MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF VERNON
HELD APRIL 18, 1961 AT TWO O'CLOCK
P.M. IN THE COUNCIL CHAMBERS OF THE
CITY HALL LOCATED AT 4305 SANTA FE
AVENyE, VERNON, CALIFORNIA.
COUNCIL PRESENT: Anderson, Furlong, Mai1liard, Malburg, Poxon
COUNCIL ABSENT: None
The meeting was called to order by Mayor R. J. Furlong
It was moved by Poxon, seconded by Anderson, that minutes
of the meeting of April 4, 1961 be approved as written and submitted.
Motion carried.
The Clerk announced that this was the time and place for
opening of bids received for the construction of a 750,000 gallon
elevated water tank, in accordance with Contract No. 253.
It was moved by Mai1liard, seconded by Poxon, that the
Clerk be instructed to open and read the bids submitted. Motion
carried.
The Clerk opened and read the following bids:

Pittsburgh-Des Moines Steel Company
$ 279,755.00
262,800.00
It was moved by Anderson, seconded by Poxon, that bids
received for the construction of a 750,000 gallon elevated water
tank, in accordance with Contract No. 253, be referred to the
Superintendent, Water & Sewer Systems, and the City Attorney for
checking and report. Motion carried.
It was moved by Anderson, seconded by Malburg, that
Ordinance No. 737 receive a third and final reading by title.
Motion carried.
Ordinance No. 737 - An Ordinance of the City of Vernon
amending Ordinance No. 642 of said City, was read for a third and
final reading by title.
It was moved by Anderson, seconded by Malburg, that
Ordinance No. 737 receive and pass a third reading and be adopted.
Motion carried.

Absent: None
John B. Moore, Administrative Officer, made a verbal report
on the results of the canvass of industry to determine if industry
was willing to financially support a chest x-ray program.
It was moved by Anderson, seconded by Malburg, that the
City of Vernon not establish a chest x-ray program at this time, and
that the State Tuberculosis Association be notified that the City of
Vernon is not interested in purchasing the mobile x-ray unit they
have available at the present time. Motion carried.

Communication from Norris-Thermador Corporation, dated
April 14, 1961, with reference to proposed chest x-ray program, was
read.
It was moved by Anderson, seconded by Poxon, that Norris-
Thermador Corporation be notified of action taken by the City Council
relative to proposed chest x-ray program. Motion carried.
Communication from Columbia Pictures Corporation, dated
April 14, 1961, requesting a license to photograph a motion picture
on the streets of the City of Vernon, on 38th Street between Santa
Fe Avenue and Alameda Street, on Tuesday, April 25, and Wednesday,
April 26,1961, between the hours of 7:00 P.M. and 5:00 A.M., was
read.
It was moved by Anderson, seconded by Poxon, that the
x'equest of Columbia Pictures Corporation be approved and license
granted. Motion carried.
Communication from D. D. Grayson, Traffic Engineer, dated
April 6, 1961, with reference to bids received for the reconstruction
of Boyle Avenue from Vernon Avenue to Leonis Boulevard, in accordance
with Contract No. 24,9, and recommending that contract be awarded to
Griffith Company on the basis of their low bid of $40,917.08, was

Resolution No. 2440 - A Resolution of the City Council of
the City of Vernon. accepting~the bid of Griffith Company for the
t~econstruction of Boyle Avenue from Vernon Avenue to Leonis
Boulevard, in accordance with Contract No. 249 of said City, was
read.
It was moved by Malburg, seconded by Poxon, that Resolution
No. 2440 be approved and adopted. Motion carried.

Communication from R. H. King, Superintendent, Water &
Sewer Systems, dated April 12, 1961, with reference to bid received
for the construction of Well No. 14 in accordance with Contract No.
255, recommending that the bid be rejected, was read.
Resolution No. 2437 - A Resolution of the City Council of
the City ot:Vernon rejecting all bids received for the construction
of Well No. 14, and rescinding Resolution No. 2423 approving Contract
No. 255 of said City, was read.
It was moved by Poxon, seconded by Malburg, that Resolution
No. 2437 be approved and adopted. Motion carried.

Sewer Systems, dated April 12, 1961, submitting Contract No. 259,
which is a revision of Contract No. 255, for the construction of

that authority be granted to advertise for bids, was read.

Eesolution No. 2438 - A Resolution of the City Council of
the City of Vernon approving Contract No. 259 for the construction
of Well No. 14, of said City, and determining the general prevailing
rate of per diem wages, was read.
It was moved by Anderson, seconded by Poxon, that
Resolution No. 2438 be approved and adopted. Motion carried.

Resolution No. 2439 - A Resolution of the City Council of
the City of Vernon directing the giving of notice inviting sealed
proposals or bids for the construction of Well No. 14 in the City

It was moved by Malburg, seconded by Poxon, that Resolution
No. 2439 be approved and adopted. Motion carried.

Communication from D. D. Grayson, Traffic Engineer, dated
April 14, 1961, submitting Contract No. 250, for the resurfacing of
Vernon Avenue from Santa Fe Avenue to Soto Street, and recommending
that said contract be approved and that authority be granted to
advertise for bids, was read.
Resolution No. 2434 - A Resolution of the City Council of
the City of Vernon approving Contract No. 250 and Plan No. A3-l580
for resurfacing of Vernon Avenue from Santa Fe Avenue to Soto Street,
and determining the general prevailing rate of per diem wages, was
read.
It was moved by Anderson, seconded by Poxon, that'
Resolution No. 2434 be approved and adopted. Motion carried.

Resolution No. 2435 - A Resolution of the City Council of
the City of Vernon directing the giving of notice inviting sealed

Communication from Mason, Muntz & Associates, dated March
30, 1961, advising that Fire Chief Husted has requested some changes
be made in the plans and specifications on Fire Station No.2 and
Communications Building, and requesting authority to proceed with
these changes under Paragraph 4, Extra Services, of the Agreement
between the Owner and Architect, at an approximate cost of $300.00

Communication from L. C. Husted, Fire Chief, dated April
12, 1961, with reference to request from Mason, Muntz & Associates,
dated March 30, 1961, for an additional $300.00 to $400.00 for
making certain changes in the plans and specifications on Fire
Station No. 2 and Communications Building, was read. (Copy to each
member of the City Council)
It was moved by Malburg, seconded by Mailliard, that in
accordance with the recommendation of the Fire Chief under date of
April 12, 1961, the request of Mason, Muntz & Associates for
additional funds be denied. Motion carried.
Communication from Edible Inc. requesting a license to
conduct a business of production of edible oleo oils at 2262 East
37th Street, was read.
It was moved by Poxon, seconded by Anderson, that the
request of Edible Inc. be referred to the Health Department with
power to act. Motion carried.
Communication from Tops Chemical Co. requesting a license
to conduct a business of selling, packaging and warehousing chemicals
at 4151 Bandini Blvd., was read.
It was moved by Anderson, seconded by Malburg, that the
request of Tops Chemical Co. be referred to the Fire Department with
power to act. Motion carried. (Pre-existing use prior to adoption
of Ordinance No. 736)
Communication from Helen Miller requesting a license to
conduct a business of Palmistry at 4905 Santa Fe Avenue, was read.
It was moved by Anderson, seconded by Malburg, that the
request of Helen Miller be referred to the Police Department for
investigation and report. MOtion carried.
Communication from Scaffold Structures Inc. requesting a
license to conduct a business of selling wood scaffold plank at
4.186 Bandini Blvd., was read.
It was moved by Poxon, seconded by Anderson, that the
request of Scaffold Structures Inc. be approved and license granted.
Motion carried.
Communication from Kleen Towel Service Co. requesting a
license to conduct a business of towel and linen service at 2501 E.
28th Street, was read.
It was moved by Anderson, seconded by Paxon, that the
request of Kleen Towel Service Co. be approved and license granted.
Motion carried.
Communication from Interphone Electric Company, dated
April 10, 1961, requesting permission to cross the street with a
pair of #19 wires for Huggins-Young Coffee Co. from 4618 Pacific
Boulevard to their new plant at 4560 Pacific Boulevard, was read.

It was moved by Anderson, seconded by Malburg, that the
request of Interphone Electric Company, dated April 10, 1961, be
referred to the City Attorney, the Consulting Electrical Engineer
and the Engineering Departments for investigation and report.
Motion carried.
Report of Carl A. Heinze, Consulting Electrical Engineer,
on operation of the electrical system by Southern California Edison
Company for the month of February, 1961, was read.
It was moved by Malburg, seconded by Mai1liard, that the
report of the Consulting Electrical Engineer be received and filed.
Motion carried.
Communication from Southern California Edison Company,
dated April 11, 1961, transmitting three copies of Renewal of Lease
between Los Angeles Metropolitan Transit Authority and the City of
Vernon for one guy wire attachment on Pole No. 25085-C located at
Pacific Boulevard four feet south of Leonis Boulevard, for execution
by the City of Vernon, was read.
It was moved by Anderson, seconded by Mailliard, that the
Mayor and the City Clerk be authorized to execute on behalf of the
City of Vernon, three copies of Renewal of Lease between Los Angeles
Metropolitan Transit Authority and the City of Vernon for one guy
wire attachment on Pole No. 25085-C. Motion carried.
Communication from The Pacific Telephone and Telegraph
Company, dated April 6, 1961, addressed to R. J. Furlong, advising
that said company does not intend to make application for a new
franchise to the City of Vernon when the present one expires on
April 22, 1963, was read. (Copy to each member of the City Council)
It was moved by Anderson, seconded by Paxon, that communi-
cation from The Pacific Telephone and Telegraph Company, dated
April 6, 1961, be received and filed. Motion carried.
Communications from D. D. Grayson, Traffic Engineer, dated
April 13, 1961, transmitting four easements for street purposes from
the General Refractories Company, Walter W. Ralphs, Jr. and Alaine
Ralphs Benson, Samuel Friedman, and Owens-Illinois Glass Company,
covering portions of Fruitland Avenue, and recommending that said
easements be accepted, were read.
It was moved by Anderson, seconded by Malburg, that ease-
ments be accepted from the General Refractories Company, Walter W.
Ralphs, Jr. and Alaine Ralphs Benson, Samuel Friedman, and Owens-
Illinois Glass Company, and that the Mayor and the City Clerk be
authorized to sign Certificates of Acceptance for recordation
purposes. Motion carried.
Statement from the Controller of the State of California,
dated April 3, 1961, showing advance Apportionment of Vehicle
License Fee Revenues for the 1960-61 Fiscal Year, was presented.
Statement from the Controller of the State of California,
dated April 3, 1961, showing estimate of Apportionments of Vehicle
License Fee Revenues for the 1961-62 Fiscal Year, was presented.

April 3, 1961, be received and filed. Motion carried.
Communication from H. M. Morrison, dated April 5, 1961,
requesting an adjustment on 1961 business license fees as Casey &
Betty's Cafeteria, 4700 S. Boyle Avenue, was only operated for three
months in 1961, was read.
It was moved by Poxon, seconded by Anderson, that in
accordance with Section 23 of Ordinance No. 710, the City Clerk be
authorized to compromise claim for license fees levied against
Casey & Betty's Cafeteria. Motion carried.
Communication from the City of South Gate, dated April 6,
1961. transmitting a copy of a letter submitted to the South Gate
City Council by Mayor Milo De1lman setting forth various reasons
why all city councilmen should attend both the U.S. Conference of
Mayors in Washington in June and the American Municipal Association
Conference in Seattle in August, was read.
It was moved by Malburg, seconded by Mailliard, that
communication from the City of South Gate, dated April 6, 1961, be
received and filed. Motion carried.
Communication from Law Offices of Rose. Klein & Marias,
dated April 12, 1961, transmitting Claim for Damages for Personal
Injury for their client, Bessie C. Bartley, was read.
It was moved by Anderson, seconded by Poxon, that Claim
for Damages for Personal Injury filed by the Law Offices of Rose,
Klein & Marias, under date of April 12, 1961, for their client,
Bessie C. Bartley, be denied. Motion carried.
Communication from J. S. Colton, Building Engineer, dated
April 11, 1961, requesting that E. H. Malkemus be reimbursed the sum
of $50.00 for a course on Inspection of Prestressed Concrete
Structures to be given by T. Y. Lin and Associates in cooperation
with the Los Angeles Department of Building and Safety for the
training of Registered Deputy Building Inspectors, on May 1. 4 & 6,
1961, was read.
It was moved by Anderson, seconded by Poxon, that the
request of the Building Engineer, dated April 11, 1961, be approved
and authority granted to issue warrant to E. H. Malkemus in the
amount of $50.00. Motion carried.
Communication from R. H. Bockhacker, Police Chief, dated
April 7, 1961, recommending that Officer C. F. Johnson be reimbursed
the sum of $10.68 from the Education and Training Budget appropri-
ation for tuition and books at East Los Angeles College in connection
with his courses in Police Science, was read.
It was moved by Anderson, seconded by Poxon, that the
recommendation of the Police Chief, dated April 7. 1961, be approved
and authority granted to issue warrant to C. F. Johnson in the
amount of $10.68. Motion carried.

request of the Health Officer, dated April 6, 1961, be approved and
authority granted to issue warrant to Vincent P. Kelley in the
amount of $15.00. Motion carried.

April 12, 1961, reporting further on employee, Mr. Jack wallace,

cation from the Engineering Departments, dated April 12, 1961, be

Communication from the Engineering D~partments, dated
April 12, 1961, requesting authority to employ Mr. Robert B. Bennett
as Engineering Aide II, Step 3, effective April 12, 1961, was read.
It was moved by Poxon, seconded by Anderson, that the
request of the Engineering Departments, dated April 12, 1961, be
approved. Motion carried.
Communications from the Engineering Departments, dated
April 7, 19G1, requesting authority to advance Clifford W. Blanton
to Utility Man III, Step 3, and Victor H. Vaits to Civil Engineering
Assistant, Step 2, both effective May 1, 1961, as both have satis-
factorily completed their probationary periods, were read.

requests of the Engineering Departments, dated April 7, 1961, be

Communication from Metal Supply Inc. requesting a license
to conduct a business of distributing metals and metal products at
2070 E. 37th St., was read.
It was moved by Poxon, seconded by Mai1liard, that the
request of Metal Supply Inc. be referred to the Police Department
with power to act. Motion carried.
Communication from C. E. Nemethi, M.D., Health Officer,
dated April 14, 1961, requesting that Rachel Richter be reimbursed
the sum of $42.25 expended for attendance at the Industrial Health
Conference, Biltmore Hotel, Los Angeles, from April 11 to April 14,
1961, was read.
It was moved by Anderson, seconded by Poxon, that the
request of the Health Officer, dated April 14, 1961, be approved
and authority granted to issue warrant to Rachel Richter in the
amount of $42.25. MOtion carried.
Communication from Maywood Glass Cafe requesting a license
to operate a cafe at 5601 District Blvd., was read.
It was moved by Poxon, seconded by Mail1iard, that the
request of Maywood Glass Cafe be referred to the Health Department
with power to act. MOtion carried.
Communication from the Vernon Lions Club, dated April 14,
1961, advising that llOperation Abolition', newsreel film of the
rioting at the House Committee on Un-American Activities at San
Francisco's City Hall, in May of 1960, will be shown at a luncheon
meeting of the Vernon Lions Club at the La Villa Basque Restaurant,
on Thursday, April 27, at 12 o'clock noon, and extending an
invitation to the City Council, Department Heads and employees of
the City to attend, was read. (Copy to each member of the City

cation from the Vernon Lions Club, dated April 14, 1961, be received

Communication from the Southern California MG Owners
Association, dated April 13, 1961, requesting permission to use the
lot behind the Fire Station on Soto Street on June 18, 1961 for the

purpose of holding a championship slalom, a maneuverability contest
in which cars are timed through a course that is defined by rubber
pylons, was read. (Copy to each member of the City Council)
It was moved by Anderson, seconded by Malburg, that the
request of the Southern California MG owners Association, dated
April 13, 1961, be denied. MOtion carried.
Communication from R. H. Bockhacker, Police Chief, dated
April 14, 1961, requesting that A. E. Chrisman be advanced from
Lieutenant, Grade 3 to Grade 2, effective May 16, 1961, was read.
It was moved by Anderson, seconded by Mailliard, that the
request of the Police Chief, dated April 14, 1961, be approved.

Communication from The Regional Planning Commission -
County of Los Angeles, dated April 14, 1961, advising that Columbia
Felt Company has applied for an exception to the M-2 Zone, in order
to establish, operate and maintain an addition to an existing
industrial building without providing the required additional off-
street parking spaces, on property located at 1426 East Slauson
Avenue, was read.
It was moved by Anderson, seconded by Poxon, that communi-
cation from The Regional Planning Commission - County of Los Angeles,
dated April 14, 1961, be received and filed. MOtion carried.
Communication from R. H. Bockhacker, Police Chief, dated
April 17, 1961, requesting authority for Sgt. M. A. deRuyter to
attend The California Check Investigators. Association Annual
Training Institute at Santa Rosa, California, on April 27 & 28, 1961,
with an expense allowance of $152.00, was read.
It was moved by Anderson, seconded by Poxon, that the
request of the Police Chief, dated April 17, 1961, be approved and
authority granted to issue warrant to M. A. deRuyter in the amount
of $152.00. Motion carried.
Communication from Star Processing Company requesting a
license to conduct a business of grease processing at 3846 Bandini

Resolution No. 24,4,1 - A Resolution of the City Council of
the City of Vernon opposing consolidation of the Municipal Court
Districts of Los Angeles. California, was read.
It was moved by Poxon, seconded by Malburg, that
Resolution No. 2441 be approved and adopted. Motion carried.

Communication from Serv-U Meat Packing Co. requesting a
license to conduct a business of meat packing at 4100 E. Sandini
Blvd., was read.
It was moved by Anderson, seconded by Poxon, that the
request of Serv-U Meat Packing Co. be referred to the Health Depart-
ment with power to act. Motion carried. (Pre-existing use prior to
adoption of Ordinance No. 736)
Ordinance No. 738 - An Ordinance of the City of Vernon
approving the annexation of certain uninhabited territory designated
'Atlantic Annexation No. Ii' to the City of Vernon, was read in full
for a first reading.
It was moved by Anderson, seconded by Poxon, that Ordinance
No. 738 receive and pass a first reading. Motion carried.

Ordinance No. 738 - An Ordinance of the City of Vernon
approving the annexation of certain uninhabited territory designated

second reading by title.
It was moved by Malburg, seconded by Poxon, that Ordinance
No. 738 receive and pass a second reading. Motion carried.

Discussion was held with reference to deducting liquidated
damages from the final payment to Integrated, Inc. for construction
of Fire Station No.3 in accordance with Specifications No. 229.
It was moved by Anderson, seconded by Paxon, that the
portion of Section 2 of Resolution No. 2419 pertaining to the balance
of $12,247.60 payable to Integrated Inc. thirty-five (35) days after
adoption of said Resolution be rescinded; that City of Vernon Warrant
No. 5091, dated April 4, 1961, in the amount of $12,247.60, which
was approved for payment by the City Council on ~pril 4, 1961, as
one of the Demands included in "Warrant Register No. 90", be re-
deposited in the United California Bank to the General Fund of the
City of Vernon; that liquidated damages in the amount of $7,550.00,
based on 151 days at $50.00 per day for each day's delay over
one hundred sixty-five (165) calendar days after commencement of
work, be deducted from the final payment; and that authority be
granted to issue new warrant in the amount of $4,697.60 payable to
Integrated, Inc. Motion carried.
