19590707 Regular City Council Meeting - Minutes I I MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD JULY 7, 1959 AT TWO O'CLOCK P.M. IN THE COUNCIL CHAMBERS OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA. COUNCIL PRESENT: Anderson, Furlong, Mailliard, Malburg, Poxon COUNCIL ABSENT: None The meeting was called to order by Mayor R. J. Furlong. It was moved by Poxon, seconded by Mailliard, that minutes of the meeting of June 23, 1959 be approved as written and submitted. Motion carried. Communication from The Atlantic Refining Company requesting a license to operate a sales office for the sale of petrochemicals at 4814 Loma Vista Avenue, was read. It was moved by Poxon, seconded by Malburg, that the request of The Atlantic Refining Company be approved and license granted. Motion carried. Communication from George McAtee dba Okeh Caterers requesting licenses to operate two lunch trucks in the City of Vernon, was read. It was moved by Poxon, seconded by Mailliard, that the request of George McAtee dba Okeh Caterers be referred to the Director of Sanitation with power to act. Motion carried. Communication from Jack's Hot Dog Stand requesting a license to operate a lunch stand at 2263 E. Vernon Avenue, was read. It was moved by Poxon, seconded by Mailliard, that the request of Jack's Hot Dog Stand be referred to the Director of Sanitation for investigation and report. Motion carried. Summary of Apportionments of Motor Vehicle License Fees for the Period June 1, 1958 to May 31, 1959 as provided by Sections 11003-5, Revenue and Taxation Code, compiled under the direction of Alan Cranston, State Controller, was presented. It was moved by poxon, seconded by Malburg, that Summary of Apportionments of Motor Vehicle License Fees be received and filed. Motion carried. Communication from Law Offices of O'Melveny & Myers, dated June 26, 1959, with reference to City of Vernon v. Southern California Edison Company, No. 697679, transmitting check from Southern California Edison Company, in the amount of $182,988.09, in payment of rental of leased property for the period May 30, 1958 to May 29, 1959, inclusive, pursuant to the 1937 Lease Agreement and pursuant to the terms of the Stipulation dated June 4, 1959, was read. The City Clerk read a letter that had been prepared, with the approval of the City Attorney, for signature by Mayor R. J. Furlong, addressed to O'Melveny & MYers, acknowledging receipt of letter dated June 26, 1959 and the check from Southern California Edison Company which was enclosed, and accepting the check with the understanding set forth in the last paragraph of letter from O'Melveny & MYers. It was moved by Anderson, seconded by Poxon, that the check tendered by Couthern California Edison Company in the amount of $182,988.09 be accepted with the understanding set forth in the last paragraph of letter dated June 26, 1959 from O'Melveny & Myers, and that the Mayor be authorized to sign letter of acceptance as read, and that same be forwarded to O'Melveny & Myers. Motion carried. Communication from State Employees' Retirement System, dated June 26, 1959, transmitting Consulting Actuaries' summary of the valuation in connection with the status under the Retirement System of the City of Vernon, as required as of June 30, 1958, by the Retirement Law, was read. (Copy to each member of the City Council.) It was moved by Anderson, seconded by Poxon, that the City Attorney be instructed to draft a resolution amending Budget Resolution No. 2280, increasing the amount of the Retirement appropriation from $112,000.00 to $200,000.00 to meet the increased contribution required by the City of Vernon beginning July 1, 1959, as determined by the periodical investigation, valuation, and determination provided by the Retirement Law. Motion carried. Report of the activities of the Police Department for the period June 16 - 30, 1959, was presented. It was moved by Malburg, seconded by Mailliard, that the report of the activities of the Police Department be received and filed. Motion carried. Communication from the County of Los Angeles Board of Supervisors advising that on June 16, 1959 they adopted a policy to make available to all cities in the County plans and specifications of capital projects which have been constructed by the County, was read. It was moved by Poxon, seconded by Malburg, that communication from the County of Los Angeles Board of Supervisors be received and filed. Motion carried. Communication from Police Sergeant R. D. Harrison requesting that he be considered as a tenant for one of the city-owned houses, was read. It was moved by Anderson, seconded by Poxon, that the request of Police Sergeant Harrison be laid over until the next meeting in order that the Department Heads may have an opportunity to make recommendations as to a possible tenant for the vacant city-owned house at 4321 Furlong Place. Motion carried. Communication from B & L Truck and Transfer Co. requesting a license to conduct a trucking business at 2055 E. 27th Street, was read. Communication from Rachel Richter, Health Nurse, extending an invitation to the Council members and City officers to be guests of the nurses at the dinner meeting of the Industrial Nurses of the City of Vernon on MOnday, July 20, 1959 at Fire Station No.2 at 5:30 P.M., was read. It was moved by Poxon, seconded by Malburg, that communication from the Health Nurse be received and filed. Motion carried. Report of Carl A. Heinze, Consulting Electrical Engineer, on operation of electrical system by Southern California Edison Company for month of May, 1959, was read. It was moved by Malburg, seconded by Mailliard, that the report of the Consulting Electrical Engineer be received and filed. Motion carried. Communication from the City of Maywood transmitting a certified copy of Maywood Resolution No. l70l, ilApproving the Hiring of Consultants for Appraisal of Government Servicesll, adopted by the Maywood City Council at their regular adjourned meeting of June 16, 1959, was read. It was moved by Anderson, seconded by Poxon, that certified copy of Maywood Resolution No. 1701 be received and filed. Motion carried. Communication from Union Pacific Railroad Company, dated June 23, 1959, transmitting, for execution on behalf of the City of Vernon, duplicate originals of proposed Extension Rider, Railroad's document CLD 11713-1, extending the term of Agreement dated September I, 1954, covering license for 30-ft. private roadway across railroad's right of way and Vernon Industrial Lead Track #3 in the City of Vernon, for a further period of five years from September 1, 1959, at a term rental of $15.00, was read. It was moved by Anderson, seconded by Poxon, that the Mayor and the City Clerk be authorized to execute Extension Rider, Railroad's document CLD 11713-1, extending the term of Agreement dated September 1, 1954, for a further period of five years from September 1, 1959, at a term rental of $15.00. Motion carried. Communication from D. D. Grayson, Traffic Engineer, requesting authority to send Mr. R. A. Petraitis to the University of California at Berkeley to attend a course in Fundamentals of Traffic Engineering, commencing August 24 and ending August 29, 1959, with an expense allowance of $212.69, was read. It was moved by Poxon, seconded by Mailliard, that the request of the Traffic Engineer be approved. Motion carried. Communication from the League of California Cities advising that its 6lst Annual Conference will be held in San Francisco on October 18 - 21, 1959; and advising that hotel reservations will be handled on a first-come, first-serve basis, and that a deposit of $10.00 is required to hold each hotel reservation, was read. The City Clerk made a verbal request for authority to make hotel reservations for representatives of the City of Vernon who plan to attend the 61stAnnual Conference of the League of California Cities to be held in San Francisco on October 18 - 21, 1959. It was moved by Anderson, seconded by Malburg, that the City Clerk be authorized to make hotel reservations for representatives of the City of Vernon who plan to attend the 61st Annual Conference of the League of California Cities in San Francisco, and that a check covering payment of deposit to hold said reservations be authorized. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated July 7, 1959, advising that the Purchasing Agent, at his request, has received two quotations for a 1959 Custom Ford Sedan, less trade-in allowance of one 1958 Ford automobile, Unit #51, Engine #C8LG142603; and requesting authority to purchase one 1959 Ford automobile from Maywood-Bell Ford Co., the lowest quotation received, at a net cost to the City of $1,170.37 plus sales tax and trade-in of Police Unit #5l, was read. It was moved by Anderson, seconded by Poxon, that authority be granted to purchase one 1959 Ford automobile from Maywood-Bell Ford Co. at a cost of $1,170.37 plus sales tax and trade-in of Police Unit #51. Motion carried. Communication from Fireman Francis E. Hill tendering his resignation from the Fire Department effective June 26, 1959, was read. It was moved by Poxon, seconded by Malburg, that resignation of Fireman Francis E. Hill be accepted. Motion carried. Communication from the City of Santa Fe Springs, dated June 29, 1959, addressed to the Fire Chief, with reference to injury suffered by Vernon Fireman Robert Beaudette while fighting a fire in the City of Santa Fe Springs under the direction of the Fire Chief of Santa Fe Springs, was read. It was moved by Anderson, seconded by Malburg, that Vernon Fire Chief Husted be instructed to notify the State Compensation Insurance Fund that the City of Santa Fe Springs should assume any liability in connection with the injury suffered by Vernon Fireman Robert Beaudette while fighting a fire in Santa Fe Springs. Motion carried. Communication from C. S. Hopcroft, dated July 7, 1959, thanking the members of the City Council for the letter of appreciation and commendation delivered to him under date of June 3, 1959, was read. It was moved by Poxon, seconded by Malburg, that letter from C. S. Hopcroft be received and filed. Motion carried. The City Attorney reported verbally that the County Counsel had requested by letter dated June 29, 1959, a stipulation waiving the statute of limitations on claims for refund of taxes on possessory interests in personal property belonging to defense plants. It was moved by Malburg, seconded by Mailliard, that Resolution No. 2284 be approved and adopted. Motion carried. It was moved by Poxon, seconded by Anderson, that Ordinance No. 726 receive and pass a first reading. Motion carried. Nelson, Jr., City Engineer, advising that he has been selected by the University of California for its Class of 1961 Engineering Executive Program, and requesting permission to participate in this program, was read. (Classes will be held on Mondays from 3:00 to 5:30 P.M. and from 7:00 to 9:30 P.M.) (Copy to each member of the City Council.) It was moved by Anderson, seconded by Malburg, that the request of the City Engineer be approved. Motion carried. Communication from Arthur E. Nelson, Jr., City Engineer, and D. D. Grayson, Traffic Engineer, recommending that the City make application for membership in the American Public Works Association at an annual membership fee of $20.00, and that the City Engineer and the Traffic Engineer be designated as representatives for the City of Vernon, was read. It was moved by Poxon, seconded by Anderson, that the recommendation of the City Engineer and the Traffic Engineer be approved. Motion carried. Police Chief Bockhacker made a verbal report recommending that Kirby Amusement be granted a license to operate a coin operated shuffle alley at Cowboy Cafe, 4401 Downey Road. It was moved by Poxon, seconded by Mailliard, that the recommendation of the Police Chief be approved and license be granted to Kirby Amusement. Motion carried. The following excavation applications, all having approval of the Engineering Department, were presented: Application 22416 - So. Calif. Edison Co. to remove pole, install one pole and sidewalk anchor in Soto Street. Application 22417 - The Pacific Tel & Tel Co. to place underground conduit in Santa Fe Avenue. Application 22418 - So. Calif. Water Co. to repair main in Santa Fe Avenue. Application 22419 - Kleen Towel Service Co. to construct 3 C.I. roof drains through curb, remove driveway and curb, and construct driveway, curb and sidewalk in N/S 28th Street. Application 22420 - Los Angeles Metropolitan Transit Authority to reconstruct northbound street car track in Santa Fe Avenue.
