MINUTES OF AN ADJOURNED REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY OF
VERNON HELD MARCH 30, 1962 AT 9:30
O'CLOCK A.M. IN THE COUNCIL CHAMBER OF
THE CITY HALL LOCATED AT 4305 SANTA FE
AVENUE , VERNON, CALIFORNIA.
COUNCIL PRESENT: Anderson. Furlong, Mailliard, Malburg, Poxon
COUNCIL ABSENT: None
The meeting was called to order by Mayor R. J. Furlong.
It was moved by Poxon. seconded by Anderson, that minutes
of the meeting of March 20, 1962 be approved as written and
submitted. Motion carried.
Communication from Montebello Meat Packing Company dba
"Hi-Pro" requesting a license to conduct a meat packing business at
4361 So. So to Street, was read.
It was moved by Poxon. seconded by Malburg, that the
request of Montebello Meat Packing Company dba "Hi-Proll be referred
to the Health Department with power to act. Motion carried.
Communication from Diamond W Supply requesting a license
to conduct a business of fabricating panel products at 4330 District
Blvd., was read.
It was moved by Poxon, seconded by Anderson, that the
request of Diamond W Supply be approved and license granted. Motion
carried.
Communication from Restcraft Company requesting a license
to conduct a business of mattress manufacturing at 2528 Santa Fe
Avenue. was read.
It was moved by Poxon, seconded by Anderson, that the
request of Restcraft Company be referred to the Fire Department with
power to act. Motion carried.
Communication from California Protein Products Company
requesting a license to conduct a business of rendering poultry
by-products at 3300 Bandini Blvd., was read.
It was moved by Poxon, seconded by Malburg, that the
request of California Protein Products Company be referred to the
Health Department with power to act. Motion carried.
Franchise Report of the American District Telegraph Company
on Ordinance No. 166 for year ending February 28, 1962, together with
check in the amount of $4,032.60, was read.
It was moved by Anderson, seconded by Poxon, that Franchise
Report of the American District Telegraph Company be received and
filed. Motion carried.
Franchise Report of the Southern California Gas Company
on Ordinance No. 607 for year ending December 31, 1961, together
with check in the amount of $69,685.83, was read.

It was moved by Anderson, seconded by Pox on , that Franchise
Report of the Southern California Gas Company be received and filed.
Motion carried.
Communication from Congressman Clyde Doyle, dated March 21,
1962, with reference to the establishment of a separate Post Office
in the City of Vernon, was read. (Copy to each member of the City
Council)
It was moved by Poxon, seconded by Malburg, that communi-
cation from Congressman Clyde Doyle, dated March 21, 1962, be
received and filed. Motion carried.
Communication from the East Central Area Planning Committee,
dated March 22, 1962, advising of a pending transportation study in
the East Central Area, and requesting that the City of Vernon submit
possible changes to the County Master Plan of Streets and Highways
with respect to Vernon's own Master Plan of Highways, was read.

It was moved by Anderson, seconded by Poxon, that communi-
cation from the East Central Area Planning Committee, dated March 22,
1962, be referred to the Traffic Engineer for study and report.
Motion carried.
Communication from the Los Angeles County Board of Super-
visors, dated March 22, 1962, advising that the Board adopted an
order supporting the attached Resolution which was introduced in the
State Senate by Senator Richard Richards and was proposed to be
introduced in the Assembly by Assemblymen Howard Thelin and Chet
Wolfrum on March 20, relative to legislative intention in the
enactment of state laws affecting the police power of cities and
counties, was read. (Copy to each member of the City Council)
Resolution No. 2544 - A Resolution of the City Council of
the City of Vernon supporting a Senate Resolution introduced by
Senator Richard Richards of Los Angeles County urging the legis-
lature of the State of California to express its intent regarding
the jurisdiction of local agencies to enforce vice ordinances, was
read.
It was moved by Malburg, seconded by Mailliard, that
Resolution No. 2544 be approved and adopted. Motion carried.

Communication from Supervisor Frank G. Bonelli, dated
March 26, 1962, transmitting a documentary which he has forwarded
to Assemblyman Milton Marks, Chairman of the Assembly Constitutional
Amendments Committee, relative to his "New Bonelli Plan" of State
reapportionment, and requesting that if the City Council concurs
in approval of the "New Bonelli Plan", it wire approval to members
of the State Legislature, was read. (Copy to each member of the
City Council)
It was moved by Anderson, seconded by Poxon, that communi-
cation from Supervisor Frank G. Bonelli. dated March 26, 1962, be
received and filed. Motion carried.

Communication from D. D. Grayson, Traffic Engineer, dated
March 28, 1962, requesting authority fOl: Gaylon R. Claiborne to
attend Fundamentals of Traffic Engineering School at the University
of California at Los Angeles from June 25 to 29, 1962, with an
expense allowance of $64.75, was read.
It was moved by Poxon, seconded by Anderson, that the
request of the Traffic Engineer, dated March 28, 1962, be approved
and authority granted to issue warrant in the amount of $64.75 to
Gaylon R. Claiborne. Motion carried.
Communication from D. D. Grayson, Traffic Engineer, dated
March 27, 1962, requesting authority for J. Persons to attend
Fundamentals of Traffic Engineering School at the University of
California at Los Angeles from June 25 to June 29, 1962, with an
expense allowance of $48.95, was read.
It was moved by Poxon, seconded by Anderson, that the
request of the Traffic Engineer, dated March 27, 1962, be approved
and authority granted to issue warrant in the amount of $48.95 to
J. Persons. Motion carried.
Communication from D. D. Grayson, Traffic Engineer, dated
March 27, 1962, requesting authority for James W. Williams to attend
Fundamentals of Traffic Engineering School at the University of
California at Los Angeles from June 25 to 29, 1962, with an expense
allowance of $48.75, was read.
It was moved by Poxon, seconded by Anderson, that the
request of the Traffic Engineer, dated March 27, 1962, be approved
and authority granted to issue warrant in the amount of $48.75 to
James W. Williams. Motion carried.
Communication from C. E. Nemethi, M.D., Health Officer,
dated March 26, 1962, requesting time off for Rachel Richter to
participate in a symposium on liThe Role of the Occupational Health
Nurse in the Development and Administration of a Health Program in
Industry" at Los Angeles State College from June 11 to 15, 1962,
was read.
It was moved by Poxon, seconded by Mailliard, that the
request of the Health Officer, dated March 26, 1962, be approved.
Motion carried.
Communications from C. E. Nemethi, M.D., Health Officer,
dated March 26, 1962, requesting authority for Louis S. Hauger and
Rachel Richter to attend the Western Safety Congress and Exhibits
at the Ambassador Hotel, Los Angeles, California, from April 17 to
19, 1962, with an expense allowance of $16.50 each, were read.
It was moved by Mailliard, seconded by Malburg, that the
requests of the Health Officer, dated March 26, 1962, be approved
and authority granted to issue warrants in the amount of $16.50
each to Louis S. Hauger and Rachel Richter. Motion carried.
Communication from R. H. King, Superintendent, Water &
Sewer Systems, dated March 29, 1962, requesting authority for J. W.
Williams to attend the A.W.W.A. California Section Spring Conference
at Yosemite, California, on April 26 & 27, 1962, with an expense
allowance of $106.00, was read.

It was moved by Anderson, seconded by Poxon, that the
request of the Superintendent, Water & Sewer Systems, dated March
29, 1962, be approved and authority granted to issue warrant in
the amount of $106.00 to J. W. Williams. Motion carried.
Communication from D. D. Grayson, Traffic Engineer, dated
March 30, 1962, requesting that Francis W. Sumner be reimbursed
the sum of $13.50 for expenses incurred while attending the Annual
Publicity Clinic conducted by the Publicity Club of Los Angeles
held at the Ambassador Hotel, was read.
It was moved by Anderson, seconded by Poxon, that the
request of the Traffic Engineer, dated March 30, 1962, be approved
and authority granted to issue warrant in the amount of $13.50 to
Francis W. Sumner. Motion carried.
Resolution No. 254.3 - A Resolution of the City Council of
the City of Vernon authorizing the execution of an Agreement between
the Department of Public Works, Division of Highways and the City
of Vernon, was read.
It was moved by Anderson, seconded by Poxon, that
Resolution No. 2543 be approved and adopted. Motion carried.

Resolution No. 2545 - A Resolution of the City Council of
the City of Vernon opposing federal taxation of interest derived
from public bonds, was read.
It was moved by Poxon, seconded by Malburg, that
Resolution No. 2545 be approved and adopted. Motion carried.

Mr. R. E. Whyte of Haskins & Sells, Certified Public
Accountants, presented a memorandum dated March 29, 1962 entitled
"Southern California Ediso~ Company and City of Vernon - Memorandum
of Understanding Re Various Matters Relating to Proposed Long-Term
Operating Agreement Relating to Vernon Electric System".
The Administrative Officer made a general statement
indicating that the proposals and procedures outlined in the
memorandum would result in the operation of the City's electrical
system at a cost to the City, which would be the same or less than
if the City of Vernon were to operate the system using its own
personnel and facilities. Mr. Whyte reviewed the memorandum,
explaining each paragraph. Mr. Donald K. Hall of Darling, Shattuck,
Hall & Call, Special Counsel to the City of Vernon, and V. R. Poxon,
City Attorney, commented upon the memorandum and related matters,
and among other observations, expressed the opinion that the City
was faced with two alternatives at the present time; one being to
continue the Agreement of June 20, 1961 in force until the actual
details of a long term operating agreement could be worked out with
Edison and put in force; the other being to enter into a proposed
temporary agreement, having the effect of giving Vernon possession
of the system as of April 3, 1962, which latter alternative would
appear to result in a greater financial return to the City.

The Administrative Officer distributed copies of a draft
of an agreement entitled "Temporary Operating Agreementil.
At this.time, 11:00 o'clock a.m., it was moved by Anderson,
seconded by Malburg, that the meeting recess for thirty (30)mtnutes
to permit members of the City Council to study the draft of an
agreement entitled "Temporary Operating Agreement". Motion carried.
The meeting .reconvened at 11:30 o'clock a.m.
It was moved by Malburg, seconded by Mail1iard, that the
City Clerk and the City Treasurer be authorized and directed to pay
the sum of $3,480,000.00 to Edison on April 2, 1962 in acco.rdance
with the terms of the Agreement of June 20, 1961, subject to written
opinion from the City Attorney and Special Counsel that said payment
is . a legal and proper. expenditure of funds. Motion carried.

It was moved by Anderson, seconded by Poxon,that the
Mayor and the City Clerk be authorized and directed to execute
agreement with Edison substantially in accordance with the draft
of the aforementioned temporary operating agreement, provided that
the maximum term to be contained therein be from April 3, 1962 to
and including December 31, 1962, and subject toear1y termina.tion by
sixty (60) days written notice from Vernon to Edison, and subject to
termination by Edison on six (6) months written notice to Vernon;
and that the memorandum entitled "Southern California Edison Company
and City of Vernon .. Memorandum of understanding Re Various Matters
Relating to Proposed Long-Term Operating Agreement Relatin8 to Vernon
Electric System" be attached to the temporary operating agreement,
with the stipulation that the memorandum does not constitute an
agreement between the parties as such, but only for the purpose of
aiding.and clarifying with respect to the terms of the temporary
operating agreement. Motion carried.

It was moved by Mailliard, seconded by Poxon, that the
City Clerk and the City Treasurer be authorized and directed to
deposit with Edison, concurrently with the payment of the afore-
mentioned $3,480,000.00, the sum of $175,000.00 pursuant to the
provisions of the temporary operating agreement relative to the
maintenance of. inventory. Motion carried.

it was moved by Mailliard, seconded by Malburg, that the meeting
