COUNCIL PRESENT: Anderson, Furlong, J:-lailliard, Malburg, Poxon COUNCIL ABSENT: None The meeting was called to order by Mayor R. J. Furlong. It was moved by Poxon, seconded by Anderson, that the minutes of the meeting of October 7, 1958 be approved as written and submitted. IvIotion carried. It was moved by Anderson, seconded by Poxon, that Ordinance No. 721 receive a third and final reading by title. Motion carried. Ordinance No. 721 - An Ordinance of the City of Vernon regulating the sale of goods, wares, merchandise, newspapers, magazines, periodicals or other printed matter in or on the public streets of the City of Vernon, was read for a third and final reading by title. It was moved by Poxon, seconded by Anderson, that Ordinance No. 721 receive and pass a third reading and be adopted. Motion carried. Ayes: Anderson, Furlong, Mailliard, Malburg, Poxon Noes: None Absent: None Communication from Arthur E. Nelson, Jr., City Engineer, advising that bids received for the reconstruction of a portion of Downey Road from Holabird Avenue to 26th Street, in accordance with Specifications No. 225, have been tabulated, checked and analyzed, and recommending that contract be awarded to C. o. Sparks, Inc. & 'Mundo Engineering Company, a joint venture, on the basis of their low bid of $8,082.53, was read. Resolution No. 2225 - A Resolution of the City Council of the City of Vernon accepting the bid of C. o. Sparks, Inc. & Mundo Engineering Company, a joint venture of California corporations, for the reconstruction of Downey Road from Holabird Avenue to 26th Street in accordance with Specifications No. 225 heretofore approved by the City Council, was read. It was moved by Mailliard, seconded by Poxon, that Resolution No. 2225 be approved and adopted. Motion carried. Nelson, Jr., City Engineer, recommending that Resolution No. 2211 be amended to provide for the payment of $4,307.37 to u.S. Industries, Incorporated for mortar lined and coated steel pipe in accordance with Specifications No. 208 and Addendum No.1, instead of $4,426.17 as provided in said resolution, was read. (Final Progress Estimate by James M. Montgomery, Consulting Engineer, establishes that the amount should be $4,307.37.) It was moved by Anderson, seconded by Poxon, that Resolution No. 2226 be approved and adopted. Motion carried. Ayes: Anderson, Furlong, Mailliard, Malburg, poxon Noes: None Absent: None Petition from Federal Ice & Cold Storage Company for a zone variance, together with check in the amount of $150.00, was read. (Copy to each member of the City Council.) Edward Hervey, Attorney for Petitioner, and J. G. Snow, Vice President & General Manager of Federal Ice and Cold Storage Company, appeared before the City Council to answer questions relative to said petition. It was moved by Anderson, seconded by Poxon, that the petition from Federal Ice & Cold .storage Company be referred to the City Attorney and the Engineering Department for investigation and report at the next meeting; that the City Attorney be instructed to draft a resolution fixing a time and place of hearing at the earliest possible date and prescribing notice to be given; and that notices for posting be printed as soon as hearing date has been fixed. Abraham Chalk of the Chalk Metal Company, 2035 East 46th Street, appeared before the City Council requesting that the City of Vernon alleviate an alleged flood condition caused by storm water in the vicinity of the above address by removing the existing wall from the forty foot strip of land owned by the City of Vernon fronting on 4.6th Street. It was moved by Anderson, seconded by Poxon, that the aforementioned matter be referred to the Engineering Department and the City Attorney to determine if said wall can be removed without causing damage to surrounding properties or without placing the City in a position of liability for damage, and to make a report of their findings to the City Council at the next meeting. Motion carried. Communication from Standard Oil Company of California requesting permission to do geopnysical survey work on lands governed by the City of Vernon, was read. (Copy to each member of the City Council.) Mr. D. S. Clark, Geophysical Field Representative, appeared before the City Council to answer questions relative to the afore- mentioned request. It was moved by Anderson, seconded by Malburg, that the request of Standard Oil Company of California be approved subject to compliance with any requirements of the City Engineer, the Superin- tendent, Water & Sewer Systems, and the Fire Chief; subject to providing the City of Vernon with certificates of public liability and property damage insurance in form and amounts to be established by the City Attorney; and subject to any other regulations that the City Attorney may impose, and in accordance with conditions outlined in applicant's letter dated October 15, 1958. Notion carried. I I 10/21/58 City Clerk Ziemer presented price quotations he had obtained from dealers on various chairs for use around the Council table. Hr. Earl Sheffer of i:.ssociated Desk Company displayed three executive posture chairs in different price ranges. It was moved by Anderson, seconded by Y~lburg, that twelve executive posture chairs be purchased from Associated Desk Company at a price of $110.25 each, and that the offer of Mr. Sheffer of a trade-in allowance of $10.00 each on the twelve existing Council chairs be accepted. Motion carried. Communication from Jack M. Brown Processing requesting a license to conduct a business of rendering meat scraps, bones, poultry offal and feathers, at 3029 E. Vernon Avenue, was read. It was moved by Anderson, seconded by Poxon, that the request of Jack M. Brown Processing be approved and license granted. Motion carried. Communication from C~ID Plant Protection requesting a license to operate a guard and patrol service in the City of Vernon, was read. It was moved by ....l\...nderson, seconded by Poxon, that the request of C~ID Plant Protection be approved and license granted subject to compliance with regulations as outlined in Ordinance No. 656. Motion carried. Communication from Darwin Laboratories, Inc. and Darwin Specialties Corp. requesting a license to conduct a business of wholesaling pharmaceuticals at 4800 District Blvd., was read. It was moved by Poxon, seconded by Malburg, that the request of Darwin Laboratories, Inc. and Darwin Specialties Corp. be referred to the Police Department and the Fire Department with power to act. Motion carried. Communication from Foster Art Service Inc. requesting a license to conduct a business of warehousing and shipping art books at 4.800 District Blvd., was read. It was moved by Anderson, seconded by Mailliard, that the request of Foster Art Service Inc. be referred to the Police Depart- ment and the Fire Department with power to act. Motion carried. Communication from Star Paper Company requesting a license to operate a sales office for selling paper products at 3715 Santa Fe Avenue, was read. It vlas moved by Poxon, seconded by Nalburg, that the request of Star Paper Company be approved and license granted. Notion carried. Communication from ~mjor Mindel & Company requesting a license to conduct a business of warehousing and curing of hides at 4.332 Alcoa Avenue, was read. Bockhacker, Police Chief, recom- mending that I. L. Brummett be advanced from Policeman Grade 3 to Grade 2, effective November 1, 1958, was read. It was moved by Poxon, seconded by Anderson, that the recommendation of the Police Chief be approved. Motion carried. Communication from R. H. Bockhacker, Police Chief, advising that he has no objection to the City Council approving the establish- ment of minimum Police standards as recommended by the League of California Cities, was read. It was moved by Anderson, seconded by Po~{on, that minimum Police standards as recommended by the League or California Cities be adopted by the City or Vernon. Motion carried. Communication from Arthur E. Nelson, Jr., City Engineer, D. D. Grayson, Traffic Engineer, and Robert H. King, Superintendent, Water & Sewer Systems, advising that David L. Schultz, Engineer's Aide, has informed the Engineering Department that he will terminate his employment with the City at the close of the working day on October 31, 1958, was read. It was moved by Anderson, seconded by Poxon, that the resignation of David L. Schultz, Engineer's Aide, as an employee of the City of Vernon, effective at the close of the working day on October 31, 1958, be accepted. Motion carried. Communication from Arthur E. Nelson, Jr., City Engineer, D. D. Grayson, Traffic Engineer, and Robert H. King, Superintendent, vlater & Sewer Systems, advising that the employment of Arthur A. Carnighan, Laborer, will be terminated effective at the close of the working day on October 21, 1958, was read. It was moved by Poxon, seconded by Anderson, that the termination of the employment of Arthur A. Carnighan, Laborer, effective at the close of the working day on October 21, 1958, be approved. Motion carried. Communication from Robert S. Stone, Director or Sanitation, requesting that he be reimbursed the sum of $9.36 rrom the Education and Training Budget appropriation for books purchased in connection with his course in Public Administration at the University or Southern California, was read. It was moved by lUlderson, seconded by Poxon, that the request of Mr. Robert S. Stone be approved, and that authority be granted to issue warrant to Mr. Stone in the amount of $9.36. Motion carried. Communication from D. M. Laird, Jr. Civil Engineer, advising that he is a candidate for the Bachelor of Science Degree in Civil Engineering at the University of Southern California, and requesting that he be allowed the sum of $230.00 from the Education and Training Budget appropriation to enroll in the Spring semester, January 1959 to June 1959, was read. It was moved by Anderson, seconded by Malburg, that the I I 10/21/58 request of D. M. Laird be approved; that authority be granted to issue warrant to fir. Laird in the amount of $230.00 at the beginning of the Spring semester; and that, in the future, all applications for financial assistance from the Education and Training Budget appropriation be submitted to the Deoartment Head concerned for . recommendation to the City Council. tfution carried. Con~unication from Mason, Muntz & Associates, Architects & Engineers, with reference to the 1958 program of the Los Angeles County Flood Control District, offering their services for the preparation of plans and specifications for the portions within the City of Vernon, providing that the electorate approve the storm drain bond issue program, was read. (Copy to each member of the City Council.) It was moved by Poxon, seconded by Anderson, that communi- ca~~on from Mason, ~Iuntz & Associates, Architects & Engineers, be received and filed. Motion carried. Report of the activities of the Police Department for the period October 1 - 15, 1958 inclusive, was presented. It was moved by Anderson, seconded by Malburg, that the report of the activities of the Police Department be received and filed. Motion carried. Report of Health Department activities for the month of September, 1958, was presented. (Copy to each member of the City Council.) It was moved by Paxon, seconded by Malburg, that the report of Health Department activities be received and filed. Motion carried. Communication from L. C. Husted, Fire Chief, requesting permission to advance F. B. Helmer from Hoseman Grade 4. (Probationary) to Hoseman Grade 3, effective November 1, 1958, was read. It was moved by Anderson, seconded by Poxon, that the request of the Fire Chief be approved. Motion carried. COTImlunication, was read, from 1~. H. Communication from Central Basin "&Jater Association extending an invitation to attend the next regular meeting of the Board of Directors to be held at Huntington Park Elks Club on November 6, 1958, was read. Communication from Public Utilities Commission of the State of California giving notice of procedure to be used at hearing in connection with Case No. 6161 - Investigation for the purpose of establishing a list for the year 1959 of railroad grade crossings of city streets or county roads most urgently in need of separation, as contemplated by Section 189 of the Streets and Highways Code, was read. It was moved by Anderson, seconded by Poxon, that communi- cation from Public Utilities Commission of the State of California be received and filed; and that the Traffic Engineer and the City Engineer be authorized to attend the meetings in Los Angeles as spectators. Motion carried. Communication from Vincent R. Poxon, City Attorney, dated October 17, 1958, with reference to the application of the Vernon Chamber of Commerce for financial aid from the City of Vernon in order to retain attorneys to appear before the Board of Equalization to obtain a reduction in the assessed valuation of the real and personal property taxes in the City, advising that a diligent research has not revealed any legal method whereby the City of Vernon could appropriate any money to the Chamber of Commerce for this purpose, was read. It was moved by Anderson, seconded by Poxon, that communi- cation from the City Attorney, dated October 17, 1958, be received and filed; and that a copy of said communication be sent to the Vernon Chamber of Commerce. Motion carried. Communication from Vincent R. Poxon, City Attorney, with reference to the application of the I~erican Can Company for an over- pass across 48th Street, recommending that this application be granted on the same terms and conditions as the one granted to Norris- Thermador Corporation across 54th Street, was read. It was moved by Anderson, seconded by Malburg, that the City Attorney be instructed to draft a license agreement between the City of Vernon and the l~erican Can Company similar to the one between the City of Vernon and Norris-Thermador Corporation. Motion carried. Ordinance No. 722 - An Ordinance of the City of Vernon providing for the purchase and sale of supplies, services and equip- ment, was read in full for a first reading. It was moved by Paxon, seconded by Mailliard, that Ordinance No. 722 receive and pass a first reading. Motion carried.
