MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF VERNON
HELD MARCH 19, 1968 AT TWO O'CLOCK
P.M. IN THE COUNCIL CHAMBER OF THE
CITY HALL LOCATED AT 4305 SANTA FE
AVENUE~ VERNON~ CALIFORNIA.

COUNC IL ABSENT: None
The meeting was called to order by Mayor R. J. Furlong.
It was moved by Mailliard, seconded by Ybarra, that
minutes of the meeting of March 5, 1958 be approved as written and
submitted. Motion carried.
Communication from ld Vezeau dba Tip Top Catering requestin€
a license to operate a lunch truck in the City of Vernon, was read.
It was moved by Malburg, seconded by Ybarra, that the
request of Ed Vezeau dba Tip Top Catering be approved and license
granted. Motion carried.
Communication from Don Tucker dba Standard Catering
requesting a license to operate a lunch truck in the City of Vernon,
was read.
It was moved by Mailliard, seconded by Anderson, that the
request of Don Tucker dba Standard Catering be referred to the Health
Department with power to act. Motion carried.
Communication from Wilford Cooper requesting a license to
operate a mobile lubrication truck to service various trucking
companies in the City of Vernon on weekends, was read.
It was moved by Malburg, seconded by Ybarra, that Wilford
Cooper be notified that a license is not required to operate a
mobile lubrication truck in the City of Vernon. Motion carried.
Notice from the Local Agency Formation Commission that
hearing has been set for March 27, 1968 on application of the Los
Angeles County Fire Department to annex territory designated as
"Annexation No. 73-67, Florence Parcel No. 1-67" to the Consolidated
Fire Protection District of Los Angeles County, was read.
It was moved by Ybarra, seconded by Anderson, that notice
from the Local Agency Formation Commission be received and filed.
Motion carried.
Communication from D. D. Grayson, Traffic Engineer, dated
March 13, 1968, with reference to bids received for the heater
remixing and asphalt resurfacing of certain streets in accordance
with Contract No. 331, recommending that the contract be awarded to
Vernon Paving Company on the basis of their bid of $38,948.67, was
read.
Resolution No. 2953 - A Resolution of the City Council of
the City of Vernon, accepting the bid of Vernon Paving Company for
heater remixing and asphalt resurfacing of certain streets in
accordance with Contract No. 331, was read.

Resolution No. 2953 be approved and adopted. Motion carried.

Communication from D. D. Grayson~ Traffic Engineer, dated
March 6, 1968, advising tbat Mr. Leroy Kramer was not employed as
authorized by City Council action March 5, 1968, inasmuch as he
failed to pass the required physical examination, was read.
It was moved by Anderson, seconded by Ybarra, that communi-
cation from the Traffic Engineer, dated March 6, 1968, be received
and filed. Motion carried.
Communication from A. E. Nelson, Jr., City Engineer, dated
March 11, 1968, transmitting a License Agreement between the City
of Vernon and MSL Industries, Inc. to construct and maintain an
electrical transformer pad and equipment on City railroad easement,
and recommending that subject to approval as to form by the City
Attorney, the License Agreement be approved and executed by the
City of Vernon, was read.
It was moved by Anderson, seconded by Ybarra, that License
Agreement between the City of Vernon and MSL Industries, Inc., as
transmitted by the City Engineer under date of March 11, 1968, be
approved; and that subject to approval as to form by the City
Attorney, the Mayor and the City Clerk be authorized to execute this
agreement on behalf of the City of Vernon. Motion carried.
Communication from A. E. Nelson, Jr., City Engineer, dated
March 7, 1958, requesting authority for Raymond R. Rich to attend
the annual meeting of the California Water Pollution Control Associ-
ation in Santa Rosa, California, from April 24 to 27, 1968, with an
expense allowance of $187.73, was read.
It was moved by Malburg, seconded by Anderson, that the
request of the City Engineer, dated March 7, 1968, be approved and
authority granted to issue warrant in the amount of $187.73 to
Raymond R. Rich. Motion carried.
Communication from V. R. Bush, Superintendent of Building,
dated March 7, 1968, requesting authority for F. W. Sumner to attend
the annual meeting of the California Water Pollution Control Associ-
ation in Santa Rosa, California, from April 24 to 27, 1968, with an
expense allowance of $187.73, was read.
It was moved by Furlong that the request of the Superin-
tendent of Building, dated March 7, 1968, be approved and authority
granted to issue warrant in the amount of $187.73 to F. W. Sumner.
Motion died for lack of a second.
Communication from R. H. King, Superintendent of the Water
Department, dated March 7, 1968, requesting authority to attend the
'6nnual meeting of the California Water Pollution Control Association

Department, dated March 7, 1968, requesting authority to attend the
Western Water and Power Symposium in Los Angeles on April 8 and 9,
1968) with an expense allowance of $42.00, was read.
It was moved by Anderson, seconded by Ybarra, that the
request of the Superintendent of the Water Department, dated March
7, 1968, be approved and authority granted to issue warrant in the
amount of $42.00 to R. H. King. Motion carried.
Communication from L. C. Husted, Fire Chief, dated March 6,
1968, advising that Francis M. Burrage, Engineer, has applied for
and been granted a service retirement from the Public Employees'
Retirement System effective at the close of the business day March
31, 1968, was read.
It was moved by Malburg, seconded by Ybarra, that a letter
be written to Mr. Francis M. Burrage expressing appreciation for the
many years of faithful and capable services given to the City of
Vernon. Motion carried.
Report of Health Department Activities for the month of
February, 1968, was presented. (Copy to each member of the City
Counc il)
It was moved by Malburg, seconded by Anderson, that Report
of Health Department Activities be received and filed. Motion
carried.
Activity Log of the Police Department for the period March
1 to 15, 1958 inclusive, was presented.
It was moved by Ybarra, seconded by Mailliard, that
Activity Log of the Police Department be received and filed. Motion
carried.
Communication from D. D. Grayson, Traffic Engineer, dated
March 14, 1968, with reference to bridge to be constructed across
the Los Angeles River by the County of Los Angeles, was read. (Copy

It was moved by Mailliard, seconded by Ybarra, that communi-
cation from the Traffic Engineer, dated March 14, 1968, be received
and filed. Motion carried.
Communication from D. D. Grayson, Traffic Engineer, dated
March 14, 1968, recommending that George Burgess, Engineering Aide
I, be authorized an automobile allowance effective April 1, 1968,
at the rate of $20.00 per month plus lO~ per mile not to exceed a

Copy of Resolution No. 61-15 of the City Council of the

It was moved by Ybarra, seconded by Anderson, that copy of
Resolution No. 68-15 of the City Council of the City of Lomite,
California, be received and filed. Motion carried.
Copy of Resolution No. 7240 of the City Council of the
City of Monterey Park opposing legislation TN'hich would permit the
imposition of any ad valorem. tax on citizens by any regional govern-
mental agency without the approval of the electorate, ~,qas presented.

Communication from D. D. Grayson, Traffic Engineer, dated
March 18, 1968, reporting that Mr. Rafael Perez, Utility Man IV,
has advised him that he will be applying for retirement benefits
from the Public Employees' Retirement System, and recommending that
Mr. Perez's salary be continued until the effective date of his
retirement, or until June 30, 1958, whichever occurs earlier, was
read. (Copy to each member of the City Council)
It was moved by Malburg, seconded by Ybarra, that the
recommendation of the Traffic Engineer, dated March 18, 1958, be
approved. Motion carried.
Communication from R. H. Bockhacker, Police Chief, dated
March 8, 1968, requesting authority for Lt. M. A. deRuyter to attend
the 15th Annual Training Conference of the California Check Investi-
gators Association at Stockton, California from April 24 to 26,
1968, with an expense allowance of $121.50, was read.
It was moved by Anderson, seconded by Ybarra, that the
request of the Police Chief, dated March 8, 1968, be approved and
authority granted to issue warrant in the amount of $121. 50 to
M. A. deRuyter. Motion carried.
Communication from R. H. Bockhacker, Police Chief, dated
March 18, 1958, recommending that certain personnel be reimbursed
the amounts as listed from the Education and Training Budget appro-
priation for Police Science courses, was read.
It was moved by Mailliard, seconded by Anderson, that the
request of the Police Chief, dated March 18, 1968, be approved and
authority granted to issue warrants in the amounts as listed. Motion
carried.
Communication from L. C. Husted, Fire Chief, dated March
15, 1968, requesting that Fireman W. R. Wilson be reimbursed the
sum of $5.50 from the Education and Training Budget appropriation
for Fire Science courses, was read.
It was moved by Malburg, seconded by Ybarra, that the
request of the Fire Chief, dated March 15, 1968, be approved and
authority granted to issue warrant in the amount of $5.50 to
W. R. Wilson. Motion carried.
Communication from L. C. Husted, Fire Chief, dated March
15, 1968, requesting authority for Captain Fred H. Colvin and
Fireman Louis C. Matteson to attend the Industrial Security
Conference on March 27, 1968 at the Ambassador Hotel, Los Angeles,
with an expense allowance of $10.00 each, was read.
It was moved by Malburg, seconded by Ybarra, that the
request of the Fire Chief, dated March 15, 1968, be approved and
authority granted to issue warrants in the amount of $10.00 each
to Fred H. Colvin and Louis C. Matteson. Motion carried.
Communication from Mr. Harold M. Dixon requesting a
license to store some tractors, trucks, crawler crane and miscel-
laneous items at 3366 Fruitland Avenue, was read.
Mr. Dixon appeared before the City Council relative to
his request.

request of Mr. Harold M. Dixon be referred to the Building Depart-
ment with power to act. Motion carried.
Communication from Mobilift - California Division of
Western Bearing Inc. requesting a license to conduct a business of
selling, servicing and renting fork lift trucks at 4927 Pacific
Blvd., ~vas read.
It was moved by Anderson, seconded by Ybarra, that the
request of Mobilift - California Division of Western Bearing Inc.
be approved and license granted. Motion carried.
Communication from C. H. McGovern, City Attorney, dated
March 18, 1968, requesting authority to attend the Spring Meeting
of City Attorneys, League of California Cities, at Santa Barbara,
from May 1 to May 3, 1968, with an expense allowance of $121.50,
1;vas read.
It was moved by Ybarra, seconded by Anderson, that the
request of the City Attorney, dated March 18, 1968, be approved and
authority granted to issue warrant in the amount of $121.50 to
C. H. McGovern. Motion carried.
Resolution No. 2951 - A Resolution of the City Council of
the City of Vernon, granting a zoning variance for Wilco Company,
a California corporation, was read.
It was moved by Mailliard, seconded by Malburg, that
Resolution No. 2951 be approved and adopted. Motion carried.

excavation applications numbered 28053 to 28059 inclusive be filed

demands presented during the period February 1 to February 29, 1968,
Tl\7hich includes Demands Nos. 1415 to 1424 (both inclusive), drawn on
the Crocker-Citizens National Bank, totaling $264,408.41 (Accounting

Mayor Furlong reported that this was the time and pIece for
the hearing on the Petition of Wilco Company for a variance from the
provisions of Ordinance No. 752, and all amendments thereto, to the
City of Vernon.
The following were duly acknowledged as being on file:
(1) Proof of Publication in the Los Angeles Daily Journa.l
on March 6, 7 and 8, 1968 of "Notice of Proposed Change from Zoning
Provisions";
(2) Affidavit of City Clerk Re Mailing Postal Card Notic0s
on application for variance of Wilco Company; and
(3) Affidavit of Posting "Notice of Proposed Change from
Zoning Provisions" by F. {~. Sumner, Building Inspector.
Communication from Vincent R. Bush, Superintendent of
Building, dated March 14, 1968, with reference to Petition for ZorH~
Variance by Wilco Company, recommending that a variance be granted,
was read. (Copy to each member of the City Council)
The City Clerk reported that there were no other written
communications relative to the petition of Wilco Company.
Mayor Furlong asked if anyone from the floor wished to
address the City Council relative to said petition.
Mr. Homer Procter of Market Confections, 4383 Bandini
Boulevard, Vernon, responded, and outlined the reasons Market
Confections was opposed to the granting of a zone variance to l.vilco
Company~
Mayor Furlong asked if anyone else from the floor wished to
address the City Council relative to the petition of Wilco Company_

Mr. J. A. McNeill of Wilco Company responded, and outlined
the reasons why he felt a zone variance should be granted to his
company.
After a general discussion of the petition for variance,
it was moved by Malburg, seconded by Anderson, tnat the City Attorney
be instructed to draft a resolution granting a variance to the Wilco
Company from the provisions of Ordinance No. 752 as recited in the
petition. Motion carried.
