MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF \lERNON
HELD AUGUST 20, 1968 AT TWO 0 I CI.OCK
P.M. IN THE COUNCIL CI~ER OF THE
CITY HALL LOCATED AT 4305 SANTA FE
AVENUE, VERNON 9 CALIFORNIA.
COUNCIL PRESENT: Anderson, Furlong, Mailliard, Ybarra
COUNCIL ABSENT: Malburg
The meeting was called to order by Mayor Furlong.
It was moved by Mailliard, seconded by Ybarra, that minutes
of the meeting of August 6, 1968 be approved as written and submitted.
Motion carried.
Communication from D. D. Grayson, Traffic Engineer, dated
August 16, 1968, transmitting a proposed license agreement between
the City of Vernon and Kal Kan Foods Incorporated covering the
construction, operation and maintenance of an overhead conveyor
over Alcoa Avenue, south of 44th Street; and recommending that the
agreement be approved and that the Mayor and the City Clerk be
authorized to execute the agreement on behalf of the City of Vernon,
was read.
It was moved by Mailliard, seconded by Anderson, that the
recommendation of the Traffic Engineer, dated August 16, 1968, be
approved, and that the Mayor and the City Clerk be authorized to
execute license agreement between the City of Vernon and Kal Kan
Foods Incorporated. Motion carried.
Copies of Ordinance No. 795 were distributed to members of
the City Council for study subsequent to the City Council meeting of
August 6, 1968.
It was moved by Anderson, seconded by Ybarra, that
Ordinance No. 795 receive a second reading by title. Motion carried.
Ordinance No. 795 - An Ordinance of the City Council of the
City of Vernon, providing for the licensing, impounding, and regu-
lating the keeping, sale, and exhibition of animals, was read for a
second reading by title.
It was moved by Mailliard, seconded by Ybarra, that
Ordinance No. 795 receive and pass a second reading. Motion carried.

It was moved by Anderson, seconded by Ybarra, that in
accordance with Government Code Section 36934, the reading of
Ordinance No. 795 in full be waived; and that Ordinance No. 795
receive a third and final reading by title. Notion unanimously
carried.

Ordinance No. 795 - An Ordinance of the City Council of the
City of Vernon, providing for the licensing, impounding, and r.egu-
lating the keeping, sale, and exhibition of animals, was read by
title for a third and final reading.
It was moved by Ybarra, seconded by Mailliard, that
Ordinance No. 795 receive and pass a third reading and be adopted.
Motion carried.

Communication from Flynn's Industrial Catering dba Tip
Dancer requesting a license to operate a lunch truck in the City'
of Vernon, was read.
It was moved by Ybarra, seconded by Anderson, that the
request of Flynn's Industrial Catering dba Tip Dancer be approved
and license granted. Motion carried.
Communication from Koffee Ken's, Inc. requesting a license
to operate a lunch truck in the City of Vernon, was read.
It was moved by Ybarra, seconded by Anderson, that the
request of Koffee Ken's, Inc. be approved and license granted.
Motion carried.
Communication from George Lumel dba Chow Down Caterers
requesting a license to operate a lunch truck in the City of Vernon,
'Vlas read.
It was moved by Ybarra, seconded by Anderson, that the
request of George Lumel dba Chow Down Caterers be approved and
license granted. Motion carried.
Communication from Caroli's Vending Machine Service
requesting a license to conduct a business of vending machine service
at !.j4ll Seville Avenue, was read.
It was moved by Mailliard, seconded by Ybarra, that the
request of Caroli's Vending Machine Service be referred to the
Building Department with power to act. Motion carried.
Communication from General Cable Corporation requesting a
license to conduct a business of distribution of wire and cable at
4510 Lorna Vista Avenue, was read.
It was moved by Mailliard, seconded by Ybarra, that the
request of General Cable Corporation be referred to the Building
Department with power to act. Motion carried.
Communication from A. R. Pearson Truck Co. Inc., dated
August 6, 1968, requesting an additional extension for one year of
the conditional permit previously granted by the City Council to use
an office trailer for their dispatch office on a temporary basis,
was read. (Copy to each member of the City Council)

It was moved by Anderson, seconded by Ybarra, that A. R.
Pearson Truck Co. Inc. be authorized to use an office trailer for
their dispatch office on a temporary basis for an additional period
of one year, maximum time limit shall be September 1, 1969, subject
to all other conditions established by the City Council at its
meeting held July 19, 1966. Motion carried.
Communication from the Finance Committee, dated August 12,
1968, making certain recommendations with reference to the summary
of anticipated major street projects for the next five years and
with reference to other pertinent matters, was read. (Copy to each
member of the City Council)
It was moved by Mailliard, seconded by Ybarra, that the
recommendations of the Finance Committee, as outli.ned in communi-
cation dated August 12, 1968, be approved. Motion carried.
Ordinance No. 796 - An Ordinance to provide for the
protection of public streets and rights of way thereof; regulating
the use thereof and the manner in which the same may be altered,
excavated under, obstructed or encroached upon; and providing
penalties for the violation of the provist%~~thereof; and repealing
Ordinances Numbers 44, 102, 134., l49, 156, 't22, 299, 542 and 592,
w~s read by title for a first reading. (Copy to each member of the

It was moved by Anderson, seconded by Ybarra, that
Ordinance No. 796 receive and pass a first reading. Motion carried.

Communication from Charles H. McGovern, City Attorney,
dated lugust 8, 1968, requesting authority to attend the League of
California Cities Institute on Labor Relations at San Francisco
from September 4 to 6, 1968, with a.n expense allowance of $l86.90,
was read.
It was moved by Anderson, seconded by Ybarra, that the
req'uest of the City Attorney, dated August 8, 1968, be approved and
al~thority granted to issue warrant in the amount of $l86.90 to
Charles H. McGovern. Motion carried.
Communication from Vincent R. Bush, Superintendent of
Building, dated August 8, 1968, advising that Riter C. Taylor, Sr.,
Building Inspector, has submitted his resignation effective at the
close of business on August 15, 1968, and recommending that the
resignation be accepted, was read.
It was moved by Ybarra, seconded by Mailliard, that the
resignation of Riter C. Taylor, Sr. be accepted. Motion carried.
Communication from R. H. King, Superintendent of the Wate~
Department, dated August 15, 1968, advising that Joseph Stark,
Utility Man, has tendered his resignation effective at the close of
business on August 19, 1968, and recommending that his resignation
be accepted, was read.
It was moved by Anderson, seconded by Ybarra, that the
resignation of Joseph Stark be accepted. Motion carried.

Report of Health Department Activities for the month of
July, 1968, was presented. (Copy to each member of the City Council)
It was moved by Ybarra, seconded by Anderson, that the
Report of Health Department Activities be received and filed. Motion
carried.
Communication from Mr. Theodore R. Wertz, Sr., dated
August 14, 1968, protesting the continued use of the gutter to
dispose of the black material used in the manufacture of bombs at
the plant of Norris Industries on 52nd Drive in the City of Vernon,
was read. (Copy to each member of the City Council)
It was moved by Anderson, seconded by Ybarra, that communi-
cation from Mr. Theodore R. Wertz, Sr., dated August 14, 1968, be
referred to the City Engineer and to the Director of Environmental
Health. Motion carried.
Communication from Louis ..). Hauger, Director of Environ'-
mental Health, dated August 15, 1968, with reference to letter from
T. R. Wertz relative to industrial waste discharging into the street
by Norris Industries, 4731 E. 52nd Drive, was read. (Copy to each
member of the City Council)
It was moved by Mailliard, seconded by Ybarra, that a copy
of communication from Louis S. Hauger, Director of Environmental
Health, dated August 15, 1968, be sent to Mr. Theodore R. Wertz, Sr.
Motion carried.
Activity Log of the Police Department for the period
August 1 to 15, 1968 inclusive, was presented.
It was moved by Anderson, seconded by Ybarra, that Activity
Log of the Police Department be received and filed. Motion carried.
Communication from V. R. Bush, Superintendent of Building,
dated August 16, 1968, requesting authority to attend the Annual
Business Meeting - International Conference of Building Officials
at Houston, Texas from September 23 to 27, 1968, inclusive, with
an expense allowance of $423.50, was read.
It was moved by Mailliard, seconded by Ybarra, that the
request of the Superintendent of Building, dated August 16, 1968,
be approved and authority granted to issue warrant in the amount
of $423.50 to V. R. Bush. Motion carried.
Communication from V. R. Bush, Superintendent of Building,
dated August 16, 1968, requesting authority for Francis W. Sumner
to attend the 39th Annual Business Conference of the Plumbing and
Mechanical Officials at Tucson, Arizona from September 30 to October
4, 1968, inclusive, with an expense allowance of $256.00, was read.
It was moved by Mailliard, seconded by Anderson, that the
~equest of the 3uperintendent of Building, dated August 16, 1968,
be approved and authori~ granted to issue warrant in the amount of
$256.00 to Francis W. Sumner. Motion carried.

Communication from Andrew Brown Company, dated August l5,
1968, requesting permission to locate a trailer on their property at
54.31 District Boulevard to house six office personnel for approxi-
mately one year, was read. (Copy to each member of the City Council)
It was moved by Mailliard, seconded by Anderson, that
Andrew Brown Company be authorized to locate one office trailer on
their property located at 54.31 District Boulevard, provided that
said trailer is used only for the purpose as outlined in their letter
dated August 15, 1968; provided that said trailer is not used for
sleeping andlor cooking purposes; provided that the requirements of
all City departments are complied with and that all necessary City
permits are obtained; and with a stipulation that the maximum time
limit said trailer may be used for the purpose as outlined shall be
September 1, 1969. Motion carried.
Communication from R. H. Bockhacker, Police Chief, dated
August 16, 1968, requesting that Officer U. E. Flick be advanced
from Policeman, Grade 3 to Grade 2, effective September 1, 1968,
was read.
It was moved by Mailliard, seconded by Ybarra, that the
request of the Police Chief, dated August l6, 1968, be approved.
Motion carried.

Washington Boulevard be approved as outlined, was read. (Copy to

It was moved by Anderson, seconded by Mailliard, that the
recommendation of the Traffic Engineer, dated August 16, 1968, be
approved. Motion carried.
Resolution No. 2976 - A Resolution of the City Council of
the City of Vernon fixing the amount of money necessary to be raised
by taxation upon the taxable property within said City as a revenue
to carryon the various departments of such municipal corporation for
the fiscal year commencing July 1, 1968, and to pay the bonded or
other indebtedness of said City of Vernon, or any portion or distr.ict
thereof, was read.
It was moved by Mailliard, seconded by Anderson, that
Resolution No. 2976 be approved and adopted. Motion carried.

Resolution No. 2977 - A Resolution of the City Council of
the City of V8rnon fixing the rate of taxes and levying the taxes
for the fiscal year beginning July l, 1968, was read.
It was moved by Mailliard, seconded by Ybarra, that
Resolution No. 2977 be approved and adopted. Motion carried.

Resolution No. 2978 - A Resolution of the City Council of
the City of Vernon, finding and determining that the public interest
and necessity require the acquisition of certain real property fo~
the purposes of improving public streets by the City of Vernon, was
read.
It was moved by Mailliard, seconded by Anderson, that
Resolution No. 2978 be approved and adopted. Motion carried.

It was moved by Ybarra, seconded by Mailliard, that
excavation applications numbered 28161 to 28177 inclusive be filed
and permits granted. Motion carried.
Hpayroll Warrant Register No. 133" coveri.ng claims and
demands presented during the period July 1 to 31, which includes
Demands Nos. 1465 to 1475 (both inclusive), drawn on the Crocker-
Citizens National Bank, totaling $275,905.28 (Accounting Period
July, 1968), was examined and audited.
It was moved by Mail1iard, seconded by Ybarra, that
Hpayro1l 'Vlarrant Register No. l331i be approved and payment authorized
for Demands Nos. 1465 to 14.75 (both inclusive), with no exceptions.

It was moved by Mailliard, seconded by Ybarra, that

Demands Nos. 8-2042 to 8-2216 (both inclusive), with no exceptions.
