved by Anderson, seconded by Poxon, that the Public Health Nurse obtain samples of various uniforms and present same to the City Council for consideration. Motion carried. Communication from Robert S. Stone, Director of Sanitation, requesting authority to pay $2.85 to Mrs. R. W. Richter to cover expenses while attending a meeting of the Los Angeles County Mental Health Survey Commission on October 28, 1957, was read. It was moved by Poxon, seconded by Anderson, that the request of the Director of Sanitation be approved. Motion carried. Communication from L. C. Husted, Fire Chief, submitting a copy of all correspondence in the Fire Department files from the National Board of Fire Underwriters, was presented. (Copy to each member of the City Council.) It was moved by Mailliard, seconded by Poxon, that communi- cation from the Fire Chief, together with a copy of all correspondence from the National Board of Fire Underwriters, be received and filed. Motion carried. Report of the activities of the Police Department for the period October 15-31, 1957 inclusive, was presented. It was moved by Malburg, seconded by Mailliard, that report of the activities of the Police Department be received and filed. Motion carried. Communication from William E. Lewis requesting a permit to operate a lunch truck in the City of Vernon, was read. It was moved by Poxon, seconded by Anderson, that the request of William E. Lewis be referred to the Director of Sanitation with power to act. Motion carried. Communication from Campbell Chain Company requesting a permit to conduct a business of wholesaling chain and chain products, including hoist products, at 2960 Leonis Blvd., was read. Skalsky, Assistant Director of Civil Defense, requesting permission to purchase ten 20' lengths of 3~n nominal size, rubber lined, double jacket cotton hose, with brass couplings, 8 thread per inch National Pipe Thread, from Surplus Federal Property, was read. (Handling and shipping charge will be $9.00 per length.) It was moved by Anderson, seconded by Poxon, that the request of the Assistant Director of Civil Defense be approved. Motion carried. Report of the work and activities of the Vernon Fire Department for the fiscal year ending June 30, 1957, was presented. (Copy to each member of the City Council.) It was moved by Malburg, seconded by Mailliard, that the report of the work and the activities of the Vernon Fire Department for the fiscal year ending June 30, 1957 be received and filed. Motion carried. Assistant City Attorney Poxon made a verbal report with reference to the amount other participating jurisdictions had been allocated from the Crossing Protection Fund in connection with the construction of grade crossing protection at Crossing No. 3A-4.2. Mr. Poxon stated that the other participating jurisdictions had been allocated an amount based on the same percentage used in computing Vernon's allocation. No action taken by the City Council. Police Chief Bockhacker made a verbal report stating that at times it was necessary to send Police Officers, on very short notice, to various cities to interview or to return suspects, and that there were no funds immediately available for financing these trip s . It was moved by Anderson, seconded by Poxon, that, whenever it is necessary for the Police Officers to travel to various cities to interview or to return suspects, the City Clerk be authorized to issue a check in an amount not to exceed $300.00 for financing any one trip. Motion carried. Police Chief Bockhacker made a verbal request for authority to have the Assistant Street Painter make ten (10) one-man measuring instruments for use of the Police Department, at an approximate cost of $10.00 each. It was moved by Poxon, seconded by Mailliard, that "Payroll Warrant Register No.4" be approved and payment authorized for Warrants Nos. 25 to 26 drawn on Citizens National Trust and Savings Bank of Los Angeles, and Warrants Nos. 19 to 24 inclusive, with no exceptions, drawn on the First National Bank of Vernon. "Warrant Register No. 8A" covering claims and demands presented during the period October 1-15, 1957, which includes Demands Nos. 931 to 933 (both inclusive) totaling $214.72 (accounting period October 16-31, 1957), was examined and audited. "'Warrant Register No. 9ft covering claims and demands presented during the period October 16-31, 1957, which includes Demands Nos. 934 to 1064 (both inclusive) totaling $10,934.60 (accounting period November 1-15, 1957), was examined and audited. It was moved by Poxon, seconded by Mailliard, that "Warrant Register No. 8A" and "Warrant Register No. 9" be approved and payment authorized for Demands Nos. 931 to 1064 inclusive, with no exceptions.
