19680416 Regular City Council Meeting - Minutes I I MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD APRIL 16, 1968 AT TWO O'CLOCK P.M. IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE. VERNON. CALIFORNIA. COUNCIL PRESENT: Anderson, Furlong, Mai11iard, Malburg, Ybarra COUNCIL ABSENT: None The meeting was called to order by Mayor R. J. Furlong. It was moved by Mai11iard, seconded by Anderson, that minutes of the meeting of April 2, 1968 be approved as written and submitted. Motion carried. Pursuant to Resolution No. 2944, the City Clerk presented his "Certificate of Canvass" of the results of the regular General Municipal Election held April 9, 1968. (Copy to each member of the City Council) Resolution No. 2958 - A Resolution of the City Council of the City of Vernon, California, reciting the fact of the General Municipal Election held in said City of Vernon on the 9th day of April, 1968, declaring the result thereof and such other matters as are provided by law, was read. It was moved by Malburg, seconded by Anderson, that Resolution No. 2958 be approved and adopted. Motion carried. Ayes: Anderson, Furlong, Mai11iard, Malburg, Ybarra Noe s : None Absent: None The City Clerk administered the Oath of Office prescribed in the State Constitution of the State of California to the duly elected members of the City Council and issued Certificates of Election to Robert J. Furlong and Charles H. Mai11iard. The election was held for the purpose of electing the following officers of said City as required by the laws relating to cities in the State of California, to wit: Two (2) Members of the City Council of said City for the full term of four years. The total number of votes cast in the City was fifty-two (52), and the number of precincts used in said election was one (1). The names of the persons voted for at said election for Members of the City Council of said City were as follows: Robert J. Furlong Charles H. Mai1liard William F. Powers The votes cast for the two (2) offices of City Council for the full term of four (4) years in the entire City (Precinct #1), were as follows: Robert J. Furlong Charles H. Mai1liard William F. Upon motion of Furlong, seconded by Anderson, Leonis C. Malburg was elected as Mayor Pro Tempore. Motion carried. Proof of Publication in the Los Angeles Daily Journal on March 26 and April 2, 1968 of "Notice of Public Hearing" was duly acknowledged as being on file. The City Clerk reported that no written communications relative to this matter had been received. No one was in the audience to comment on the adoption of Ordinance No. 791. It was moved by Anderson, seconded by Ybarra, that Ordinance No. 791 receive a second reading by title. Motion carried. Notice from the Local Agency Formation Commission that hearing has been set for April 24, 1968 on application of the Los Angeles County Fire Department to annex territory designated as "Annexation No. 80-67, Florence Parcel 2-67", to the Consolidated Fire Protection District of Los Angeles County, was presented. It was moved by Malburg, seconded by Ybarra, that notice from the Local Agency Formation Commission be received and filed. Motion carried. Communication from the California Highway Commission, dated April 2, 1968, transmitting a copy of its resolution stating their policy on the planning and design of highway projects when parks are involved, was read. It was moved by Ybarra, seconded by Anderson, that communi- cation from the California Highway Commission, dated April 2, 1968, together with transmittal, be received and filed. Motion carried. Copy of letter from the Vernon Chamber of Commerce, dated April 1, 1968, addressed to Police Chief R. H. Bockhacker, relative to the Vernon Police Department and law enforcement, was read. (Copy to each member of the City Council) It was moved by Malburg, seconded by Mail1iard, that copy of letter from the Vernon Chamber of Commerce, dated April 1, 1968, addressed to Police Chief R. H. Bockhacker, be received and filed. Motion carried. I I -5- 4/16/68 Communication from the Division of Highways, State of California, dated April 2, 1968, with reference to information to report to the 1969 Legislature as required by Section 256 of the Streets and Highways Code, and transmitting guidelines for future additions to, or deletions from, the State Highway System as contained in the recent SCR 31 (Stub Route) Report to the Legislature, was read. (Copy to each member of the City Council) It was moved by Ybarra, seconded by Mailliard, that communi- cation from the Division of Highways, State of California, dated April 2, 1968, together with transmittal, be referred to the Traffic Engineer. Motion carried. Claim for Damages against the City of Vernon, dated March 29, 1968, by Dolores Rodriguez and Alfred M. Rodriguez, for personal injuries sustained by Dolores Rodriguez, was presented. (Copy to each member of the City Council) It was moved by Malburg, seconded by Ybarra, that Claim for Damages against the City of Vernon, dated March 2Q, 1968, by Dolores Rodriguez and Alfred M. Rodriguez, be denied and referred to the City Attorney and the City's insurance carrier for necessary action. Motion carried. Co~~unication from State Senator H. L. Richardson, addressed to Mayor R. (Copy to each member of the City Council) Resolution No. 2957 - A Resolution of the City Council of the City of Vernon, urging the adoption of Senate Bill 425, was read. It was moved by Mailliard, seconded by Anderson, that Resolution No. 2957 be approved and adopted. Motion carried. (Copy to each member of the City Council) It was moved by Mai11iard, seconded by Malburg, that communication from the County of Los Angeles/Department of Real Estate Management, dated April 1, 1968, be referred to the Traffic Engineer for investigation and report. Ordinance No. 794 - An Ordinance of the City Council of the City of Vernon, regulating the transporting or conveying of food for commercial purposes in wholesale food vehicles and providing for the issuance of permits for said vehicles within the City of Vernon, was presented. It was moved by Mai11iard, seconded by Ybarra, that Ordinance No. 794 be read by title for a first reading. Motion carried. It was moved by Mailliard, seconded by Anderson, that Ordinance No. 794 receive and pass a first reading. Motion carried. It was moved by Ybarra, seconded by Malburg, that Ordinance No. 793 be read by title for a first reading. Motion carried. Looper, dated April 5, 1968, requesting permission to remodel the kitchen at 4328 Furlong Place at his expense and with the understanding that the improvement will be a permanent part of the premises, was read. (Copy to each member of the City Council) It was moved by Malburg, seconded by Ybarra, that Jack H. Looper be granted permission to remodel the kitchen at 4328 Furlong Place as set forth in his letter dated April 5, 1968, provided that said improvements are made subject to the conditions as outlined in his letter dated April 5, 1968. Motion carried. Activity Log of the Police Department for the period April 1 to 15, 1968 inclusive, was presented. It was moved by Ybarra, seconded by Anderson, that Activity Log of the Police Department be received and filed. Motion carried. Communication from F. A. Ziemer, City Clerk, dated April 10, 1968, requesting authority to employ Mr. John Shee Long as Deputy City Clerk - Utility, Grade 5, for a temporary period during summer vacation from approximately June 14, 1968 to approximately September 15, 1968, was read. Bockhacker, Police Chief, dated April 10, 1968, requesting authority to advance C. W. Frank to Policeman, Grade 2, and C. J. Kemp to Policeman, Grade 3, effective May 1, 1968, was read. It was moved by Mailliard, seconded by Anderson, that the request of the Police Chief, dated April 10, 1968, be approved. Motion carried. Communication from L. C. Husted, Fire Chief, dated April 10, 1968, requesting authority to purchase four Motorola portable radios, was read. (Copy to each member of the City Council) It was moved by Mailliard, seconded by Ybarra, that the request of the Fire Chief, dated April 10, 1968, be approved. Motion carried. Report of Health Department Activities for the month of March, 1968, was presented. (Copy to each member of the City Council) It was moved by Anderson, seconded by Ybarra, that Report of Health Department Activities be received and filed. Motion carried. Communication from C. E. Nemethi, M.D., Health Officer, dated April 11, 1968, requesting authority to attend the California Statewide Conference of Health Officers and Sanitation Directors at Asilomar, California, from May 8 to 10, 1968, inclusive, with an expense allowance of $184.75, was read. It was moved by Malburg, seconded by Anderson, that the request of the Health Officer, dated April 11, 1968, be approved and authority granted to issue warrant in the amount of $184.75 to C. E. Nemethi, M.D. Motion carried. Communication from C. E. Nemethi, M.D., Health Officer, dated April 11, 1968, requesting authority for Louis S. Hauger to attend the California Statewide Conference of Health Officers and Sanitation Directors at Asilomar, California, from May 6 to 10, 1968, inclusive, with an expense allowance of $275.25, was read. It was moved by Malburg, seconded by Anderson, that the request of the Health Officer, dated April 11, 1968, be approved and authority granted to issue warrant in the amount of $275.25 to Louis S. Hauger. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated April 11, 1968, advising that Officer Robert L. Johncox was terminated from the Police Department effective as of the close of business on April 11, 1968, was read. It was moved by Mailliard, seconded by Ybarra, that communi- cation from the Police Chief, dated April 11, 1968, be received and filed. Motion carried. I I -8- 4/16/68 Communication from R. H. Bockhacker, Police Chief, dated April 12, 1968, recommending that Lt. J. L. Morrison be reimbursed the sum of $68.45 from the Education and Training Budget appropri- ation for a course at the University of California, was read. It was moved by Anderson, seconded by Mailliard, that the recommendation of the Police Chief, dated April 12, 1968, be approved and authority granted to issue warrant in the amount of $68.45 to J. L. Morrison. Motion carried. Communication from D. D. Grayson, Traffic Engineer, dated April 15, 1968, recommending that tbe alley between 45th Street and Packers Avenue be vacated and that permanent easement for utilities as enumerated in Section 8330 of the Streets and Highways Code, including access for adjacent property owners, be reserved, was read. (Copy to each member of the City Council) It was moved by Malburg, seconded by Mailliard, that communication from the Traffic Engineer, dated April 15, 1968, be laid over until the next regular meeting. Motion carried. Communication from TASC with reference to proposed change in the Bylaws of TASC, to enlarge the area of TASC by including Imperial County and the remixing portions of San Bernardino and Riverside Counties, transmitting a sample resolution for consideration, incorporating these proposed revisions in the Agreement and the proposed revision changes in the wording of the Bylaws, was read. (Copy to each member of the City Council) It was moved by Malburg, seconded by Ybarra, that the City Attorney be instructed to draft a resolution approving and agreeing to the change in area of TASC, and approving and agreeing to the proposed changes in the Bylaws of TASC. Motion carried. Resolution No. 2956 - A Resolution of the City Council of the City of Vernon, urging the adoption of the Legislative Proposals initiated by the District Attorney of the County of Los Angeles as of February 1, 1968, was read. Grayson, Traffic Engineer, made an oral progress report on the current personal illness of Mr. Rafael Perez, Utility Man IV, supplementing the written report Mr. Grayson made under date of March 18, 1968 to the City Council at its meeting held March 19, 1968. A general discussion was held relative to re-evaluating the action taken by the City Council on March 19, 1968 to continue Mr. Perez's salary until the effective date of his retirement, or until June 30, 1968, whichever occurred earlier. It was moved by Malburg, seconded by Mai1liard, that in view of the recent adverse development in the condition of Mr. Perez's health, the Traffic Engineer be instructed to make a progress report on Mr. Perez's current personal illness to the City Council in approximately one month, and at that time the City Council would re-evaluate its action taken on March 19, 1968. "Warrant Register No. 259" covering claims and demands presented during the period April 1 to 15, which includes Demands Nos. 8-947 to 8-1128 (both inclusive) drawn on the United California Bank, totaling $1,384,666.96 (Light and Power Warrants $1,264,451.50) (Accounting Period April, 1968), was examined and audited. W. Sumner, Building Inspector. Communication from D. D. Grayson, Traffic Engineer, dated April 10, 1968, with reference to Petition by Donald F. Shaw, Donald W. Shaw and E. Mayor Furlong asked if anyone from the floor wished to address the City Council relative to said petition. Mr. Nathan Gillin of Gillin and Scott, Attorneys for the Petitioners, responded and recited reasons why the petitioners believed that a variance should be granted. Mr. Gillin introduced Mr. Harry Krantz, President of Midwest Pork Products Company, and questioned h~ relative to his present operations and proposed operations if the variance was granted.
