CITY COUNCIL OF THE CITY OF VERNON
HELD DECEMBER 5, 1967 AT TWO O'CLOCK

The meeting was called to order by Mayor R. J. Furlong.
It was moved by Ybarra, seconded by Anderson, that minutes
of the meeting of November 21, 1967 be approved as written and
submitted. Motion carried.
Communication from R. H. King, Superintendent, Water &
Sewer Systems, dated November 30, 1967, with reference to bids
received for Water Main Lining - Phase I in accordance with Contract
No. 333, recommending that the contract be awarded to Pipe Linings,
Inc. on the basis of their bid of $111,264.40, was read.
Resolution No. 292q - A Resolution of the City Council of
the City of Vernon, accepting the bid of Pipe Linings, Inc. for
Water Main Lining - Phase I, in accordance with Contract No. 333,
was read.
It was moved by Mailliard, seconded by Ybarra, that
Resolution No. 2929 be approved and adopted. Motion carried.

Absent: None
Communication from J & L Service requesting a license to
operate a service station at 5200 Santa Fe Avenue, was read.
It was moved by Mailliard, seconded by Anderson, that the
request of J & L Service be referred to the Building Department with
power to act. Motion carried.
Communication from the City of Lakewood, dated November
28, 1967, transmitting a copy of its Resolution No. 1919 opposing
the preliminary plan of the Southern California Rapid Transit
District as announced October 30, 1967, was read. (Copy to each
member of the City Council)
It was moved by Malburg, seconded by Ybarra, that communi-
cation from the City of Lakewood, dated November 28, 1967, together
with transmittal, be received and filed. Motion carried.
Communication from L. C. Husted, Fire Chief, dated November
27, 1967, requesting authority for Captain Lawrence M. Jackson to
attend the American Academy of Orthopaedic Surgeons Course entitled
"Initial Emergency Care & Transportation of the Sick & Injured" at
San Diego, California from December 14 to 16, 1967, inclusive, with
an expense allowance of $101.75, was read.
It was moved by Anderson, seconded by Ybarra, that the
request of the Fire Chief, dated November 27, 1967, be approved and
authority granted to issue warrant in the amount of $101.75 to
Lawrence M. Jackson. Motion carried.

Communication from R. H. Bockhacker, Police Chief, dated
November 27, 1967, recommending that the Jail, Photo Lab and Report
Writing Room be air conditioned as soon as practical; and transmit-
ting a proposal from the Bay Cities Furnace and Air Conditioning
Company for air conditioning these three rooms, was read. (Copy
to each member of the City Council)
It was moved by Malburg, seconded by Mai11iard, that
communication from the Police Chief, dated November 27, 1967, be
referred to the Finance Committee for consideration in the 1968-69
Budget appropriation. Motion carried.
Activity Log of the Police Department for the period
November 16 - 30, 1967 inclusive, was presented.
It was moved by Anderson, seconded by Ybarra, that
Activity Log of the Police Department be received and filed. Motion
carried.
Communication from A. E. Nelson, Jr., City Engineer, dated
November 30, 1967, transmitting a license agreement between The
Atchison, Topeka and Santa Fe Railway Company and the City of Vernon
covering the installation of a water line on right-of-way between
30th Street and 37th Street, and recommending that the license
agreement be approved and that the Mayor and the City Clerk be
authorized to execute the agreement on behalf of the City of Vernon,
was read.
It was moved by Mail1iard, seconded by Ybarra, that the
Mayor and the City Clerk be authorized and directed to execute, on
behalf of the City, license agreement between The Atchison, Topeka
and Santa Fe Railway Company and the City of Vernon covering the
installation of a water line on right-of-way between 30th Street
and 37th Street. Motion carried.
Communication from D. D. Grayson, Traffic Engineer, dated
November 27, 1967, transmitting a license agreement between The
Atchison, Topeka and Santa Fe Railway Company and the City of Vernon
regarding future improvements to Washington Boulevard; and recom-
mending that the license agreement be approved and that the Mayor
and the City Clerk be authorized to execute the agreement on behalf
of the City of Vernon, was read. (Copy to each member of the City
Council)
It was moved by Anderson, seconded by Ybarra, that the
Mayor and the City Clerk be authorized and directed to execute,
on behalf of the City, license agreement between The Atchison,
Topeka and Santa Fe Railway Company and the City of Vernon regarding
future improvements to Washington Boulevard. Motion carried.
Communication from D. D. Grayson, Traffic Engineer, dated
December 1, 1967, advising that Susan B. Beal has submitted her
resignation to be effective at the close of business on December 12,
1967, and recommending that the resignation be accepted, was read.
It was moved by Anderson, seconded by Malburg, that the
resignation of Susan B. Beal be accepted. Motion carried.

Communication from Susan B. Bea1, dated November 28, 1967,
extending her sincere thanks and appreciation to the City of Vernon
for affording her t~e opportunity of employment, was read. (Copy
to each member of the City Council)
It was moved by Malburg, seconded by Ybarra, that communi-
cation from Susan B. Bea1, dated November 2~, 1967, be received and
filed. Motion carried.
Communication from D. D. Grayson, Traffic Engineer, dated
December 1, 1967, transmitting Grant Deed from Clougherty Packing
Company covering certain property required for the Bandini Extension
project, and recommending that the deed be accepted and that the
Mayor and the City Clerk be authorized to execute Certificate of
Acceptance, was read.
It was moved by Malburg, seconded by Mai11iard, that Grant
Deed be accepted from Clougherty Packing Company and that tbe Mayor
and the City Clerk be authorized to execute Certificate of
Acceptance. Motion carried.
Communication from D. D. Grayson, Traffic Engineer, dated
December 1, 1967, transmitting Grant Deed from Charles M. King and
Beulah King covering certain property required for the Bandini
Extension project, and recommending that the deed be accepted and
that the Mayor and the City Clerk be authorized to execute Certificate
of Acceptance, was read.
It was moved by Anderson, seconded by Ybarra, that Grant
Deed be accepted from Charles M. King and Beulah King and that the
Mayor and the City Clerk be authorized to execute Certificate of
Acceptance. Motion carried.
Communication from D. D. Grayson, Traffic Engineer, dated
December 1, 1967, transmitting easement for street purposes from
Mr. Joseph Freed and Mr. Benjamin H. Werber covering a portion of 26th
Street, and recommending that easement be accepted and that the
grantors be advised of the official recordation, was read.
It was moved by Mai11iard, seconded by Anderson, that
Easement be accepted from Joseph Freed and Benjamin H. Werber and
that the Mayor and the City Clerk be authorized to execute Certifi-
cate of Acceptance. Motion carried.
Communication was read from R. H. Bockhacker, Police Chief,
dated December 1, 1967, requesting that the following personnel,

It was moved by Anderson, seconded by Ybarra, that the
request of the Police Chief, dated December 1, 1967, be approved.

license to conduct a business of gasoline distribution at 2727 E.
37th Street, was read.

It was moved by Mailliard, seconded by Ybarra, that the
request of American Oil Company be referred to the Building Depart-
ment with power to act. Motion carried.
Communication from L. C. Husted, Fire Chief, dated
December 4, 1967, recommending that Byron Jackson Pump Division be
granted an extension of one year to use the six trailers on their
property at 2300 E. Vernon Avenue as temporary offices, was read.
It was moved by Malburg, seconded by Ybarra, that the
recommendation of the Fire Chief, dated December 4, 1967, be
approved; and that Byron Jackson Pump Division be granted permission
to use the six trailers located on their property at 2300 E. Vernon
Avenue as temporary offices until December 1, 1968, subject to the
conditions stipulated in the minutes of October 4, 1966. Motion
carried.
Communication from D. D. Grayson, Traffic Engineer, dated
December 4, 1967, outlining the understanding reached between the
Traffic Engineer and Mr. Kenneth L. Larson for the acquisition of
certain property located on Bandini Boulevard (private street);
and recommending that the City Council approve the provisions as
outlined and authorize the Mayor and the City Clerk to execute
documents necessary to consummate the sale, was read. (Copy to
each member of the City Council)
It was moved by Ybarra, seconded by Mailliard, that the
recommendation of the Traffic Engineer, dated December 4, 1967, be
approved; and that the Mayor and the City Clerk be authorized to
execute documents necessary to consummate the sale of certain
property, as outlined, to the City of Vernon by Kenneth L. Larson.
Motion carried.
Communication from Southern California Edison Company,
dated December 4, 1967, transmitting in duplicate The Atchison,
Topeka and Santa Fe Railway Company's Form 2762, "Mutual Termination
Agreement", for a license dated May 1, 1957, was presented.
It was moved by Ybarra, seconded by Malburg, that the
Mayor and the City Clerk be authorized to execute, on behalf of the
City, The Atchison, Topeka and Santa Fe Railway Company's Form 2762,
"Mutual Termination Agreement". Motion carried.
Resolution No. 2926 - A Resolution of the City Council of
the City of Vernon requesting the Public Utilities Commission to
make an allocation from the Crossing Protection Fund, was read.
It was moved by Mailliard, seconded by Ybarra, that
Resolution No. 2926 be approved and adopted. Motion carried.

Resolution No. 2927 - A Resolution of the City Council of
the City of Vernon requesting the Public Utilities Commission to make

Resolution No. 2927 be approved and adopted. Motion carried.

Resolution No. 2925 - A Resolution of the City Council of
the City of Vernon finding the public interest and convenience
require the sale of a site dedicated to a public use, declaring the
City's intention to sell said property, fixing the time and place
for hearing protests to said sale, providing for publication of
notice of hearing, and fixing the time of final action for said
sale, was read.
It was moved by Mailliard, seconded by Ybarra, that
Resolution No. 2925 be approved and adopted. Motion carried.

audited.

Mayor Furlong announced that this was the time and place
for the hearing on the Petition of Loretta Clampett and Samuel
Mizrahi for a variance from the provisions of Ordinance No. 752,
and all amendments thereto, of the City of Vernon.
The following were duly acknowledged as being on file:
(1) Proof of Publication in the Los Angeles Daily Journal
on November15, 21 and 28, 1967 of "Notice of Proposed Change from
Zoning Provisions";
(2) Affidavit of City Clerk Re Mailing Postal Card Notices
on application for variance of Loretta Clampett and Samuel Mizrahi;
and
(3) Affidavit of Posting "Notice of Proposed Change from
Zoning Provisions" by F. W. Sumner, Building Inspector.
Communication from Vincent R. Bush, Superintendent of
Building, dated December 1, 1957, with reference to Petition for
Zone Variance by Loretta Clampett and Samuel Mizrahi, outlining
the Building Department's findings in connection with this matter;
transmitting Exhibits A through D showing respectively existing
zoning, existing land use, subject property site plan, and
surrounding property ownership and use; and transmitting Exhibits
E and F showing respectively photographs of subject and adjacent
property, and present operation at 1845 South Soto Street, Los
Angeles, California, was presented. (Copy to each member of the
City Council)
The documents transmitted by Mr. Bush with his communi-
cation, dated December 1, 1967, were examined and discussed by the
City Council.

Co~~unication from L. C. Husted, Fire Chief, dated December
4, 1967, with reference to Petition for Zone Variance by Loretta
Clampett and Samuel Mizrahi, recommending that the petition be denied
for the reasons as outlined, was read. (Copy to each member of the
City Council)
Communication from the City of Los Angeles, dated December
4, 1967, advising that the request for Variance to permit a scrap
metal use would not appear to affect the City of Los Angeles since
said use is directly opposite their M-3 Heavy Industrial Zone, was
presented.
The City Clerk reported tbat there were no other written
communications relative to the petition of Loretta Clampett and
Samuel Mizrahi.
Mayor Furlong asked if anyone from the floor wished to
address the City Council relative to said petition.
Mr. Samuel Mizrahi addressed the City Council with
reference to his method of operation.
Mr. Frank Reynolds, builder of industrial buildings,
addressed the City Council opposing the granting of a variance to
permit a scrap metal use.
Mr. Larry Geisser, representing management of Cleveland
Wrecking Company, addressed the City Council opposing the granting
of a variance to permit a scrap metal use.
After a general discussion of the petition for variance,
it was moved by Malburg, seconded by Mailliard, that the City
Attorney be instructed to draft a resolution denying a variance to
Loretta C1ampett and Samuel Mizrahi from the provisions of Ordinance
No. 752 as recited in the petition. Motion carried.

Mayor Furlong adjourned the meeting at 1:20 p.m.
