IN THE COUNCIL CHAMBERS OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA. COUNCIL PRESENT: Anderson, Furlong, Nailliard, Malburg, poxon COUNCIL ABSENT: None The meeting was called to order by Mayor R. J. Furlong. It was moved by Poxon, seconded by Anderson, that minutes of the meeting of March 1, 1960 be approved as written and submitted. Motion carried. Communication from David S. Boshes, dated March 9, 1960, requesting that he be relieved from his bid to construct Fire Station No.3, due to a misunderstanding on two sub-bids he received over the telephone, was read. (Copy to each member of the City Council.) Communication from Mason, Muntz & Associates, dated March 10, 1960, with reference to bid received from David S. Boshes, the low bidder, on the construction of Fire Station No. 3 in accordance with Specifications No. 229, was read. (Copy to each member of the City Council.) Communication from Mason, Muntz & Associates, dated March 11, 1960, recommending that the contract for the construction of Fire Station No.3, in accordance with Specifications No. 229, be awarded to Integrated Constructors and Engineers, Inc., the second low bidder, for the sum of $122,476.00, and that David S. Boshes be relieved of their bid due to a mistake in calculating the amount of same bid, was read. (Copy to each member of the City Council.) Resolution No. 2328 - A Resolution of the City Council of the City of Vernon releasing the bid of David S. Boshes and accepting the bid of Integrated, Inc., for Fire Station No.3, in accordance with Specifications No. 229 of the City of Vernon, was read. It was moved by Poxon, seconded by Malburg, that Resolution No. 2328 be approved and adopted. Motion carried. Ayes: Anderson, Furlong, Mai1liard, Malburg, poxon Noes: None Absent: None Communication from Robert S. Stone, Director of Sanitation, dated February 19, 1960, with reference to request of John C. Whittaker Company to locate a mobile trailer office facility at 4301 Downey Road, recommending that the request be approved with the understanding that said company comply with the conditions as outlined, was read. (Laid over at meeting of 3/1/60.) Communication from L. C. Husted, Fire Chief, recommending that John C. Whittaker Company be granted permission to locate a mobile trailer on the premises at 4301 Downey Road to be used as an office facility, was read. It was moved by Anderson, seconded by Mai1liard, that John C. Whittaker Company be granted permission to locate a mobile trailer I I 3/15/60 Office facility on the premises at 4301 Downey Road provided that said company comply with the conditions as outlined in communication from Robert S. Stone, Director of Sanitation, dated February 19, 1960. Motion carried. C. E. Nemethi, M.D., Health Officer, appeared before the City Council and discussed verbally the radiation protection program of the City, and recommended that such a program be under the admini- strative control of the City Health Department. It was moved by Anderson, seconded by Poxon, that the Health Officer be instructed to formulate a letter to the State Health Department recommending that the Vernon Health Department be designated by the State Health Department as an agent of the State for admini- stration of the radiation protection program. Motion carried. Communication from Mason, Muntz & Associates, dated March 4, 1960, with reference to proposal for providing architectural and engineering services in connection with the proposed apartment facility, advising that, in case of termination of the project during and before completion of the plans and specifications, the renumera- tion for the professional services rendered to such date would be based upon two and one-half (2\) times their production cost, and that, should such professional services be completed in the prepara- tion of the plans and specifications wherein same is ready for adoption and/or ready for advertising for bids, then the renumeration for such professional services would be eighty (80%) per cent of the fee, was read. Communication from the City Engineer, the Superintendent, Water & Sewer Systems, and the Traffic Engineer, dated February 26, 1960, transmitting proposal from Mason, Muntz & Associates, dated February 25, 1960, for providing architectural and engineering services in connection with the proposed apartment facility, together with preliminary floor plan and perspective, and recommending that agreement be entered into in accordance with the proposal and that the preliminary plans be approved, was read. (Laid over at meeting of 3/1/60.) It was moved by Anderson, seconded by Mail1iard, that preliminary plans of the proposed apartment facility be approved, and that agreement be entered into with Mason, Muntz & Associates for providing architectural and engineering services in accordance with proposal dated February 25, 1960 and March 4, 1960. Motion carried. Communication from Mason, Muntz & Associates, dated March 10, 1960, transmitting seven (7) copies of the Survey of Requirements and Alterations to City Hall and Fire Station No. One of City Hall Facilities, 4305 Santa Fe Avenue, was read. (Copy to each member of the City Council.) It was moved by Malburg, seconded by poxon, that Survey of the Requirements and Alterations to City Hall and Fire Station No. One of City Hall Facilities, 4305 Santa Fe Avenue, be received for study. Motion carried. Communication from R. H. Bockhacker, police Chief, dated March 9, 1960, transmitting a sketch of the present police facilities, I I 3/15/60 and requesting that consideration be given to adding both the indicated Red and Green areas to the Police Department, was read. It was moved by Anderson, seconded by Malburg, that communication from the Police Chief, dated March 9, 1960, be received and filed. Motion carried. Communication from the Traffic Engineer, the Superintendent, Water & Sewer Systems, and the City Engineer, dated February 26, 1960, transmitting report covering preliminary studies for the City Public Works Facility as prepared by Engineering-Science, Inc., recommending that the City Council approve in principle the over-all site utili- zation plan as shown on Plate #2 of the report; authorize preparation of plans and specifications for construction of the Public Works Facility as shown on Plate #5 of the report; and authorize the Engineering Departments to proceed with studies on the proposed new reservoir and pumping station, was read. (Laid over at meeting of 3/1/60. ) It was moved by Anderson, seconded by Poxon, that the recommendations of the Traffic Engineer, the Superintendent, Water & Sewer Systems, and the City Engineer, be approved as outlined in communication dated February 26, 1960. Motion carried. Communication from the City of Duarte transmitting copies of Resolutions Numbers 60-18 and 60-19, which are suggested amendments to the County Planning Ordinance and to the State Planning Act, was read. It was moved by Anderson, seconded by Poxon, that communi- cation from the City of Duarte, together with copies of Resolutions Numbers 60-18 and 60-19, be received and filed. Motion carried. Communication from State Compensation Insurance Fund trans- mitting dividend check in the amount of $8,599.48 on the City's workmen's compensation insurance policy, which represents 26.5% of the premium paid for the year ending May 7, 1959, was read. It was moved by Anderson, seconded by Poxon, that communi- cation from State Compensation Insurance Fund be received and filed. Motion carried. Communication from WID. R. Kal1ian Corp., dated March 5, 1960, requesting a license to operate possibly two commercial parking lots in the City of Vernon, was read. (Copy to each member of the City Council.) It was moved by Anderson, seconded by Mai11iard, that the request of WID. R. Kallian Corp. be referred to the Fire Department with power to act. Motion carried. Communication from Cal Carton Manufacturing Co. requesting a license to conduct a business of manufacturing paper cartons at 2424 E. 26th Street, was read. It was moved by Malburg, seconded by Mai1liard, that the request of Cal Carton Manufacturing Co. be referred to the Fire Department with power to act. Motion carried. I I 3/15/60 Communication from Courtesy Caterers requesting a license to operate a lunch truck in the City of Vernon, was read. It was moved by Poxon, seconded by Mailliard, that the request of Courtesy Caterers be approved and license granted. Motion carried. Communication from Steel Unlimited requesting a license to conduct the business of steel jobber, and storage of used clothing rags in bales, at 2304 E. 48th St., was read. It was moved by poxon, seconded by Anderson, that the request of Steel Unlimited be referred to the Fire Department and the Police Department with power to act. Motion carried. Communication from Lou Canale Catering Co. requesting a license to operate a lunch truck in the City of Vernon, was read. It was moved by Poxon, seconded by Anderson, that the request of Lou Canale Catering Co. be referred to the Health Depart- ment with power to act. Motion carried. Communication from R. H. Bockhacker, police Chief, advising that Detective Sergeant Frank E. Sweeney was absent from duty from February 19, 1960 up to and including March 8, 1960, due to a traffic accident, and recommending that he receive full pay for the days absent as injuries were sustained in line of duty, was read. (Copy to each member of the City Council.) It was moved by Anderson, seconded by poxon, that the recommendation of the Police Chief be approved. Motion carried. Communication from R. H~ Bockhacker, police Chief, advising that Lieutenant J. M. Beringhele has been absent from duty since February 26, 1960, and requesting that his salary be continued for the present, was read. (Copy to each member of the City Council.) It was moved by Mai11iard, seconded by Anderson, that the request of the Police Chief be approved. Motion carried. Communication from R. H. Bockhacker, police Chief, recom- mending that T. L. Miller be advanced from policeman Grade 4 to Grade 3, effective March 16, 1960, as he will have satisfactorily passed his six months probationary period, was read. It was moved by Malburg, seconded by Mai11iard, that the recommendation of the Police Chief be approved. Motion carried. Communications from R. H. Bockhacker, police Chief, dated March 9, 1960, requesting that Sgt. J. L. Morrison and Sgt. M. A. deRuyter be authorized to attend the 7th Annual Conference of California State Check Investigators Association at Long Beach, California, from April 27 to 29, 1960, with an expense allowance of $49.80 each, were read. It was moved by Anderson, seconded by Poxon, that the requests of the Police Chief be approved and authority granted to issue warrants in the amount of $49.80 each to J. L. Morrison and M. Spongberg, Chairman of the Los An~el:s County Division Gas Tax Committee, dated March 8, 1960, ~ra~sm~~t~ng a report of said Committee, dated February 17, 1960, ~nd~cat~ng three possible changes in the distribution of the gasoline tax in Los Angeles County, was read. It was moved by Anderson, seconded by Poxon, that communi- cation from Virgil H. Spongberg, Chairman of the Los Angeles County Division Gas Tax Committee, dated March 8, 1960, together with report of said Committee, dated February 17, 1960, be received and filed. Motion carried. Communication from David D. Grayson, Traffic Engineer, dated March 10, 1960, submitting Contract No. 235 for the reconstruction of Vernon Avenue from Soto Street to Downey Road, and recommending that said Contract be approved and that authorization be granted to adver- tise for bids, was read. Resolution No. 2325 - A Resolution of the City Council of the City of Vern~onapproving Contract No. 235 and Plan No. A3-l54.4 for reconstruction of Vernon Avenue from Soto Street to Downey Road, and determining the general prevailing rate of per diem wages, was read. It was moved by Malburg, seconded by Poxon, that Resolution No. 2325 be approved and adopted. Motion carried. Ayes: Anderson, Furlong, Mai11iard, Malburg, poxon Noes: None Absent: None Resolution No. 2326 - A Resolution of the City Council of the City of Vernon directing the giving of notice inviting sealed proposals or bids for the reconstruction of Vernon Avenue from Soto Street to Downey Road, in accordance with Contract No. 235 of the City of Vernon, was read. It was moved by Poxon, seconded by Anderson, that Resolution No. 2326 be approved and adopted. Motion carried. Ayes: Anderson, Furlong, Mai1liard, Malburg, poxon Noes: None Absent: None Agreement, between the City of Vernon and the other ten cities in the southeast mutual aid pact, to render supplemental fire and police protection to the other parties in the event of a fire, disturbance or other local emergency of a magnitude that has developed, or appears to develop, beyond the control of a single party, and therefore, requires the forces of one or all of the other parties, was read. It was moved by Anderson, seconded by poxon, that the Mayor and the City Clerk be authorized to execute the Agreement between the City of Vernon and the other ten cities in the southeast mutual aid pact. Motion carried. Communication from Arthur E. Nelson, Jr., City Engineer, dated March 7, 1960, with reference to bids received for the construction of sanitary sewers in 26th Street, Downey Road, Soto Street and Washington Boulevard, in accordance with Contract No. 232, recommending that the contract be awarded to Montebe1lo Sewer Company, Inc., on the basis of their low bid of $136,379.77, was read. "l'r~".'" ct;:.~O I I 3/15/60 Resolution No. 2327 - A Resolution of the City Council of the City of Vernon accepting the bid of Montebello Sewer Company, Inc., for the construction of sanitary sewers in 26th Street, Downey Road, Soto Street and Washington Boulevard in accordance with Contract No. 232 heretofore approved by the City Council, was read. It was moved by Anderson, seconded by poxon, that Resolution No. 2327 be approved and adopted. Motion carried. Ayes: Anderson, Furlong, Mai1liard, Malburg, poxon Noes: None Absent: None Communication from the Public Utilities Commission, State of California, dated March 7, 1960, with reference to installation of crossing protection at Soto Street (Crossings Nos. 3A-4.63-C and 25-0. 95-C, recommending that the appropriate parties concerned initiate contract negotiations so that the installation can be made as soon as practicable, was read. (Copy to each member of the City Council.) It was moved by Anderson, seconded by Malburg, that communi- cation from the Public Utilities Commission, State of California, dated March 7, 1960, be referred to the Traffic Engineer for study and report. Motion carried. Communication from the Controller of the State of California advising that Section 11005 of the Revenue and Taxation Code, as amended effective September 18, 1959, provides that for the purpose of apportioning Motor Vehicle License Fees to cities the State Controller shall give credit for uninhabited annexations "by multi- plying the number of registered electors therein by three, two years after the completion of annexation proceedings or at such earlier time as the legislative body may request", was read. It was moved by Anderson, seconded by poxon, that the State Controller be requested to give credit for uninhabited annexation known as the HBandini Annexation" for the purpose of apportioning Motor Vehicle License Fees to the City of Vernon, and that September 28, 1959 be specified as the date the population of the annexed territory is to be established. Motion carried. Report of the activities of the police Department for the period March 1 - 14, 1960 inclusive, was presented. It was moved by Malburg, seconded by Mail1iard, that the report of police Department activities be received and filed. Motion carried. Communication from Robert H. King, Superintendent, Water & Sewer Systems, requesting authority to attend the American Water works Association meeting in Monterey, California, on April 22, 1960, with an expense allowance of $92.00, was read. It was moved by Poxon, seconded by Anderson, that the request of the Superintendent, Water & Sewer Systems, be approved and authority granted to issue warrant in the amount of $92.00 to Robert H. King. Motion carried. Communication from Robert H. Communication from City of Lakewood transmitting a certified copy of Resolution No. 1003 requesting the Governor to include on his Special Session Call a revision of the California Narcotics Law, was read. It was moved by Anderson, seconded by Malburg, that communi- cation from the City of Lakewood, together with certified copy of Resolution No. 1003, be received and filed. Motion carried. Communication from L. C. Husted, Fire Chief, transmitting a copy of a letter received from the Pacific Rating Bureau regarding the new official fire insurance rates for the City of Vernon, was read. (Copy of letter from Pacific Rating Bureau to each member of the City Council.) It was moved by Anderson, seconded by Malburg, that communi- cation from the Fire Chief, together with copy of letter received from Pacific Rating Bureau, be received and filed. Motion carried. Communication from L. C. Husted, Fire Chief, dated March 14, 1960, submitting specifications for the purchase of one new 1750 ga1lon-per-minute pumping engine for the Fire Department, for approval, was read. It was moved by Anderson, seconded by Poxon, that specifi- cations for the purchase of one new 1750 gal10n-per-minute pumping engine for the Fire Department be approved; and that said specifi- cations be referred to the City Attorney for preparation of the neces- sary documents. Motion carried. Communications from F. A. Ziemer, City Clerk,and L. R. Burch, City Treasurer, requesting authority to attend the Seminar on Finance Administration and the City Clerk's Institute in Berkeley, California, on May 4 and 5, 1960, with an expense allowance of $116.40 each, were read. It was moved by Anderson, seconded by poxon, that the requests of the City Clerk and City Treasurer be approved and authority granted to issue warrants in the amount of $116.40 each to F. A. Ziemer and L. R. Burch. Motion carried. Invitation to the Grand Opening of La Villa Basque French Restaurant on Monday, March 21, 1960, from Eleven a.m. to Nine p.m., was read.
