MINUTES OF A REGUlAR MEETING OF THE
CITY COUNCIL OF THE CITY OF VERNON
HELD SEPTEMBER 5, 1967 AT TWO O'CLOCK
P . M. IN THE COUNC IL CHAMBER OF THE
CITY HALL LOCATED AT 4305 SANTA FE
AVENUE, VERNON, CALIFORNIA.
COUNCIL PRESENT: Anderson, Furlong, Mail1iard, Malburg, Ybarra
COUNCIL ABSENT: None
The meeting was called to order by Mayor R. J. Furlong.
It was moved by Mailliard, seconded by Ybarra, that minutes
of the meeting of August 15, 1967 be approved as written and submitted
Motion carried.
Communication from Babcock-Phillips Corporation requesting
a license to conduct a business of manufacturing hassocks and replace-
ment cushions at 4464 District Blvd., was read.
It was moved by Anderson, seconded by Ybarra, that the
request of Babcock-Phillips Corporation be referred to the Building
Departmemt with power to act. Motion carried.
Communication from Jack Cornell & Associates requesting a
license to conduct a business of warehousing school supplies at 4770
E. 50th Street, was read.
It was moved by Mailliard, seconded by Malburg, that the
request of Jack Cornell & Associates be referred to the Building
DepartmE!nt with power to act. Motion carried.
Communication from Earl Bailey dba Bailey's Catering
requesti.ng a license to operate a lunch truck in the City of Vernon?
was read.
It w'as moved by Malburg, seconded by Mailliard, that the
request of Earl Bailey dba Bailey's Catering be approved and license
granted. Motion carried.
Summons to appear in Case Number 425531 brought by
Clarence D. Saunders against the City of Vernon and John L. Chav2Z,
Doe I, Doe II and Doe III, in the Municipal Court of Los Angeles
Judicial District, County of Los Angeles, State of California, fer
property damage caused by negligent act or omission of employee
within scope of employment, was presented.
It was moved by Malburg, seconded by Ybarra, that Summons
to appear in Case Number 425531 brought by Clarence D. Saunders
against the City of Vernon and John L. Chavez, Doe I, Doe II and
Doe III, in the Municipal Court of Los Angeles Judicial District,
County of Los Angeles, State of California, for property damage
caused by negligent act or omission of employee within scope of
employment, be referred to the City Attorney and the City's insurance
carrier for necessary action. Motion carried.
Communication from Southern California Edison Company,
dated August 21, 1967, transmitting original and duplicate copy of
a license between The Atchison, Topeka and Santa Fe Railway Comp~ny
and the City of Vernon (Railway's Document No. A-170G8) covering
the construction, maintenance and use of an electrical supply line

containing three conductors across or along the premises of Santa Fe
at or near the station of Hobart in the City of Vernon, was read.

It was moved by Mai11iard, seconded by Ybarra, that the
Mayor and the City Clerk be authorized and directed to execute~ on
behalf of the City of Vernon, License identified as The ~tchison,
Topeka and Santa Fe Railway Company's Document No. A-17008. Motion
carried.
Copy of Resolution No. 1967 -49 of the l~ocal Agency
Formation Commission of the County of Los Angeles making determina-
tions and approving the proposed annexation of territory, designated
as "Annexation No. 37" to County Sanitation District No.2, '\:..ras
presented.
It was moved by Anderson, seconded by Ybarra, that copy
of Resolution No. 1967-49 of the Local Agency Formation Commission
of the County of Los Angeles be received and filed. Motion carried.
Mr. Jack M. Brown, of J and M Processing and Rendering~
Inc., appeared before the City Council with reference to the
removal of a garage located at 3848 Bandini Blvd., within the
ultimate planned width of Bandini Blvd., and requested an extension
of time to permit the removal of the structure.
It was moved by Malburg, seconded by Ybarra, that J and
M Processing and Rendering, Inc. be authorized to retain the garag~
located at 3848 Bandini Blvd. until November 15, 1957, at which
time it should be demolished. Motion carried.
Communication from Motorola Communications and Electronics,
Inc., dated August 21, 1967, submitting a new upgraded Maintenance
Agreement covering the maintenance of radio equipment for the Police
and Fire Departments, was read. (Copy to each member of the City
Council)
It was moved by Mai11iard, seconded by Ybarra, that the
Mayor and the City Clerk be authorized to execute new upgraded
Maintenance Agreement submitted by Motorola Communications and
Electronics, Inc. covering the maintenance of radio equipment for
the Police and Fire Departments. Motion carried.
Communication from Vincent R. Bush, Superintendent of
Building, dated August 14, 1967, requesting authority to attend the
Annual Meeting - Structural Engineers Association of California ~t
Lake Tahoe from October 12 to 14, 1967, inclusive, with an expense
allowance of $231.40, was read.
It was moved by Malburg, seconded by Mai1liard, that the
request of the Superintendent of Building, dated August 14, 1967,
be denied. Motion carried.
Communication from C. E. Nemethi, M.D., Health Officer,
dated August 24, 1967, requesting authority to attend the California
Conference of Local Health Officers - Special Meeting on Regional
Planning at Burlingame, California, on August 30, 1967, with an
expense allowance of $45.25, was read.

It was moved by Anderson, seconded by Ybarra, that the
request of the Health Officer, dated August 24, 1967, be approved
and authority granted to issue warrant in the amount of $45.25 to
C. E. Nemethi, M.D. Motion carried.
Communication from C. E. Nemethi, M.D., Health Officer,
dated August 17, 1967, recommending that Mrs. Mayrose Snyder be
advanced from City Health Nurse Grade 2 to Grade 1, effective
Se?tember 1, 1967, was read.
It was moved by Mail1iard, seconded by Ybarra, that the
recommendation of the Health Officer, dated August 17, 1967, be
approved. Motion carried.
Communication from D. D. Grayson, Traffic Engineer, dated
August 24, 1967, outlining the understanding reached between the
Traffic Engineer and California Protein Products Company for the
acquisition of certain property located on Bandini Boulevard (private
street); and recommending that the City Council approve the
provisions as outlined and authorize the Mayor and the City Clerk
to execute the documents necessary to consummate the sale~ was
read. (Copy to each member of the City Council)
It was moved by Mail1iard, seconded by Ybarra, that the
recommendation of the Traffic Engineer~ dated August 24, 1967, be
approved; and that the Mayor and the City Clerk be authorized to
execute documents necessary to consummate the sale of certain
property, as outlined, to the City of Vernon by California Protein
Products Company. Motion carried.
Communication from D. D. Grayson, Traffic Engineer, dated
August 31, 1957, transmitting agreement form, executed by the City
of Huntington Park, for improvement of traffic signals at Boyle
and Slauson Avenues and recommending that the City Council approve
this agreement and that the Mayor and the City Clerk be authorized
to execute it on behalf of the City of Vernon, was read. (Copy to
each member of the City Council)
It was moved by Malburg, seconded by Anderson, that the
recommendation of the Traffic Engineer, dated August 31, 1967, be
approved; and that the Mayor and City Clerk be authorized to
execute agreement on behalf of the City of Vernon. Motion carried.
Communication from D. D. Grayson, Traffic Engineer, dated
August 29, 1967, transmitting an easement for street purposes from
National Cold Storage Company covering a portion of 51st Street,
and recommending that this easement be accepted and that the grantor
be advised of the official recordation, was read.
It was moved by Mai1liard, seconded by Ybarra, that
Easement be accepted from National Cold Storage Company and that
the Mayor and the City Clerk be authorized to execute Certificate
of Acceptance. Motion carried.
Communication from D. D. Grayson, Traffic Enginaer, dated
August 25, 1967, requesting authority to advance John Manok to
Construction Inspector, Step 1, effective September 1~ 1967; and
to reclassify Robert A. Galuppo from Engineering Aide 1, Step 4,
to Civil Engineering Assistant, Step 5, effective September 1, 1967,
was read. (Copy to each member of the City Council)

It was moved by Anderson, seconded by Ybarra, that the
requests of the Traffic Engineer, dated August 25, 1967, be approved.
Motion carried.
Communication from L. C. Husted, Fire Chief) and V. R. Buoh,
Superintendent of Building, dated August 31, 1967, transmitting
copy of letter from Roach Industrial Building Co., dated August 23,
1967, requesting extension of Permit #l8420; and recommending that
the request of Roach Industrial Building Co. be approved without
payment of additional fee, was read. (Copy to each member of the
City Council)
It was moved by Malburg, seconded by Ybarra, that the
recommendation of the Fire Chief and the Superintendent of Building,
dated August 31, 1967, be approved. Motion carried.
Communication from L. C. Husted, Fire Chief, dated August
25, 1967, requesting authority to purchase one air conditioner for
the dormitory at Fire Station No.4 at an estimated cost of $250.00,
was read.
It was moved by Mailliard, seconded by Anderson, that the
request of the Fire Chief, dated August 25, 1967, be approved.
Motion carried.
Activity Log of the Police Department for the period
August 15 - 31, 1967 inclusive, was presented.
It was moved by Malburg, seconded by Mailliard, that
Activity Log of the Police Department be received and filed. Motion
carried.
Communication from Law Offices of English, MacDowell &
Flanders, dated August 31, 1967, with reference to claim of the
City of Vernon against their client, Mr. James D. Borne, was read.

It was moved by Malburg> seconded by Mailliard, that the
offer of settlement of claim by English, MacDowell & Flanders,
dated August 31, 1967, for their client, Mr. James D. Borne, be
denied; and that the City Attorney be instructed to advise English,
MacDowell & Flanders, and further that the City Attorney be
authorized to settle the matter on a time-payment basis. Motion
carried.
The City Attorney reported orally that the escrow
instructions for the acquisition of the approximate 153 square feet
from the Estate of E. F. Alt, Deceased, and the Rich Manufacturing
Company were completed, and requesting that the Mayor and the City
ClerK be authorized to execute said escrow instructions.
It was moved by Mail1iard, seconded by Ybarra, that the
Mayor and the City Clerk be authorized to execute documents necessary
to consummate purchase of the abovementioned property. Motion
carried.
Resolution No. 2918 - A Resolution of the City Council of
the City of Vernon, extending its condolence on the passing of
Gilbert A. Anderson, former City Clerk of the City of Vernon, was
read.

It was moved by Malburg, seconded by Mailliard, that
Resolution No. 2918 be approved and adopted. Motion carried.

The following excavation applications, all having approval
of the Engineering Departments, were presented:
Application 27931 - Western Union Telegraph Co. to remove
pole and lateral cable from MH to pole
at SE corner 48th St. & Alameda St.
(E Rdwy).
Application 27932 - C. E. Nemethi, M.D. to construct side-
walk at 5600 Santa Fe Ave.
Application 27933 - Pacific Telephone Co. to place MH and
conduit in E/s Santa Fe Ave. S/o 28th
St.
Application 27934 - Pacific Telephone Co. to place MH and
conduit in E/s Santa Fe Ave. N/o
Fruitland Ave.
Application 27935 - Andrew Brown Co. to construct roof to
curb drain at 543l District Blvd.
Application 27936 - Central Manufacturing District, Inc. to
install railroad signal cables at NE
corner Leonis Blvd. & Seville Ave.
It was moved by Anderson, seconded by Ybarra, that
excavation applications numbered 27931 to 27936 inclusive be filed
and permits granted. Motion carried.
"Warrant Register No. 244" covering claims and demands
presented during the period August 16 to 31, which includes Demands
Nos. 7-2095 to 7-2201 (both inclusive) drawn on the United Californi.a.
Bank, totaling $367,783.84 (Light and Power Warrants $177,615.15)
(Accounting Period September, 1967), was eX4mined and audited.
It was moved by Mailliard, seconded by Ybarra, that
''Warrant Register No. 244" be approved and payment authorized for
Demands Nos. 7-2096 to 7.2201 (both inclusive), with no exceptions.
Motion carried.

It was moved by Ybarra, seconded by Malburg, that out of
respect to the memory of Gilbert A. Anderson, who passed away on
