COUNCIL PRESENT: Anderson, Mai11iard, Malburg, Ybarra
COUNCIL ABSENT: Furlong
The meeting was called to order by Mayor Pro Tempore
Leonis C. Malburg.
It was moved by Mai11iard, seconded by Ybarra, that minutes
of the meeting of April 21, 1970 be approved as written and submitted.
Motion carried.
Communication from County Sanitation Districts of Los
Angeles County, dated April 15, 1970, transmitting a certified copy
of a "Resolution of Intention to Construct, Maintain and Operate a
Refuse Transfer and Disposal System", approved and adopted by the
Board of Directors of County Sanitation District No. 23 of Los
Angeles County on April 8, 1970, was read. (Copy to each member of
the City Council)
It was moved by Mai1liard, seconded by Anderson, that
communication from County Sanitation Districts of Los Angeles
County, dated April 15, 1970, together with transmittal, be received
and filed. Motion carried.
Communication from L. C. Husted, Fire Chief, and V. R.
Bush, Superintendent of Building, dated April 17, 1970, transmitting
a request from Trico Die Cut Company, dated April l6, 1970, for
waiver of fire sprinklers at 2529 Chambers Street; and recommending
that the request of Trico Die Cut Company for a substitute system
in place of an automatic fire sprinkler system be denied as there
is no type of alternate protection system that would meet the
building code requirement for this type of occupancy, and further
recommending that no certificate of occupancy be issued for this
building under its present use, was read. (Copy to each member
of the City Council)
It was moved by Mai11iard, seconded by Ybarra, that the
request from Trico Die Cut Company, dated April 16, 1970, with
reference to the building at 2529 Chambers Street, be referred to
the Building and Fire Departments with power to act. Motion carried.
Communication from X. J. Padilla, Assistant Director of
Civil Defense, dated April 27, 1970, transmitting the City of Vernon
Civil Defense and Disaster Plan for study; and requesting that it be
approved at the convenience of the City Council, with permission to
furnish copies to the proper interested parties, was read. (Copy
of plan to each member of the City Council)
It was moved by Anderson, seconded by Ybarra, that the
City of Vernon Civil Defense and Disaster Plan, as transmitted by
the Assistant Director of Civil Defense with communication dated
April 27, 1970, be received for study. Motion carried.

Communication from C. E. Nemethi, M.D., Health Officer,
dated April 27, 1970, requesting authority to attend the California
Statewide Conference of Health Officers and Sanitation Directors
at Asilomar, Monterey, California, from May 13 to 15, 1970,
inclusive, with an expense allowance of $201.25, was read.
It was moved by Mail1iard, seconded by Ybarra, that the
request of the Health Officer, dated April 27, 1970, be approved
and authority granted to issue warrant in the amount of $201.25
to C. E. Nemethi, M.D. Motion carried.
Communication from C. E. Nemethi, M.D., Health Officer,
dated April 27, 1970, requesting authority for Louis S. Hauger to
attend the California Statewide Conference of Health Officers and
Sanitation Directors and Executive Committee Meeting at Asilomar,
Monterey, California, from May 11 to 14, 1970, inclusive, with an
expense allowance of $248.00, was read.
It was moved by Mai1liard, seconded by Ybarra, that the
request of the Health Officer, dated April 27, 1970, be approved
and authority granted to issue warrant in the amount of $248.00
to Louis S. Hauger. Motion carried.
Communication from R. H. King, Director of Public Works,
dated April 29, 1970, transmitting an easement for street purposes
from Mobil Oil Corporation covering a portion of 37th Street; and
recommending that the easement be accepted and that the grantor be
advised of the official recordation, was read.
It was moved by Mai11iard, seconded by Anderson, that
Easement be accepted from Mobil Oil Corporation, and that the Mayor
and the City Clerk be authorized to execute Certificate of Acceptance.
Motion carried.
Communication from R. H. Bockhacker, Police Chief, dated
April 24, 1970, advising that Lieutenant Emrick has returned to
duty, effective as of April 22, 1970; and recommending that,
effective as of May 1, 1970, that Sergeant M. C. Wooten's salary
be that of a Sergeant, Grade 2, was read. (Sergeant Wooten has
been acting Lieutenant in charge of the Records Division during
Lieutenant Emrick's absence and his salary has been that of
Lieutenant, Grade 4.)
It was moved by Ybarra, seconded by Mai11iard, that the
recommendation of the Police Chief, dated April 24, 1970, be
approved. Motion carried.
Activity Log of the Police Department for the period
April 16 to 30, 1970 inclusive, was presented.
It was moved by Anderson, seconded by Ybarra, that Activity
Log of the Police Department be received and filed. Motion carried.
Communication from R. H. King, Di.rector of Public Works,
dated April 30, 1970, advising that Robert T. Trejo, Utility Man III,
has sub~itted his resignation to be effective May 7, 1970; and
recommending that Mr. Trejo's resignation be accepted effective at
the close of business on May 26, 1970, to allow for his vacation,
was read.

It was moved by Mai11iard, seconded by Ybarra, that the
resignation of Robert T. Trejo be accepted effective at the close
of business on May 26, 1970. Motion carried.
Communication from R. H. Bockhacker, Police Chief, dated
April 30, 1970, requesting authority to attend the Annual Conference
of the California Peace Officer's Association in PaLm Springs,
California, from May 17 to 20, 1970, inclusive, with an expense
allowance of $158.00, was read.
It was moved by Ybarra, seconded by Anderson, that the
request of the Police Chief, dated April 30, 1970, be approved and
authority granted to issue warrant in the amount of $158.00 to
R. H. Bockhacker. Motion carried.
Communication from R. H. King, Director of Public Works,
dated May 4, 1970, requesting authority to reclassify Glen Ashby
from Foreman, Step 1, to Construction Inspector, Step 1, effective
May 1, 1970; and requesting that Mr. Ashby be paid a mileage
allowance of $75.00 per month for the use of his automobile in the
performance of his duties with the City, effective May 1, 1970,
was read.
It was moved by Ybarra, seconded by Anderson, that the
requests of the Director of Public Works, dated May 4, 1970, be
approved. Motion carried.
Communication from Joseph A. Venezia, Deputy City Clerk,
dated May 4, 1970, requesting permission to lease the city-owned
house at 3560 E. Vernon Avenue when it becomes available, was read.
It was moved by Mai11iard, seconded by Ybarra, that the
city-owned house at 3560 E. Vernon Avenue be leased to Joseph A.
Venezia when it becomes available for occupancy. Motion carried.
Communication from Charles H. McGovern, City Attorney,
dated May 4, 1970, requesting authority to attend the Spring Meeting,
City Attorney's Department, League of California Cities, in Newport
Beach, California, on May 7 & 8, 1970, with an expense allowance of
$73.00, was read.
It was moved by Mai11iard, seconded by Anderson, that the
request of the City Attorney, dated May 4, 1970, be approved and
authority granted to issue warrant in the amount of $73.00 to
C. H. McGovern. Motion carried.
Communication from V. R. Bush, Superintendent of Building,
dated May 5, 1970, requesting authority to advance R. H. Patnaude
from Senior Mechanical Inspector, Grade 3, to Senior Mechanical
Inspector, Grade 2, effective June 1, 1970, was read.
It was moved by Ybarra, seconded by Anderson, that the
request of the Superintendent of Building, dated May 5, 1970, be
approved. Motion carried.
Resolution No. 3094 - A Resolution of the City Council of
the City of Vernon, commending John Parkhurst, Chief Engineer and
General Manager of the Los Angeles County Sanitation Districts for
his selection as one of the top ten public works men of the year,
was read.

It was moved by Anderson, seconded by Mai1liard, that
Resolution No. 3094 be approved and adopted. Motion carried.

Ordinance No. 811 - An Ordinance of the City Council of
the City of Vernon, prohibiting the blocking of sidewalks or the
blocking of entrances, exits, or approaches upon any public place
within the City of Vernon, was read in full for a first reading.
It was moved by Anderson, seconded by Ybarra, that
Ordinance No. 811 receive and pass a first reading. Motion carried.

It was moved by Anderson, seconded by Ybarra, that
Ordinance No. 811 receive a second reading by title. Motion carried.
Ordinance No. 811 - An Ordinance of the City Council of
the City of Vernon, prohibiting the blocking of sidewalks or the
blocking of entrances, exits, or approaches upon any public place
within the City of Vernon, was read for a second reading by title.
It was moved by Mail1iard, seconded by Ybarra, that
Ordinance No. 811 receive and pass a second reading. Motion carried.

Ordinance No. 812 - An Ordinance of the City Council of
the City of Vernon, prohibiting the display of any facsimile of a
firearm with the intent to terrify, alarm, threaten, or intimidate
any person or persons, was read in full for a first reading.
It was moved by Mai11iard, seconded by Anderson, that
Ordinance No. 812 receive and pass a first reading. Motion carried.

It was moved by Mailliard, seconded by Ybarra, that
Ordinance No. 812 receive a second reading by title. Motion carried.
Ordinance No. 812 - An Ordinance of the City Council of

Ordinance No. 813 receive and pass a first reading. Motion carried.

It was moved by Anderson, seconded by Ybarra, that
Ordinance No. 813 receive a second reading by title. Motion carried.

It was moved by Ybarra, seconded by Anderson, that

Mayor Pro Tempore Malburg made an oral request for
permission to be absent from 2 or 3 City Council meetings, or more
if necessary, a8 he is planning an extended trip to Europe.
It was moved by Mailliard, seconded by Ybarra, that the
request of Mayor Pro Tempore Malburg be approved. Motion carried.
"Warrant Register No. 308" covering claims and demands
presented during the ,period April 16 to April 30, which includes
Demands Nos. 70-1081 to 70-1171 (both inclusive), drawn on the
United California Bank, totaling $307,399.58 (Light and Power
Warrants $2,082.92) (Accounting Period May, 1970), was examined and
audited.
It was moved by Mailliard, seconded by Ybarra~ that
''Warrant Register No. 308" be approved and payment authorized for
Demands Nos. 70-1081 to 70-1171 (both inclusive), with no exceptions.
Motion carried.

it was moved by Anderson, seconded by Ybarra, that the meeting
