MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF VERNON
HELD JANUARY 20, 1959 AT illO 0 I CLOCK

COUNCIL PRESENT: Anderson, Furlong, Mailliard, Malburg, poxon
COUNCIL ABSENT: None
The meeting was called to order by Mayor R. J. Furlong.
It was moved by Poxon, seconded by Anderson, that the
minutes of the meeting of January 6, 1959 be approved as written
and submitted. Motion carried.
Communication from Daniel H. Sklar & Co. requesting a
license to conduct a commission brokerage business at 3261 E. 44th
Street, was read.
It was moved by Anderson, seconded by Poxon, that the request
of Daniel H. Sklar & Co. be approved and license granted. Motion
carried.
Communication from Brown Drayage, Inc. requesting a license
to conduct a motor carrier business at 2850 S. Alameda Street, was
read.
It was moved by ~~lburg, seconded by Paxon, that the request
of Brown Drayage, Inc. be approved and license granted. Motion
carried.
Communication from California Avocado Growers Association
requesting a license to conduct a wholesale merchandising business
at 4833 Everett Avenue, was read.
It was moved by Poxon, seconded by Anderson, that the
request of California Avocado Growers Association be approved and
license granted. Motion carried.
Communication from Certified Container Company requesting
a license to conduct a business of manufacturing corrugated cartons
at 5100 S. Boyle Avenue, was read.
It was moved by Poxon, seconded by Malburg, that the request
of Certified Container Company be referred to the Fire Department with
power to act. Motion carried.
Communication from Crippled Children's Society of Los Angeles
County, Inc. requesting permission to place coin containers in the
City of Vernon during the Easter Seal campaign period, February 27
to March 29, 1959, was read.
It was moved by Anderson, seconded by Poxon, that the request
of Crippled Children I s Society of Los Angeles County, 'Inc. be approved.
Motion carried.
Report of Carl A. Heinze, Consulting Electrical Engineer,
on operation of electrical system by Southern California Edison
Company for the month of November, 1958, was read.

It was moved by Malburg, seconded by Mailliard, that the
report of the Consulting Electrical Engineer be received and filed.
Motion carried.
Communication from State Compensation Insurance Fund
transmitting a premium refund check in the amount of $4,318.23 on
Policy No. 25023-55 for the period 5-7-55 to 5-7-56, was read.
It was moved by Anderson, seconded by Poxon, that refund
check in the amount of $4,318.23 from State Compensation Insurance
Fund be accepted and deposited. Motion carried.
Communication from Walter H. Pitcher, an employee of
Southern California Edison Company, requesting permission to rent
Olympic Cottage No.6, formerly occupied by Mr. C. H. Mailliard, was
read.
It was moved by Anderson, seconded by Poxon, that the request
of Walter H. Pitcher be approved. Motion carried.
Communication from Arthur E. Nelson, Jr., City Engineer,
dated January 9, 1959, advising that Nick Tomovich & Son, contractor
for the construction of Vernon-Alcoa Relief Sewer, Specifications No.
220, feels that consideration should be given to provide for an
additional partial payment as the work cannot be completed until the
contractor for County Sanitation District No. 1 completes the Vernon
Extension Relief Trunk Sewer; and recommending that authority be
granted to pay Nick Tomovich & Son an additional partial payment of
ten percent, amounting to $20,824.90, as it is felt that the remaining
five percent, $10,412.45, will insure completion of the contract, was
read.
Resolution No. 2241 - A Resolution of the City Council of
the City of Vernon authorizing the payment of a partial payment to
Nick Tomovich & Son, contractor for the construction of the Vernon-
Alcoa Relief Sewer under Specifications No. 220 of the City of
Vernon, was read.
It was moved by Anderson, seconded by Poxon, that Resolution
No. 2241 be approved and adopted. Motion carried.

Communication from Vincent R. Poxon, City Attorney, dated
January 9, 1959, with reference to retirement of Fireman Lloyd
Graham, advising that it is the opinion of the attorneys for the
State Compensation Insurance Fund that the three months period that
Mr. Graham was on inactive duty at full pay immediately following
his injury should be deducted from the twelve month provision of
labor code Section 4850 when the temporary disability and the final
retirement arose out of the same injury or occurrence, was read.

It was moved by Malburg, seconded by Mailliard, that communi-
cation from the City Attorney, dated January 9, 1959, be received and
filed. Motion carried.
Communication from F. A. Ziemer, City Clerk, advising that

The National Cash Register Company has delivered one accounting
machine and accessories in accordance with Specifications No. 224,
and recommending that same be accepted and that authority be granted
to pay for same in accordance with the terms of the contract, was
read. (Copy to each member of the City Council.)
Resolution No. 2242 - A Resolution of the City Council of
the City of Vernon accepting the furnishing and delivery of one
accounting machine and accessories in accordance with Specifications
No. 224 of the City of Vernon, was read.
It was moved by Mailliard, seconded by Anderson, that
Resolution No. 2242 be approved and adopted. Motion carried.

Communication from F.A. Ziemer, City Clerk, requesting
authority to purchase a new Royal standard typewriter for use by the
Purchasing Department at an approximate cost of $225.00, was read.
It was moved by Poxon, seconded by Anderson, that the
request of the City Clerk be approved. Motion carried.
Communication from F. A. Ziemer, City Clerk, requesting
that three 10,000 lumen street lights be installed on Fruitland Avenue
west of Downey Road in the vicinity of the city-owned houses, was read.

It was moved by Anderson, seconded by Malburg, that the
request of F. A. Ziemer, City Clerk, be approved and that the Southern
California Edison Company be notified to make the installation at the
locations designated by Consulting Electrical Engineer Heinze.
Motion carried.
Communication from Motor Sergeant G. W. Walter submitting
a bid of $5.00 for the old counter that was taken out of the old
police station and is now being stored in the police garage, was read.
It was moved by Poxon, seconded by Malburg, that the bid
submitted by Motor Sergeant G. W. Walter be accepted. Motion carried.
Communication from Palm House Restaurant requesting a
license to operate a food and liquor restaurant and a cocktail lounge
at 2500 S. Soto Street, was read.
It was moved by Poxon, seconded by Malburg, that the request
of Palm House Restaurant be approved and license granted. Motion
carried.
Communication from The Cleveland Twist Drill Company
requesting a renewal of their permit to haul rubbish from their
premises located at 2301 East 38th Street over the public streets
to an authorized dump or incinerator located outside the City of
Vernon, was read.
It was moved by Malburg, seconded by Poxon, that the request
of The Cleveland Twist Drill Company be approved and permit granted.
Motion carried.

Communication from John B. Vivilacqua requesting a license
to operate a lunch truck in the City of Vernon, was read.
It was moved by Poxon, seconded by Anderson, that the
request of John B. Vivilacqua be referred to the Director of Sanitation
with power to act. Motion carried.
Communication from Dee Bee Cartage Co., Inc. requesting a
license to conduct a hauling and general freight business at 5151 S.
Santa Fe Avenue, was read.
It was moved by Poxon, seconded by Malburg, that the
request of Dee Bee Cartage Co., Inc. be approved and license granted.
Motion carried.
Report of the activities of the Police Department for the
period January 1 - 15, 1959, inclusive, was presented.
It was moved by Malburg, seconded by Mailliard, that the
report of the activities of the Police Department be received and
filed. Motion carried.
Communication from Fireman C. P. Silverthorne requesting
that he be reimbursed the sum of $5.55 from the Education and Training
Budget appropriation for tuition and books required in connection with
his studies at East Los Angeles Junior College, was read. (L. C.
Husted, Fire Chief, recommended approval of said request.)
It was moved by Poxon, seconded by Anderson, that the recom-
mendation of the Fire Chief be approved and that authority be granted
to issue warrant to Fireman Silverthorne in the amount of $5.55.
Motion carried.
Communication from R. H. Bockhacker, Police Chief, recom-
mending that C. J. Allen be advanced from Policeman Grade 3 to Grade
2, effective January 16, 1959, was read.
It was moved by Poxon, seconded by Anderson, that the
recommendation of the Police Chief be approved. Motion carried.
Communication from Los Angeles City Board of Education,
dated January 7, 1959, transmitting two copies of permit covering
the use of certain space at Vernon Fire Station, 3375 Fruitland
Avenue, Vernon, California, for the purpose of conducting school
classes for the fiscal year 1958-1959, without rental charge to the
Board, as a branch of Huntington Park Adult School, was read.
It was moved by Anderson, seconded by Mailliard, that the
Los Angeles City Board of Education be granted permission to use
certain space at Vernon Fire Station, 3375 Fruitland Avenue, for the
purpose stated, and that F. A. Ziemer, City Clerk, be authorized to
sign the necessary permit. Motion carried.
Resolution No. 2243 - A Resolution of the City Council of
the City of Vernon authorizing the execution of a License Agreement
with American Can Company, was read.
It was moved by Malburg, seconded by Poxon, that Resolution

No. 2243 be approved and adopted. Motion carried.

Claim for damages, in the amount of $90.71, from Mr. Leo A.
Hahn in connection with accident involving one of City of Vernon's
vehicles and his 1956 Ford sedan, was read.
It was moved by Anderson, seconded by Malburg, that claim
for damages, in the amount of $90.71, presented by Mr. Leo A. Hahn,
be referred to the insurance carrier of the City of Vernon for neces-
sary action, and that Mr. Hahn be so advised. Motion carried.
It was moved by Malburg, seconded by Anderson, that the Fire
Chief be instructed to present preliminary plans or recommendations
for the construction of Fire Station No.3 on the property recently
acquired in the vicinity of 26th Street and Soto Street; that the
Water Department be instructed to present preliminary plans or recom-
mendations for the construction of water pumping and storage facilities
on the 26th and Soto Street property; and that the Engineering
Department be instructed to contact the various department heads to
obtain a preliminary estimate of space needs of various departments,
and to present preliminary plans or recommendations for the construction
of second-story facilities above the new Police Department building.
Motion carried.

of the Engineering Department, were presented:
Application 22128 - So. Calif. Gas Co. to test for gas leaks
in N/ s 26th St. \J/o Soto St.
Application 22129 - So. Calif. Gas Co. to repair gas mains
in Soto St., 46th St., and Vernon Ave. at
specified locations.
Application 22130 - So. Calif. Gas Co. to test for gas leaks
in Alameda St. at specified locations.
Application 22131 - So. Calif. Gas Co. to relay gas service
in N/s 26th St. W/~~L Soto St.
Application 22132 - So. Calif. Water Co. to install water
meter box in Santa Fe Ave. S/o Vernon Ave.
Application 22133 - Abrams Bros. to construct driveway aprons
in S/s 26th St. and E/s Soto St.
Application 22134 - So. Calif. Gas Co. to relay gas service
in E/s Hampton St. N/NPL E. 49th St.
Application 22135 - So. Calif. Gas Co. to repair gas main
in Vernon Ave. E/EPL Hawthorne Ave.
Application 22136 - So. Calif. Gas Co. to repair gas main in
Santa Fe Ave. N/NPL E. Vernon Ave.
Application 22137 - So. Calif. Gas Co. to repair gas main in
Santa Fe Ave. at 37th St.

"1']arrant Register No. 3711 covering claims and demands
presented during the period January 1 to 15, which includes Demands
Nos. 4856 to 4977 (both inclusive) drawn on the Citizens National
Bank, totaling $29,310.22 (accounting period January, 1959), was
examined and audited.
It was moved by Mailliard, seconded by Poxon, that i~~arrant
Register No. 3711 be approved and payment authorized for Demands Nos.
4,856 to 4977 (both inclusive), with no exceptions. Motion carried.
