MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF VERNON
HELD APRIL 1, 1958, AT TWO 0' CLOCK
P.M. IN THE COUNCIL CHAMBERS OF THE
CITY HALL LOCATED AT 4305 SANTA FE
AVENUE, VERNON, CALIFORNIA.
COUNCIL PRESENT: Anderson, Furlong, Mailliard, Malburg, Poxon
COUNCIL ABSENT: None
The meeting was called to order by Mayor R. J. Furlong.
It was moved by Malburg, seconded by Mailliard, that the
minutes of the meeting of March 18, 1958 be approved as written and
submitted. Motion carried.
The Clerk announced that this was the time and place for
opening of bids for constrltction of transmission main and rate-of-
flow control piping in accordance with Specifications No. 209.
It was moved by Mailliard, seconded by Malburg, that the
Clerk be instructed to open and read the bids submitted. Motion
carried.
The Clerk opened and read the following bids:

It was moved by Anderson, seconded by Mailliard, that the
bids submitted for construction of transmission main and rate-of-
flow control piping in accordance with Specifications No. 209, be
referred to the Engineering Department and the City Attorney for
checking and report. Motion carried.
It was moved by Anderson, seconded by Poxon, that Ordinance
No. 712 receive a third and final reading by title. Motion carried.
Ordinance No. 712 - An Ordinance of the City of Vernon
declaring its intention to close-up, vacate and abandon a portion
of 30th Street (formerly Bethel Street), in the City of Vernon,
County of Los Angeles, State of California, was read for a third
and final reading by title.
It was moved by Poxon, seconded by Malburg, that Ordinance
No. 712 receive and pass a third reading and be adopted. Motion
carried.

Communication from Mason, Muntz & Associates, Consulting
Engineers, dated March 26, 1958, submitting a tabulation and analysis
of the bids received on March 18, 1958 for the Municipal Housing,
Fruitland and Vernon, Vernon, California, in accordance with Specifi-
cations No. 216 and Plans No. B-15-l458, and recommending that
contract be awarded to H. & U. Construction Company in the amount
of $67,109.50, was read. (Copy to each member of the City Council.)

March 27, 1958, recommending that contract be awarded per the recom-
mendation outlined in letter from Mason, Muntz & Associates,
Consulting Engineers, dated March 26, 1958, with reference to
construction of Municipal Housing in accordance with Specifications
No. 216, was read.
It was moved by Anderson, seconded by Poxon, that the
recommendation of the Building Engineer be approved. Motion carried.
Resolution No. 2151 - A Resolution of the City Council of
the City of Vernon accepting bid of H. & U. Construction Company
for Municipal Housing, Fruitland and Vernon, Vernon, California, in
accordance with Specifications No. 216 and Plans No. B-15-1458, was
read.
It was moved by .Anderson, seconded by Poxon, that Resolution
No. 2151 be approved and adopted. Motion carried.

Communication from Mason, Muntz & Associates, Consulting
Engineers, dated March 26, 1958, submitting a tabulation and analysis

Communication from J. S. Colton, Building Engineer, dated
March 27, 1958, recommending that contract be awarded per the recom-
mendation outlined in letter from Mason, Muntz & Associates, Consulting
Engineers, dated March 26, 1958, with reference to rehabilitation of
the City Hall, Fire Station and Pump Plant #1, in accordance with
Specifications No. 217, was read.
It was moved by Malburg, seconded by Mailliard, that the
recommendation of the Building Engineer be approved. Motion carried.
Resolution No. 2150 - A Resolution of the City Council of
the City of Vernon accepting~bid of Menke Bros., Inc. for rehabili-
tation of the City Hall, Fire Station and Pump Plant No. 1 in
accordance with Specifications No. 217 and Plans No. B-15-1459
consisting of five sheets and B-15-l460 consisting of three sheets,
was read.
It was moved by Malburg, seconded by Y~i11iard, that
Resolution No. 2150 be approved and adopted. Motion carried.

Communication from W. W. Plum, General Manager of Modern
Plastic Company, requesting permission to appear before the City
Council to discuss installation of a water main on the west side of
Pacific Boulevard in the vicinity of Leonis Boulevard, was read.
Mayor Furlong invited Mr. Plum to address the City Council.

Mr. Plum appeared before the City Council and requested
information relative to any plans that the City of Vernon might have
for installing a water main on the west side of Pacific Boulevard in
the vicinity of Leonis Boulevard.
Mr. Plum was informed that the present plan of the City of
Vernon is to install a water main on the west side of Pacific Boulevard
extending from Fruitland Avenue north to approximately 175 feet north
of the center line of Leonis Boulevard, and that the approximate date
for the completion of this project is September 1, 1958.
It was moved by Malburg, seconded by Poxon, that communi-
cation from W. W. Plum, General Manager of Modern Plastic Company, be
received and filed. Motion carried.
Communication from F. A. Ziemer, Chief Deputy City Clerk,
requesting that he and Deputy City Clerk Burch be authorized to
attend the Seminar on Finance Procedures on April 30, 1958, and the
Biennial City Clerks' Institute on May 1 and 2, 1958, in Monterey,
California, with an expense allowance of $150.00 each, was read.
(Both meetings sponsored by the League of California Cities.)
It was moved by Anderson, seconded by Poxon, that the request
of Chief Deputy City Clerk Ziemer be approved. Motion carried.
Communication from Shaw Food Inc. requesting a license to
operate a lunch truck in the City of Vernon, was read.
It was moved by Poxon, seconded by Malburg, that the request
of Shaw Food Inc. be referred to the Director of Sanitation with
power to act. Motion carried.
Communication from ~Vm. McGrath requesting a license to
operate a lunch truck in the City of Vernon, was read.
It was moved by Poxon, seconded by Anderson, that the
request of WID. McGrath be referred to the Director of Sanitation with
power to act. MOtion carried.
Communication from Vernon Horse Buyers, Inc. requesting a
license to conduct a business of buying horses at 3701 Downey Road,
was read.
It was moved by Poxon, seconded by Anderson, that the
request of Vernon Horse Buyers, Inc. be referred to the Director of
Sanitation with power to act. Motion carried.
Communication from Larson Equipment Company requesting a
license to conduct a machinery sales, service and repair business at
3838 Santa Fe Avenue, was read.
It was moved by Anderson, seconded by Malburg, that the
request of Larson Equipment Company be approved and license granted.
Motion carried.
Communication from Mackey Machine Works requesting a license
to conduct a machine shop business at 5075 Santa Fe Avenue, was read.
It was moved by poxon, seconded by Malburg, that the request
of Mackey Machine Works be approved and license granted. Motion
carried.

Communication from Mason, Muntz & Associates, Consulting
Engineers of the City of Vernon, relative to proposed Vernon City
Limit and City of Vernon signs, submitting two prints showing on one
the signs proposed to be erected in the City within the limits of the
Central Manufacturing District (private streets) and the other showing
where signs are proposed to be located in the remainder of the City,
and requesting that the Engineering Department be authorized to
purchase and install a total of forty-three signs as outlined, was
read. (Copy to each member of the City Council.)
It was moved by Poxon, seconded by Malburg, that the request
of Mason, Muntz & Associates, Consulting Engineers of the City of
Vernon, be approved. Motion carried.
Communication from Mason, Muntz & Associates, Consulting
Engineers of the City of Vernon, transmitting original statement from
E. J. Joergenson, M.D. advising that May I, 1958 is the anticipated
date that Robert L. Mantle, Maintenance Man, will be able to resume
his work, and requesting instructions from the City Council relative
to further payments to Mr. Mantle for time off, was read. (Copy to
each member of the City Council.)
It was moved by Anderson, seconded by Poxon, that Robert L.
Mantle, Maintenance Man, be paid his full salary for the second half
of March and the month of April, 1958, and that he be allowed his
regular annual vacation of two weeks later in the year after he has
resumed work. Motion carried.
Communication from R. H. Bockhacker, Police Chief, recom-
mending that A. E. Palen be advanced from Policeman Class 4 to Class
3 effective April 16, 1958, as he will have satisfactorily completed
his six months probationary period on that date, was read.
It was moved by Mailliard, seconded by Malburg, that the
recommendation of the Police Chief be approved. Motion carried.
Communication from R. H. Bockhacker, Police Chief,
requesting permission to appoint City Nurse Rachel Richter as Police
Matron, effective as of April I, 1958, was read.
It was moved by Anderson, seconded by Poxon, that the
request of the Police Chief be approved. Motion carried.
Communication from Theo. Hamm Brewing Company, with
reference to the use of Sealite White Oakum and Sealite acid-
resistant Caulking Yarn on a specific project, advising that the
work has been completed and that they have no further interest in
pursuing this matter at this time, was read.
It was moved by Anderson, seconded by Mailliard, that
communication from Theo. Hamm Brewing Company be received and filed.
Motion carried.
Franchise Report of the Southern California Gas Company
on Ordinance No. 607 for year ending December 31, 1957, together
with check in the amount of $47,293.79, was read.
It was moved by Poxon, seconded by Malburg, that Franchise
Report submitted by the Southern California Gas Company be received
and filed. Motion carried.

Franchise Report of the Richfield Oil Corporation on
Ordinance No. 432 for year ending December 31, 1957, together with
check in the amount of $272.88, was read.
It was moved by Poxon, seconded by Malburg, that Franchise
Report submitted by Richfield Oil Corporation be received and filed.
Motion carried.
Report from the State Board of Equalization with reference
to sales tax distribution for the first quarter of 1958, was read.
It was moved by Malburg, seconded by Poxon, that the report
from the State Board of Equalization be received and filed. Motion
car:r:ied.
Annual report from the Local Planning Office, Department
of Finance, State of California, entitled "California Plans", was
presented.
It was moved by Anderson, seconded by Poxon, that the annual
report from the Local Planning Office, Department of Finance, State
of California, entitled "California PlansH, be received and filed.
Motion carried.
Communication from Union Pacific Railroad Company trans-
mitting a copy of its application for authority to Abandon 37 Non-
Agency Stations in the State of California which has been filed with
the Public Utilities Commission of the State of California, was read.
It was moved by Poxon, seconded by Malburg, that communi-
cation from the Union Pacific Railroad Company, together with a copy
of its application to the Public Utilities Commission of the State
of California, be received and filed. Motion carried.
Reports of 'Carl A. Heinze, Consulting Electrical Engineer,
on operation of electrical system by Southern California Edison
Company for months of January and February, 1958, were read.
It was moved by Poxon, seconded by Malburg, that the reports
of Consulting Electrical Engineer Heinze be received and filed. Motion
carried.
Report of the activities of the Police Department for the
period March 16 - 31, 1958 inclusive, was presented.
It was moved by Malburg, seconded by Mailliard, that the
report of the activities of the Police Department be received and filed.
Motion carried.
Communication from R. H. Bockhacker, Police Chief, recom-
mending that Lease Agreement between the City of Vernon and Motor
Officer G. C. Robbins for one 1953 Harley Davidson Motorcycle, Engine
#53FL4963, be renewed effective as of April 9, 1958, was read.
It was moved by Mailliard, seconded by Poxon, that the
recommendation of the Police Chief be approved. Motion carried.
Communication from James Kilty Check Cashing Service
requesting a license to conduct a check cashing business at 2353 East
38th Street, was read.

It was moved by Mailliard, seconded by Anderson, that the
request of James Kilty Check Cashing Service be approved and license
granted. Motion carried.
Communication from H. G. Whitmore, Chairman of the Committee
for the Opening of Randolph Street, stating that he and Mr. Louis
Meller, President of the Huntington Park Safety Council, would
appreciate the City Council of the City of Vernon arranging a time
and place of meeting with the various Mayors and other persons
interested in the opening of the north side of Randolph Street, was
read.
It was moved by Malburg, seconded by Poxon, that the City
Clerk be instructed to prepare a letter for signature by Mayor Furlong
addressed to Mr. H. G. Whitmore, Chairman of the Committee for the
Opening of Randolph Street, advising him that the City Council of the
City of Vernon does not feel that it should sponsor such a meeting at
this time, but that Mayor Furlong will meet with said committee at a
mutually convenient time and place. Motion carried.
Communication from R. H. Bockhacker, Police Chief, requesting
permission to purchase one vehicle from the King Motor Company at a
price of $1,909.45 plus sales tax, was read.
It was moved by Poxon, seconded by Anderson, that the request
of the Police Chief be approved. Motion carried.
Communication from G. G. Skalsky, Assistant Director of
Civil Defense, extending his thanks to the City Council and the Fire
Department for their cooperation in making the Southern California
Civil Defense and Disaster Association meeting recently held at Fire
Station No. 2 a success, was read.
It was moved by Poxon, seconded by Malburg, that communi-
cation from the Assistant Director of Civil Defense be received and
filed. Motion carried.
Communication from Mason, Muntz & Associates, Consulting
Engineers of the City of Vernon, submitting an original letter from
the Southern California Water Company in which is stated that they
will relocate their 811 water line in Santa Fe Avenue to make room for
the City of Vernon's Metropolitan Water District connecting pipeline
provided that the City of Vernon will pay the cost of the work
involved, was read. (Estimated cost $1,100.00)
It was moved by Poxon, seconded by Malburg, that communi-
cation from Mason, Muntz & Associates, Consulting Engineers of the
City of Vernon, together with original letter from Southern Califcrnia
Water Company with reference to relocation of 8" water line in Santa
Fe Avenue, be referred to the City Attorney for investigation and
report. Motion carried.
Franchise Report of the American District Telegraph Company
on Ordinance No. 166 for year ending February 28, 1958, together with
check in the amount of $3,872.80, was read.
It was moved by Poxon, seconded by V~lburg, that Franchise
Report submitted by the American District Telegraph Company be
received and filed. Motion carried.

Communication from W. J. Middleton Co. requesting a license
to conduct a business of distributing a Bar-B-Q accessory to whole-
salers at 4814 Loma Vista Avenue, was read.
It was moved by Poxon, seconded by Malburg, that the
request of W. J. Middleton Co. be approved and license granted.
Motion carried.
Communication from Joseph L. Nuney requesting a license to
operate a lunch truck in the City of Vernon, was read.
It was moved by Anderson, seconded by Poxon, that the
request of Joseph L. Nuney be referred to the Director of Sanitation
with power to act. Motion carried.
Communication from Darling, Shattuck & Edmonds, Special
Counsel, dated March 28, 1958, with reference to franchise payments
for the calendar year 1957 tendered by Southern California Edison
Company, advising that they are of the opinion that the payments may
be accepted without prejudice to the City's position that the 1937
Lease Agreement with Southern California Edison Company has been
terminated and that the City of Vernon is entitled to immediate
possession of the Vernon electric distribution and transmission
system, and suggesting a form of letter to be used in notifying
Edison that the City is accepting the payments, was read. (Darling,
Shattuck & Edmonds advised that Edison's calculations should be
verified before any suggested action be taken.)
It was moved by Malburg, seconded by Poxon, that franchise
reports submitted by Southern California Edison Company on Franchise
Ordinances Nos. 503, 504 and 611 for period ending December 31, 1957,
be referred to Carl A. Heinze, Consulting Electrical Engineer, for
checking and report, and upon verification of Edison's calculations
by Consulting Electrical Engineer Heinze, that the City accept the
payments and Edison be notified that the City is accepting the
payments, and that the substance of the letter to Edison be in
accordance with the suggestion outlined in letter from Darling,
Shattuck & Edmonds, dated March 26, 1958. Motion carried.

It was moved by Paxon, seconded by Malburg, that Resoluuion
No. 2149 be approved and adopted. Motion carried.

v. R. Poxon, Assistant City Attorney, made a verbal report
with reference to Jean C. Dionne, Amusement Games and Juke Boxes,
relative to installing a coin operated bowling game in the City of
Vernon, recommending that a license be granted upon the payment of
the license fee as required by License Ordinance No. 710.

It was moved by Poxon, seconded by Malburg, that the recom-
mendation of the Assistant City Attorney be approved. Motion carried.
V. R. Poxon, Assistant City Attorney, reported verbally that
he had contacted the office of Assemblyman Frank G. Bonelli with
reference to Assembly Constitutional Amendment 1 relative to ceiling
and limitation on County taxes and assessments, and that he had been
advised by that office that ACA-1 had been sent back to Committee and
that a resolution in support of said Amendment would not be necessary
as it undoubtedly would not get out of Committee.
Communication from Carl A. Heinze, Consulting Electrical
Engineer, submitting his resignation as an employee of the City of
Vernon, effective as of the close of business April 15, 1958, was
read.
It was moved by Poxon, seconded by Malburg, that the
resignation of Carl A. Heinze as en employee of the City of Vernon
be accepted with regrets. Motion carried.
V. R. Poxon, Assistant City Attorney, reported verbally
that Mr. Moran of The F1intkote Company objected to the 90 day
revocation provision in the recently authorized license agreement to
cover construction of a 12-inch cast iron water line across 52nd
Street. ~x. Poxon explained that this provision is standard in all
similar types of license agreements authorized by the City.
It was moved by Poxon, seconded by Malburg, that the 90
day revocation provision be retained in said license agreement.
Motion carried.

and audited.

It was moved by Mailliard, seconded by Malburg, that

and payment authorized for Demands Nos. 2113 to 2266 (both inclusive),
with no exceptions. Motion carried.
It was moved by Malburg, seconded by Mailliard, that the
meeting adjourn until Wednesday, April 2, 1958, at 3:30 p.m. Motion
carried.
