MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF VERNON
HELD JANUARY 20, 1970 AT TWO O'CLOCK
P.M. IN THE COUNCIL CHAMBER OF THE
CITY HALL LOCATED AT 4305 SANTA FE
AVENUE. VERNON. CALIFORNIA.
COUNCIL PRESENT: Anderson, Furlong, Mailliard, Ybarra
COUNCIL ABSENT: Malburg
The meeting was called to order by Mayor R. J. Furlong.
It was moved by Mailliard, seconded by Ybarra, that minutes
of the meeting of January 6, 1970 be approved as written and
submitted. Motion carried.
The Clerk announced that this was the time and place for
opening of bids received for reconstruction of Bandini Boulevard and
37th Street from Santa Fe Avenue 'to Atlantic Boulevard and Sierra
Pine Avenue, in accordance with Contract No. 338.
It was moved by Mailliard, seconded by Ybarra, that the
Clerk be instructed to open and read the bids submitted. Motion
carried.
The Clerk opened and read the following bids:

It was moved by Anderson, seconded by Ybarra, that bids
received for reconstruction of Bandini Boulevard and 37th Street
from Santa Fe Avenue to Atlantic Boulevard and Sierra Pine Avenue,
in accordance with Contract No. 338, be referred to the Director of
Public Works and the City Attorney for checking and report. Motion
carried.

It was moved by Mailliard, seconded by Ybarra, that bids
received for improvement of Santa Fe Avenue between Pacific Boulevard
and Slauson Avenue, in accordance with Contract No. 334, be referred
to the Director of Public Works and the City Attorney for checking
and report. Motion carried.

It was moved by Mailliard, seconded by Anderson, that the

It was moved by Anderson, seconded by Ybarra, that bids
received for Unprovement of Downey Road property, in accordance with
Contract No. 350, be referred to the Director of Public Works and
the City Attorney for checking and report. Motion carried.
Communication from Anchor Hocking Glass Corporation, dated
January 7, 1970, requesting permission to construct their new
electrical sub-stations three feet back from the property line on
District Blvd., and not five feet as suggested by the City
Engineering Department; and requesting permission to appear before
the meeting of January 20, 1970 to show photographs and maps of the
property involved and to answer any questions, was read. (Copy to
each member of the City Council)

Corporation appeared before the City Council and showed photographs
and maps of the property involved and answered questions:

It was moved by Anderson, seconded by Ybarra, that communi-

be referred to the Director of Public Works for study and report.
Motion carried.
It was moved by Ybarra, seconded by Anderson, that
Ordinance No. 808 receive a second reading by title. Motion carried.

amending Ordinance No. 788, was read for a second reading by title.

Ordinance No. 808 receive and pass a second reading. Motion carried.

It was moved by Ybarra, seconded by Mailliard, that in
accordance with Government Code Section 36934t the reading of
Ordinance No. 808 in full be waived; and that Ordinance No. 808
receive a third and final reading by title. Motion unanimously
carried.

Ordinance No. 809 be read by title for a third and final reading.

Ordinance No. 809 - An Ordinance of the City of Vernon
providing for subdivision map checking fees, and repealing Ordinance
No. 762 of the City of Vernon, was read by title for a third and
final reading.
It was moved by Anderson, seconded by Ybarra, that
Ordinance No. 809 receive and pass a third reading and be adopted.

"Claim for Damages Pursuant to Section 910 of the Govern-
ment Code of the State of California", dated January 6, 1970, filed
by Fishman and George, Attorneys at Law, on behalf of Linda L. Dyer
et aI, was presented.
It was moved by Mailliard, seconded by Ybarrat that "Claim
for Damages Pursuant to Section 910 of the Government Code of the
State of California", dated January 6, 1970, filed by Fishman and
George, Attorneys at Law, on behalf of Linda L. Dyer et al, be denied
and referred to the City Attorney and the City's insurance carrier
for necessary action. Motion carried.
Communication from L. C. Husted, Fire Chief, dated January
8, 1970, advising that Fireman Frank C. Costigan has submitted a
letter of resignation effective at the close of the business day
January 31, 1970, was read.
It was moved by Mailliard, seconded by Ybarra, that the
resignation of Fireman Frank C. Costigan be accepted. Motion carried
Communication from L. C. Husted, Fire Chief, dated January
13, 1970, requesting permission to advance certain personnel as
listed, effective February 1, 1970, was read. (Copy to each member

request of the Fire Chief, dated January 13, 1970, be approved~
Motion carried.
Communication from X. J. Padilla, Assistant Director of
Civil Defense, dated January 9, 1970, requesting authority to
attend the Annual Conference of the California Civil Defense and
Disaster Association at San Diego from January 21 to January 23,
1970, with an expense allowance of $102.50, was read.
It was moved by Ybarra, seconded by Anderson, that the
request of the Assistant Director of Civil Defense, dated January 9,
1970, be approved and authority granted to issue warrant in the
amount of $102.50 to X. J. Padilla. Motion carried.
Communication from R. H. King, Director of Public Works,
dated January 7, 1970, recommending that the Bandini No.1, River-
side No.2, Atlantic No. 1 and United States Steel Corporation
Annexations be withdrawn from the Southeast Mosquito Abatement
District, was read.
It was moved by Mailliard, seconded by Ybarra, that communi-
cation from the Director of Public Works, dated January 7, 1970, be
referred to the City Attorney for a report. Motion carried.
Communication from R. H. King, Director of Public Works,
dated January 14, 1970, transmitting Contract No. 336 for Heater
Remixing and Asphalt Resurfacing of certain streets, and recommending
that this contract be approved and that authority be granted to
advertise for bids, was read.
Resolution No. 3068 - A Resolution of the City Council of
the City of Vernon, approving Contract No. 336 for Heater Remixing
and Asphalt Resurfacing of certain streets and giving notice inviting
sealed proposals or bids in accordance with Contract No. 336 of the
City of Vernon, was read.
It was moved by Mailliard, seconded by Anderson, that
Resolution No. 3068 be approved and adopted. Motion carried.

Communication from R. H. King, Director of Public Works,
dated January 15, 1970, transmitting an easement for water and sewer
line purposes from Dase Land Company covering a parcel adjacent to
.....ew'el Avenue (private) north of 37th Street, and recommending that the
easement be accepted and that the grantors be advised of the official
recordation, was read.
It was moved by Ybarra, seconded by Anderson, that
Easement be accepted from Dase Land Company, and that the Mayor and
the City Clerk be authorized to execute Certificate of Acceptance.
Motion carried.
Communication from C. E. Nemethi, M.D., Health Officer,
dated January 12, 1970, requesting authority for Louis S. Hauger
to attend Committee Hearing, Retail Food Act, as Local Health
Department Representative at Sacramento, California on January 26)
1970, with an expense allowance of $89.80, was read.

It was moved by Mailliard, seconded by Ybarra, that the
request of the Health Officer, dated January 12, 1970, be approved
and authority granted to issue warrant in the amount of $89.80 to
Louis S. Hauger. Motion carried.
Communication from V. R. Bush, Superintendent of Building,
dated January 14, 1970, requesting authority to attend the Annual
Meeting of Earthquake Engineering Research Institute at San Francisco
on February 14, 1970, with an expense allowance of $54.00, was read.
It was moved by Ybarra, seconded by Mailliard, that the
request of the Superintendent of Building, dated January 14, 1970,
be approved and authority granted to issue warrant in the amount of
$54.00 to V. R. Bush. Motion carried.
Communication from R. H. Bockhacker, Police Chief, dated
January 13, 1970, requesting that G. M. Alverez be advanced from
Policeman, Grade 2 to Grade 1, effective February 1, 1970, was read.
It was moved by Mailliard, seconded by Anderson, that the
request of the Police Chief, dated January 13, 1970, be approved.
Motion carried.
Activity Log of the Police Department for the period
January 1 to 15, 1970, inclusive, was presented.
It was moved by Ybarra, seconded by Anderson, that Activity
Log of the Police Department be received and filed. Motion carried.
Communication from R. H. King, Director of Public Works,
dated January 15, 1970, requesting authority to reclassify Anthony
Hollander from Engineering Aide I, Step 2, to Construction
Inspector, Step 5, effective February 1, 1970; and requesting that
Mr. Hollander be paid the sum of $75.00 per month for the use of
his automobile in the performance of his duties with the City,
was read.
It was moved by Ybarra, seconded by Mailliard, that the
requests of the Director of Public Works, dated January 15, 1970,
be approved. Mot ion carried.
Communication from R. H. King, Director of Public Works,
dated January 15, 1970, requesting authority to purchase an
additional wall rack file unit at a cost of approximately $100.00,
was read.
It was moved by Anderson, seconded by Mailliard, that the
request of the Director of Public Works, dated January 15, 1970, be
approved. Motion carried.
Communication from RQ H. Bockhacker? Police Chief, dated
January 15, 1970, requesting authority to attend the California
Peace Officers' Association Meeting in Fresno from February 9 to
13, 1970, with an expense allowance of $192.00, was read.
It was moved by Mail1iard, seconded by Ybarra, that the
request of the Police Chief, dated January 15, 1970, be approved
and authority granted to issue warrant in the amount: of $192.00
to R. H. Bockhacker. Motion carried.

Report of Health Department Activities for the month of
December, 1969, was presented. (Copy to each member of the City
Council)
It was moved by Ybarra, seconded by Mailliard, that Report
of Health Department Activities be received and filed. Motion
carried.
Communication from L. C. Husted, Fire Chief, dated January
19, 1970, requesting permission to employ eleven (11) men, as listed,
effective February 1, 1970, as Hosemen, Grade 4, pending satisfactory
completion of medical examination, was read. (Copy to each member
of the City Council)
It was moved by Mailliard, seconded by Anderson, that the
request of the Fire Chief, dated January 19, 1970, be approved.
Motion carried.
Notice from the League of California Cities, dated Jailuary
15, 1970, announcing an Institute on Labor Relations for City
Officials to be held at the Biltmore Hotel, Los Angeles, California,
from March 18 - 20, 1970, was read. (Registration fee of $50.00
per person includes the cost of the program, syllabus, luncheons,
receptions, and other conference incidentals.)
It was moved by Anderson, seconded by Ybarra, that any
interested elected official or department head, including the City
Attorney, be authorized to attend the Institute on Labor Relations
for City Officials; and that any authorized person attending be
reimbursed for expenses incurred. Motion carried.
Resolution No. 3069 - A Resolution of the City Council of
the City of Vernon, calling and giving notice of the holding of a
General Municipal Election to be held in said City on Tuesday, the
14th day of April, 1970, for the election of certain officers of
said City as required by the provisions of the laws of the State
of California relating to General Law Cities, was read.
It was moved by Ybarra, seconded by Anderson, that
Resolution No. 3069 be approved and adopted. Motion carried.

"Payroll Warrant Register No. 15l" covering claims and
demands presented during the period December 1 to December 31,
which includes Demands Nos. 1639 to 1648 (both inclusive), drawn on
the Crocker-Citizens National Bank, totaling $281,937.70 {Accounting
Period December, 1969, was examined and audited.
It was moved by Mailliard, seconded by Ybarra, that
"Payroll vJarrant Register No. 151" be approved and payment authorized
for Demands Nos. 1639 to 1648 (both inclusive), with no exceptions.

presented during the period January 1 to January 15, which includes
Demands Nos. 9-3399 to 9-3402 and to 70-171 (both inclusive) drawn
on the United California Bank, totaling $1,043,156.66 (Light and
Power Warrants $965,773.38) {Accounting Period January, 1970, was
examined and audited.
It was moved by Mailliard, seconded by Ybarra, that
"Warrant Register No. 301" be approved and payment authorized for
Demands Nos. 9-3399 to 9-3402 and to 70-171 (both inclusive), with
no exceptions. Motion carried.
