IN THE COUNCIL CHAMBERS OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA. COUNCIL PRESENT: Anderson, Furlong, Mailliard, Malburg, Poxon COUNCIL ABSENT: None The meeting was called to order by Mayor R. J. Furlong. It was moved by Anderson, seconded by Malburg, that the minutes of the meeting of January 7, 1958 be approved as written and submitted. Motion carried. It was moved by Anderson, seconded by Poxon, that Ordinance No. 708 receive a third and final reading by title. Motion carried. Ordina~ce No. 798 - An Ordinance of the City of Vernon providing for the regulation of catering vehicles in said City, was read for a third and final reading by title. It was moved by Anderson, seconded by Malburg, that Ordinance No. 708 receive and pass a third reading and be adopted. Motion carried. Ordi.nance No. 709 - An Ordinance of the City of Vernon making it unlawful to keep, maintain or conduct, or cause to be kept, maintained or conducted, any lunch, meal or eating cart, wagon or stand used in selling or vending popcorn, candy, peanuts, or any other article of food or drink upon any public street, alley or place in the City of Vernon, and repealing all ordinances in conflict herewith, was read for a third and final reading by title. It was moved by Poxon, seconded by Malburg, that Ordinance No. 709 receive and pass a third reading and be adopted. Motion carried. Ayes: Anderson, Furlong, Mailliard, Malburg, Poxon Noes: None Absent: None Joint report relative to cross-connection control submitted by the Water, Building and Health Departments, dated January 2, 1958, outlining the responsibilities of each of the three City Departments in the proposed program, together with a tentative method of operation for the establishment of an adequate cross-connection control program for the City of Vernon. (Laid over at meeting of 1/7/58.) Communication from John B. Moore, Administrative Assistant, requesting additional time to submit information to the City Council relative to the needs of the Health Department with reference to a cross-connection control program, was read. I I 1/21/58 It was moved by ~oxon, seconded by I~i11iard, that the request of the Administrative Assistant be approved and that the matter relative to the establishment of an adequate cross-connection control program for the City of Vernon be laid over pending receipt of information pertaining to the needs of the Health Department in carrying out its responsibility under this program. Motion carried. Communication from L. C. Husted, Fire Chief, transmitting five copies of lIRu1es and Regulations for the Government of the Officers and Members of the City of Vernon Fire Department", and requesting that same be approved and adopted by the City Council and that authority be granted to have 100 copies printed at a cost of $175.00, was read. (Laid over at meeting of 1/7/58.) It was moved by Malburg, seconded by Mai11iard, that the ttRu1es and Regulations for the Government of the Officers and Members of the City of Vernon Fire Departmenttl be approved as submitted and be adopted, and that authority be granted to have 100 copies printed at a cost of $175.00. Motion carried. Mr. L. R. Guerra, Vice President and General Manager of Cantlay & Tanzo1a, Inc. and Western Truck Lines, Ltd., appeared before the City Council and stated that the Cant1ay and Tanzo1a interests, in the paving of their yard located at 2550 E. 28th Street, had inadvertently paved a portion of 30th Street. Mr. Guerra requested that the Cant1ay and Tanzo1a interests be allowed to utilize the unused portion of 30th Street. Communication was read from Mason, Muntz & Associates, Consulting" Engineers of the City of Vernon, advising that the Cantlay and Tanzo1a interests have paved with asphalt concrete the entire width of 30th Street from approximately east right-of-way line of the /A. T. & S. F. Railway Company to the easterly end of 30th Street as dedicated, and requesting that authority be granted to the Engineering Department and the City Attorney's office to negotiate with the Cantlay and Tanzola interests and to recommend to the City Council a feasible method of settling this matter to the satisfaction of all concerned. It was moved by Poxon, seconded by Anderson, that the Engineering Department and the City Attorney's office be authorized to negotiate with the Cant1ay and Tanzola interests for the purpose of making recommendations to the City Council for a feasible method of settling this matter to the satisfaction of all concerned. Motion carried. Communication from Mason, Muntz & Associates, Consulting Engineers of the City of Vernon, requesting authority to advance Delwin J. Tucker, Assistant Maintenance Man, Grade 3 to Grade 2, effective February 1, 1958, as he will have satisfactorily completed his six months probationary period, was read. It was moved by Anderson, seconded by Poxon, that the request of Mason, Muntz & Associates, Consulting Engineers of the City of Vernon, be approved. Motion carried. Communication from Mason, Muntz & Associates, Consulting Engineers of the City of Vernon, advising that it will be necessary to secure additional right-of-way before proceeding with the construction work for widening of the 26th Street bridge, and I I 1/21/58 submitting Engineering Department Drawing No. A4-l470 showing the parcels involved, together with their legal description, was read. It was moved by Anderson, seconded by Poxon, that the City Attorney be authorized to secure a title report on the parcels involved and that authority be granted to negotiate for the acquisition of the necessary right-of-way. Motion carried. Communication from Mason, Muntz & Associates, Consulting Engineers of the City of Vernon, advising that George Savala Company has completed the construction of asphalt concrete pavement resurfacing and appurtenances in So to Street south of Fruitland Avenue and north of south city boundary in accordance with Specifications No. 207, and recommending that the work be accepted by the City of Vernon and that payment be authorized in accordance with the terms of the contract, was read. It was moved by Anderson, seconded by Malburg, that the recom- mendation of Mason, Muntz & Associates, Consulting Engineers of the City of Vernon, be approved. Motion carried. Resolution No. 2123 - A Resolution of the City Council of the City of Vernon accepting the construction of asphalt concrete pavement resurfacing and appurtenances in Soto Street south of Fruitland Avenue and north of south city boundary in accordance with Specifications No. 207 of said City, was read. It was moved by Anderson, seconded by ~~lburg, that Resolution No. 2123 be approved and adopted. Motion carried. Evans as Engineering Clerk, Grade 4, effective January 15, 1958, on a temporary basis, in place of William H. Morrison, who was granted a military leave of absence without pay, was read. It was moved by Malburg, seconded by Poxon, that the request of Mason, Muntz & Associates, Consulting Engineers of the City of Vernon, be approved. Motion carried. Communication from R. H. Bockhacker, Police Chief, transmitting copy of Resolution No. 4131 of the City of Huntington Park providing for mutual aid between the Police Department of the City of Huntington Park and surrounding communities, and recommending that a resolution similar to City of Vernon's Resolution No. 2090, a resolution which provided for mutual aid between the Vernon Fire Department and other communities, be adopted providing for mutual aid between the Vernon Police Department and surrounding communities, was read. It was moved by Poxon, seconded by Mailliard, that the recommendation of the Police Chief be referred to the City Attorney for a report or for drafting a resolution if he deems it advisable. Motion carried. Communication from R. H. Bockhacker, Police Chief, recom- mending that Charles J. Allen be advanced from Policeman Grade 4 to I I 1/21/58 Grade 3, effective January 16, 1958, as he has satisfactorily passed his six months probationary period, was read. It was moved by Anderson, seconded by Poxon, that the recom- mendation of the Police Chief be approved. Motion carried. Communication from R. H. Bockhacker, Police Chief, requesting authority to send Detective Frank Sweeney to the 23rd Southern California Narcotics Officers Conference to be held in Santa Barbara, California, on January 23, 1958, with an expense allowance of $20.00, was read. It was moved by P~derson, seconded by Malburg, that the request of the Police Chief be approved. Motion carried. Communication from R. H. Bockhacker, Police Chief, advising that the Attorney General has called a special all-zone ltChiefs of Po1iceH meeting in Fresno, California, on January 31, 1958, and requesting permission to attend with a $50.00 expense allowance, was read. It was moved by Anderson, seconded by Malburg, that the request of the Police Chief be approved. Motion carried. Communication from John B. Moore, Administrative Assistant, transmitting a letter from Michie City Publications Company of Los Angeles, together with their proposal in contract form for codifying the ordinances of the City of Vernon at a base price of $7,500.00, was read. The Administrative Assistant recommended that the proposal of Michie City Publications Company of Los Angeles be accepted and that authority be granted to enter into a contract with said company for codifying City of Vernon ordinances. (Copy of all papers mailed to each member of the City Council.) Discussion was held with reference to the various types of binders that could be used. It was stated that if the code was bound in the "Matthew Bender Binder" it would entail an additional cost of three dollars per volume. It was moved by Poxon, seconded by Mail1iard, that the proposal of Michie City Publications Company of Los Angeles be accepted and that the City Attorney be instructed to prepare the necessary contract, including a provision for using the ilMatthew Bender Binder", together with resolution authorizing said contract. Motion carried. Communication from Capitol Metals Co., Inc. requesting a permit to conduct a business of selling and distributing sheet metal products at 4848 Santa Fe Avenue, was read. It was moved by Poxon, seconded by Mai11iard, that the request of Capitol Metals Co., Inc. be approved and permit granted. Motion carried. Communication from David T. Wither1y Engineers requesting a refund of the permit portion of the building fees charged on the Capitol Metals building at 4554 Seville Avenue as this project is being abandoned, was read. (Total fees paid $278.25, $125.00 for the filing fee and $153.25 for the permit fee.) It was moved by Poxon, seconded by Anderson, that the sum of $153.25 be refunded to David T. Witherly Engineers. Motion carried. I I 1/21/58 Communication from American Society for Public Administration advising that the Southern California Regional Conference of the American Society for Public Administration will be held in San Diego on January 31, 1958, was read. It was moved by Malburg, seconded by Mailliard, that communi- cation from American Society for Public Administration be received and filed. Motion carried. Communication from Central Basin Water Association extending an invitation to attend the next regular meeting of the Board of Directors to be held in Huntington Park on February 6, 1958, was read. It was moved by Malburg, seconded by Anderson, that communi- cation from Central Basin Water Association be received and filed. Motion carried. Report of the activities of the Police Department for the period January 1 - 15,1958 inclusive, was presented. It was moved by Poxon, seconded by Malburg, that report of the activities of the Police Department be received and filed. Motion carried. Communication from R. H. Bockhacker, Police Chief, requesting permission to post the east curb of Santa Fe Avenue, between 37th and 38th Streets, restricting parking between 6:30 A.M. and 8:00 A.M., and between 3:30 P.M. and 6:00 P.M., Saturdays, Sundays and holidays excepted, was read. It was moved by Anderson, seconded by Malburg, that the request of the Police Chief be approved. Motion carried. Discussion was held with reference to the establishment of streetcar safety zones on Santa Fe Avenue and on Pacific Boulevard near the intersection of Santa Fe Avenue. It was moved by Malburg, seconded by Mailliard, that street- car safety zones be established on Santa Fe Avenue from the north city boundary to Pacific Boulevard and on Pacific Boulevard just easterly of the Santa Fe Avenue intersection, and that parking be restricted in the vicinity of said safety zones. The matter was referred to the Police Chief and the Engineering Department for investigation and report relative to the type of safety zone most feasible, including such items as safety buttons and reflectors, and to the City Attorney's office relative to any legal questions involved in the establishment of said safety zones. Motion carried. Communication from R. H. Bockhacker, Police Chief, requesting authority to employ Robert E. Shank, Jr. as Policeman Grade 4, effective February 1, 1958, pending physical examination, to replace Frank G. Gwynn who resigned, was read. It was moved by Anderson, seconded by Poxon, that the request of the Police Chief be approved. Motion carried. Franchise Report of the Los Angeles Transit Lines on Franchise Ordinances Nos. 91, 521 and 576 for period ending December 31, 1957, together with check in the amount of $2,467.09, was read. (Last year $2,349.70) I I 1/21/58 It was moved by Anderson, seconded by Poxon, that Franchise Report of the Los Angeles Transit Lines be received and filed. Motion carried. Communication from the Los Angeles County Assessor's Office requesting that Vernon City Tax Districts No. 1 and No. 2 be consolidated into Tax District No. 1 since both tax districts have the same ad valorem tax rate, was read. Notice of action taken by the City Council is to be received by the County Assessor's Office and the State Board of Equalization in Sacramento on or before January 31, 1958. It was moved by Anderson, seconded by Poxon, that the above- mentioned matter be referred to the City Attorney's office and the Engineering Department with a view to consolidating said districts during the ensuing year, and that the County Assessor's Office be advised that the City of Vernon would be unable to make the consolidation this year due to the time element involved. Motion carried. Communication from J. S. Colton, Building Engineer, recommend- ing that the City of Vernon become an active Class t1AfI Member of the International Conference of Building Officials at an annual membership fee of $40.00, was read. It was moved by Malburg, seconded by Anderson, that the recom- mendation of the Building Engineer be approved. Motion carried. Communication from L. C. Husted, Fire Chief, submitting a report of the training exercises held in the Central Manufacturing District during the month of December 1957, was read. (Copy to each member of the City Council.) It was moved by Malburg, seconded by Poxon, that communication from the Fire Chief, together with report of the training exercises, be received and filed. Motion carried. Communication from L. C. Husted, Fire Chief, requesting permission to promote J. L. Looper from Driver Grade 1 to Captain Grade 3, effective January 16, 1958, was read. It was moved by Anderson, seconded by Poxon, that the request of the Fire Chief be approved. Motion carried. Communication from Robert S. Stone, Director of Sanitation, tramsitting a copy of a letter that he has written to the State Health Department relative to the plans of the City of Vernon for a rabies control program, was read. It was moved by Anderson, seconded by Poxon, that communi- cation from the Director of Sanitation be received and filed. Motion carried. Communication from Law Offices of Gordon, Knapp, Gill & Hibbert, with reference to Contract No. 1009, dated April 17, 1956, between the City of Vernon and County Sanitation District No. 1 of Los Angeles County, suggesting that the City of Vernon give notice to the District of termination, effective upon approval of such termination by the Sanitation District, as there is no further purpose to be served by said agreement, was read. Motion carried. Communication from L. C. Husted, Fire Chief, advising that Roseman D. E. Wasley has resigned effective February 1, 1958, and recommending that said resignation be accepted, was read. It was moved by Malburg, seconded by Poxon, that the recom- mendation of the Fire Chief be approved and resignation of Roseman D. E. Wasley be accepted. Motion carried. Communication was read from L. C. Husted, Fire Chief, reporting that the following changes have taken place in the personnel of the Fire Department: H. A. Davidson - Resigned, effective as of the close of business January 8, 1958. R. E. Hieronymus - Terminated due to inability to meet physical agility requirements, effective as of the close of business January 15, 1958. L. M. B10ch- Terminated due to conduct unbecoming a fireman, effective as of the close of business January 11, 1958. It was moved by Anderson, seconded by Poxon, that the changes that have taken place in the personnel of the Fire Department be approved as reported by the Fire Chief. Motion carried. Resolution No. 2124 - A Resolution of the City Council of the City of Vernon requesting the Board of Supervisors of the County of Los Angeles to permit the Registrar of Voters of said County to render specified services to the City of Vernon, relating to the conduct of a General Municipal Election to be held in said City on April 8, 1958, was read. It was moved by Anderson, seconded by Malburg, that Resolution No. 2124 be approved and adopted. Motion carried. It was moved by Anderson, seconded by Malburg, that Resolution No. 2125 be approved and adopted. Motion carried. It was moved by Poxon, seconded by Malburg, that Resolution No. 2126 be approved and adopted. Motion carried. It was moved by Anderson, seconded by Poxon, that Ordinance No. 710 receive and pass a first reading. Motion carried.
