MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF VERNON
HELD MARCH 3, 1959 AT TWO O'CLOCK
P.M. IN THE COUNCIL CHAMBERS OF THE
CITY HALL LOCATED AT 4305 SANTA FE
AVENUE, VERNON) CALIFORNIA.
COUNCIL PRESENT: Anderson, Furlong, Mailliard, Malburg, poxon
COUNCIL ABSENT: None
The meeting was called to order by Mayor R. J. Furlong.
It was moved by Poxon, seconded by Anderson, that the minutes
of the meeting of February 24, 1959 be approved as written and submitted.
Motion carried.
The City Clerk advised that the resolution adopted by the
City Council of the City of Santa Fe Springs, expressing appreciation
for use of fire equipment, had been framed in accordance with
instructions received from the City Council on February 17, 1959, and
inquired if the City Council had a preference as to where same should
be hung.
It was moved by Anderson, seconded by Poxon, that said
resolution be hung in the Fire Chief's office. Motion carried.
Communication from Merwin D. Hansen, Engineering Department
employee, requesting that he be reimbursed the sum of $9.88 from the
Education and Training Budget appropriation for text books required
in connection with his studies at the University of Southern California,
together with recommendation for approval from Arthur E. Nelson, Jr.,
City Engineer, D. D. Grayson, Traffic Engineer and R. H. King, Super-
intendent, Water & Sewer Systems, was read.
It was moved by Anderson, seconded by Poxon, that the recom-
mendation of the City Engineer, the Traffic Engineer, and the Super-
intendent, Water & Sewer Systems, be approved and that authority be
granted to issue warrant to Merwin D. Hansen in the amount of $9.88.
Motion carried.
It was moved by Anderson, seconded by Mailliard, that
Ordinance No. 724 receive a third and final reading by title. Motion
carried.
Ordinance No. 724 - An Ordinance of the City of Vernon
repealing Ordinance No. 703 of said City, was read for a third and
final reading by title.
It was moved by Poxon, seconded by Mailliard, that Ordinance
No. 724 receive and pass a third reading and be adopted. Motion
carried.

Invitation from the City Council of the City of Lakewood
to attend lIOpen Houseii in celebration of the City's Fifth Birthday
Anniversary on Sunday, March 8, 1959, from 2:00 to 5:00 p.m., was
read.

It was moved by Anderson, seconded by Malburg, that the
Administrative Officer be instructed to send flowers to the City of
Lakewood in honor of the City's Fifth Birthday Anniversary. Motion
carried.
Communication, was read, from R. H. Bockhacker, Police
Chief, transmitting requests from various Police Department personnel
for reimbursement from the Education and Training Budget appropriation
for tuition and books, and recommending that the requests be approved,
as listed below:

It was moved by Anderson, seconded by Mailliard, that the
recommendation of the Police Chief be approved and that authority
be granted to issue warrants to Officers Emrick, Sweeney, Morrison
and Anderson, as requested. Motion carried.
Communication from The Metropolitan Water District of
Southern California, dated February 26, 1959, requesting that the
City of Vernon adopt a resolution expressing opposition to Assembly
Bill No. 286 and to the adoption by the Legislature of any other
statute authorizing or encouraging the use of domestic water supply
reservoirs for recreational purposes, and transmitting a sample
resolution for this purpose, was read. (Copy to each member of the
City Council.)
Resolution No. 2254 - A Resolution of the City Council of
the City of Vernon urging defeat of Assembly Bill 286, was read.
It was moved by Malburg, seconded by Mailliard, that
Resolution No. 2254 be approved and adopted. Motion carried.

Communication from Mr. M. Farbstein submitting an informal
request for an opinion as to the attitude of the City Council with
reference to the granting of a license for conducting a trailer
court business on a portion of the property at 2322 E. Vernon Avenue
and 4439 Santa Fe Avenue, was read.
It was moved by Anderson, seconded by Malburg, that Mr. M.
Farbstein be advised that the City Council feels that this is not a
proper location for a trailer court due to the proximity of industrial
plants; that a copy of City of Vernon Ordinance No. 632 be sent to
him; and that his attention be called to the State Health & Safety
Code relative to trailer parks. Motion carried.
Communication from G. G. Skalsky, Assistant Director of
Civil Defense, dated February 27, 1959, requesting authority to
purchase one Stand-By Generator, for use at Fire Station No.3,
through the State Educational l\gency for Surplus Property at a cost
to the City of Vernon of between $700.00 and $800.00, was read.

It was moved by Anderson, seconded by Poxon, that the
request of the Assistant Director of Civil Defense, dated February
27, 1959, be approved. Motion carried.
Report of the activities of the Police Department for the
period February 16 - 28, 1959 inclusive, was presented.
It was moved by Malburg, seconded by Mai11iard, that the
report of the activities of the Police Department be received and
filed. Motion carried.
Communication from Councilman Hollis M. Peavey, City of
Downey, dated February 26, 1959, advising that they believe Assembly
Bill No. 919 would encourage the Consolidated County Fire Departments
to take over fire department services of cities and areas without
proper local jurisdiction, and transmitting a copy of a resolution
adopted by the City Council of the City of Downey on February 24,
1959, with the hope that the City Council of the City of Vernon will
pass a similar resolution, was read.
Communication from Assemblyman George A. Wilson, dated
February 28, 1959, suggesting that the City Council pass a resolution
indicating the official position of the City of Vernon relative to
Assembly Bill No. 919, was read.
Resolution No. 2253 - A Resolution of the City Council of
the City of Vernon urging the defeat of Assembly Bill 919, was read.
It was moved by Malburg, seconded by Mai11iard, that
Resolution No. 2253 be approved and adopted. Motion carried.

Communication from Richard C. Hart, Attorney at Law, dated
February 26, 1959, with reference to the contract between the City
of Vernon and Utility Construction Company for the construction of
transmission main and rate-of-f10w control piping under Specifications
No. 209, and with reference to balance due Utility Construction
Company under said contract, was read. (Copy to each member of the
City Council.)
Resolution No. 2255 - A Resolution of the City Council of
the City of Vernon accepting the construction of transmission main
and rate-of-f10w control piping in accordance with Specifications No.
209 of said City, was read.
It was moved by Mai11iard, seconded by ~~lburg, that
Resolution No. 2255 be approved and adopted. Motion carried.

Communication from Ka1 Kan Foods, Inc., dated February 27,
1959, requesting that the City of Vernon alleviate the serious
traffic congestion and acute danger to life currently existing on
44th Street between Downey Road and Alcoa Avenue; and stating that
it is their belief that this can be accomplished if the City of
Vernon will take over this street and complete its paving, was read.

It was moved by Anderson, seconded by Malburg, that communi-
cation from Kal Kan Foods, Inc., dated February 27, 1959, be laid over
until the next regular meeting. Motion carried.
Communication from State of California Disaster Office,
dated February 2, 1959, addressed to Mayor R. J. Furlong, relative to
the re-establishment of the Area E Civil Defense and Disaster
Organization, transmitting a Joint Powers Agreement and requesting
that consideration be given to acceptance of the Agreement and that
the California Disaster Office be notified of the action taken; and
suggesting a method for selecting an Area Executive as prescribed in
the Joint Powers Agreement, was read. (Copy to each member of the
City Council.)
It was moved by Malburg, seconded by Mailliard, that the
City Attorney be instructed to draft a resolution authorizing execution
of the Joint Powers Agreement as transmitted. Motion carried.
Communication from Robert S. Stone, Director of Sanitation,
requesting that he be reimbursed the sum of $25.80 from the Education
and Training Budget appropriation for tuition and books required in
connection with his studies at the University of Southern California,
was read.
It was moved by Anderson, seconded by Poxon, that the request
of Mr. Stone be approved and that authority be granted to issue warrant
to him in the amount of $25.80. Motion carried.
Communication from John B. Moore, Administrative Officer,
dated February 27, 1959, with reference to design and location of
Communications Building in relation to study of utilization of space
in City Hall, suggesting, if it is the desire of the Council to have
the overall space requirements of City Hall departments considered
at the same time as the design and location of the Communications
Building, that authorization be granted to consult with Mr. Muntz
concerning cost estimates of the overall plan rather than limiting
architectural services to the Communications Building, was read.

It was moved by Anderson, seconded by poxon, that authori-
zation be granted to consult with Mr. Muntz concerning cost. estimates
of the overall plan rather than limiting architectural services to the
Communications Building. Motion carried.
Communication from John B. Moore, Administrative Officer,
dated March 2, 1959, with reference to annexation of Packers Avenue
County Island, transmitting letter from Howlett, Weiler and Ide,
attorneys representing the committee of property owners in the above
island, dated February 27, 1959, in which they inquire as to the
possibility of having the City of Vernon assume the cost of water and
sewerage facilities in the event of annexation; and it is recommended
by the Administrative Officer that authority be granted to have the
Tax Service Information Department of Title Insurance and Trust
Company prepare a tax report at an approximate cost of $lOO.OO~o
the City of Vernon in order to be able to estimate the amount of tax
revenues which the area would pay to the City of Vernon, was read.

be granted to have the Tax Service Information Department of Title
Insurance and Trust Company prepare a tax report of the property
located in the i'packers Avenue County Island'l at an approximate
cost of $100.00 to the City of Vernon, and that Howlett, Weiler
and Ide, Attorneys at Law, be so advised. Motion carried.
Progress Report No. 1 submitted by the Los Angeles Bureau
of Municipal Research, dated February 25, 1959, on Vernon City Real
Property Inventory and Tax Audit, was presented. (Copy to each
member of the City Council.)
It was moved by Malburg, seconded by Anderson, that Progress
Report No. 1 submitted by the Los Angeles Bureau of Municipal Research,
dated February 25, 1959, on Vernon City Real Property Inventory and
Tax Audit, be received for study. Motion carried.
Communication from Marsh Wall Products Inc. requesting a
license to conduct a distributing, sales and warehousing business at
3050 Leonis Blvd., was read.
It was moved by Malburg, seconded by Mailliard, that the
request of Marsh Wall Products Inc. be approved and license granted.
Motion carried.
Communication from Southern California Edison Company
submitting franchise report on Franchise Ordinances Nos. 503 and 611
for period ending December 31, 1958, together with check in the amount
of $496.24; and submitting franchise report on Franchise Ordinance
No. 504 for period ending December 31, 1958, together with check in
the amount of $1,824.62, was read.
It was moved by Malburg, seconded by Poxon, that communication
from Southern California Edison Company, dated March 2, 1959, together
with Franchise Reports on Franchise Ordinances Nos. 503, 504 and 611,
be referred to Special Counsel Darling, Shattuck & Edmonds, for study
and report. Motion carried.
Report of Carl A. Heinze, Consulting Electrical Engineer,
on operation of electric system by Southern California Edison Company
for the month of December, 1958, was read.
It was moved by Anderson, seconded by Poxon, that the report
of the Consulting Electrical Engineer be received and filed. Motion
carried.
Resolution No. 2252 - A Resolution of the City Council of
the City of Vernon extending for ninety days the time within which
Federal Ice & Cold Storage Company may comply with the variance
granted under Resolution No. 2234 of the City of Vernon, was read.
It was moved by Poxon, seconded by Malburg, that Resolution
No. 2252 be approved and adopted. Motion carried.

It was moved by Anderson, seconded by Poxon, that the City
Attorney be authorized and instructed to institute eminent domain
proceedings to acquire necessary easements for widening the 26th
Street bridge unless he is able to obtain the grants within five days
