19600802 Regular City Council Meeting - Minutes I I MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD AUGUST 2, 1960 AT TWO O'CLOCK P.M. IN THE COUNCIL CHAMBERS OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE. VERNON, CALIFORNIA. COUNCIL PRESENT: Anderson, Furlong, Mailliard, Poxon COUNCIL ABSENT: Malburg The meeting was called to order by Mayor R. J. Furlong. It was moved by Poxon, seconded by Anderson, that minutes of the meeting of July 19, 1960 be approved as written and submitted. Motion carried. The Clerk announced that this was the time and place for opening of bids received for the reconstruction of 55th Street from Santa Fe Avenue to the east City Boundary, in accordance with Contract No. 237. It was moved by Poxon, seconded by Anderson, that the Clerk be instructed to open and read the bids submitted. Motion carried. The Clerk opened and read the following bids: George Savala Paving Co. Benedict Company Vernon Paving Company Griffith Company $ 19,989.24 15,697.76 16,930.74 16,329.80 20,482.80 It was moved by Anderson, seconded by Poxon, that bids received for the reconstruction of 55th Street from Santa Fe Avenue to the east City Boundary, in accordance with Contract No. 237, be referred to the City Attorney and the Engineering Department for checking and report. Motion carried. The Clerk announced that this was the time and place for opening of bids received for the installation of traffic signals at the intersection of Santa Fe Avenue and 55th Street, in accordance with Contract No. 245. It was moved by Anderson, seconded by Poxon, that the Clerk be instructed to open and read the bids submitted. Motion carried. I I -2- 8/2/60 Communication from Mason, Muntz & Associates, dated July 26, 1960, with reference to bids received for the construction of Municipal Apartment Housing, in accordance with Specifications No. 239, recommending that the contract be awarded to Hand U Construction Company on the basis of their low bid of $77,464.33, was read. (Copy to each member of the City Council) Communication from J. S. Colton, Building Engineer, dated July 28, 1960, with reference to bids received for the construction of Municipal Apartment Housing, in accordance with Specifications No. 239, recommending that the contract be awarded to Hand U Construction Company, was read. (Copy to each member of the City Council) It was moved by Anderson, seconded by Poxon, that the City Attorney be instructed to draft a resolution rejecting all bids received for the construction of Municipal Apartment Housing, in accordance with Specifications No. 239; and authorizing the City Clerk to re-advertise for sealed proposals or bids for the construction of Municipal Apartment Housing, in accordance with Specifications No. 239. Motion carried. Communication from D. D. Grayson, Traffic Engineer, dated July 25, 1960, submitting Contract No. 243 for the installation of traffic signals at Downey Road and Fruitland Avenue, and recommending that said contract be approved and that authorization be granted to advertise for bids, was read. Resolution No. 2360 - A Resolution of the City Council of the City of Vernon approving Contract No. 243 and Plan No. TV 6002 for installation of traffic signals at the intersection of Downey Road and Fruitland Avenue, and determining the general prevailing rate of per diem wages, was read. It was moved by Mail1iard, seconded by Poxon, that Resolution No. 2360 be approved and adopted. I Motion carried. It was moved by Anderson, seconded by Mai11iard, that Resolution No. 2361 be approved and adopted. Motion carried. It was moved by Poxon, seconded by Anderson, that Resolution No. 2363 be approved and adopted. Motion carried. Retirement System and the City Council of the City of Vernon be amended by adding Section 21365.5 and Sections 21380-6, effective October 1, 1960, was read. (Copy to each member of the City Council) Ordinance No. 730 - An Ordinance of the City Council of the City of Vernon authorizing an amendment to th~ contract between the City of Vernon and the Board of Administration of the California State Employees. Retirement System, was read in full for a first reading. It was moved by Anderson, seconded by Poxon, that Ordinance No. 730 receive and pass a first reading. Motion carried. Ordinance No. 730 - An Ordinance of the City Council of the City of Vernon authorizing an amendment to the contract between the City of Vernon and the Board of Administration of the California State Employees' Retirement System, was read for a second reading by title. It was moved by Anderson, seconded by Poxon, that Ordinance No. 730 receive and pass a second reading. Motion carried. Communication from Production Engineering & Supply requesting a license to conduct the business of design engineering and industrial sales at 3001 E. 44th Street, was read. It was moved by Anderson, seconded by Poxon, that request of Production Engineering & Supply be approved and license granted. Motion carried. Communication from Aqua Sonic Pool Cleaner Co. requesting a license to conduct the business of marketing of swimming pool vacuum cleaners made and assembled locally at 2222 E. 38th Street, was read. It was moved by Poxon, seconded by Anderson, that request of Aqua Sonic Pool Cleaner Co. be approved and license granted. Motion carried. Communication from Central Basin Water Association, dated July 18, 1960, extending an invitation to attend the next regular meeting of the Board of Directors of said Association to be held at the Huntington Park Elk's Club, 3355 East Gage Avenue, Huntington Park, at 6:30 P.M. on Thursday, August 4, 1960, was read. It was moved by Anderson, seconded by Poxon, that communi- cation from Central Basin Water Association, dated July 18, 1960, be received and filed. Motion carried. Report of a General Test Check Audit of the accounts and records of the Municipal Court of the San Antonio Judicial District for the fiscal year 1958-59 in accordance with requirements of Section 71383 of the Government Code, submitted by the Office of the Auditor-Controller, County of Los Angeles, was read. It was moved by Mailliard, seconded by Poxon, that Report of a General Test Check Audit of the accounts and records of the Municipal Court of the San Antonio Judicial District be received and filed. Motion carried. Communication from D. D. Grayson, Traffic Engineer, dated July 22, 1960, requesting that R. A. Petraitis, Engineering Department employee, be granted a military leave of absence with pay for the period August 15 to 26, 1960, for annual active duty for training at Camp Roberts, California, with the 63rd Division, U.S. Army Reserve, was read. It was moved by Anderson, seconded by Mailliard, that the request of the Traffic Engineer be approved. Motion carried. I I -5- 8/2/60 Communication from A. E. Nelson, Jr., City Enginee~, D. D. Grayson, Traffic Engineer, and R. H. King, Superintendent, Water & Sewer Systems, dated July 26, 1960, requesting authority to advance Paul K. Swisher to Engineering Aide II, Step 3, effective August 1, 1960, as he has satisfactorily completed his probationary period, was read. It was moved by Anderson, seconded by Poxon, that the request of the City Engineer, Traffic Engineer and Superintendent, Water & Sewer Systems, be approved. Motion carried. Communication from U. S. Growers Cold Storage, Inc., dated July 20, 1960, requesting that the curb be painted green 100 feet west of the new plant, which is now under construction, on the north side of 44th Street and 50 feet east on the same side of the street, was read. It was moved by Poxon, seconded by Anderson, that communi- cation from U. S. Growers Cold Storage, Inc., dated July 20, 1960, be referred to the Traffic Engineer with power to act. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated July 20, 1960, advising that Motorola Communications & Electronics, Inc. has completed the installation of certain Police Department radio equipment, as enumerated, in accordance with Specifications No. 233, and requesting that same be accepted; and further requesting that the service contract with R.C.A. be terminated and a new service contract be entered into with a Motorola Service Company, was read. (Copy to each member of the City Council) It was moved by Poxon, seconded by Mailliard, that communi- cation from the Police Chief, dated July 20, 1960, be laid over until the City Council meeting of August 16, 1960. Bockhacker, Police Chief, dated July 28, 1960, requesting authority to visit the El Centro Police Department for a demonstration of "Cap-chur Equipment II , for use in capturing escaping livestock, with an expense allowance of $26.50, was read. (Copy to each member of the City Council) It was moved by Poxon, seconded by Anderson, that the request of the Police Chief be approved and authority granted to issue warrant in the amount of $26.50 to R. H. Bockhacker. Motion carried. Report of activities of the Police Department for the period July 16 - 31, 1960, inclusive, was presented. It was moved by Anderson, seconded by Paxon, that the report of activities of the Police Department be received and filed. Motion carried. Communication from Dick's Service requesting a license to operate a service station at 3101 E. Slauson Avenue, was read. It was moved by Poxon, seconded by Anderson, that request of Dick's Service be approved and license granted. Motion carried. I I -6- 8/2/60 Communication from Richard A. Herren, dated July 27, 1960, requesting refund of a business license, in the amount of $18.75, which he had obtained to operate a restaurant at 4401 Downey Road, was read. (Copy to each member of the City Council) It was moved by Anderson, seconded by Poxon, that the request of Richard A. Herren be approved and authority granted to issue warrant in the amount of $18.75 to Richard A. Herren. Motion carried. Communication from Ladish Pacific Division, Ladish Co., dated July 27, 1960, requesting consideration for the granting of a pedestrian controlled traffic light and/or crosswalk, linking their two properties on Alcoa Avenue approximately 340 feet north of the Alcoa-Slauson intersection, was read. (Copy to each member of the City Council) It was moved by Anderson, seconded by Paxon, that communi- cation from Ladish Pacific Division, Ladish Co., dated July 27, 1960, be referred to the Traffic Engineer for study and consultation with Ladish Pacific Div., Ladish Co. as to a suitable solution regarding linking their two properties on Alcoa Ave. Motion carried. Communication from the Board of Administration, State Employees' Retirement System, dated July 27, 1960, with reference to their annual meeting to be held in San Francisco, on August 12, 1960, and requesting representation from the City of Vernon, was read. It was moved by Anderson, seconded by Poxon, that communi- cation from the Board of Administration, State Employees' Retirement System, dated July 27, 1960, be received and filed. Motion carried. Communication from Mary H. McCarroll, dated July 27, 1960, with reference to bill received from the City of Vernon for $25.00 for alleged damage to a 35-mile speed limit sign by her son, was read. (Copy to each member of the City Council) It was moved by Poxon, seconded by Mailliard, that communi- cation from Mary H. McCarroll, dated July 27, 1960, be referred to the Engineering Department for study and report as to the extent of damage. Motion carried. Communication from David D. Grayson, Traffic Engineer, dated July 29, 1960, requesting permission to contact the Metropolita; Transit Authority relative to their future plans for abandonment or reconstruction of the streetcar tracks in Santa Fe Avenue in order to facilitate design of two major public works projects which are planned by the City of Vernon in Santa Fe Avenue, was read. It was moved by Poxon, seconded by Mailliard, that Mayor Furlong be authorized to contact the Metropolitan Transit Authority relative to their future plans for abandonment or reconstruction of the streetcar tracks in Santa Fe Avenue. Motion carried. Petition received by the Chief Deputy City Clerk on July 29, 1960 for annexation to the City of Vernon purportedly bearing signatures of twenty-five percent of the landowners by area and assessed valuation in the territory proposed to be annexed to the City of Vernon, was read. I I -7- 8/2/60 It was moved by Poxon, seconded by Mailliard, that the City Clerk be instructed to check the last equalized assessment roll of the County of Los Angeles to determine if said petition is signed by the requisite number of qualified signers, and to report the results of said check at the next meeting. Motion carried. Communication from Vincent R. Poxon, City Attorney, requesting authority to attend the National Institute of Law Officers Annual Conference to be held in Denver, Colorado, from September 25 to September 30, 1960, with an expense allowance of $349.51, was read. It was moved by Anderson, seconded by Mailliard, that the request of the City Attorney be approved and authority granted to issue warrant in the amount of $349.51 to Vincent R. Poxon. Motion carried. Communication from So. Calif. Edison Company, dated July 29, 1960, together with check in the amount of $145,937.50 repre- senting principal amount of bonds due October 1, 1960 ($98,000.00) and semi-annual interest due October 1, 1960 ($25,132.50) and interest due April 1, 1961 ($22,805.00) on Vernon Light and Power Bonds, in accordance with 1937 lease agreement and Stipulation dated June 4, 1959, was read. It was moved by Anderson, seconded by Poxon, that communi- cation from So. Calif. Edison Company, dated July 29, 1960, be referred to Consulting Electrical Engineer Heinze for verification of the amount transmitted and report. Motion carried. Communication from L. C. Husted, Fire Chief, recommending that Fireman Ronald L. Cummings be granted a leave of absence with pay to participate in Active Duty Training with the 15th U.S. Army Corps during the period August 14 through August 27, 1960, was read. It was moved by Poxon, seconded by Mailliard, that the request of the Fire Chief be approved. Motion carried. Communication from R. H. Bockhacker, Police Chief, recom- mending that Officer R. E. Shank be advanced from Officer Grade 2 to Grade 1, effective August 1, 1960, was read. It was moved by Mailliard, seconded by Poxon, that the recommendation of the Police Chief be approved. Motion carried. Communication from David D. Grayson, Traffic Engineer, submitting a report of status of right of way acquisition for improving curb returns at intersections of Vernon Avenue with Alcoa Avenue, Boyle Avenue and Downey Road; and recommending that eminent domain proceedings be initiated for those parcels for which easements have not been obtained, was read. It was moved by Anderson, seconded by Poxon, that the City Attorney be authorized and instructed to institute eminent domain proceedings where necessary to acquire easements for improving curb returns at intersections of Vernon Avenue with Alcoa Avenue, Boyle Avenue and Downey Road. Motion carried. Communication from Berny's Grill requesting a license to conduct a restaurant at 5214 Santa Fe Avenue, was read. Communication from Bechtel Corporation, dated July 29, 1960, requesting a license agreement with the City of Vernon to install and maintain two 3-inch underground conduits across 46th Street, was read. It was moved by Anderson, seconded by Poxon, that the request of Bechtel Corporation, dated July 29, 1960, be referred to the Engineering Department and the City Attorney for investigation and report. Motion carried. Communication from Frank G. Bonelli Testimonial Dinner Committee, dated July 29, 1960, with reference to testimonial dinner for Frank G. Bonelli on Wednesday, August 17, 1960, and suggesting that the City of Vernon might wish to adopt a resolution honoring Supervisor Bonelli, was read. It was moved by Anderson, seconded by Mailliard, that communication from Frank G. Bonelli Testimonial Dinner Committee, dated July 29, 1960, be referred to the City Attorney for drafting of a resolution honoring Supervisor Bonelli; and authorizing Mayor Furlong to sign this resolution. Motion carried. The Administrative Officer reported orally that in connection with the installation of a 15" sewer in Bandini Boulevard, which was constructed at the expense of abutting property owners and to which title has been transferred to the City of Vernon, there is being carried an account receivable against Charles M. King and George Miller on the books of the City of Vernon for engineering and incidental services performed by city personnel, in the amount of $310.13, and that the Administrative Officer has discussed this matter with Mr. King, one of the debtors, and the account is disputed, it being contended that the services in question were performed pursuant to an understanding to the effect that no charge would be made by the City of Vernon for those services, if the property owners involved would pay all other costs and convey title to the City of Vernon, which has been done. It was moved by Anderson, seconded by Poxon, that this matter be referred to the City Attorney, City Clerk and Administrative Officer, with instructions to discuss it further with the debtors, and recommend to the City Council what further action should be taken. Resolution No. 2361 - A Resolution of the City Council of the City of Vernon requesting the state officials engaged in water contract negotiations to prepare and submit a proposed contract with the Metropolitan Water District of Southern California as soon as possible so that the people of the Central Basin Municipal Water District and the Directors of the Metropolitan Water District may be able to reach a decision as to their position prior to the November 8, 1960 General Election, was read. "Warrant Register No. 74" covering claims and demands presented during the period July 16 to 31, which includes Demands Nos. 2843 to 2957 (both inclusive), drawn on the California Bank, totaling $74,534.18 (accounting period August, 1960), was examined and audited.
