MINtlfES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF VERNON
HELD SEPTEMBER 19, 1967 AT TWO O'CLOCK
P.M. IN THE COUNCIL CHAMBER OF THE
CITY HALL LOCATED AT 4305 SANTA FE
AVENUE~ VERNON~ CALIFORNIA.
COUNCIL PRESENT: Anderson, Furlong, Mai11iard, Malburg, Ybarra
COUNCIL ABSENT: None
The meeting was called to order by Mayor R. J. Furlong.
It was moved by Ybarra, seconded by Mai11iard, that
minutes of the meeting of September 5, 1967 be approved as written
and submitted. Motion carried.
Communication from Heslin Food Sales requesting a license
to conduct a business of food broker at 5050 S. Alameda Street, was
read.
It was moved by Anderson, seconded by Malburg, that the
request of Heslin Food Sales be referred to the Building Department
with power to act. Motion carried.
Communication from George W. Truitt requesting a license
to operate a cafe at 2213 E. 38th Street, was read.
It was moved by Anderson, seconded by Malburg, that the
request of George W. Truitt be referred to the Building Department
with power to act. Motion carried.
Communication from D. D. Grayson, Traffic Engineer, dated
September 6, 1967, transmitting an easement for street purposes from
Bohemian Distributing Company covering a portion of 51st Street,
and recommending that this easement be accepted and that the grantor
be advised of the official recordation, was read.
It was moved by Malburg, seconded by Ybarra, that Easement
be accepted from Bohemian Distributing Company and that the Mayor and
the City Clerk be authorized to execute Certificate of Acceptance.
Motion carried.
Communication from D. D. Grayson, Traffic Engineer, dated
September 11, 1967, transmitting proposed agreement between the
City of Vernon and Sinclair Investment Company for the dedication
of certain land regarding future improvements to Washington Boulevard;
and recommending that the City Council approve the agreement and that
the Grant Deed be accepted and the grantor advised of the official
recordation, was read. (Copy to each member of the City Council)
It was moved by Anderson, seconded by Ybarra, that the
Mayor and the City Clerk be authorized to execute Agreement between
the City of Vernon and Sinclair Investment Company for the dedication
of certain land regarding future ~provements to Washington Boulevard;
and that Grant Deed be accepted from Sinclair Investment Company
and that the Mayor and the City Clerk be authorized to execute
Certificate of Acceptance. Motion carried.

Communication from C. E. Nemethi, M.D., Healt~ Officer,
dated September 11, 1967, requesting authority for Louis S. Hauger
to attend the Executive Committee Meeting of the California
Conference Directors of Sanitation at Fresno, California, from
September 28 to 29 inclusive, with an expense allowance of $125.70,
was read.
It was moved by Mailliard, seconded by Anderson, that the
request of the Health Officer, dated September 11, 1967, be approved
and authority granted to issue warrant in the amount of $125.70 to
Louis S. Hauger. Motion carried.
Communication from C. E. Nemethi, M.D., Health Officer,
dated September 11, 1967, requesting authority for Mayrose Snyder
to attend the Western Industrial Health Conference at San Francisco,
California, from September 29 to 30 inclusive, with an expense
allowance of $152.40, was read.
It was moved by Mai1liard, seconded by Ybarra, that the
request of the Health Officer, dated September 11, 1967, be approved
and authority granted to issue warrant in the amount of $152.40 to
Mayrose Snyder. Motion carried.
Communication from R. H. Bockhacker, Police Chief, dated
September 8, 1967, requesting authority to attend the 69th Annual
Conference League of California Cities at San Francisco, California,
from October 15 to 18, 1967 inclusive, with an expense allowance
of $225.40, was read.
It was moved by Ybarra, seconded by Mai11iard, that the
request of the Police Chief, dated September 8, 1967, be approved
and authority granted to issue warrant in the amount of $225.40 to
R. H. Bockhacker. Motion carried.
Communication from R. H. Bockhacker, Police Chief, dated
September 14, 1967, requesting authority to advance certain personnel,
effective October 1, 1967, was read. (Copy to each member of the
City Council)
It was moved by Malburg, seconded by Mail1iard, that the
request of the Police Chief, dated September 14, 1967, be approved.
Hot ion carried.
Report of Health Department Activities for the month of
August 1967, was presented. (Copy to each member of the City
Council)
It was moved by Anderson, seconded by Ybarra, that Report
of Health Department Activities be received and filed. Motion
carried.
Activity Log of the Police Department for the period
September 1 - 15, 1967 inclusive, was presented.
It was moved by Malburg, seconded by Ybarra, that Activity
Log of the Police Department be received and filed. Motion carried.

Communication from Victor H. Vaits, Civil Engineer, dated
September 14, 1967, requesting that he be reimbursed the sum of
$40.00 from the Education and Training Budget appropriation for a
course entitled "Mass Transit Planning" at the University of
California Extension, together with recommendation for approval by
the Traffic Engineer, was read.
It was moved by Malburg, seconded by Ybarra, that the
recommendation of the Traffic Engineer, dated September 14, 1967,
be approved and authority granted to issue warrant in the amount
of $4C.00 to Victor H. Vaits. Motion carried.
Communication from Morris Vance, Administrative Assistant,
dated September 14, 1967, requesting that he be reimbursed the sum
of $100.00 from the Education and Training Budget appropriation for
a course entitled "Organization and Management Theory" at the
University of Southern California, together with recommendation for
approval by the Traffic Engineer, was read.
It was moved by Anderson, seconded by Mailliard, that the
recommendation of the Traffic Engineer, dated September 14, 1967,
be approved and authority granted to issue warrant in the amount
of $100.00 to Morris Vance. Motion carried.
Communication from V. R. Bush, Superintendent of Building,
dated September 15, 1957, requesting reconsideration of his request
of August 14, 1967, to attend the annual meeting of the Structural
Engineers Association of California, was read. (Copy to each member
of the City Council)
It was moved by Furlong, seconded by Mailliard, that the
request of the Superintendent of Building, dated September 15, 1967,
be approved and authority granted to issue warrant in the amount of
$231.40 to v. R. Bush. Motion carried.
Communication from L. C. Husted, Fire Chief, dated
September 18, 1967, requesting that certain personnel be reimbursed
the amounts as listed from the Education and lraining Budget appro-
priation for Fire Science courses, was read.
It was moved by Mailliard, seconded by Ybarra, that the
request of the Fire Chief, dated September 18, 1967, be approved
and authority granted to issue warrants in the amounts as listed.
Motion carried.
Communication from the City Engineer, the Superintendent,
Water & Sewer Systems, and the Traffic Engineer, dated August 24,
1967, transmitting the third annual Report of Activities of the City
of Vernon Public Works Departments, was read. (Copy to each member
of the City Council)
It was moved by Ybarra, seconded by Mailliard, that communi-
cation from the City Engineer, the Superintendent, Water & Sewer
Systems, and the Traffic Engineer, dated August 24, 1967, together
with transmittal, be received and filed. Motion carried.
Communication from R. H. Bockhacker, Police Chief, dated
September 18, 1967, recommending that Officer E. T. Brazil be
reimbursed the sum of $12.95 and that Lt. M. A. deRuyter be
reimbursed the sum of $8.93 from the Education and Training Budget
appropriation for courses in Police Science, was read.

It was moved by Malburg, seconded by Anderson, that the
recommendation of the Police Chief, dated September 18, 1967, be
approved and authority granted to issue warrants in the amounts of
$12.95 to E. T. Brazil and $8.93 to M. A. deRuyter. Motion carried.
Resolution No. 2919 - A Resolution of the City Council of
the City of Vernon, granting a zoning variance for United Investment
Group, Annie M. Margozewitz, and Harvey Wm. Bornstein, was read.
It was moved by Mailliard, seconded by Ybarra, that
Resolution No. 2919 be approved and adopted. Motion carried.

of the Engineering Departments, were presented:

trench and install pipe at 3360
Fruitland Ave.
Application 27939 - Cutting Engineering Works to construct
sidewalk and driveway at 2031 E. 38th
St.
Application 27940 - The Pacific Telephone Co. to place
buried cable and splice box in 38th
St. from 274' E/o CL Alameda St. to
49' E/o CL Ross St.
Application 2794l - Pacific Telephone Co. to place buried
cable in S/s Fruitland Ave. wlo Dm~ley
Rd.
Application 27942 - California Water Service Co. to repair
leaking 611 gate valve in 26th St. &
Ayers Ave.
It was moved by Malburg, seconded by Ybarra, that
excavation applications numbered 27937 to 27942 inclusive be filed
and permits granted. Motion carried.
"Warrant Register No. 245" covering claims and demands
presented during the period September 1 to l5, which includes
Demands Nos. 7-2202 to 7-2359 (both inclusive), drawn on the United
California Bank, totaling $828,936.23 (Light and Power Warrants
$803,076.57)(Accounting Period September, 1967), was examined and
audited.
It was moved by Mailliard, seconded by Ybarra, that
"Warrant Register No. 245" be approved and payment authorized for
Demands Nos. 7-2202 to 7-2359 (both inclusive), with no exceptions.
Motion carried.

"Payroll Warrant Register No. 122" covering claims and
demands presented during the period August 1 to August 31, which
includes Demands Nos. 1356 to 1365 (both inclusive), drawn on the
Crocker-Citizens National Bank, totaling $256,704.91 (Accounting
Period August, 1967), was examined and audited.
It was moved by Mai1liard, seconded by Ybarra, that
"Payroll Harrant Register No. 122" be approved and payment authorized
for Demands Nos. 1356 to 1365 (both inclusive), with no exceptions.
Motion carried.

There being no further business to come before the meeting,
it was moved by Anderson, seconded by Ybarra, that the meeting

Mayor Pro Tempore Malburg reported that this was the time
and place for the hearing on the Petition of United Investment Group,
Annie M. Margozewitz and Harvey Wm. Bornstein for a variance from the
provisions of Ordinance No. 752, and all amendments thereto, of the
City of Vernon.
The following were duly acknowledged as being on file:
(1) Proof of Publication in the Los Angeles Daily Journal
on August 29, September 5 and September 12, 1967 of "Notice of
Proposed Change from Zoning Provisions";
(2) Affidavit of City Clerk Re Mailing Postal Card Notices
on application for variance of United Investment Group, Annie M.
Margozewitz and Harvey Wm. Bornstein; and
(3) Affidavit of Posting "Notice of Proposed Change from
Zoning Provisions" by George W. Burgess, Engineering Aide.
Communication from Vincent R. Bush, Superintendent of
Building, dated September 15, 1967, with reference to Petition for
Zone Variance by United Investment Group, Annie M. Margozewitz and
Harvey Wm. Bornstein, transmitting Exhibits A, Band C, showing
respectively the existing zoning in the surrounding area, the
existing land use, and a large scale plot of the property, was
presented. (Copy of letter to each member of the City Council)
The documents transmitted by Mr. Bush with his communi-
cation, dated September 15, 1967, were examined and discussed by
the City Council.
The City Clerk reported that there were no other communi-
cations relative to the petition of United Investment Group, Annie M,
Margozewitz and Harvey Wm. Bornstein.
Mayor Pro Tempore Malburg asked if anyone from the floor
wished to address the City Council relative to said petition. No
one responded.

After a general discussion of the petition for variance,
it was moved by Anderson, seconded by Ybarra, that the City Attorney
be instructed to draft a resolution granting a variance to United
Investment Group, Annie M. Margozewitz and Harvey Wm. Bornstein
from the provisions of Ordinance No. 752 as recited in the petition.
Motion carried.
