MINUTES OF A REGULAR MEETJ.NG OF THE
CITY COUNCIL OF THE CITY OF VERNON
HELD APRIL q" 1961 AT TWO 0' CLOCK
P.M. IN THE COUNCIL CHAMBERS OF THE

The meeting was called to order by Mayor R. J. Furlong.
It was moved by Poxon, seconded by Anderson, that minutes
of the meeting of March 21, 1961 be approved as written and submitted.
Motion carried.
The Clerk announced that this was the time and place for
opening of bids received for the reconstruction of Boyle Avenue from
Vernon Avenue to Leonis Boulevard, in accordance with Contract No.
249.
It was moved by Poxon, seconded by Malburg, that the Clerk
be instructed to open and read the bids submitted. Motion carried.
The Clerk opened and read the following bids:

'It was moved by Poxon, seconded by Malburg, that bids
received for the reconstruction of Boyle Avenue from Vernon Avenue
to Leonis Boulevard, in accordance with Contract No. 249, be
referred to the Traffic Engineer and City Attorney for checking and
report. Motion carried.
The Clerk announced that this was the time and place for
opening of bids received for the construction of Well No. 14, in
accordance with Contract No. 255.
It was moved by Malburg, seconded by Mail1iard, that the
Clerk be instructed to open and read the bids submitted. Motion
carried.

It was moved by Poxon, seconded by Anderson, that bid
received for the construction of Well No. 14, in accordance with
Contract No. 255, be referred to the Superintendent, Water & Sewer
Systems, and the City Attorney for checking and report. Motion
carried.
Ordinance No. 736 - An Ordinance of the City of Vernon
directing that no building 'permit be issued for any building or
structure in conflict with and prohibiting any other use in conflict
with a proposed new zoning ordinance, was read in full for a first
reading.

It was moved by Poxon, seconded by Anderson, that the
Council finds that the proposed ordinance is an emergency measure,
and that the emergency recited in Section 1 of the ordinance exists
and that the ordinance should be indicated as an emergency measure.

Communication from Chanslor-Western Oil and Development
Company, dated April 4, 1961, requesting that the City CouncIl
consider the adoption of an appropriate resolution, favoring the
enactment by the Congress making it possible to return the Cheli
Air Force Depot property to Chanslor-Western Oil and Development
Company, a subsidiary of the Atchison, Topeka and Santa Fe Railway
Company, on such fair and equitable terms as are consistent with
the principles of the Surplus Property Act of 1944, was read.
E. H. Farrar, Vice President, Chanslor-Western Oil and
Development Company, appeared before the City Council and urged the
City of Vernon to support the return to Chans10r-Western Oil and
Development Company of the portion of the Base declared surplus to
the Government's needs.
Resolution No. 2436 - A'Reso1ution of the City Council of
the City of Vernon supporting the return to Chanslor-Western Oil
and Development Company of the portion of Che1i Air Force Base
declared surplus to the Government's needs, was read.
It was moved by Anderson, seconded by Poxon, that
Resolution No. 2436 be approved and adopted. Motion carried.

John W. Shenk, Ill, Special Counsel, appeared before the
City Council and made a progress report on matters pertaining to
Vernon's sewage disposal problems and as to the status of the matter
of separating the City of Vernon sewer system from the City of Los
Angeles.
It was moved by Anderson, seconded by Malburg, that
Ordinance No. 735 receive a third and final reading by title.
Motion carried.
Ordinance No. 735 - An Ordinance of the City of Vernon
amending Ordinance No. 710 of said City, was read for a third and
final reading by title.
It was moved by Anderson, seconded by Malburg, that
Ordinance No. 735 receive and pass a third reading and be adopted.
Motion carried.

Communication from L. C. Husted, Fire Chief, dated March
27, 1961, advising that Crown Coach Corporation has delivered one
1750 gallon per minute pumper in accordance with Specifications No.
240, and recommending that same be accepted and that authority be
granted to pay for same in accordance with the terms of the contract,
was read.
Resolution No. 2430 - A Resolution of the City Council of
the City of Vernon accepting one 1750 gallon per minute Triple
Combination Pumper, in accordance with Specifications No. 240 here-
tofore approved by the City of Vernon, was read.
It was moved by Malburg, seconded by Mailliard, that
Resolution No. 2430 be approved and adopted. Motion carried.

1961, requesting a license to operate one Seeburg 222 SH - Phonograph

It was moved by Anderson, seconded by Mailliard, that the
request of Music Systems, Inc. be approved and license granted.
Motion carried.
Franchise Report of the American District Telegraph
Company on Ordinance No. 166 for year ending February 28, 1961,
together with check in the amount of $4,192.13, was presented.
It was moved by Anderson, seconded by ~~lburg, that
Franchise Report of the American District Telegraph Company on
Ordinance No. 166 be received and filed. Motion carried.
Franchise Report of the Richfield Oil Corporation on
Ordinance No. 432 for year ending December 31, 1960, together with
check in the amount of $200.00, was presented.
It was moved by Poxon, seconded by Anderson, that Franchise
Report of the Richfield Oil Corporation on Ordinance No. 432 be
received and filed. Motion carried.
Franchise Report of the Southern California Gas Company
on Ordinance No. 607 for year ending Oecember 31, 1960, together
with check in the amount of $62,879.13, was presented.
It was moved by Anderson, seconded by Poxon, that Franchise
Report of the Southern California Gas Company on Ordinance No. 607
be received and filed. Motion carried.
Communication and report from C. A. Heinze, Consulting
Electrical Engineer, dated March 17, 1961, with reference to payments
tendered by Southern California Edison Company in connection with
Franchise Ordinances Nos. 503, 504 and 611, and Los Angeles County
Franchise Ordinance No. 7062 for territory included in the Bandini
No. 1 and No.2 and Riverside No.2 annexations, was read. (Copy

Attorney, dated March 23, 1961, with reference to payment received
from Southern California Edison Company under Los Angeles County
Franchise No. 7062 for property recently annexed to the City of
Vernon, was read. (Copy to each member of the City Council)
Communication from Southern California Edison Company"
dated April 3, 1961, transmitting corrected franchise report on
Los Angeles County Franchise No. 7062 for property recently annexed
to the City of Vernon, and advising that check in the amount of
$2,792.42 transmitted with communication dated February 27, 1961,
included an overpayment of $7.64, was read.
It was moved by Anderson, seconded by Mailliard, that check
in the amount of $2,792.42 be accepted in connection with Franchise
Ordinances Nos. 503, 504 and 611, and Los Angeles County Franchise
Ordinance No. 7062, and that authority be granted to issue warrant
to Southern California Edison Company in the amount of $7.64
covering refund for overpayment under Los Angeles County Franchise
Ordinance No. 7062. MOtion carried.
News release from Southern Pacific Public Relations
Department, dated March 23, 1961, with reference to Southern
Pacific's proposal to acquire stock control of the Western Pacific,

It was moved by Anderson, seconded by Poxon, that news
release from Southern Pacific Public Relations Department, dated
March 23, 1961, be received and filed. MOtion carried.
Communication from the City of Monrovia, dated March 17,
1961, transmitting a copy of Resolution No. 2294 endorsing a
legislative program to amend the Mayo-Breed Formula as proposed
in AB 1320, was read.
It was moved by Malburg, seconded by Mailliard, that
communication from the City of Monrovia, dated March 17, 1961,
together with copy of Resolution No. 2294,be received and filed.
Motion carried.
Resolution No. 2433 - A Resolution of the City Council of
the City of Vernon supporting Assembly Bill 1320, was read.
It was moved by Malburg, seconded by Mail1iard, that
Resolution No. 2433 be approved and adopted. Motion carried.

Communication from Standard Oil Company of California,
Western Operations, Inc., dated March 22, 1961, requesting permission
to conduct a geophysical survey within the city limits of Vernon in

It was moved by Anderson, seconded by Poxon, that the
request of Standard Oil Company of California be approved subject to
compliance with any requirements of the City Engineer, the Superin-
tendent, Water & Sewer Systems, and the Fire Chief; subject to
providing the City of Vernon with certificates of public liability
and property damage insurance in form and amounts to be established
by the City Attorney; and subject to any other regulations that the
City Attorney may impose, and in accordance with conditions outlined
in applicant's letter dated March 22, 1961. Motion carried.
Communication from the Los Angeles County Board of
Supervisors, dated March 20, 1961, advising that in accordance with
directives issued by the President of the United States and the
Governor of the State of California, urging acceleration of local
government construction in order to improve the economy, the Board
adopted an order on March 14, 1961, that the enclosed copies of
reports on the accelerated construction program of the County of
Los Angeles be forwarded to all Cities of Los Angeles County, was

communication from the Los Angeles County Board of Supervisors,
dated March 20, 1961, be received and filed. Motion carried.
Communication from D. D. Grayson, Traffic Engineer, dated
March 21, 1961, transmitting an easement for street purposes from
The Bassick Company, covering a portion of Fruitland Avenue, and
recommending that said easement be accepted, was read.
It was moved by Poxon, seconded by Anderson, that easement
be accepted from The Bassick Company and that the Mayor and City
Clerk be authorized to sign Certificate of Acceptance for recordation
purposes. Motion carried.
Communication from A. E. Nelson, Jr., City Engineer, dated
March 23, 1961, requesting authority to attend the Public Works
Officers Institute at Santa Maria, California, from April 23 to
25, 1961, with an expense allowance of $108.73, was read.
Communication from D. D. Grayson, Traffic Engineer, dated
March 23, 1961, requesting authority to attend the Public Works
Officers Institute at Santa Maria, California, from April 23 to
25, 1961, with an expense allowance of $108.73, was read.
It was moved by Anderson, seconded by Poxon, that the
requests of the City Engineer and the Traffic Engineer, both dated
March 23, 1961, be approved and authority granted to issue warrants
to A. E. Nelson, Jr. and D. D. Grayson in the amount of $108.73 each.

Communication signed by Mayor Arthur H. Cox, Pomona, Mayor
L. F. Donegan, Monterey Park, and Councilman D'Arcy Quinn, Alhambra,
dated March 24, 1961, advising that the League of California Cities
meeting of April 6th will be devoted to a discussion debate on
Municipal Court Consolidation Proposal) and requesting that the
City's representative be prepared to give the consensus of the City's
view on the Court Consolidation Plan) was read. (Copy to each

It was moved by Anderson, seconded by Poxon, that the City
Attorney be instructed to draft a resolution opposing the proposed
Municipal Court Consolidation. Motion carried.
Communication from the City of Paramount, dated March 24,
1961, transmitting a copy of Resolution No. 61:033 supporting AB 127
as a warranted extension of the Brown Act, was read.
It was moved by Anderson, seconded by Poxon, that communi-
cation from the City of Paramount, dated March 24, 1961, together
with copy of Resolution No. 61:033, be received and filed. MOtion
carried.
Communication from R. H. King, Superintendent, Water &
Sewer Systems, dated March 28, 1961, requesting authority for
Francis W. Sumner to attend the Annual Conference of California
Sewage and Industrial Wastes Association at Santa Monica, California,
from April 26 to 29, 1961, with an expense allowance of $95.50, was
read.
It was moved by Poxon, seconded by Malburg, that the
request of the Superintendent, Water & Sewer Systems, dated March
28, 1961, be approved and authority granted to issue warrant to
Francis W. Sumner in the amount of $95.50. Motion carried.
Communication from R. H. King, Superintendent, Water &
Sewer Systems, dated March 28, 1961, requesting authority to attend
the Annual Conference of California Sewage and Industrial Wastes

March 29, 1961, advising that Mr. David B. ~fuitford advised that he
will not be able to accept the job as Civil Engineer with the City
of Vernon, as authorized by City Council action March 21, 1961, was
read.

communication from the Engineering Departments, dated March 29, 1961,
be received and filed. Motion carried.
Communication from C. R. Compton, Chief Engineer and
General Manager, County Sanitation Districts of Los Angeles County,
dated March 29, 1961, with reference to proposed Annexation No. 1
to County Sanitation District No. 23 of Los Angeles County, was

Resolution No. 2431 - A Resolution of the City Council of
the City of Vernon, California, granting its consent to the
annexation of a certain portion of said City to County Sanitation
District No. 23 of Los Angeles County, was read.

27, 1961, requesting authority to purchase a supply of adhesive
telephone labels, listing the new Fire Department Business telephone
number, the Fire Department Emergency telephone number and the
Police Department telephone number, at an approximate cost of $7.53
per thousand in quantities of 12,000 or more, was read.
It was moved by Malburg, seconded by Mailliard, that the
request of the Fire Chief, dated March 27, 1961, be approved.

Communication from Robert S. Stone, dated March 28, 1961,
submitting his resignation as Director of Sanitation of the Vernon
Health Department, effective at the close of business May 26, 1961,
and requesting that he be granted authority to take his annual
vacation leave from May 15 to 26 inclusive, was read. (Copy to
each member of the City Council)
It was moved by Anderson, seconded by Poxon, that the
resignation of Robert S. Stone as Director of Sanitation be accepted,
effective at the close of business May 26, 1961, and that Mr. Stone
be granted authority to take his annual vacation leave from May 15
to 26 inclusive. Motion carried.
Communication from L. C. Husted, Fire Chief, dated March
27, 1961, requesting permission to advance Thomas L. Scott from
Hoseman Grade 2 to Grade 1, effective April 1, 1961, was read.
It was moved by Anderson, seconded by Poxon, that the
request of the Fire Chief, dated March 27, 1961, be approved. Motion
carried.
Communication from Tyrco Industries requesting a license
to conduct a business of selling tires and tubes, automotive parts
and accessories and rubber supplies at 3300 Leonis Blvd., was read.
It was moved by Malburg, seconded by Mailliard, that the
request of Tyrco Industries be approved and license granted. Motion
carried.
Communication from Ernest E. Debs, Chairman of the Board
of Supervisors, County of Los Angeles, dated March 27, 1961,
expressing appreciation for the tribute paid him in hosting the
testimonial luncheon for him on March 17, was read.

request of Reliable Unloading Service of Vernon be referred to the
Police Department with power to act. Motion carried.
Communication from Arthur E. Nelson, Jr., City Engineer,
dated March 23, 1961, advising that Montebello Sewer Company, Inc.
has completed the work of sanitary sewer construction in 26th Street,
Downey Road, Soto Street and Washington Boulevard in accordance with
Contract No. 232, and recommending that same be accepted and that
authority be granted to pay for same in accordance with the terms
of the contract, was read.
Resolution No. 2432 - A Resolution of the City Council of
the City of Vernon accepting the construction of sanitary sewers in
26th Street, Downey Road, Soto Street and Washington Boulevard, in
accordance with Contract No. 232 heretofore approved by the City of
\ Vernon, was read.

Communication from Mason, Muntz & Associates, dated March
30, 1961, advising that Fire Chief Husted has requested some changes
be made in the plans and specifications on Fire Station No. 2 and
Communications Building, and requesting authority to proceed with
these changes under Paragraph 4, Extra Services, of the Agreement
between the Owner and Architect, at an approximate cost of $300.00
to $400.00, was read. (Copy to each member of the City Council)
It was moved by Anderson, seconded by Malburg, that
communication from Mason, Muntz & Associates, dated March 30, 1961,
be laid over until the next regular meeting in order that the Fire
Chief may confer with Mason, Muntz & Associates relative to this
matter and report back to the City Council. Motion carried.
Communication from Rulon A. Rodda dba HiGrade Food
Distributor requesting a license to operate a lunch truck in the
City of Vernon, was read.
It was moved by Poxon, seconded by Mailliard, that the
request of Rulon A. Rodda dba HiGrade Food Distributor be referred
to the Health Department with power to act. Motion carried.
Report of Police Department activities for the period
March 16 - 31, 1961 inclusive, was presented.
It was moved by Poxon, seconded by Anderson, that the
report of Police Department activities be received and filed. Motion

Communication from the Engineering Departments, dated
March 30, 1961, requesting authority to employ Mr. Gaylon R.
Claiborne as Civil Engineering Assistant, Step 3, effective
approximately June 12, 1961, was read.
It was moved by Anderson, seconded by Poxon, that the
request of the Engineering Departments, dated March 30, 1961, be
approved. Motion carried.
Communication from the City of Inglewood, dated March 31,
1961, advising that the City Council at their meeting on March 28,
took action to oppose the proposed Municipal Court consolidation
until a full, complete and careful study of its effects on local
justice can be made, and inviting all cities to join in opposing
consolidation until there has been sufficient time and study given
to determining the impact of the proposed legislation on the
efficient administration of local justice by cities of Los Angeles
County and other interested parties, was read. (Copy to each member
of the City Council)

communication from the City of Inglewood, dated March 31, 1961, be
received and filed. Motion carried.
Communication from Cyril Silverberg dba Commerce Catering
requesting a license to operate a lunch truck in the City of Vernon,
was read.
It was moved by Poxon, seconded by Mailliard, that the
request of Cyril Silverberg dba Commerce Catering be approved and
license granted. MOtion carried.
Communication from Burk Meat Company requesting a license
to conduct a wholesale meat business at 3305 E. Vernon Avenue, was
read.
It was moved by Malburg, seconded by Mailliard, that the
request of Burk Meat Company be referred to the Health Department
with power to act. Motion carried.
Copy of a communication from the California Highway Patrol,
addressed to Fire Chief Husted, dated March 22, 1961, commending
Fireman D. E. Podlas for his unhesitating cooperation and assistance
at the scene of a major injury traffic collision on the Santa Ana
Freeway near the Atlantic Boulevard overcrossing, City of Commerce,
was read.
It was moved by Mailliard, seconded by Anderson, that
copy of a communication from the California Highway Patrol, dated
March 22, 1961, be received and filed. Motion carried.
Communication from L. C. Husted, Fire Chief, dated April
3, 1961, with reference to the installation of a direct, unlisted
telephone in the Fire Departments of Maywood, Bell, Huntington Park
and Vernon, so that all four cities would be immediately notified
of a fire call in any part of the district that these cities cover,
at a cost of approximately twenty dollars per month for each city and
a fifteen dollar installation charge for each city, requesting that
the Fire Department be authorized to install said direct telephone
line and that the Pacific Telephone Company be authorized to bill

the City of Vernon for the total service as the other three cities
have agreed to send a check to the City of Vernon each month for
their share, was read. (Copy to each member of the City Council)

request of the Fire Chief be approved, as outlined in his communi-
cation dated April 3, 1961. MOtion carried.
Communication from John B. Moore, Administrative Officer,
dated March 24, 1961, with reference to proposed chest x-ray program,
was read. (Copy to each member of the City Council)
It was moved by Anderson, seconded by Mailliard, that the
Administrative Officer canvass industry to determine if industry is
willing to financially support a chest x-ray program, and to report
his findings to the City Council at the next regular meeting. Motion
carried.

amending Ordinance No. 642 of said City, was read in full for a
first reading.
