19680220 Regular City Council Meeting - Minutes I I MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD FEBRUARY 20, 1968 AT TWO 0' CLOCK P.M. IN THE COUNCIL CRAMBER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA. COUNCIL PRESENT: Anderson, Furlong, Mai11iard, Ybarra COUNCIL ABSENT: Malburg The meeting was called to order by Mayor R. J. Furlong. It was moved by Mai11iard, seconded by Anderson, that minutes of the meeting of February 6, 1968 be approved as ~v.ritten and submitted. Motion carried. The Clerk announced that this was the time and place for hearing protests to the sale of certain real property as described in Resolution No. 2941, and for taking final action on the sale of certain real property as described in Resolution No. 2941. The following were duly acknowledged as being on file: (1) Proof of Publication in the Los Angeles Daily Journal on February 6, 1968 of Resolution No. 2941; and (2) Affidavit of City Clerk Re Posting three (3) copies of Resolution No. 2941 upon the parcel of property affected. The Mayor asked if anyone present wished to protest the sale of certain real property as described in Resolution No. 2941. No protests were heard or made. Resolution No. 2945 - A Resolution of the City Council of the City of Vernon, determining final action on the sale of a site dedicated to a public use, declaring the City's intention to sell said property, and determining that no protests have been received, was read. It was moved by Anderson, seconded by Ybarra, that Resolution No. 2945 be approved and adopted. Motion carried. Ayes: Anderson, Furlong, Mai1liard, Ybarra Noes: None Absent: Malburg Ordinance No. 790 - An Ordinance of the City of Vernon regulating solicitations for charitable, patriotic, philanthropic and other purposes; requiring registration of those engaged in solicitation for such purposes; prohibiting solicitations by false or fraudulent statements; and providing penalties for the violation of this Ordinance, was presented. It was moved by Mailliard, seconded by Ybarra, that Ordinance No. 790 receive a second reading by title. Motion carried. Grayson, Traffic Engineer, dated February 15, 1968, with reference to bids received for traffic signal improvements on Slauson Avenue at Boyle-State Street, in accordance with Contract No. 330, recommending that the contract be awarded to C. T. & F., Inc. on the basis of their bid of $14,120.00, was read. Resolution No. 2946 - A Resolution of the City Council of the City of Vernon, accepting the bid of C. T. & F., Inc. for traffic signal installation at Slauson Avenue and Boyle-State Street~ in accordance with Contract No. 330 of the City of Vernon, was read. It was moved by Mail1iard, seconded by Ybarra, that Resolution No. 2946 be approved and adopted. Motion carried. It was moved by Mail1iard, seconded by Anderson, that the request of Rhodes Jewelers be referred to the Building Department with power to act. Motion carried. Communication from Union Terminal Warehouse requesting a license to conduct a business of public warehousing and trans- portation of property operations at 2211 East 52nd Street, was read. It was moved by Mai11iard, seconded by Ybarra, that the request of Union Terminal Warehouse be referred to the Building Department with power to act. Motion carried. I I -3- 2/20/68 Communication from the Board of Supervisors, County of Los Angeles, dated February 6, 1968, requesting the governing body of each city and each school district within the County of Los Angeles to defer the placing of special measures on a county-wide ballot until the General Election in November, 1968, was read. (Copy to each member of the City Council) It was moved by Mailliard, seconded by Ybarra, that communication from the Board of Supervisors, County of Los Angeles, dated February 0, 1958, be received and filed. Motion carried. Communication from the County of Los Angeles/Department of Real Estate Management, dated February 6~ 1968, addressed to the Planning Commission, giving notification of County-owned property being processed for sale, and requesting the City of Vernon to review and report whether or not disposition of the subject property by the County conforms to Vernon's general plan, was read. (Copy to each member of the City Council) It was moved by Mailliard, seconded by Anderson, that communication from the County of Los Angeles/Department of Real Estate Management, dated February 6, 1968, be referred to the Traffic Engineer for review and report. Motion carried. Communication from the Automobile Club of Southern California, dated February 12, 1968, transmitting on behalf of their member, Verna Vanderwold, claim against the City of Vernon, dated February 10, 1968, together with a repair bill in the amount of $21.79, was read. It was moved by Ybarra, seconded by Anderson, that claim against the City of Vernon by Verna Vande~vold, dated February 10, 1968, be denied and referred to the City Attorney, the City's insurance carrier and Pipe Linings, Inc. for necessary action. Motion carried. Summons to appear in Case Number 28343 brought by Frederick W. Postal vs. City of Vernon, a municipal corporation, David Wayne Perkins, Doe I, Doe II and Doe III, in The Municipal Court of San Antonio Judicial District for property damage, was presented. It was moved by Mailliard, seconded by Ybarra, that Summons to appear in Case Number 28343 brou~lt by Frederick W. Postal vs. City of Vernon, a municipal corporation, David Wayne Perkins, Doe I, Doe II and Doe III, in The Municipal Court of San Antonio Judicial District for property damage, be referred to the City Attorney and the City's insurance carrier for necessary action. Motion carried. Communication from Esquire Maintenance Co., dated February 12, 1968, requesting that the monthly charge for janitorial services for the City Hall be increased by $22.19 per month, effective March 1, 1968, due to increases contained in labor contracts, was read. (Copy to each member of the City Council) It was moved by Anderson, seconded by Ybarra, that the increase for janitorial services requested by Esquire Building Maintenance Company under date of February 12, 1968, be approved; and that the Mayor and the City Clerk be authorized to sign copy of letter approving and accepting the $22.19 monthly increase. I I -4- 2/20/68 Communication from Southern California Edison Company, dated February 12, 1968, transmitting a License between The Atchison, Topeka and Santa Fe Railway Company and the City of Vernon (Railway's Document No. A-17007) for electric supply line across railway property which is required for the extension of distribution facilities to serve the Pacific Vegetable Oil Corporation, was read. It was moved by Mailliard, seconded by Ybarra, that the Mayor and the Ci.ty Clerk be authorized to execute, on behalf of the City of Vernon, License identified as The Atchison, Topeka and Santa Fe Railway Company's Document No. A-17007. Motion carried. Communication from D. D. Grayson, Traffic Engineer, dated February 8, 1968, transmi.tting a letter dated January 18, 1968 from Mr. LeRoy Crandall of LeRoy Crandall and Associates outlining a proposal under which they would perform required soil investigation in connection with the design of Bandini Boulevard Extension; and recommending that the firm of LeRoy Crandall and Associates be retained for the necessary soil investigation as indicated in their letter dated January 18, 1968, was read. (Copy to each member of the City Council) It was moved by Mai11iard, seconded by Anderson, that the recommendation of the Traffic Engineer, dated February 8, 1968, be approved and authority granted to retain the services of leRoy Crandall and Associates in accordance with their proposal of January 18, 1968. Motion carried. Communication from D. D. Grayson, Traffic Engineer, dated February 17, 1968, requesting authority to advance Teresa L. Snyder to Engineering Clerk IV, Step 4, effective March 1, 1968, as she will have satisfactorily completed the probationary period, was read. It was moved by Ybarra, seconded by Anderson, that the request of the Traffic Engineer, dated February 17, 1968, be approved. Motion carried. Communication from D. D. Grayson, Traffic Engineer, dated February 14, 1968, transmitting Contract No. 331, Heater Remixing and Asphalt Resurfacing of Certain Streets, and recommending that this contract be approved and that authority be granted to advertise for bids, was read. Resolution No. 2943 - A Resolution of the City Council of the City of Vernon, approving Contract No. 331 for Heater Remixing and Asphalt Resurfacing of Certain Streets, and directing the giving of notice inviting sealed proposals or bids in accordance with Contract No. 331 of the City of Vernon, was read. It was moved by Mai11iard, seconded by Ybarra, that Resolution No. 2943 be approved and adopted. Motion carried. Husted, Fire Chief, dated February 14, 1968, requesting that certain personnel be reimbursed the amounts as listed from the Education and Training Budget appropriation for Fire Science courses, was read. (Copy to each member of the City Council) It was moved by Anderson, seconded by Ybarra, that the request of the Fire Chief, dated February 14, 1968, be approved and authority granted to issue warrants in the amounts as listed. Motion carried. Communication from A. E. Nelson, Jr., City Engineer, dated February 15, 1968, requesting authority to employ Billy J. Mitchell as Engineering Aide II, Step 5, effective February 19, 1968, pending satisfactory physical examination, was read. It was moved by Mailliard, seconded by Ybarra, that the request of the City Engineer, dated February 15, 1968, be approved. Motion carried. Report of Health Department Activities for the month of January, 1968, was presented. (Copy to each member of the City Council) It was moved by Ybarra, seconded by Anderson, that Report of Health Department Activities be received and filed. Motion carried Activity Log of the Police Department for the period February 1 - 15, 1968 inclusive, was presented. It was moved by Ybarra, seconded by Anderson, that Activity Log of the Police Department be received and filed. Motion carried. Communication from Morris B. Vance, Administrative Assistant, dated February 15, 1968, requesting that he be reimbursed the sum of $100.00 from the Education and Training Budget appropri- ation for a course at the University of Southern California entitled "Seminar in the Administration of Local Government", together with recommendation for approval by the Traffic Engineer, was read. It was moved by Mailliard, seconded by Ybarra, that the recommendation of the Traffic Engineer be approved and authority granted to issue warrant in the amount of $100.00 to Morris B. Vance. Motion carried. Communication from L. C. Husted, Fire Chief, dated February 15, 1968, requesting authority to advance Robert J. Glassner from Autofireman,Grade 3 to Grade 2, effective March 1, 1968, was read. It was moved by Ybarra, seconded by Anderson, that the request of the Fire Chief, dated February 15, 1968, be approved. Motion carried. I I -6- 2/20/68 Communication from R. H. King, Superintendent of the Water Department, dated February 16, 1968, requesting authority to employ Mr. LaVerne W. Cole as Utility Man III, Step 5, effective March 1, 1968, pending satisfactory physical examination, was read. It was moved by Mailliard, seconded by Ybarra, that the request of the Superintendent of the Water Department, dated February 16, 1968, be approved. Motion carried. Communication from D. D. Grayson, Traffic Engineer, dated February 16, 1968, transmitting a revised agreement and maintenance schedule for the bridge and pumpbouse at Downey Road and 25th Street to include the substructure of the railroad bridge immediately north of the 26th Street bridge; and recommending that the agreement, as revised, be approved and that the Mayor and the City Clerk be authorized to execute the agreement on behalf of the City of Vernon, was read. (Copy to each member of the City Council) It was moved by Anderson, seconded by Ybarra, that the Mayor and the City Clerk be authorized to execute, on behalf of the City of Vernon, agreement, as revised, between the County of Los Angeles and the City of Vernon for the maintenance of the bridge and pumphouse facility at Dawney Road and 26th Street and the inspection and maintenance of the substructure of the railroad bridge immediately north of the 26th Street bridge. Motion carried. Communication from D. D. Grayson, Traffic Engineer, dated February 15, 1968, transmitting a letter dated February 12, 1968 from Mr. W. S. Crosbie of the Roy C. Seeley Company, outlining a proposal under which they would perform required appraisal in connection with the Santa Fe Avenue and 25th-26th Street intersection reconstruction; and recommending that the firm of Roy C. Seeley Company be retained to perform the required appraisal as indicated in the letter dated February 12, 1958, was read. (Copy to each member of the City Council) It was moved by Ybarra, seconded by Anderson, that the recommendation of the Traffic Engineer, dated February 15, 1968, be approved and authority granted to retain the services of the Roy C. Seeley Company in accordance with their proposal dated February 12, 1968. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated February 6, 1968, requesting that L. F. Hayes be advanced from Policeman, Grade 2 to Grade 1, effective March 1, 1968, was read. It was moved by Mailliard, seconded by Ybarra, that the request of the Police Chief, dated February 6, 1968, be approved. Motion carried. 1967 Annual Report of the Vernon Police Department was presented. (Copy to each member of the City Council) It was moved by Anderson, seconded by Ybarra, that the 1967 Annual Report of the Vernon Police Department be received and filed. Motion -carried. I I -7- 2/20/68 Copy of Resolution No. CS-6022 of the City Council of the City of Culver City, California, expressing opposition to the lessening of penalties for the possession or use of marijuana; and urging the State Legislature to strengthen the laws pertaining to the illegal use of LSD and other dangerous drugs by placing them inth€ felony category, was presented. It was moved by Mailliard, seconded by Ybarra, that copy of Resolution No. CS-6C22 of the City Council of the City of . Culver City, California, be received and filed. Motion carried. Copy of Resolution No. 2210 of the City Council of the City of El Segundo, California, joining the endorsement of the County Supervisors Association in opposing any action to downgrade penalties for the use of marijuana, LSD, and other dangerous drugs, was presented. Communication from the Law Offices of Gillin and Scott, dated February 15, 1968, transmitting Amendment to Petition for Variance, filed on behalf of Donald F. Shaw, Donald W. Shaw and E. William Sparr, from the provisions of Section 20 of Ordinance No. 752 to permit vehicle access so as to provide facilities for backing trucks and trailers over the public right of way onto land owned by Petitioners at 3055 East 44th Street, was read. (Copy of Amendment to Petition to each member of the City Council) It was moved by Ybarra, seconded by Anderson, that the City Attorney be instructed to draft a resolution fixing the time and place for the hearing on the petition for a variance from the provisions of Section 20 of Ordinance No. 752 from Donald F. Shaw, Donald W. Shaw and E. William Sparr for April 16, 1968 at the hour of 1:00 p.m. in the Council Chamber of the City Hall. Motion carried. Reports from various City Departments with reference to the request of John Bedford Trucking for a land occupancy permit for property directly behind S & W Foods on Lorna Vista Avenue for the purpose of parking trailers and tractors with an office trailer along with a temporary utility pole, were read. It was moved by Mailliard, seconded by Anderson, that John Bedford Trucking be granted a license to conduct a business on the property directly behind S & 1/l Foods on Lorna Vista Avenue, provided that all the requirements as recommended by the various City Departments are complied with and all necessary City permits are obtained; and that John Bedford Trucking be authorized to locate a conventional type office trailer on said property, provided that said trailer is not used for sleeping and/or cooking purposes, provided that the requirements of all City Departments are complied with and that all necessary City permits are obtained, and with a stipulation that the maximum time limit that said trailer may be used shall be March 1, 19S9. Resolution No. 2044 - A Resolution of the City Council of the City of Vernon, California, ordering the canvass of the General Municipal Election to be held on the 9th day of April, 1968, to be made by the City Clerk of the City of Vernon, California, was read. "'Warrant Register No. 255" covering claims and demands presented during the period February 1 to 15, which includes Demands Nos. 8-378 to 8-551 (both inclusive) drawn on the United California Bank, totaling $1,032,031.05 (Light and Power Warrants $941,908.34) (Accounting Period February, 1968), was examined and audited. It was moved by Mailliard, seconded by Ybarra, that ''Warrant Register No. 255" be approved and payment authorized for Demands Nos. 8-378 to 8-551 (both inclusive), wit~ no exceptions.
