19690916 Regular City Council Meeting - Minutes I I MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD SEPTEMBER 16, 1969 AT TWO O'CLOCK P.M. IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANIA FE AVENUE. VERNON. CALIFORNIA. COUNCIL PRESENT: Anderson, Furlong, Mai11iard, Malburg, Ybarra COUNCIL ABSENT: None The meeting was called to order by Mayor R. J. Furlong. It was moved by Anderson, seconded by Ybarra, that minutes of the meeting of September 2, 1969 be approved as written and submitted. Motion carried. The Clerk announced that this was the time and place for opening of bids received for First Street Improyement, in accordance with Contract No. 342. It was moved by Malburg, seconded by Mai1liard, that the Clerk be instructed to open and read the bids submitted. Motion carried. The Clerk opened and read the following bids: Fred Weisz & Associates Sully Miller Contracting Co. Griffith Company Vernon Paving Company O. J. Padilla Paving Co. $ 27,481.25 2S, 917 .70 30,202.50 26,971.25 ,28,036.50 It was moved by Malburg, seconded by Anderson, that bids received for First Street Improvement, in accordance with Contract No. 342, be referred to the Director of Public Works and the City Attorney for checking and report. Motion carried. The Clerk announced that this was the t~e and place for opening of bids received for Street Sweeper, in accordance with Contract No. 344. It was moved by Mai11iard, seconded by Ybarra, that the Clerk be instructed to open and read the bids submitted. Motion carried. The Clerk opened and read the following bids: Dearth Machinery Co. Kemp Yorke Equipment Co. $ 12,994.20 13,633.70 It was moved by Mai11iard, seconded by Anderson, that bids received for the Street Sweeper, in accordance with Contract No. 344, be referred to the Director of Public Works and the City Attorney for checking and report. Motion carried. The Clerk announced that this was the ttme and place for opening of bids received for Asphalt Truck, in accordance with Contract No. 345. It was moved by Ybarra, seconded by Malburg, that the Clerk be instructed to open and read the bids submitted. Motion carried. Motion carried. Communication from Morris B. Pendleton requesting a license to conduct an office for Chairman of Board of Directors of a tool manufacturing company at 2833 Leonis Blvd., Suite 309, was read. CounciLman Malburg disclosed that he is the owner of the property located at 2833 Leonis Blvd. It was moved by Anderson, seconded by Ybarra, that the request of Morris B. Pendleton be approved and license granted. Motion carried. Communication from Weber Truck and Warehouse requesting a license to conduct a warehousing and trucking business at 5035 Gifford Avenue, was read. It was moved by Ybarra, seconded by Anderson, that the request of Weber Truck and Warehouse be referred to the Building Department with power to act. Motion carried. Communication from State Senator Lawrence E. Walsh, dated September 8, 1969, with reference to the Quimby-Walsh Act which was recently signed by the Governor, and restores control of topless and bottomless entertainers to local government, was read. It was moved by Malburg, seconded by Ybarra, that communi- cation from State Senator Lawrence E. Walsh, dated Septeuwer 8, 1969, be received and filed. Motion carried. Communication from Bechtel Corporation, dated September 3, 1969, requesting authority to retain one 20' x 50' trailer for an additional year, was read. (Copy to each member of the City Council) It was moved by Anderson, seconded by Mailliard, that Bechtel Corporation be authorized to use an office trailer at 2734 East 46th Street on a temporary basis for an additional period of one year, maximum time limit shall be October 1, 1970, subject to all other conditions established by the City Council at its meeting held August 15, 1967. Motion carried. Communication from R. H. King, Director of Public Works, dated September 5, 1969, transmitting an easement for street purposes from The Clorox Company covering a portion of Bandini Boulevard; and recommending that the easement be accepted and that the grantors be advised of the official recordation, was read. I I -3- 9 16 69 It was moved by Mailliard, seconded by Ybarra, that Easement be accepted from The Clorox Company and that the Mayor and the City Clerk be authorized to execute Certificate of Acceptance. Motion carried. Communication from R. H. King, Director of Public Works, dated September 8, 1969, transmitting an easement for street purposes from Tepanos Manasian and Helen Manasian covering a portion of Bandini Boulevard; and recommending that the easement be accepted and that the grantors be advised of the official recordation, was read. It was moved by Malburg, seconded by Anderson, that Easement be accepted from Tepanos Manasian and Helen Manasian and that the Mayor and the City Clerk be authorized to execute Certificate of Acceptance. Motion carried. Communication from R. H. King, Director of Public Works, dated August 18, 1969, with reference to understanding reached with Mr. John S. Schneiders representing Certified Grocers of California Ltd., owners of Spartan Grocers, Inc.; and recommending that the City Council approve the provisions and authorize the expenditure of funds, was read. (Copy to each member of the City Council) It was moved by Malburg, seconded by Ybarra, that the recommendation of the Director of Public Works, dated August 18, 1969, be approved. Motion carried. Communication from R. H. King, Director of Public Works, dated September 4, 1969, transmitting an easement for street purposes from Spartan Grocers, Inc.; and recommending that the easement be accepted and that the grantors be advised of the official recordation, was read. It was moved by Malburg, seconded by Anderson, that Easement be accepted from Spartan Grocers, Inc. and that the Mayor and the City Clerk be authorized to execute Certificate of Acceptance. Motion carried. Communication from R. H. King, Director of Public Works, dated September 8, 1969, with reference to a revised license fee schedule for pipe lines or conduits across a street pursuant to the fees adopted in Resolution No. 2980 which apply to Ordinance No. 796, the Encroachment Ordinance, was read. (Copy to each member of the City Council) It was moved by Anderson, seconded by Ybarra, that communi- cation from the Director of Public Works, dated September 8, 1969, be referred to the Finance Committee. Motion carried. Communication from R. H. King, Director of Public Works, dated September 10, 1969, transmitting proposed License Agreement between the City of Vernon and California Weavers, Inc. covering the construction, operation and maintenance of a ten-inch cast iron force main and four cement concrete thrust blocks in 52nd Street; and recommending that the agreement be approved and that the Mayor and the City Clerk be authorized to execute same on behalf of the City of Vernon, was read. I I -4- 9 16 69 It was moved by Malburg, seconded by Ybarra, that the Mayor and the City Clerk be authorized to execute, on behalf of the City of Vernon, License Agreement between the City of Vernon and California Weavers, Inc. covering the construction, operation and maintenance of a ten-inch cast iron force main and four cement concrete thrust blocks in 52nd Street. Motion carried. Communication from R. H. King, Director of Public Works, dated September 10, 1969, transmitting a report on "Pacific Boulevard Improvement", and recommending that Proposal A, T,01ith the mentioned modification, be approved and requesting authority to prepare plans and specifications for construction, was read. (Copy to each member of the City Council) It was moved by Mailliard, seconded by Ybarra, that the recommendation of the Director of Public Works, dated September 10, 1969, be approved. Motion carried. Communication from R. H. King, Director of Public Works, dated September 10, 1969, advising that Mr. Felipe Acosta, Utility Man with the Water Department, has tendered his resignation effective at the close of business September 30, 1969, was read. It was moved by Malburg, seconded by Anderson, that the resignation of Mr. Felipe Acosta be accepted. Motion carried. Resolution No. 3038 - A Resolution of the City Council of the City of Vernon, expressing its appreciation to Felipe Acosta for many years of service, was read. It was moved by Malburg, seconded by Anderson, that Resolution No. 3038 be approved and adopted. Motion carried. Furlong be reimbursed the sum of $30.95 from the Education and Training Budget appropri- ation for Police Science courses at East Los Angeles College, was read. It was moved by Mai11iard, seconded by Anderson, that the recommendation of the Police Chief, dated September 9, 1969, be approved and authority granted to issue warrant in the amount of $30.95 to D. K. Furlong. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated September 9, 1969, requesting authority to advance Transcriber- Typist E. R. Callender to Grade 1, effective as of October 1, 1969, was read. It was moved by Mailliard, seconded by Ybarra, that the request of the Police Chief, dated September 9, 1969, be approved. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated August 20, 1969, requesting authority for Sgt. Frank E. Sweeney to attend the California Narcotics Officers Association Annual State Training Conference at Ramada Sands, City of South Lake Tahoe, from October 15 to October 17, 1969 inclusive, with an expense allowance of $216.40, was read. Sweeney. Motion carried. Communication from C. E. Nemethi, M.D., Health Officer, dated September 5, 1969, requesting authority for Louis S. Hauger to attend the Western Industrial Health Conference in San Francisco, California from October 16 to October 18, 1969 inclusive, with an expense allowance of $216.90, was read. It was moved by Mail1iard, seconded by Anderson, that the request of the Health Officer, dated September 5, 1969, be approved and authority granted to issue warrant in the amount of $216.90 to Louis S. Hauger. Motion carried. Communication from C. E. Nemethi, M.D., Health Officer, dated September 5, 1969, requesting authority for Richard W. Hilton to attend the American Water Works Association Backflow Prevention Seminar at Santa Barbara, California on September 24, 1969, with an expense allowance of $44.00, was read. It was moved by Malburg, seconded by Ybarra, that the request of the Health Officer, dated September 5, 1969, be approved and authority granted to issue warrant in the amount of $44.00 to Richard lJ.J. Hilton. Motion carried. Report of Health Department Activities for the month of August 1969, was presented. (Copy to each member of the City Council) It was moved by Anderson, seconded by Ybarra2 that Report of Health Department Activities be received and filed. Motion carried. Activity Log of the Police Department for the period September 1 to 15, 1969 inclusive, was presented. It was moved by Malburg, seconded by Ybarra, that Activity Log of the Police Department be received and filed. Motion carried. Quitclaim Deed from the County of Los Angeles transferring County-owned property to the City of Vernon for the sum of $6,500.00 as authorized by the City Council at its meeting held July 1, 1969, was presented. It was moved by Ybarra, seconded by Anderson, that Quitclaiffi Deed be accepted from the County of Los Angeles and that the Mayor and the City Clerk be authorized to execute Certificate of Acceptance. Motion carried. Communication from R. H. King, Director of Public Works, dated September 16, 1969, transmitting an assignment of easement for sewer line in right-of-way between 44th Street and Downey Road from Kal Kan Foods, Inc., and recommending that the assignment be accepted and that the grantors be advised of the official recordation, 'I:>1as read. It was moved by Mailliard, seconded by Ybarra, that Assign- ment of Easement be accepted from Kal Kan Foods, Inc. and that the Mayor and the City Clerk be authorized to execute Certificate of Acceptance. Pipe and Supply Company, dated penalty assessed for late payment converting their accounts payable It was moved by Malburg, seconded by Ybarra, that the request of Keenan Pipe and Supply Company, dated September 15, 1969, be approved. Motion carried.. Communication from V. R. Bush, Superintendent of Building, dated September 15, 1969, recommending that Western Tube and Conduit of Los Angeles, Inc., 2730 E. 37th Street, be permitted to add 17,000 square feet to their existing structures and to omit fire sprinkler protection systems from their buildings, provided that at any time in the future the occupancy of these buildings should change: then the necessary fire sprinkler systems shall be installed, was read. It was moved by Ybarra, seconded by Mailliard, that the recommendation of the Superintendent of Building, dated September 15, 1969, be approved. Motion carried. Communication from The London Broiler requesting a license to operate an additional hot truck in the City of Vernon, was read. It was moved by Anderson, seconded by Ybarra, that the request of The London Broiler be approved and license granted. Motion carried. It was moved by Anderson, seconded by Ybarra, that Ordinance No. 803 be read by title for a first reading. Motion carried. Ordinance No. 803 - An Ordinance of the City of Vernon, fixing the rates to be charged for electrical energy distributed and supplied by said City of Vernon within its boundaries, and repealing Ordinances Nos. 766, 783, and 786 of said City, was read by title for a first reading. It was moved by Malburg, seconded by Ybarra, that Ordinance No. 803 receive and pass a first reading. Motion carried. Ayes: Anderson, Furlong, Mailliard, Malburg, Ybarra Noes: None Absent: None Resolution No. 3039 - A Resolution of the City Council of the City of Vernon, urging the League of California Cities to oppose any change in the current tax exemption on State and local govern- ment bond interest, was read. It was moved by Malburg, seconded by Ybarra, that Resolution No. 3039 be approved and adopted. Motion carried. It was moved by Mailliard, seconded by Ybarra, that "Payroll Warrant Register No. 146" be approved and payment authorized for Demands Nos. 1598 to 1607 (both inclusive), with no exceptions.
