MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF VERNON
HELD MARCH 21, 1961 AT TWO O'CLOCK
P.M. IN THE COUNCIL CHAMBERS OF THE

The meeting was called to order by Mayor R. J. Furlong.
It was moved by Poxon, seconded by Anderson, that minutes
of the meeting of March 7, 1961 be approved as written and submitted.
Motion carried.
Communication from D. D. Grayson, Traffic Engineer, and
R. H. King, Superintendent, Water & Sewer Systems, dated March 13,
1961, with reference to bid received for furnishing and installing
Radio Communication System in accordance with Contract No. 252,
recommending that contract be awarded to Motorola Communications and
Electronics, Inc., on the basis of their bid of $20,599.70, including
sales tax, was read.
Resolution No. 2421 - A Resolution of the City Council of
the City of Vernon accepting the bid of MOtorola Communications and
Electronics, Inc. for furnishing and installing Radio Communication
System, in accordance with Contract No. 252 of said City, was read.
It was moved by Anderson, seconded by Poxon, that
Resolution No. 2421 be approved and adopted. Motion carried.

Communication from D. D. Grayson, Traffic Engineer, dated
March 10, 1961, advising that Electric and Machinery Service, Inc.
has completed the Traffic Signal Installation, Soto Street Project,
in accordance with Contract No. 247, and recommending that the work
be accepted and that authority be granted to pay for same in
accordance with the terms of the contract, was read.
,Besolution No. 2427 - A Resolution of the City Council of
the City of Vernon accepting the installation of traffic signals at
five intersections of Soto Street, in accordance with Contract No.
247 heretofore approved by the City of Vernon, was read.
It was moved by Malburg, seconded by Mailliard, that
Resolution No. 2427 be approved and adopted. Motion carried.

Communication from D. D. Grayson, Traffic Engineer, dated

that said contract be approved and that authority be granted to
advertise for bids, was read.

Resolution No. 2414 - A Resolution of the City Council of
the City of Vernon approving Contract No. 249 and Plan No. A3-1S78
for reconstruction of Boyle Avenue from Vernon Avenue to teonis
Boulevard, and determining the general prevailing rate of per diem
wages, was read.
It was moved by Anderson, seconded by Paxon, that
Resolution No. 2414 be approved and adopted. Motion carried.

Resolution No. 24.15 - A Resolution of the City Council of
the City of Vernon directing the giving of notice inviting sealed
proposals or bids for reconstruction of Boyle Avenue from Vernon
Avenue to Leonis Boulevard, in accordance with Contract No. 24.9 of
the City of Vernon, was read.
It was moved by Poxon, seconded by Malburg, that
Resolution No. 2415 be approved and adopted. Motion carried.

Communication from the Engineering Departments, dated
March 15, 1961, advising of disciplinary action taken against
Mr. Jack Wallace, Utility Man, for being unable to perform his
regularly assigned duties, was read.
It was moved by Anderson, seconded by Poxon, that
disciplinary action taken by the Engineering Departments against
Mr. Jack Wallace be approved; and that the Engineering Departments
make a further report on this matter to the City Council in thirty
(30) days. Motion carried.
Communication from R. H. King, Superintendent, Water &
Sewer Systems, dated March 17, 1961, submitting Contract No. 255
for the construction of Well No. 14 and recommending that said
contract be approved and that authority be granted to advertise for
bids, was read.
Resolution No. 2423 - A Resolution of the City Council of
the City of Vernon approving Contract No. 255 for the construction
of Well Number 14, and determining the general prevailing rate of
per diem wages, was read.
It was moved by Anderson, seconded by Mail1iard, that
Resolution No. 2423 be approved and adopted. Motion carried.

Communication from F. A. Ziemer, City Clerk, dated March
14, 1961, with reference to examination of the sales and use tax
records of the State Board of Equalization pertaining to sales and
use ta~ces collected by said Board for the City of Vernon, was read.

It was moved by Anderson, seconded by Malburg, that F. A.
Ziemer and/or L. R. Burch and/or G. G. Skalsky be authorized to
examine the records of the State Board of Equalization at Sacramento
pertaining to sales and use taxes collected by said Board for the
City of Vernon; that said examination be made at a time convenient
to the City Clerk's Office and to the State Board of Equalization;
and that necessary expenses involved in connection with said
examination be authorized. Motion carried.
Communication from Saul Barret, Inc. requesting a license
to conduct a business of warehousing and transportation at 1823 E.
27th Street, was read.
It was moved by Poxon, seconded by Malburg, that the
request of Saul Barret, Inc. be referred to the Health Department
with power to act. Motion carried.
Communication from Mr. & ~~s. John V. Neale requesting a
license to operate the Smart & Final Iris Company cafeteria at
4700 S. Boyle Avenue, was read.
It was moved by Poxon, seconded by Anderson, that the
request of Mr. & Mrs. John V. Neale be referred to the Health
Department with power to act. Motion carried.
Communication from Leo's Lunch Service requesting a license
to operate a lunch truck in the City of Vernon, was read.
It was moved by Poxon, seconded by Malburg, that the
request of Leo's Lunch Service be approved and license granted.
Motion carried.
Communication from Howard J. Berger dba High Noon Catering
requesting a license to operate a lunch truck in the City of Vernon,
was read.
It was moved by Pox on , seconded by Anderson, that the
request of Howard J. Berger dba High Noon Catering be approved and
license granted. MOtion carried.
Communication from Kal I<an Foods, Inc. requesting a license
to operate general offices at 3386 E. 44th Street for their canned
pet foods industry, was read.
It was moved by Anderson, seconded by Malburg, that the
request of Kal Ran Foods, Inc. be approved and license granted.
Motion carried.

Communication from Musick's Canteen requesting a license
to operate a pre-prepared sandwich shop at 3601 Santa Fe Avenue,
was read.
It was moved by Anderson, seconded by Poxon, that the
request of Musick's Canteen be approved and license granted. Motion
carried.
Communication from D. D. Grayson, Traffic Engineer, dated
March 7, 1961, transmitting easement for street purposes from John B.
Leonis, Jr., covering a portion of Fruitland Avenue near Downey Road,
and recommending that said easement be accepted, was read.
It was moved by Anderson, seconded by Poxon, that easement
be accepted from John B. Leonis, Jr., and that the Mayor and the
City Clerk be authorized to sign Certificate of Acceptance for
recordation purposes. Motion carried.
Communication from D. D. Grayson, Traffic Engineer, dated
March 10, 1961, transmitting an easement for street purposes from
Lenore M; Carroll, covering a portion of Fruitland Avenue near
Downey Road, and recommending that said easement be accepted, was
read.
It was moved by Anderson, seconded by Poxon, that easement
be accepted from Lenore M. Carroll, and that the Mayor and the City
Clerk be authorized to sign Certificate of Acceptance for recordation
purposes. MOtion carried.
Communication from Southern California Regional Association
of County Supervisors, dated March 9, 1961, transmitting a copy of
their resolution urging a revision of the so-called Mayo-Breed
Formula to provide a minimum of 60 percent of State Highway
Construction Funds to the Southern Counties as compared to the 55
percent currently allocated, and requesting the City Council to take
similar action, was read. (Copy to each member of the City Council)
It was moved by Anderson, seconded by Poxon, that the City
Attorney be instructed to draft a resolution urging a revision of the
so-called Mayo-Breed Formula to provide a minimum of 60 percent of
State Highway Construction Funds to the Southern Counties as compared
to the 55 percent currently being allocated. Motion carried.
Communication from Chanslor-Western Oil and Development
Company, dated March 10, 1961, expressing appreciation for the manner
in which the Vernon Fire Department cleaned up their offices
following water flooding of the premises sometime between midnight
and 5:00 a.m. on ~mrch 10, was read.
It was moved by Anderson, seconded by Poxon, that communi-
cation from Chanslor-Western Oil and Development Company, dated
March 10, 1961, be received and filed. Motion carried.
Communication from the City of Palos Verdes Estates, dated
March 6, 1961, transmitting a copy of Resolution No. 345 opposing
AB 127 as an unwarranted extension of the Brown Act, was read.
It was moved by Anderson, seconded by Malburg, that communi-
cation from the City of Palos Verdes Estates, dated March 6, 1961,
together with copy of Resolution No. 345, be received and filed.

Copy of Resolution No. 61-127 of the City Council of the
City of Temple City opposing AB 127 as an unwarranted extension of
the Brown Act, was read.
It was moved by Anderson, seconded by ~alburg, that copy
of Resolution No. 61-127 of the City Council of the City of Temple
City be received and filed. Motion carried.
Report of the annual audit of the accounts and records of
the Municipal Court of the San Antonio Judicial District for the
fiscal year 1959-60 in accordance with requirements of Section
71383 of the Government Code, submitted by the Office of the
Auditor-Controller, County of Los Angeles, was read.
It was moved by Malburg, seconded by Mai1liard, that the
report of the annual audit of the accounts and records of the
Municipal Court of the San Antonio Judicial District for the fiscal
year 1959-60, be received and filed. Motion carried.
Communication from Hollis M. Peavey, Temporary Chairman,
Independent Cities Los Angeles County, dated March 14, 1961,
transmitting a copy of the recommendations of the Legislative
Committee of the Independent Cities of Los Angeles County with
reference to certain assembly bills and also the consolidation of
the Municipal Courts, was read. (Copy to each member of the City
Council)
It was moved by Anderson, seconded by Poxon, that communi-
cation from Hollis M. Peavey, Temporary Chairman, Independent Cities
Los Angeles County, dated March 14, 1961, together with copy of the
recommendations of the Legislative Committee of the Independent
Cities of Los Angeles County, be received and filed. Motion carried.
Communication from the Engineering Departments, dated
March 9, 1961, requesting authority to employ Mr. David Whitford
as Civil Engineer, Step 5, effective approximately April 10, 1961,
was read.
It was moved by Anderson, seconded by Malburg, that the
request of the Engineering Departments, dated March 9, 1961, be
approved. Motion carried.
Communication from D. D. Grayson, Traffic Engineer, dated
March 14, 1961, requesting authority for Victor Vaits, Engineering
Department employee, to attend Fundamentals of Traffic Engineering
at the University of California, Berkeley, California, from June
12 to 16, 1961, with an expense allowance of $201.12, was read.
It was moved by Anderson, seconded by Poxon, that the
request of the Traffic Engineer, dated March 14, 1961, be approved
and authority granted to issue warrant to Victor Vaits in the amount
of $201.12. Motion carried.
Communication from R. H. Bockhacker, Folice Chief, dated
March 16, 1961, requesting that L. S. Rosenkrantz be reimbursed
the sum of $2.50 from the Education and Training Budget appropriation
for registration fee in connection with his Police Science courses
at East Los Angeles College, was read.

It was moved by Anderson, seconded by Mailliard, that the
request of the Police Chief, dated March 16, 1961, be approved and
that authority be granted to issue warrant to L. S. Rosenkrantz in
the amount of $2.50. Motion carried.
Communication from G. G. Skalsky, Assistant Director of
Civil Defense, dated March 17, 1961, requesting authority to attend
the Southern California and Northern California Civil Defense &
Disaster Association joint meeting at Fresno, California, from April
7 to 9, 1961, with an expense allowance of $89.10, was read.
It was moved by Anderson, seconded by Poxon, that the
request of the Assistant Director of Civil Defense, dated March
17, 1961, be approved and authority granted to issue warrant to
G. G. Skalsky in the amount of $89.10. MOtion carried.
Report of Health Department activities for the month of
February, 1961, was presented.
It was moved by Malburg, seconded by Mailliard, that the
report of Health Department activities be received and filed. Motion
carried.
Report of Police Department activities for the period
March 1 - 15, 1961, inclusive, was presented.
It was moved by Malburg, seconded by Poxon, that the report
of Police Department activities be received and filed. Motion
carried.
Communication from D. D. Grayson, Traffic Engineer, dated
March 17, 1961, requesting authority for Castulo Lopez, Glenwood
Ashby, Robert Mantle, Ray Corella and Don Radcliffe to attend the
Western Safety Congress, Ambassador Hotel, Los Angeles, March 30,
1961, with an expense allowance of $8.00 each, was read.
It was moved by Poxon, seconded by Anderson, that the
request of the Traffic Engineer, dated March 17, 1961, be approved
and authority granted to issue warrants to Castulo Lopez, G1enwood
Ashby, Robert l~ntle, Ray Corella and Don Radcliffe in the amount
of $8.00 each. Motion carried.
Communication from R. H. King, Superintendent, Water &
Sewer Systems, dated March 16, 1961, requesting authority to attend
the 13th Regional Spring Meeting, California Section, American Water
Works Association, in Santa Barbara, California, on April 13 & 14,
1961, with an expense allowance of $54..00, was read.
It was moved by Poxon, seconded by Anderson, that the
request of the Superintendent, Water & Sewer Systems, dated March
16, 1961, be approved and authority granted to issue warrant to
R. H. King in the amount of $54.00. Motion carried.
Communication from Ben King dba Okeh Catering requesting
a license to operate a lunch truck in the City of Vernon, was read.
It was moved by Poxon, seconded by Malburg, that the
request of Ben King dba Okeh Catering be referred to the Health
Department with power to act. Motion carried.

Report of Carl A. Heinze, Consulting Electrical Engineer,
on operation of electrical system by Southern California Edison
Company for the month of January, 1961, was read.
It was moved by Anderson, seconded by Poxon, that the
report of the Consulting Electrical Engineer be received and filed.
Motion carried.
Communication from John B. MOore, Administrative Officer,
dated March 21, 1961, with reference to inquiry of Mr. Henry
Himmelfarb requesting informal expression of opinion as to the
construction of a 200-unit motel, with bar, restaurant and health
club facilities at the northeast corner of Ayers Avenue and Bandini
Boulevard, was presented. (Copy to each member of the City Council)
Mr. Himmelfarb not being present, it was moved by Anderson,
seconded by Mail1iard, that communication from the Administrative
Officer, dated March 21, 1961, be received and filed. Motion carried.
Communication from C. E. Nemethi, M.D., Health Officer,
dated ~~rch 21, 1961, with reference to establishing a tetanus
prophylactic program, was read. (Copy to each member of the City
Council)
It was moved by Malburg, seconded by Anderson, that the
Health Department be authorized to purchase vaccine to immunize City
employees against tetanus at no cost to said employees; that the
Health Department be authorized to immunize City residents and the
families of the City employees against tetanus at cost; and that
special consideration be given to any family in the City who cannot
pay for said immunization. MOtion carried.
Ordinance No. 735 - An Ordinance of the City of Vernon
amending Ordinance No. 710 of said City, was read in full for a
first reading.
It was moved by Anderson, seconded by Malburg, that
Ordinance No. 735 receive and pass a first reading. Motion carried.

It was moved by Anderson, seconded by Malburg, that
Ordinance No. 735 receive and pass a second reading. Motion carried.

dated March 20, 1961, addressed to the attention of Mr. C. A. Heinze,

Railroad Company covering proposed 7-KV crossing at Charter Street
and Dovmey Road, was read.

Mayor and the City Clerk be authorized to execute Overhead Wire
Crossing Agreement C.L.D. No. 13889. Motion carried.

presented during the period March 1 to 15, which includes Demands
Nos. 4860 to 4984 (both inclusive), drawn on the California Bank,
totaling $69,512.44 (accounting period March, 1961), was examined
and audited.

Register No. 89 be approved and payment authorized for Demands Nos.
