19691118 Regular City Council Meeting - Minutes I I MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD NOVEMBER 18, 1969 AT TWO O'CLOCK P.M. IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE. VERNON. CALIFORNIA COUNCIL PRESENT: Anderson, Furlong, Mai1liard, Malburg, Ybarra COUNCIL ABSENT: None The meeting was called to order by Mayor R. J. Furlong. It was moved by Ybarra, seconded by Anderson, that minutes of the meeting of November 4, 1969 be approved as written and submitted. Motion carried. The Clerk announced that this was the time and place for opening of bids received for the construction of Wells Nos. 16 and 17. in accordance with Contract No. 347. It was moved by Malburg, seconded by Mai11iard, that the Clerk be instructed to open and read the bids submitted. Motion carried. The Clerk opened and read the following bids: Midway Drilling and Pump Co. Roscoe Moss Company Option I Option II $ 73,650.00 70,639.00 $ 147,300.00 138,278.00 It was moved by Malburg, seconded by Ybarra, that bids received for the construction of Wells Nos. 16 and 17, in accordance with Contract No. 347, be referred to the Director of Public Works and the City Attorney for checking and report. Motion carried. Mr. Milton S. Klein, Vice President of The Selig Chemical Industries, California Troy Branch, appeared before the City Council relative to the proposed installation of a 20 horsepower boiler at 2840 So. Alameda Street. It was moved by Malburg, seconded by Ybarra, that the matter relative to the proposed installation of a 20 horsepower boiler at 2840 So. Alameda Street be referred to the Building Department and the Fire Department for investigation and report. Motion carried. It was moved by Anderson, seconded by Ybarra, that Ordinance No. 805 receive a second reading by title. Motion carried. Ordinance No. 805 - An Ordinance of the City Council of the City of Vernon, requiring the issuance of health permits for specified businesses and vehicles, and setting forth rules and regulations pertaining to the same, was read for a second reading by title. It was moved by Anderson, seconded by Ybarra, that Ordinance No. 805 receive and pass a second reading. Motion carried. King, Director of Public Works, dated November 12, 1969, requesting authority to advance Jera1d Selvin Ness to Utility Man IV, Step 4, effective December 1, 1969, as he will have satisfactorily completed his probationary period, ~las read. It was moved by Malburg, seconded by Mai11iard, that the request of the Director of Public Works, dated November 12, 1969, be approved. Motion carried. Communication from R. H. King, Director of Public Works, dated November 12, 1969, transmitting Contract No. 34.8 for Jewel Avenue (Private) Water and Sewer Line Construction; and recommending that this contract be approved and that authority be granted to advertise for bids, was read. R<?.;~,21u1::icn No. 3052 - A Resolution of the City Council of the City of Vernon, approving Contract No. 348 for Jewel Avenue (Private) Water and Sewer Line Construction, and giving the notice inviting sealed proposals or bids in accordance with Contract No. 348 of the City of Vernon, was read. It was moved by Malburg, seconded by Ybarra, that Resolution No. 3052 be approved and adopted. Motion carried. King, Director of Public Works, dated November l4, 1969, requesting authority to change the seven existing 11,000 lumen mercury vapor fixtures on 44th Street between Alcoa Avenue and Downey Road to seven 20,000 lumen mercury vapor fixtures, was read. It was moved by Ybarra, seconded by Anderson, that the request of the Director of Public Works, dated November 14, 1969, be approved. Motion carried. I I -3- 1l 18 69 Communication from R. H. Bockhacker, Police Chief, dated November 6, 1969, recommending that Sgt. Frank Sweeney's indefinite suspension be modified to a suspension of three weeks, without pay, for violation of Sections 400.15 and 500.5 of the Department's Manual of Policy and Ethics; and that the Sergeant be returned to duty effective as of Saturday, November 8, 1969, was read. (Copy to each member of the City Council) It was moved by Mail1iard, seconded by Ybarra, that the recommendation of the Police Chief, dated November 6, 1969, be approved. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated November 10, 1969, advising that Officer U. E. Flick has tendered his resignation effective as of the end of his tour of duty on November 29, 1969; and recommending that the resignation be accepted, was read. It was moved by Malburg, seconded by Ybarra, that the re8ignation of Officer U. E. Flick be accepted. Motion carried. Activity Log of the Police Department for the period November 1 to 15, 1969 inclusive, was presented. It was moved by Malburg, seconded by Anderson, that Activity Log of the Police Department be received and filed. Motion carried. Report of Health Department Activities for the month of October 1969, was presented. (Copy to each member of the City Council) It was moved by Ybarra, seconded by Anderson, that Report of Health Department Activities be received and filed. Motion carried. Communication from Space Rentals, Inc., dated November 14, 1969, requesting permission to use a 12' x 60' mobile office trailer for a temporary period of one year on the property at 3094 E. Vernon Avenue, was read. (Copy to each member of the City Council) Councilman Malburg disclosed that he is the owner of the property at 3094 E. Vernon Avenue. It was moved by Anderson, seconded by Ybarra, that Space Rentals, Inc. be authorized to locate a 12' x 60' mobile office trailer on the property at 3094 E. Vernon Avenue, provided that said trailer is used only for the purposes as outlined in their letter dated November 14, 1969; provided that said trailer is not used for sleeping and/or cooking purposes; provided that the requirements of all City departments are complied with and that all necessary City permits are obtained; and with a stipulation that the maximum time limit said trailer may be used shall be December 1, 1970. Motion carried. Communication from L. C. Husted, Fire Chief, dated November 12, 1969, advising that Fireman Sam C. Capra sustained a job-connected back injury on November 27, 1968; and recommending that Capra apply for a disability retirement effective December 1, 1969, was read. Capra be deleted from the pa)~011 at the close of business on November 30, 1969. Motion carried. Resolution No. 3053 - A Resolution of the City Council of the City of Vernon, commending Sam C. Capra for his years of service to the City of Vernon, was read. It was moved by Malburg, seconded by Ybarra, that Resolution No. 3053 be approved and adopted. Motion carried. Husted, Fire Chief, dated November 14, 1969, recommending that the City of Vernon include within its existing telephone Fire Alarm System four telephone Fire Alarm boxes located in the City of Maywood; recommending that the City Council make a request to the Maywood City Council that the City of Vernon be allowed to maintain said alarm boxes within the City of Ma~7oodls boundary; and recommending that each of these four alarm boxes be posted with an appropriate notice indicating that the alarm would be transmitted to the City of Vernon, was read. (Copy to each member of the City Council) It was moved by Anderson, seconded by Mai11iard, that the recommendations of the Fire Chief, dated November l4, 1969, be approved. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated November 14, 1969, requesting that lease agreement between the City of Vernon and Officer Raymond D. Tisdale for one 1966 Harley- Davidson Motorcycle, Engine No. 66FL12320, be terminated; and requesting that the lease agreement, as submitted, between the City of Vernon and Officer Raymond D. Tisdale for one 1970 Har1ey- Davidson Motorcycle, Engine No. lA14209HO, be approved effective as of November 18, 1969, was read. It was moved by Mai11iard, seconded by Ybarra, that the requests of the Police Chief, dated November 14, 1969, be approved and that the Mayor and the City Clerk be authorized to execute new lease agreement on behalf of the City of Vernon. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated November 13, 1969, requesting authority to advance R. V. Sapp to Policeman Grade 2 and R. D. Adams to Policeman Grade 3, effective December 1, 1969, was read. It was moved by Malburg, seconded by Mai1liard, that the request of the Police Chief, dated November 13, 1969, be approved. Motion carried. Communication from Atlantic Richfield Company, dated November l7, 1969, making application for a period of 40 years from time to time to excavate for and lay, construct, reconstruct, connect with other pipe lines, maintain, operate, repair, alter, change the size of, abandon in place and/or remove a private pipe line system together with all appurtenances and cathodic protection facilities necessary to properly maintain and operate said pipe line system, I I -5- 11 l8 69 for the transportation of oil, gas, gasoline, petroleum, water and/or other liquid substances along the route, under, along, over and across certain streets, alleys and highways, as enumerated, through the City of Vernon, was read. (Franchise Ordinance No. 432 expires on March 3, 1970.) (Copy to each member of the City Council) It was moved by Malburg, seconded by Ybarra, that communi- cation from Atlantic Richfield Company, dated November 17, 1969, be referred to the Director of Public Works, the City Attorney and the Fire Chief, for investigation and report. Motion carried. Communication from Canale Foods requesting a license to operate a lunch truck in the City of Vernon, was read. It was moved by Ybarra, seconded by Mai11iard, that the request of Canale Foods be referred to the Fire Department with power to act. Motion carried. Communication from Ski1fab Metal Products, dated November 14, 1969, requesting permission to use a forty foot trailer on the premises at 4150 Bandini Blvd. on a temporary basis for a period of approximately two months during the construction of their offices, was read. It was moved by Mai1liard, seconded by Malburg, that Ski1fab Metal Products be authorized to locate a forty foot trailer on the premises at 4150 Bandini Blvd., provided that said trailer is used only for the purposes as outlined in their letter dated November 14, 1969; provided that said trailer is not used for sleeping and/or cooking purposes; provided that the requirements of all City departments are complied with and that all necessary City permits are obtained; and with a stipulation that the maximum time limit said trailer may be used shall be June 1, 1970. Motion carried. Communication from Pacific Packing Company, dated November 17, 1969, requesting permission to use a 12' x 40' trailer on the premises at 4224 District Blvd. as an office facility to replace the one now being used by the Sid Miller Meat Company at the same address, was read. It was moved by Malburg, seconded by Ybarra, that the request of Pacific Packing Company, dated November 17, 1969, be referred to the Building, Fire and Health Departments for investi- gation and report. Motion carried. "Payroll Warrant Register No. 148" covering claims and demands presented during the period October 1 to October 31, which includes Demands Nos. 1619 to 1629 (both inclusive), drawn on the Crocker-Citizens National Bank, totaling $283,103.96, was examined and audited. It was moved by Mai11iard, seconded by Ybarra, that "Payroll Warrant Register No. 148" be approved and payment authorized for Demands Nos. 1619 to 1629 (both inclusive), with no exceptions. Motion carried. Ayes: Anderson, Furlong, Mail1iard, Malburg, Ybarra Noes: None Absent: None I I -6- 11 18 69 "Warrant Register No. 29719 covering claims and demands presented during the period November 1 to November l5, which includes Demands Nos. 9-2883 to 9-3042 (both inclusive), drawn on the United California Bank, totaling $1,004,414.86 (Light and Power Warrants $950,559.53) (Accounting Period November, 1969), was examined and audited. It was moved by Mai11iard, seconded by Ybarra, that "Warrant Register No. 297" be approved and payment authorized for Demands Nos. 9-2883 to 9-3042 (both inclusive), with no exceptions. Motion carried. Ayes: Anderson, Furlong, Mai11iard, Malburg, Ybarra Noe s : None Absent: None The Mayor announced that the Finance Committee would meet on November 21, 1969 at 9:00 a.m. in the Council Chamber of the City Hall for the purpose of discussing current matters, and will be continued, if necessary, from time to time at the order of the Chairman.
