19581118 Regular City Council Meeting - Minutes I I MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD NOVEMBER 18, 1958 AT TwO O'CLOCK P.M. IN THE COUNCIL CHAMBERS OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA. COUNCIL PRESENT: Anderson, Furlong, Mailliard, Poxon COUNCIL ABSENT: Malburg The meeting was called to order by Mayor R. J. Furlong. It was moved by Poxon, seconded by Anderson, that the minutes of the meeting of November 5, 1958 be approved as written and submitted. Motion carried. Mr. Louis M. Bloch, former Fireman, appeared before the City Council and requested that he be reinstated to his position as a Fireman. The City Council suggested to Mr. Bloch that he file an application for a job with the Water, Street and Engineering Departments. It was moved by Anderson, seconded by Poxon, that Ordinance No. 723 receive a third and final reading by title. Motion carried. Ordinance No. 723 - An Ordinance of the City of Vernon providing regulations for rodent control and rubbish disposal, and repealing all ordinances or parts of ordinances in conflict herewith, was read for a third and final reading by title. It was moved by Anderson, seconded by Poxon, that Ordinance No. 723 receive and pass a third reading and be adopted. Motion carried. Ayes: Anderson, Furlong, Mailliard, Poxon Noes: None Absent: Malburg Communication from Feather River Project Association, dated November 5, 1958, inviting the membership of all cities in Los Angeles County and their financial support in the drive for needed water development; and advising that the Board of Directors has approved the rate of $5.00 for each $1 million of assessed valuation, with a $25.00 minimum membership, was read. Communication from Nat Handel, dated November 7, 1958, with reference to proposed construction of a bowling alley, etc. at N.E. corner of 46th and Seville, advising that the preliminary plans include off-street parking for slightly over one-hundred cars, and inquiring if this amount of parking, in conjunction with a proposed 20,000 square foot building, meets with the approval of the City of Vernon, was read. Stone,Director of Sanitation, requesting permission for Rachel Richter to attend the "Medical ServiceH Region Workshop Meeting of the California Disaster Office at San Bernardino on November 19, 1958, with an expense allowance of $10.00, was read. It was moved by Anderson, seconded by Poxon, that the request of the Director of Sanitation be approved. Motion carried. Communication from F. A. Ziemer, City Clerk, recommending that Rosanne G. Dee be advanced from Typist-Switchboard Operator, Grade 2 to Grade 1, effective December 1, 1958, was read. It was moved by Mailliard, seconded by Poxon, that the recommendation of the City Clerk be approved. Motion carried. Communication from Simon T. Vasquez requesting a license to peddle Mason shoes in the City of Vernon, was read. It was moved by Mailliard, seconded by Poxon, that the request of Simon T. Vasquez be approved and license granted. Motion carried. Communication from Musick's Lunch requesting a license to operate a lunch truck in the City of Vernon, was read. It was moved by Poxon, seconded by L\nderson, that the request of Musick's Lunch be approved and license granted. Motion carried. Communication from State Employees' Retirement System, dated November 10, 1958, transmitting a contract in quadruplicate between the City of Vernon and the Consulting Actuaries relative to the periodic investigation and valuation to be made as of June 30, 1958; and to make as of June 30, 1958, such valuation of assets and liabilities as may be necessary to determine the contribution which would be required by the City of Vernon if it elected to purchase the Safety Members 'Widows Clause protection, was read. It was moved by Anderson, seconded by Poxon, that Mayor Furlong be authorized to execute for the City of Vernon the contract between the City of Vernon and the Consulting Actuaries relative to certain actuarial investigations and valuations in connection with the State Employees' Retirement System. Motion carried. Communication from Haskins & Sells, Certified Public Accountants, dated November 11, 1958, transmitting six copies of "0 ;, ;. I I ^ , 11/18/58 each of their reports, dated September 17, 1958, on examination of the various funds of the City of Vernon for the year ended June 30, 1958, and on examination of the cash balances as of June 30, 1958 and cash receipts and disbursements for the year then ended, was read. (Copy to each member of the City Council.) It was moved by Anderson, seconded by Poxon, that the reports of Haskins & Sells, dated September 17, 1958, be received and filed. Motion carried. Communication, was read, from D. D. Grayson, Traffic Engineer, and A. E. Nelson, Jr., City Engineer, requesting that the following classification be established for the Engineering Depart- ments; and that authority be granted to employ an Engineering Clerk III, exact grade dependent upon applicant's qualifications and experience: Engineering Clerk III, (Charges to be equally distributed to the Engineering, Traffic Engineering and Street, and Water and Sewer Systems Department) Grade 1 - 2 - 3 - 4 - 5 - $417.00 395.00 375.00 355.00 337.00 It was moved by Anderson, seconded by Poxon, that the request of the Traffic Engineer and the City Engineer be approved, and that authority be granted to employ an Engineering Clerk III, exact grade dependent upon ~pplicant's qualifications and experience. Resolution No. 2231 - A Resolution of the City Council of the City of Vernon amending Salary Resolution No. 2185, Schedule I, Engineering, Traffic Engineering and Street Department, and Water and Sewer Systems, by adding thereto the classification "Engineering Clerk IIIlt, fixing the compensation therefor, and repealing all resolutions in conflict herewith, was read. It was moved by Mailliard, seconded by Poxon, that Resolution No. 2231 be approved and adopted. Motion carried. Nelson, Jr., City Engineer, requesting authority to change the classification of Albert Mervish, Engineering Secretary, Grade 1 to Engineering Clerk, Grade 1, effective November 16, 1958, due to an assignment of additional responsibility within the department, was read. It was moved by Anderson, seconded by Poxon, that the request of the Traffic Engineer and the City Engineer be approved. Motion carried. Communication from D. D. Grayson, Traffic Engineer, and A. E. Nelson, Jr., City Engineer, transmitting a copy of liThe California Freeway System" which was discussed at a State-wide conference which they attended at the Hotel Statler; and requesting that reimbursement be authorized for expenses incurred in the amount of $9.00 each, was read. Motion carried. Communication, was read, from L. C. Husted, Fire Chief, requesting that the following men be advanced in grade, effective December 1, 1958: x. J. T. D. E. "w. H. D. MOtion carried. Communication from L. C. Husted, Fire Chief, with reference to application of A. R. Koomler to conduct a business of dealing in used brick at 2640 East 26th Street, recommending that license be granted provided it is used for the storage and cleaning of used brick and the storage of the necessary equipment incidental to this type of work; and recommending that before the license is granted, the application be referred to the Health Department in view of the fact that Mr. Koomler will provide living quarters for one employee in a trailer that is now parked on the premises with no visible means for sanitary facilities, was read. It was moved by Anderson, seconded by Poxon, that the recommendations of the Fire Chief be approved; and that, before the license is granted, application be referred to the Health Department for investigation and report. Motion carried. Communication from Frank G. Bonelli, Supervisor, First District, County of Los Angeles, with reference to Bond Issue Proposition N, the proposal to construct 184 storm drains throughout the County, urging that in order to secure an early start on construction projects within the City of Vernon, that detailed planning proceed forthwith, was read. (Copy to each member of the City Council.) It was moved by Poxon, seconded by Mailliard, that communi- cation from Frank G. Bonelli, Supervisor, First District, County of Los Angeles, be received and filed. Motion carried. Communication from Ray Schwegler and family acknowledging the expression of sympathy from the City of Vernon upon the death of Howard R. Schwegler, was read. It was moved by Poxon, seconded by Mailliard, that card from Ray Schwegler and family be received and filed. Motion carried. Communication from John H. Saunders, Attorney at Law, dated November 10, 1958, transmitting petition of Mr. & Mrs. Peter M. Lazzari for the annexation to the City of Vernon of their property described as all of Lot 18 of the John R. Taylor's Vernon Avenue Villa Lots, in the County of Los Angeles, State of California, as per map recorded in book 4, page 42 of Maps, in the office of the county recorder of said county, was read. Lazzari be referred to the Engineering Department and the City Attorney for study and report; and that the City Attorney be authorized to obtain a title report on Lot 18 of the John R. Taylor's Vernon Avenue Villa Lots. Motion carried. Communication from Remington Rand, dated November 3, 1958, transmitting a list of records, which are recommended for immediate destruction after approval of the City Attorney and final action by the City Council, was read. (Copy to each member of the City Council.) It was moved by Anderson, seconded by Poxon, that communi- cation from Remington Rand, dated November 3, 1958, be referred to the City Attorney for study and report. Motion carried. Report of the activities of the Police Department for the period November 1 - 15, 1958 inclusive, was presented. It was moved by Anderson, seconded by Poxon, that the report of the activities of the Police Department be received and filed. Motion carried. Communication from Commercial Cooperage Co. requesting a license to conduct a business of reconditioning paint pails at 2736 E. 37th Street, was read. It was moved by Poxon, seconded by Mailliard, that the request of Commercial Cooperage Co. be referred to the Fire Depart- ment and Health Department with power to act. Motion carried. Communication from Lieutenant L. F. Ely requesting that he be considered as a tenant for one of the city-owned houses, was read. It was moved by Anderson, seconded by Poxon, that the request of Lieutenant L. F. Ely be received and filed for future consideration. Motion carried. Communication from Robert S. Stone requesting reimbursement in the amount of $8.27 from the Education and Training Budget appro- priation for additional books necessary for his studies at the University of Southern California, was read. It was moved by Poxon, seconded by Mailliard, that the request of Robert S. Stone be approved and that authority be granted to issue warrant to Mr. Stone in the amount of $8.27. Motion carried. Communication from L. C. Husted, Fire Chief, advising that he has suspended Fireman W. J. Eaton from further duty, without pay, for conduct unbecoming a fireman, effective November 13, 1958, was read. It was moved by Mail1iard, seconded by Poxon, that the action of the Fire Chief be approved. Motion carried. Communication from Ladish Pacific Division, Ladish Co., requesting permission to install underground conduits across Alcoa '~', "') , :'." I I 11/18/58 Avenue, and to construct a drainage basin and line on their private property, same being covered by a building application, was read. (Copy to each member of the City Council.) It was moved by Poxon, seconded by Mai11iard, that the request of Ladish Pacific Division, Ladish Co., be referred to the City Attorney and the Engineering Department for drafting a license agreement providing for the installation of underground conduits across Alcoa Avenue. Motion carried. Communication from The Metropolitan Water District of Southern California, dated November 14, 1958, advising that the City Council, on or before the tenth day of December, 1958, may declare its intention to payout of its municipal funds the whole or a stated percentage of the amount of taxes to be derived from the area of The Metropolitan Water District of Southern California lying within the City of Vernon, as such amount of taxes shall be fixed in August, 1959, by resolution of the Board of Directors of The Metropolitan Water District of Southern California in levying taxes for the fiscal year 1959-60, was read. It was moved by Mai11iard, seconded by Poxon, that communi- cation from The Metropolitan Water District of Southern California, dated November 14, 1958, be received and filed. Motion carried. Communication from Cleo vlliorton Lumber Co. requesting a license to conduct a wholesale lumber broker business at 2627 S. Soto Street, was read. It was moved by Poxon, seconded by Mai11iard, that the request of C1eowborton Lumber Co. be referred to the Fire Department and the Health Department with power to act. Motion carried. Communication from D. D. Grayson, Traffic Engineer, and A. E. Nelson, Jr., City Engineer, advising that Mr. John Albrecht, Pumping Plant Operator, has informed the Engineering Department that he will retire from the service of the City effective at the close of the working day on November 16, 1958, was read. It was moved by Anderson, seconded by Poxon, that communi- cation from the Traffic Engineer and the City Engineer be received and filed. Motion carried. Communication from David D. Grayson, Traffic Engineer, advising that plans and specifications are being prepared for the resurfacing of Soto Street between the L.A. River Bridge and the South City Boundary, was read. It was moved by Poxon, seconded by Mailliard, that communi- cation from the Traffic Engineer be received and filed. ~btion carried. Communication from Hamilton Kiln Company requesting a license to conduct a business of kiln drying lumber at 3183 Bandini Blvd., was read. It was moved by Poxon, seconded by Anderson, that the request of Hamilton Kiln Company be referred to the Fire Department with power to act. Motion carried. It was moved by Anderson, seconded by Poxon, that the request of Detective M. A. deRuyter be received and filed for future consideration. Motion carried. Communication from Carl A. Heinze, Consulting Electrical Engineer, dated November 18, 1958, submitting four bids received for approximately 3,700 pounds of insulated scrap copper wire and approxi- mately 700 pounds of lead covered cable which has been returned to the City by the Southern California Edison Company in the operation of the Vernon City electric distribution system, and recommending that the bid of Zlotkin Metals, the highest bidder, in the amount of $16.61 cwt. for the scrap copper wire and $9.00 cwt. for the scrap lead cable be accepted, was read. It was moved by Poxon, seconded by Y~illiard, that the recommendation of the Consulting Electrical Engineer be approved, and that the bid of Charles Zlotkin for approximately 3,700 pounds of insulated scrap copper wire and approximately 700 pounds of lead covered cable, be accepted. Motion carried. Communication from Benatti's requesting a license to operate a restaurant and delicatessen at 2353 E. 38th Street, was read. It was moved by Poxon, seconded by Anderson, that the request of Benatti's be referred to the Fire Department and the Health Department with power to act. Motion carried. V. R. Poxon, City Attorney, made a verbal progress report on the litigation between the City of Vernon and Southern California Edison Company concerning the lease agreement dated February 23, 1937, covering the City's electrical generating and distributing system. Mr. John B. Moore, Administrative Officer, distributed to the members of the City Council, for study, copies of a communi- cation he had received from the Los Angeles Bureau of Municipal Research, dated November 17, 1958, submitting information and a proposal concerning a survey of taxable property in the City of Vernon. The following excavation applications, all having approval of the Engineering Department, were presented: Application 22044 - Keenan Pipe and Supply Co. to construct driveway apron and curb in S/s 27th St. W/o Santa Fe Avenue. Application 22045 - So. Calif. Gas Co. to drill and repair bar holes to test for gas leaks at four specified locations. It was moved by Anderson, seconded by Poxon, that excavation applications numbered 22044 and 22045 be filed and permits granted. Motion carried. "Warrant Register No. 34" covering claims and demands presented during the period November 1 to 15, which includes Demands Nos. 4399 to 4513 (both inclusive) drawn on the Citizens National Bank, totaling $23,774.20 (accounting period November, 1958), was examined and audited. It was moved by Mailliard, seconded by Poxon, that llWarrant Register No. 34" be approved and payment authorized for Demands Nos. 4399 to 4513 (both inclusive), with no exceptions. Motion carried.
