MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF VERNON
HELD APRIL 5, 1960 AT TWO O'CLOCK
P.M. IN THE COUNCIL CHAMBERS OF THE
CITY HALL LOCATED AT 4305 SANTA FE
AVENUE, VERNON, CALIFORNIA.
COUNCIL PRESENT: Anderson, Furlong, Mailliard, Malburg, poxon
COUNCIL ABSENT: None
The meeting was called to order by Mayor R. J. Furlong.
It was moved by Poxon, seconded by Anderson, that minutes
of the meeting of March 15, 1960 be approved as written and submitted.
Motion carried.
The Clerk announced that this was the time and place for
opening of bids received for the reconstruction of Vernon Avenue
from Soto Street to Downey Road, in accordance with Contract No.
235.
It was moved by Malburg, seconded by ~~illiard, that the
Clerk be instructed to open and read the bids submitted. Motion
carried.

It was moved by Poxon, seconded by Anderson, that bids
received for the reconstruction of Vernon Avenue from Soto Street to
Downey Road, in accordance with Contract No. 235, be referred to the
City Attorney and the Engineering Department for checking and report.
Motion carried.
Communication from the Special Power Committee of the
Vernon Chamber of Commerce, dated March 22, 1960, signed by L. J.
Soracco, Chairman, and Frank H. Wheelock, Co-Chairman, on the subject
of the City of Vernon versus Southern California Edison Company, was
read. (Copy to each member of the City Council.)
Mr. L. J. Soracco and Mr. Frank H. Wheelock appeared before
the City Council and discussed this matter.
It was moved by Anderson, seconded by Malburg, that the
Administrative Officer, the Mayor, the Consulting Electrical Engineer,
and the Special Power Committee of the Vernon Chamber of Commerce,
meet with Darling, Shattuck & Edmonds, Special Counsel, for the
purpose of discussing the legal problems involved in settling the
differences between the City of Vernon and Southern California
Edison Company; and that the results of this meeting be reported to
the City Council. Motion carried.
Communication from the Kiwanis Club of Vernon, dated April

1, 1960, making application for a City license to advertise, parade
and exhibit the Al G. Kelly and Miller Bros. Circus in the City on
April 30, 1960, requesting that the City Council waive the $100.00
permit fee in view of the fact that this would be a charity fund-
raising drive, was read. (Copy to each member of the City Council.)
President Kenneth Tremayne and Secretary Clyde R. Hoagland
of the Kiwanis Club of Vernon appeared before the City Council and
discussed this matter.
It was moved by Anderson, seconded by Poxon, that the
Kiwanis Club of Vernon be granted a license to advertise, parade
and exhibit the Al G. Kelly and Miller Bros. Circus in the City on
April 30, 1960, subject to compliance with regulations of all City
departments and all ordinances of the City; and that the license
fee in this particular instance be waived. Motion carried.

Communication from Magic Chef requesting a license to
conduct a business of wholesaling Magic Chef ranges at 4814 Loma
Vista Avenue, was read.

request of Magic Chef be approved and license granted. Motion carried.
Communication from Robert O.Wallace, dba Bob's Catering,
requesting a license to operate a lunch truck in the City of Vernon,
was read.
It was moved by Malburg, seconded by Poxon, that the request
of Robert o. Wallace, dba Bob's Catering, be approved and license
granted. Motion carried.
Communication from Lillian Kreimeier, dba Will & Li11
Catering, requesting a license to operate a lunch truck in the City
of Vernon, was read.
It was moved by Poxon, seconded by Anderson, that the
request of Lillian Kreimeier, dba Will & Li11 Catering, be referred
to the Health Department with power to act. Motion carried.
Communication from Gaxiola Garage requesting a license to
conduct a business of repairing cars and trucks at 2328 E. Vernon
Avenue, was read.
It was moved by Poxon, seconded by Anderson, that the
request of Gaxiola Garage be approved and license granted. Motion
carried.
Communication from Frederick P. Hampshire requesting a
Veteran's Exempt License to sell book needles in the City of Vernon,
was read.
It was moved by Anderson, seconded by Poxon, that the
request of Frederick P. Hampshire be approved and Veteran's Exempt
License granted. Motion carried.

Communication from Bents requesting a license to operate
a hot dog stand at 2263 E. Vernon Avenue, was read.
It was moved by Poxon, seconded by Anderson, that the
request of Ben's be referred to the Health Department with power to
act. Motion carried.
Communication from Robert A. North, dba Kopper Kart
Catering, requesting a license to operate a lunch truck in the City
of Vernon, was read.
It was moved by Poxon, seconded by Anderson, that the
request of Robert A. North, dba Kopper Kart Catering, be approved
and license granted. Motion carried.
Communication from Dalton's Truck Wash requesting a license
to conduct a mobile truck washing business in the City of Vernon, was
read. (Copy to each member of the City Council.)
It was moved by Poxon, seconded by Malburg, that the
request of Dalton's Truck Wash be referred to the Fire Department
and the Health Department with power to act. Motion carried.
Communication from Daubert Chemical Company requesting a
license to manufacture automotive undercoating, sound deadners,
sealing compounds and rubber based adhesives, at 4151 Bandini Blvd.,
was read.
It was moved by Poxon, seconded by Malburg, that the
request of Daubert Chemical Company be referred to the Health Depart-
ment with power to act. Motion carried.
Communication from The Cleveland Twist Drill Company
requesting a permit to haul rubbish from the premises at 2301 East
38th Street over the public streets to an authorized dump or incin-
erator located outside the City of Vernon, was read.
It was moved by Malburg, seconded by Mailliard, that the
request of The Cleveland Twist Drill Company be approved and permit
granted. Motion carried.
Communication from pennsalt Chemicals Corporation, dated
March 18, 1960, advising that they moved out of the City of Vernon
on August 1, 1959, and requesting a refund in the amount of $50.00
covering the 1960 City of Vernon License Fee, which they paid under
date of February 5, 1960, was read.
It was moved by Anderson, seconded by Malburg, that the
request of Pennsalt Chemicals Corporation be approved and authority
granted to issue warrant in the amount of $50.00 to said corporation~
Motion carried.
Franchise Report of the American District Telegraph
Company on Ordinance No. 166 for year ending February 29, 1960,
together with check in the amount of $4,,495.41, was presented.
It was moved by Anderson, seconded by Poxon, that Franchise
Report of the American District Telegraph Company on Ordinance No.
166 be received and filed. Motion carried.

It was moved by Anderson, seconded by Poxon, that Franchise
Report of the Richfield Oil Corporation on Ordinance No. 432 be
received and filed. Motion carried.
Franchise Report of the Southern California Gas Company
on Ordinance No. 607 for year ending December 31, 1959, together with
check in the amount of $57,775.87, was presented.
It was moved by Poxon, seconded by Malburg, that Franchise
Report of the Southern California Gas Company on Ordinance No. 607
be received and filed. Motion carried.
Communication from Carl A. Heinze, Consulting Electrical
Engineer,'dated March 18,1960, with reference to payments tendered
by Southern California Edison Company in connection with Franchise
Ordinances Nos. 503, 504. and 611, was presented. (Copy to each member
of the City Council.)
It was moved by Anderson, seconded by Poxon, that communica-
tion from the Consulting Electrical Engineer, dated March 18, 1960,
be received and filed. Motion carried.
Communication from the Los Angeles County Board of Super-
visors, dated March 14, 1960, advising that Notice of Intention to
circulate a petition in a certain unincorporated territory of Los
Angeles County for incorporation of a new city to be known as the
City of Walnut Park, has been filed with the Board of Supervisors by
the proponents at 2:05 p.m. on March I, 1960, was read.
It was moved by Anderson, seconded by Poxon, that communi-
cation from the Los Angeles County Board of Supervisors, dated March
14., 1960, be received and filed. Motion carried.
Communication from the Los Angeles County Boundary Commis-
sion, dated March 17, 1960, giving notification that a proposal has
been filed with the Secretary of the County Boundary Commission for
the annexation of territory known as Conier Annexation to the City
of Montebello, was read.
It was moved by Anderson, seconded by Malburg, that communi-
cation from the Los Angeles County Boundary Commission, dated March
17, 1960, be received and filed. Motion carried.
Communication from American National Rent-A-Car System,
dated March 15, 1960, transmitting a "Claim for Damage" in the amount
of $648.90, was read.
It was moved by Anderson, seconded by Malburg, that the
claim of American National Rent-A-Car System, dated March 15, 1960,
be denied, and that said claim be referred to the City's insurance
carrier. Motion carried.
Communication from R. H. Bockhacker, police Chief, dated
March 21, 1960, recommending that Officers J. R. Tucker and G. \<J.
Wilcox be suspended one day each, without pay, for violation of
Section 400.13 of the Police Department's Manual of Policy and
Ethics, was read.

It was moved by Poxon, seconded by Malburg, that the
recommendation of the Police Chief be approved. Motion carried.
Communication from C. B. Davis tendering his resignation
as an employee of the Vernon Police Department to be effective as
of the end of his tour of duty on Friday, March 25, 1960, together
with recommendation for approval by the Police Chief, was read.
It was moved by Anderson, seconded by Poxon, that the
resignation of C. B. Davis as an employee of the Vernon Police
Department be accepted. Motion carried.
Communication from R. H. Bockhacker, Police Chief, recom-
mending that C. A. Foster be advanced from Policeman Grade 2 to Grade
1, effective March 16, 1960, was read.
It was moved by Poxon, seconded by ~fulburg, that the recom-
mendation of the Police Chief be approved. Motion carried.
Communication from R. H. Bockhacker, Police Chief, requesting
authority to employ Edward Vega as Policeman, Grade 4" effective April
1, 1960, was read.
It was moved by Anderson, seconded by Poxon, that the
request of the Police Chief be approved. Motion carried.
Communication from Los Angeles County Epilepsy Society
requesting cooperation in their 1960 Fund Campaign which is to be
held in July, was read.
It was moved by Anderson, seconded by Poxon, that the
request of the Los Angeles County Epilepsy Society be approved.
Motion carried.
Communication from C. E. Nemethi, M.D., Health Officer,
requesting authority for Vincent P. Kelley to attend the Western
Regional Conference, Institute of Sanitation Management, at Oakland,
California, on March 31, 1960 to April 2, 1960, with an expense
allowance of $146.00, was read.
It was moved by Anderson, seconded by Poxon, that the
request of the Health Officer be approved and authority granted to
issue warrant in the amount of $146.00 to Vincent P. Kelley. Motion
carried.
Communication from C. E. Nemethi, M.D., Health Officer,
requesting that he be authorized to attend a Public Hearing on New
Radiation Registration Rules & Regulations at Berkeley, on April
22, 1960, with an expense allowance of $70.20, was read.
It was moved by Malburg, seconded by Mailliard, that the
request of the Health Officer be approved and authority granted to
issue warrant in the amount of $70.20 to C. E. Nemethi, M.D. Motion
carried.
Communication from C. E. Nemethi, M.D., Health Officer,
requesting that Robert S. Stone be authorized to attend a meeting of
Statewide Directors of Sanitation (sponsored by State Health Depart-
ment) at Pacific Grove, California, on May 31, 1960 to June 2, 1960,
with an expense allowance of $94.50, was read.

It was moved by Anderson, seconded by Mailliard, that the
request of the Health Officer be approved and authority granted to
issue warrant in the amount of $94.50 to Robert S. Stone. Motion
carried.
Communication from the Controller of the State of California,
Division of County Budgets and Reports, dated March 15, 1960,
requesting that the City Council, by formal action, designate the
title (not the name) of the official now responsible for the Annual
Street Report to the State Controller, was read.
Resolution No. 2329 - A Resolution of the City Council of
the City of Vernon appointing the City Clerk as the officer of the
City to make and file the annual reports with the Office of the State
Controller as required by Section 2151 of the Streets and Highways
Code of the State of California, was read.
It was moved by Anderson, seconded by Malburg, that
Resolution No. 2329 be approved and adopted. Motion carried.

Communication from Mason, Muntz & Associates, dated March
21, 1960, transmitting final statement in the amount of $614.20 for
Architectural and Engineering services rendered from March 1, 1960
to date on Survey of Requirements and Alterations to City Hall and
Fire Station No.1, was read. (Copy to each member of the City
Council.)
It was moved by Anderson, se~onded by Poxon, that final
statement rendered by Mason, Muntz & Associates on Survey of Require-
ments and Alterations to City Hall and Fire Station No.1, be approved,
and authority granted to issue warrant in the amount of $614.20 to
Mason, Muntz & Associates. Motion carried.
Communication from Mason, Muntz & Associates, dated March
17, 1960, transmitting original and two copies of the Standard Form
of Agreement between Owner and Architect, for providing architectural
and engineering services in connection with the proposed apartment
facility, was read.
It was moved by Poxon, seconded by Anderson, that Mayor
Furlong be authorized to execute for the City of Vernon the Standard
Form of Agreement between owner and architect, for providing archi-
tectural and engineering services in connection with the proposed
apartment facility, provided that said agreement is approved by the
City Attorney as being in accordance with proposals of Mason, Muntz
& Associates, dated February 25 and March 4, 1960. Motion carried.
Communication from the Finance Committee, dated March 23,
1960, recommending that the City Council adopt a resolution giving
notice of its intention to approve an amendment to the contract
between the State Employees' Retirement System and the City of
Vernon, effective July 1, 1960, to include the 1957 survivor program
(Section 21365.5), and to include the 1959 survivor program (Section
21380-6); and that the City of Vernon enter into a contract with the
firm of Coates, Herfurth and England, Consulting Actuaries, to
determine the approximate contribution which would be required of
the City of Vernon in the event that the contract between the State

Employees' Retirement System and the City of Vernon was amended to
include the 1957 survivor program (Section 21365.5), was read. (Copy
to each member of the City Council.)
It was moved by Anderson, seconded by Poxon, that the
recommendations of the Finance Committee, dated March 23, 1960, be
approved; that the City Attorney be instructed to draft a resolution
of intention to approve an amendment to the contract between the
State Employees' Retirement System and the City of Vernon, effective
July 1, 1960, to include the 1957 survivor program (Section 21365.5)
and to include the 1959 survivor program (Section 21380-6); and that
Mayor Furlong be authorized to execute for the City of Vernon the
contract between the City of Vernon and the firm of Coates, Herfurth
and England, Consulting Actuaries, to determine the approximate
contribution which would be required of the City of Vernon in the
event that the contract between the State Employees' Retirement
System and the City of Vernon was amended to include Section 21365.5.

Demand on the City of Vernon filed by City of Los Angeles,
Department of Public Works, Bureau of Accounting, for total sewage
disposal charges due for the period February 1, 1946 to June 30,
1959, inclusive, in the amount of $854,,937.40, was presented.
It was moved by Anderson, seconded by Malburg, that demand
on the City of Vernon filed by City of Los Angeles, Department of
Public Works, Bureau of Accounting, be referred to Special Counsel
Shenk; and that the City Attorney be instructed to contact Special
Counsel Shenk with reference to the possibility of accelerating the
steps necessary for completion of the internal sewer system in the
City of Vernon and completion of the withdrawal from the Los Angeles
City Sewer System. Motion carried.
Communication from L. C. Husted, Fire Chief, dated March
21, 1960, addressed to the City Clerk, advising that Harold G.
Woodworth has applied for Service Retirement with the State Employees'
Retirement System, effective May 1, 1960, was read.
It was moved by Malburg, seconded by Mailliard, that letter
of appreciation be written to Mr. Harold G. woodworth and that a copy
of said letter be spread upon the official minutes of the City Council.

mendation ef the Pelice Chief be approved and that license be denied

various lecations in the City. Motion carried.
Communication frem Rachel Richter, Health Nurse, requesting
that she be considered as a tenant fer the first house available on
Furlong Place, was read. (Copy to each member of the City Council.)
It was moved by Andersen, seconded by Poxon, that communi-
cation from the Health Nurse be received and filed for future
consideration. Motien carried.
Communicatien from Madsen Range Cempany, Inc., dated March
30, 1960, requesting that penalty not be levied against them for not
paying license fee en prescribed deadline date, was read.

It was moved by Poxon, seconded by Mai11iard, that in
accordance with Section 23 of Ordinance No. 710,the City Clerk be
authorized to compromise claim for penalty levied against Madsen
Range Company. Motion carried.
Communication from John B. Moore, Administrative Officer,
dated March 31, 1960, with reference to supervision and inspection on
construction of Fire Station No.3, was read. (Copy to each member of
the City Council.)
It was moved by Anderson, seconded by Poxon, that the super-
v~s~on and inspection services on construction of Fire Station No. 3
be approved as outlined in letter from the Administrative Officer,
dated March 31, 1960, and that Mason, Muntz & Associates be so advised.

Communication from John B. Moore, Administrative Officer,
dated March 31, 1960, with reference to the general nature of the
specifications to be followed in the construction of the eight-unit
apartment house, was read: (Copy to each member of the City Council.)
It was moved by Anderson, seconded by Poxon, that the
general nature of the specifications to be followed in the construction
of the eight-unit apartment house be approved as outlined in letter
from the Administrative Officer, dated March 31, 1960, and that Mason,
Muntz & Associates be so advised. Motion carried.
Communication from Howard Manufacturing Co. of California,
dated March 30, 1960, requesting that they not be assessed a penalty
for late payment of 1960 license fee, was read. (Copy to each member
of the City Council.)
It was moved by Poxon, seconded by Mailliard, that in
accordance with Section 23 of Ordinance No. 710, the City Clerk be
authorized to compromise claim for penalty levied against Howard
Manufacturing Co. of California. Motion carried.
Report of activities of the Police Department for the period
March 15 - 31, 1960 inclusive, was presented.
It was moved by Anderson, seconded by Poxon, that the report
of activities of the Police Department be received and filed. Motion
carried.
Communication from David D. Grayson, Traffic Engineer,
dated April 1, 1960, transmitting Contract No. 236 for the resurfacing
of Slauson Avenue from Boyle Avenue to Downey Road, and recommending
that said contract be approved and that authorization be granted to
advertise for bids, was read.
Resolution No. 2330 - A Resolution of the City Council of
the City of Vernon approving Contract No. 236 for resurfacing of
Slauson Avenue from Boyle Avenue to Downey Road, and determining the
general prevailing rate of per diem wages, was read.
It was moved by Anderson, seconded by poxon, that Resolution
No. 2330 be approved and adopted. Motion carried.

Resolution No. 2331 - A Resolution of the City Council of
the City of Vernon directing the giving of notice inviting sealed
proposals or bids for the resurfacing of Slauson Avenue from Boyle
Avenue to Downey Road, in accordance with Contract No. 236 of the
City of Vernon, was read.
It was moved by Anderson, seconded by Poxon, that Resolution
No. 2331 be approved and adopted. Motion carried.

Communication from Vernon Truck Wash requesting a license
to conduct a truck washing business at 3420 Bandini Blvd., was read.
It was moved by Anderson, seconded by Mailliard, that the

the Superintendent, Water & Sewer Systemsifor investigation and report.

Communication from Helm's Bakeries requesting a license to
operate a bakery truck in the City of Vernon, was read.
It was moved by Anderson, seconded by Poxon, that the
request of Helm's Bakeries be referred to the Health Department with
power to act. Motion carried.
Communication from David D. Grayson, Traffic Engineer, dated
April 4" 1960, transmitting study proj ecting street, bridge and rail-
way grade separation deficiencies to 1980, and recommending that this
study be approved and authority be granted to so advise the State of
California, was read.
It was moved by Poxon, seconded by Mailliard, that the study

The City Clerk advised the City Council that this was the
meeting at which to appoint a canvassing board for the canvass of
absent voter ballots of the General Municipal Election to be held on

the time and place of the canvass.

following be appointed and designated as a canvassing board to canvass
the absent voter ballots of the General Municipal Election to be held

Communication from Robert H. King, Superintendent, Hater
& Sewer Systems, and David D. Grayson, Traffic Engineer, dated April
5, 1960, requesting authority for Messrs. Lopez, Mantle, Ashby,
Corrella and Radcliffe .to attend various sessions of the Western
Safety Congress and Exhibits April 11-13, at the Ambassador Hotel,
with an expense allowance of $2.50 each, was read.
It was moved by Anderson, seconded by Poxon, that the
request of the Superintendent, VJater & Sewer Systems, and the Traffic
Engineer be approved and authority granted to issue warrants to
Messrs. Lopez, Mantle, Ashby, Corrella and Radcliffe in the amount
of ~2.50 each. Motion carried.
Resolution No. 2332 - A Resolution of the City Council of
the City of Vernon approving Specifications No. 240 for the furnishing
of one 1750 gallon per minute Triple Combination Pumper, was read.
It was moved by Poxon, seconded by Anderson, that Resolution
No. 2332 be approved and adopted. Motion carried.

It was moved by Anderson, seconded by Mai11iard, that
building permit be granted in connection with application number
22900, subject to approval by the Engineering Department of frontage
improvements of the property involved. Motion carried.
lIWarrant Register No. 6611 covering claims and demands
presented during the period March 16 to 31, which includes Demands
Nos. 1856 to 2016 (both inclusive), drawn on the California Bank
totaling $38,982.55 (accounting period April, 1960), was examined
and audited.
It was moved by Anderson, seconded by Poxon, that llW-arrant
Register No. 66" be approved and payment authorized for Demands Nos.
1856 to 2016 (both inclusive), with no exceptions. Motion carried.
