19620807 Regular City Council Meeting - Minutes I I MINUTES OF A REGULAR MEETING OF THE CITY COlmCIL OF THE CITY OF VERNON HELD AUGUST 7, 1962 AT TWO O'CLOCK P.M. IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE! VERNON! CALIFORNIA. COUNCIL PRESENT: Anderson, Furlong, Mailliard, Malburg, Poxon COUNCIL ABSENT: None The meeting was called to order by Mayor R. J. Furlong. It was moved by Poxon, seconded by Anderson, that minutes of the meeting of July 17, 1962 be approved as written and submitted. Motion carried. The Clerk announced that this was the time and place for opening of bids received for the furnishing of two dump trucks in accordance with Contract No. 278. It was moved by Poxon, seconded by Malburg, that the Clerk be instructed to open and read the bids submitted. Motion carried. The Clerk opened and read the following bid: Ben Barclay Motors $ 9,447.90 It was moved by Anderson, seconded by Malburg, that bid received for the furnishing of two dump trucks, in accordance with Contract No. 278, be referred to the Engineering Departments and the City Attorney for checking and report. Motion carried. Communication from D. D. Grayson, Traffic Engineer, dated June 14, 1962, transmitting a report on Bandini Boulevard Extension; recommending that the City take the necessary action to amend the Highway Master Plan for the Metropolitan Area, County of Los Angeles, extending Bandini Boulevard, and that the exact alignment of said street be determined so that steps can be taken to reserve the required right-of-way; and recommending that the Traffic Engineer be authorized to investigate possible ways to obtain financial assistance in accomplishing the construction of the new street, was read. (Copy to each member of the City Council) (Tabled temporarily for further study at the meeting of 6/19/62) Mr. G. N. Ramseyer, Operations Department, and Mr. Richard H. Zahm, Jr., Counsel, of Mobil Oil Company, appeared before the City Council with reference to proposed acquisition of right-of-way through Mobil's property. It was moved by Mai1liard, seconded by Anderson, that the City take the necessary action to amend the Highway Master Plan for the Metropolitan Area, County of Los Angeles, to extend Bandini Boulevard, and that the exact alignment of said street be determined so that steps can be taken to reserve the required right-of-way; that the Traffic Engineer be authorized to investigate possible ways to obtain financial assistance in accomplishing the construction of the new street; that the Traffic Engineer be authorized to negotiate with Mobil Oil Company for the acquisition of the necessary right- of-way and to report the result of said negotiations to the City I -2- 8/7/62 Council; and that if negotiations with Mobil Oil Company for the acquisition of the necessary right-of-way are not successful, that the amendment to the Master Highway Plan for the Metropolitan Area, County of Los Angeles, extending Bandini Boulevard, be rescinded. Resolution No. 2570 - A Resolution of the City Council of the City of Vernon approving Contract No. 285 and Plan Number P 1680 for Bandini Boulevard Improvement, Downey Road to Ayers Avenue, and determining the general prevailing rate of per diem wages, was read. It was moved by Anderson, seconded by Poxon, that Resolution No. 2570 be approved and adopted. Motion carried. It was moved by Poxon, seconded by Mailliard, that Resolution No. 2571 be approved and adopted. Motion carried. King, Superintendent, Water & Sewer Systems, dated August 2, 1962, submitting Contract No. 284 for Booster Plant No. 3 Remote Control and Report-Back System, and recommending that said contract be approved and that authority be granted to advertise for bids, was read. Resolution No. 2572 - A Resolution of the City Council of the City of Vernon approving Contract No. 284 and Plan No. WS 1681 for the Booster Plant No. 3 Remote Control and Report-Back System, and determining the general prevailing rate of per diem wages, was read. It was moved by Mailliard, seconded by Malburg, that Resolution No. 2572 be approved and adopted. Motion carried. It was moved by Anderson, seconded by Mail1iard, that communication from the Los Angeles County Boundary Commission, dated July 17, 1962, be received and filed. Motion carried. Communication from the Central Basin Water Association, dated July 16, 1962, extending an invitation to attend the next regular meeting of the Board of Directors of said Association at the Huntington Park Elks Club on Thursday, August 2, 1962, was read. It was moved by Anderson, seconded by Poxon, that communi- cation from the Central Basin Water Association, dated July 16, 1962, be received and filed. Motion carried. Summons to appear in Action No. 797678 brought against the County of Los Angeles, the City of Vernon, John R. Quinn as Assessor of the County of Los Angeles, and Harold J. Ost1y, as Treasurer and Tax Collector of the County of Los Angeles by D. N. & E. Walter & Co., a California corporation, in the Superior Court of the State of California, in and for the County of Los Angeles, for refund of taxes paid under protest, was read. It was moved by Anderson, seconded by Mai11iard, that Summons to appear in Action No. 797678, in the Superior Court of the State of California, in and for the County of Los Angeles, be received and filed. Motion carried. Communication from Crosetti Bros., Inc., dated July 1, 1962, advising that the billing for janitorial services in the new Police Department Building will be increased in the amount of $13.50 per month, effective as of August 1, 1962, due to a wage increase to their employees belonging to the Service and Maintenance Employees' Union, was read. (New monthly charge will be $278.63 as compared to present $265.13) It was moved by Anderson, seconded by Mail1iard, that the increased billing by Crosetti Bros., Inc., in the amount of $13.50 per month, effective as of August 1, 1962, for janitorial services in the new Police Department Building, be approved. Motion carried. Communication from Southern California Edison Company, dated July 26, 1962, setting forth the suggested procedure for handling the settlement of the accounts of Edison and Vernon and the amounts payable by the respective parties as of April 2, 1962, and requesting that if the suggested procedure for handling the settlement of accounts of Edison and Vernon and the amounts payable by the respective parties as specified are satisfactory, the City of Vernon indicate its acceptance thereof on the carbon copy of said letter, and return the same to Edison for their records, was read. (Copy to each member of the City Council) I I -4- 8/7/62 It was moved by Mailliard, seconded by Anderson, that communication from Southern California Edison Company, dated July 26, 1962, be referred to the City Attorney and Special Counsel for an opinion relative to the legal requirements involved, if any, in connection with said settlement, and be referred to Haskins & Sells for an opinion as to the correctness of the amounts payable by the respective parties as specified in said letter. Motion carried. Communication from Cooper, Butler & Cooper, Attorneys at Law, dated July 22, 1962, with reference to contract between the City of Vernon and Integrated Constructors and Engineers, Inc. for the construction of Fire Station No. 3 in accordance with Specifi- cations No. 229, requesting that the City of Vernon provide Integrated with an opportunity to present data concerning the delays during construction of Fire Station No. 3 and causes therefor, was read. (Copy to each member of the City Council) It was moved by Anderson, seconded by Mailliard, that in accordance with the request of Cooper, Butler & Cooper, Attorneys at Law, dated July 22, 1962, Integrated Constructors & Engineers, Inc. be granted an opportunity to be heard at the meeting of the City Council to be held on September 18, 1962 and present data concerning the delays during construction of Fire Station No. 3 and causes therefor, provided that Integrated supply a complete summary in outline form of the points it proposes to cover in the hearing, and provided that said summary is delivered to the City Clerk no later than ten (10) days before the date of the hearing. Motion carried. Communication from County of Los Angeles, Department of Auditor-Controller, dated July 20, 1962, addressed to the Admini- strative Officer, advising that an overpayment in the amount of $2,974,.49 was made to the City of Vernon as a distribution of the assets of the East Los Angeles Fire Protection District due the City of Vernon upon the withdrawal of the Vernon-Riverside annexation from the District, and requesting that the amount overpaid be returned to the East Los Angeles Fire Protection District, was read. (Copy to each member of the City Council) It was moved by Anderson, seconded by Poxon, that the request of the County of Los Angeles, Department of Auditor- Controller, dated July 20, 1962, be approved and authority granted to issue warrant in the amount of $2,974.49 to East Los Angeles Fire Protection District. Motion carried. Copy of Resolution No. 62-43-321 of the City Council of the City of Irwinda1e affirming its approval and support of portions of H.R. 11199 relating to extension of federal-aid secondary system urban areas, was read. It was moved by Anderson, seconded by Poxon, that copy of Resolution No. 62-43-321 of the City Council of the City of Irwindale, be received and filed. Motion carried. Communication from Milt Myers, General Contractor, requesting a license to conduct a business of contracting and appli- cation of aluminum siding, at 2947 E. 44th Street, was read. Communication from Cincinnati Milling & Grinding Machines, Inc. requesting a license to conduct a business of selling machine tools, lubricants and grinding wheels at 3850 Santa Fe Avenue, was read. It was moved by Poxon) seconded by Mailliard, that the request of Cincinnati Milling & Grinding Machines, Inc. be approved and license granted. Motion carried. Communication from Amchem Products Inc. requesting a license to operate a sales office at 4210 Charter Street) was read. It was moved by Anderson, seconded by Poxon, that the request of Amchem Products Inc. be approved and license granted. Motion carried. Communication from Crawford-Egan Co. requesting a license to conduct a business of polyurethane foam insulation at 2150 E. 37th Street, was read. It was moved by Malburg, seconded by Mailliard, that the request of Crawford-Egan Co. be referred to the Fire Department with power to act. Motion carried. Communication from the Engineering Departments, dated July 18, 1962, requesting authority to employ Dale S. Lucas as Utility Man IV, Step 5, effective July 23, 1962, was read. It was moved by Anderson, seconded by Poxon, that the request of the Engineering Departments, dated July 18, 1962, be approved. Motion carried. Communication from D. D. Grayson, Traffic Engineer, dated July 31, 1962, with reference to the request of Mr. P. T. Keenan, Keenan Pipe and Supply Company, for the installation of traffic control signals at the intersection of Santa Fe Avenue and 27th Street, recommending that the request be denied for the reasons as outlined, was read. (Copy to each member of the City Council) It was moved by Malburg, seconded by Mailliard, that communication from the Traffic Engineer, dated July 31, 1962, be laid over until the next regular meeting. Motion carried. Communication from D. D. Grayson, Traffic Engineer, dated July 25, 1962, advising that the general contractor for Contract No. 273 is unable to complete the work within the time limits specified in the contract for reasons beyond his control, and recommending that an extension of time of 45 calendar days be granted, was read. It was moved by Anderson, seconded by poxon, that the recommendation of the Traffic Engineer, dated July 25, 1962, be approved. Motion carried. I I -6- 8/7/62 Communication from the Engineering Departments, dated August 1, 1962, advising that William H. Morrison, Engineering Clerk II, has requested two weeks' leave of absence to participate in Annual Active Duty for training with the California Air National Guard beginning August 20, 1952, and recommending that Mr. Morrison be granted leave of absence with pay for this period, was read. It was moved by Poxon, seconded by Malburg, that the recommendation of the Engineering Departments, dated August 1, 1962, be approved. Motion carried. Communication from the Engineering Departments, dated August 1, 1962, requesting authority to reclassify Victor H. Vaits to Civil Engineering Associate, Step 3, effective August 1, 1962, was read. It was moved by Anderson, seconded by Poxon, that the request of the Engineering Departments, dated August 1, 1962, be approved. Motion carried. Communication from D. D. Grayson, Traffic Engineer, dated July 31, 1962, transmitting a report on parkway tree planting, and recommending that the City Council approve the comprehensive City- v!ide Parkway Planting Plan, as outlined in said report; and approve the replanting of Leonis Boulevard in accordance with the plans attached to said report, was read. (Copy to each member of the City Council) It was moved by Anderson, seconded by Poxon, that the recommendation of the Traffic Engineer, dated July 31, 1962, be approved. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated July 30, 1962, requesting authority to have Motorola Radio install an extender kit on the main radio station on a trial basis, and requesting authority to purchase the equipment at a cost of $91.50 if it proves satisfactory, was read. (Copy to each member of the City Council) It was moved by Poxon, seconded by Anderson, that the requests of the Police Chief, dated July 30, 1962, be approved. Motion carried. Communication from L. C. Husted, Fire Chief, dated July 30, 1962, advising that Fireman K. M. Slifka has received orders from Commanding Officer, Company llG", United States l'1arine Corps Reserve to attend Annual Field Training (Summer Camp) scheduled for August 18 to September 1, 1962, inclusive, and requesting that Fireman Slifka be granted a leave of absence with pay to perform his military duties, was read. It was moved by Mai11iard, seconded by Nalburg, that the request of the Fire Chief, dated July 30, 1962, be approved. Motion carried. Activity Log of the Police Department for the period July 16 - 31, 1962 inclusive, was presented. Communication from Bailey's Catering requesting a license to operate a lunch truck in the City of Vernon, was read. It was moved by Poxon, seconded by Anderson, that the request of Bailey's Catering be referred to the Health Department with power to act. Motion carried. Communication from the Engineering Departments, dated August 2, 1962, requesting authority to employ Henry R. Vasquez as Utility Man I, Step 3, effective September 1, 1962, was read. (Copy to each member of the City Council) It was moved by Mailliard, seconded by Anderson, that the request of the Engineering Departments, dated August 2, 1962, be approved. Motion carried. Communication from Don's Catering requesting a license to operate a lunch truck in the City of Vernon, was read. It was moved by Poxon, seconded by Anderson, that the request of Don's Catering be referred to the Health Department with power to act. Motion carried. Easement from Seaside Oil Company for road purposes in connection with the improvement of the intersection of Atlantic Boulevard and District Boulevard, was presented. It was moved by Anderson, seconded by Poxon, that Easement be accepted from Seaside Oil Company and that the Mayor and the City Clerk be authorized to execute Certificate of Acceptance. Motion carried. Resolution No. 2574 - A Resolution of the City Council of the City of Vernon finding and determining that the public interest and necessity require the acquisition of certain electric transmission lines, metering facilities, transformers and appurtenances and other related properties used or useful in supplying electric energy to the City of Vernon and certain electric consumers and customers within said City, and the inhabitants thereof, and the acquisition thereof by the City of Vernon by eminent domain proceedings of said properties by Southern California Edison Company, was read. It was moved by Poxon, seconded by Anderson, that Resolution No. 2574 be approved and adopted. Motion carried. Harris retired effective as of August 1, 1962 after 32 years of service with the Fire Department. "Warrant Register No. 122" covering claims and demands presented during the period July 16 to 31, which includes Demands Nos. 9310 to 9486 (both inclusive), drawn on the California Bank, totaling $63,738.29, and Demands Nos. 19 to 22 .(both inclusive), drawn on the California Bank Light and Power Fund, totaling $4,478.31 (accounting period August, 1962), was examined and audited. It was moved by Poxon, seconded by Mailliard,that "Warrant Register No. 122" be approved and payment authorized for Demands Nos. 9310 to 9486 (both inclusive) and Demands Nos. 19 to 22 (both inclusive), with no exceptions.
