19620918 Regular City Council Meeting - Minutes I I MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD SEPTEMBER 18, 1962 AT TWO O'CLOCK P.M. IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA COUNCIL PRESENT: Anderson, Furlong, Mailliard, Malburg COUNCIL ABSENT: Poxon The meeting was called to order by t.~yor R. J. Furlong. It was moved by Anderson, seconded by Malburg, that minutes of the meeting of September 4., 1962 be approved as written and submitted. Motion carried. Communication from Cooper, Butler & Cooper, Attorneys at Law, dated September 4, 1962, transmitting original Petition for Payment of Claim on behalf of Integrated, Inc. for consideration and action, was read. (Copy to each member of the City Council) Representatives of Integrated, Inc. attended the City Council meeting. Mr. Virgil J. Butler of the law firm of Cooper, Butler & Cooper, representing Integrated, Inc., and Mr. Don Muntz, Architect, of the firm Mason, Muntz & Associates, representing the City of Vernon, addressed the City Council concerning the delays during construction of Fire Station No.3. It was moved by Malburg, seconded by Mailliard, that communication from Cooper, Butler & Cooper, Attorneys at Law, dated September 4., 1962, together with original Petition for Payment of Claim on behalf of Integrated, Inc., be received for further study and consideration. Motion carried. Communication from J. S. Colton, Building Engineer, dated August 30, 1962, requesting permission for E. H. Malkemus, Building Inspector, to attend the Annual Business Conference of the Western Plumbing Officials Association in Salt Lake City, Utah, from October 22 to 26, 1962, inclusive, with an expense allowance of $257.94, was pr~sented for reconsideration. It was moved by Malburg, seconded by Anderson, that the request of the Building Engineer, dated August 30, 1962, be approved a.nd authority granted to issue warrant in the amount of $257.94 to E. H. Malkemus. Motion carried. Ordinance No. 742 - An Ordinance of the City of Vernon accepting the requirements of Section 13522 of the Penal Code relating to training of Law Enforcement Officers, was read for a third and final reading by title. Inc. requesting a license to conduct a freight transportation business at 4641 Hampton Street, was read. It was moved by Anderson, seconded by Malburg, that the request of Dependable Service Trucking Co. Inc. be approved and license granted. Motion carried. Communication from West Shaw Distributing Co. requesting a license to conduct a business of distributing books at 2110 East 25th Street, was read. It was moved by Anderson, seconded by Yalburg, that the request of West Shaw Distributing Co. be referred to the Police Department with power to act. Motion carried. Communication from Packaging Corporation of America requesting a license to conduct a business of packaging various materials at 4633 Downey Road, was read. It was moved by Mailliard, seconded by Anderson, that the request of Packaging Corporation of America be referred to the Fire Department and the Health Department with power to act. Motion carried. Communication from Fiscal & Financial Services, Inc. requesting a license to conduct a bookkeeping service business at 4575 Pacific Blvd., was read. It was moved by Anderson, seconded by Mailliard, that the request of Fiscal & Financial Services, Inc. be approved and license granted. Motion carried. Communication from Shu-Mak-Up, Inc., dated September 12, 1962, requesting that the curb be painted green from the front door east to the end of their building located at 3317 E. 50th Street, was read. (Copy to each member of the City Council) It was moved by Malburg, seconded by Mailliard, that the request of Shu-Nak-Up, Inc., dated September 12, 1962, be referred to the Traffic Engineer for a report. Motion carried. Communication from Crosetti Bros., Inc., dated September 12, 1962, con~ending the Vernon Police Department, was read. (Copy to each member of the City Council) It was moved by Mailliard, seconded by Malburg, that communication from Crosetti Bros., Inc., dated September 12, 1962, be received and filed. Motion carried. Communication from the County of Los Angeles Road Department, dated September 12, 1962, advising that the City of Vernon's apportionment of 1962-63 Aid to Cities monies is $3,647.00, was read. Motion carried. Communication from the Los Angeles County Heart Association, dated August 31, 1962, requesting the City Council to give its whole- hearted support to the 1963 Heart Fund Campaign, was read. It was moved by Anderson, seconded by Mailliard, that communication from the Los Angeles County Heart Association, dated August 31, 1962, be received and filed. Motion carried. Communication from the Engineering Departments, dated September 5, 1962, transmitting a letter of resignation from Mr. Gaylon R. Claiborne, and recommending that Mr. Claiborne's resignation be accepted effective at the close of business on October 5, 1962, was read. It was moved by Anderson, seconded by Mailliard, that resignation of Mr. Gaylon R. Claiborne be accepted effective at the close of business on October 5, 1962. Motion carried. Communication from D. D. Grayson, Traffic Engineer, dated September 12, 1962, advising that Mr. Theodore Kusch has tendered his resignation effective at the close of business on September 11, 1962, and recommending that Mr. Kusch's resignation be accepted, was read. It was moved by Anderson, seconded by Malburg, that the resignation of Mr. Theodore Kusch be accepted effective at the close of business on September 11, 1962. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated September 7, 1962, requesting that Officer John R. Smith be advanced from Policeman Grade 4 to Grade 3, effective October 1, 1962, as he has satisfactorily completed his probationary period, was read. It was moved by Anderson, seconded by Malburg, that the request of the Police Chief, dated September 7, 1962, be approved. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated September 11, 1962, requesting that Sgt. Frank E. Sweeney be authorized to attend the F.B.I. Narcotics Training School in Washington, D.C., starting October 29,1962 and ending November 9, 1962, with an expense allowance of $630.90, was read. It was moved by Anderson, seconded by Malburg, that the request of the Police Chief, dated September 11, 1962, be approved and authority granted to issue warrant in the amount of $630.90 to Frank E. Sweeney. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated September 13, 1962, recommending that Lease Agreement between the City of Vernon and Motor Officer G. C. Robbins for one 1962 Harley- Davidson Motorcycle, Engine #62FL2963, be renewed effective September 25, 1962, was read. It was moved by ~~illiard, seconded by Malburg, that the recommendation of the Police Chief, dated September 13, 1962, be approved and that said lease agreement be renewed. Motion carried. Linke for one 1961 Har1ey- Davidson Motorcycle, Engine #61FLH3502, be renewed effective September 25, 1962, was read. It was moved by Mai11iard, seconded by Malburg, that the recommendation of the Police Chief, dated September 13, 1962, be approved and that said lease agreement be renewed. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated September 13, 1962, recommending that Lease Agreement between the City of Vernon and Motor Officer R. N. Baker for one 1961 Har1ey- Davidson Motorcycle, Engine #61FL1425, be renewed effective September 28, 1962, was read. It was moved by Mai11iard, seconded by Malburg, that the recommendation of the Police Chief, dated September 13, 1962, be approved and that said lease agreement be renewed. Motion carried. Report of Health Department activities for the month of August, 1962, was presented. (Copy to each member of the City Council) It was moved by Anderson, seconded by Mai11iard, that report of Health Department activities be received and filed. Motion carried. Communication from Harold W. Faber, Engineering Aide, dated September 13, 1962, requesting that he be reimbursed the sum of $235.76 from the Education and Training Budget appropriation for tuition and books in connection with his studies at the University of California in Engineering courses, together with recommendation for approval from the Engineering Departments, was read. It was moved by Anderson, seconded by Malburg, that the recommendation of the Engineering Departments be approved and authority granted to issue warrant in the amount of $235.76 to Harold W. Faber. Motion carried. Telegram from Pittsburgh-Des Moines Steel Co., dated September 7, 1962, requesting the City of Vernon to hold further action in abeyance pending study of contract by their counsel, was read. Communication from Pittsburgh-Des Moines Steel Co., dated September 14, 1962, with reference to contract for the construction of an elevated tank in accordance with Contract No. 253, requesting that the question of acceptability of appearance of the Vernon tank be referred to a committee of impartial individuals, qualified by experience, and mutually acceptable to the Vernon engineers and Pittsburgh-Des Moines Steel Co., with both parties agreeing to be bound by the decision of the committee, and both parties sharing equally in whatever expenses are incurred by the committee, was read. (Copy to each member of the City Council) Mr. R. H. King, Superintendent, Water & Sewer Systems, requested authority to engage the services of Robert W. Hunt, Engineers, by purchase order, at the rate of $100.00 per day, to inspect the elevated tank to determine if said tank meets AWWA standards. N 'J~ I I -5- 9/18/62 It was moved by Anderson, seconded by Mailliard, that communication from Pittsburgh-Des Moines Steel Co., dated September 14" 1962, be referred to the Engineering Departments for study and report; and that the Superintendent, Water & Sewer Systems, be authorized to engage the services of Robert W. Hunt, Engineers, by purchase order, at the rate of $100.00 per day, to inspect the elevated tank for the purpose of determining if said tank meets A~vA standards. Motion carried. Communication from Paul Nopar, Industrial Real Estate, requesting a license to conduct a real estate business at 4575 Pacific Blvd., was read. It was moved by Malburg, seconded by Mailliard, that the request of Paul Nopar, Industrial Real Estate, be approved and license granted. Motion carried. Communication from Lynn & Ike Catering dba Kopper Kart Catering requesting a license to operate a lunch truck in the City of Vernon, was read. It was moved by Anderson, seconded by Malburg, that the request of Lynn & Ike Catering dba Kopper Kart Catering be approved and license granted. Motion carried. Activity Log of the Police Department for the period September 1 - 15, 1962, inclusive, was presented. It was moved by Anderson, seconded by Malburg, that Activity Log of the Police Department be received and filed. Motion carried. Communication from Associated Freight Lines requesting a license to conduct a trucking business at 2580 Downey Road, was read. It was moved by Anderson, seconded by Malburg, that the request of Associated Freight Lines be approved and license granted. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated September 17, 1962, requesting authority to attend the Attorney General's All-Zone meeting of Chiefs of Police at Berkeley, California, from September 24 to 27, 1962, with an expense allowance of $136.23, was read. It was moved by Anderson, seconded by Malburg, that the request of the Police Chief, dated September 17, 1962, be approved and authority granted to issue warrant in the amount of $136.23 to R. H. Bockhacker. Motion carried. Copy of Amendment to Application No. 44.036 of the County of Los Angeles for the construction of a grade separation on Downey Road under The Atchison, Topeka and Santa Fe Railway tracks, Crossing No. 2-14,4..5, in the City of Vernon, California, before the Public Utilities Commission of the State of California, was read. (Copy to each member of the City Council) It was moved by Anderson, seconded by Mailliard, that copy of Amendment to Application No. 44086 before the Public Utilities Commission of the State of California be received and filed. Motion carried. I I -6- 9/18/62 Communication from Central Sheet Metal Works Inc. requesting a license to conduct a business of sheet metal fabrication at 2619-29 Santa Fe Avenue, was read. It was moved by Malburg, seconded by Mailliard, that the request of Central Sheet Metal Works Inc. be approved and license granted. Motion carried. A document entitled lfStipulation and Interim Agreement and Petition for Orderll in form for filing in the Superior Court of the State of California for the County of Los Angeles in Case No. 786,656, entitled iiCentral & West Basin Water Replenishment District v. Adams, et alii, was placed before the City Council, which stipulation and agreement provides for certain stipulations and restrictions affecting water rights and pumping rights of the City of Vernon and other water producers. After discussion, it was moved by Anderson, seconded by Malburg, that the Mayor and the City Clerk be authorized and instructed to execute said Stipulation and Interim Agreement on behalf of the City of Vernon. ~~tion carried. Mr. D. D. Grayson, Traffic Engineer, reported to the City Council that the Engineering Departments were planning on holding open house at the new Public Works Facility on October 17, 1962, provided that there were no objections by the City Council. Mr. Grayson requested that the City Council authorize the Mayor to sign a Proclamation requesting the general observance in Vernon of National Public Works Week, October 14 to 20, 1962. Motion carried. Communication from The Southeast Young Democrats of the 52nd Assembly District, dated September 13, 1962, addressed to Mr. John B. Moore, Administrative Officer, advising that the Southeast Young Demo's will honor Congressman Clyde Doyle on Saturday, September 29th, by leading an autocade through the various cities in the Southeast area, and requesting permission to include the City of Vernon on the autocade itinerary, was read. It was moved by Anderson, seconded by Mailliard, that The Southeast Young Democrats of the 52nd Assembly District be advised that the City Council would be pleased to have Congressman Doyle's autocade visit the City of Vernon, and that the communication from The Southeast Young Democrats of the 52nd Assembly District, dated September 13, 1962, be referred to the Police Department with a request that all appropriate courtesies be extended to said autocade.
