MINUTES OF A REGUIAR MEETING OF THE
CITY COUNCIL OF THE CITY OF VERNON
HELD JUNE 3, 1970 AT TWO O'CLOCK
P.M. IN THE COUNCIL CHAMBER OF THE
CITY HALL LOCATED AT 4305 SANl'A FE
AVENUE. VERNON. CALIFORNIA.
COUNCIL PRESENT: Anderson, Furlong, Mailliard, Ybarra

The meeting was called to order by Mayor R. J. Furlong.
It was moved by Mailliard, seconded by Ybarra, that
minutes of the meeting of May 19, 1970 be approved as written and
submitted. Motion carried.
Communication from the State of California - Transportation
Agency, Department of Public Works, dated May 5, 1970, advising that
$11,445.00 has been apportioned to the City of Vernon representing
its share in California's allocation of federal TOPICS funds for the
1970-71 fiscal year, was presented.
It was moved by Mailliard, seconded by Ybarra, that communi-
cation from the State of California - Transportation Agency, Depart-
ment of Public Works, dated May 5, 1970, be referred to the Director
of Public Works. Motion carried.
Copy of Resolution No. 5722 of the City Council of the
City of Azusa expressing intention to increase its city property tax
rate to compensate for any tax levied on its municipally-owned
electric utility by state legislation, was presented.
It was moved by Anderson, seconded by Ybarra, that copy
of Resolution No. 5722 of the City Council of the City of Azusa be
received and filed. Motion carried.
Copy of Resolution No. 1057 of the City Council of the
City of Lawndale, California supporting Proposition 1 on the June
ballot, was presented.
It was moved by Ybarra, seconded by Mailliard, that copy
of Resolution No. 1057 of the City Council of the City of Lawndale,
California be received and filed. Motion carried.
Clatm for damages against the State of California and City
of Vernon, dated May 19, 1970, filed by Berger, Blietz & Huntoon,
Attorneys at Law, on behalf of Geraldine Watson, was presented.
It was moved by Anderson, seconded by Ybarra, that claim
for damages against the City of Vernon, dated May 19, 1970, filed
by Berger, Blietz & Huntoon, Attorneys at Law, on behalf of Geraldine
Watson, be denied and referred to the City Attorney and the City's
insurance carrier for necessary action. Motion carried.
Summons in Case No. SEC 2894 in the Superior Court of the
State of California for the County of Los Angeles, filed by Percy C.
Whitaker, Jr., John Hightower and Leroy Bragg vs. City of Vernon,
Ralph D. Gott, Does I thru X, inclusive, was presented.

It was moved by Mailliard, seconded by Anderson, that
Surrmons in Case No. SEC 2894 in the Superior Court of the State of
California for the County of Los Angeles, filed by Percy C. ~fuitaker,
Jr., John Hightower and Leroy Bragg vs. City of Vernon, Ralph D~
Gott, Does I thru X, inclusive, be referred to the City Attorney and
the City's insurance carrier for necessary action. Motion carried.
Communication from L. C. Husted, Fire Chief, dated May 25,
1970, requesting authority for Lawrence M. Jackson to attend a
program entitled "Fracture Handling and Extrication of Automobile
Accident Victim" at Los Angeles (U.C.L.A.) on June 6 and 7, 1970
with an expense allowance of $52.76, was presented.
It was moved by Ybarra, seconded by Anderson, that the
request of the Fire Chief, dated May 25, 1970, be approved and
authority granted to issue warrant in the amount of $52.76 to
Lawrence M. Jackson. Motion carried.
Communication from George H. Thompson dba Bandini Truck
Terminal, dated May 25, 1970, requesting permission to locate 3 or
4 small portable office buildings on the property at 3152 Bandini
Blvd. to be used for the dispatchers of several small trucking
companies, was presented. (Copy to each member of the City Council)
It was moved by Ybarra, seconded by Mai11iard, that
George H. Thompson dba Bandini Truck Terminal be authorized to locate
three (3) small portable office buildings on the property at 3152
Bandini Boulevard, provided that said portable office buildings are
used only for the purposes as outlined in his letter dated May 25,
1970; provided that said portable office buildings are not used for
sleeping and/or cooking purposes; provided that the requirements of
all City departments are complied with and that all necessary City
permits are obtained; and with a stipulation that the maximum time
limit said portable office buildings may be used shall be June 1,
1971. Motion carried.
Communication from Lois Za1tosky, Deputy City Clerk, dated
May 25, 1970, requesting that she be considered as a tenant for a
one or two bedroom apartment when a vacancy exists, was presented.
It was moved by Anderson, seconded by Ybarra, that the
city-owned apartment at 3376 E. 50th Street be leased to Lawrence M.
Jackson when it becomes available for occupancy. Motion carried.
It was moved by Ybarra, seconded by Anderson, that the
city-owned apartment at 3382 E. 50th Street be leased to Lois
Zaltosky when it becomes available for occupancy. Motion carried.
Communication from R. H. Bockhacker, Police Chief, dated
May 25, 1970, requesting that Sergeant T. L. Miller be reimbursed
the sum of $12.69 from the Education and Training Budget appropri-
ation for Police Science courses at East Los Angeles College, was
presented.
It was moved by Anderson, seconded by Ybarra, that the
request of the Police Chief, dated May 25, 1970,be approved and
authority granted to issue warrant in the amount of $12.69 to
T. L. Miller. Motion carried.

Activity Log of the Police Department for the period May
16 to 31, 1970 inclusive, was presented.
It was moved by Ybarra, seconded by Mail1iard, that Activity
Log of the Police Department be received and filed. Motion carried.
Communication from Anthony B. Hollander, Construction
Inspector, dated May 29, 1970, requesting that he be reimbursed the
sum of $42.70 from the Education and Training Budget appropriation
for classes, Summer and Fall semester, in Inspection Technology at
L.A. Trade Technical College, together with recommendation for
approval by the Director of Public Works, was presented.
It was moved by Anderson, seconded by Mai1liard, that the
recommendation of the Director of Public Works, dated May 29, 1970,
be approved and authority granted to issue warrant in the amount of
$42.70 to Anthony B. Hollander. Motion carried.
Communication from the Finance Committee, dated June 1,
1970, signed by R. J. Furlong, Chairman, transmitting a proposed
salary resolution with a recommendation that it be approved; and
making certain other recommendations relative to the fiscal affairs
of the City, was presented. (Copy of communication and proposed
resolution to each member of the City Council)
It was moved by Ybarra, seconded by Anderson, that the
recommendations of the Finance Committee, dated June 1, 1970, be
approved. Motion carried.
Resolution No. 3095 - A Resolution of the City Council of
the City of Vernon fixing the compensation for certain employees
of said City as of July 1, 1970, authorizing certain expense
allowances, and repealing all resolutions in conflict herewith,
was read.
It was moved by Ybarra, seconded by Anderson, that
Resolution No. 3095 be approved and adopted. Motion carried.

Communication from R. H. Bockhacker, Police Chief, dated
June 1, 1970, with reference to the physical condition of Sgt. A. L.
Dwyer, who has been absent from duty since December 29, 1969 due to
a line of duty injury, recommending that unless his physical
condition improves sufficiently to enable him to carry out the
duties of a police sergeant, he continue with his retirement
proceedings, was presented.
It was moved by Ybarra, seconded by Anderson, that the
recommendation of the Police Chief, dated June 1, 1970, be approved.
Motion carried.
Communication from Mrs. A. M. McOmie, 4627 E. 52nd Place,
Maywood, dated May 30, 1970, complaining about the blower installed
by the Thermador Co. on 52nd Drive, was presented. (Copy to each
member of the City Council)

It was moved by Ybarra, seconded by Mailliard, that communi.
cation fr.~ Mrs. A. M. McOmie, dated May 30, 1970, be referred to the
Building and Health Departments for investigation and report. Motion
carried.
Comnlunication from L. C. Husted, Fire Chief, dated May 27,
1970, advising that Assistant Fire Chief Thomas F. Lara sustained
a job-connected heart condition and has been off duty with this
illness since July 1, 1969; and recommending that his retirement
from the City become effective July 1, 1970, was read.
It was moved by Mai1liard, seconded by Ybarra, that the
recommendation of the Fire Chief, dated May 27, 1970, be approved;
and that the City Attorney be instructed to draft a resolution
commending Thomas F. Lara for his many years of loyal and
conscientious service to the City of Vernon. Motion carried.
Discussion was held with reference to the City of Vernon
Civil Defense and Disaster Plan as submitted to the City Council on
May S, 1970 by the Assistant Director of Civil Defense.
It was moved by Mailliard, seconded by Ybarra, that the
City of Vernon Civil Defense and Disaster Plan be approved as trans-
mitted by the Assistant Director of Civil Defense with communication
dated April 27, 1970; and that the Assistant Director of Civil
Defense be granted permission to furnish copies to the proper
interested parties. Motion carried.
Discussion was held with reference to expenses incurred
by Carmel in the successful litigation brought by the City of Carmel
to test the legality of the 1969 legislation requiring all public
officials to disclose their financial interests.
It was moved by Mailliard, seconded by Anderson, that the
City of Vernon contribute $200.00 towards the cost of the litigation,
and that authority be granted to issue warrant in the amount of
$200.00 to the City of Carmel-By-The Sea. Motion carried.
Ordinance No. 814 - An Ordinance of the City of Vernon,
repealing Ordinance No. 787 of the City of Vernon, establishing rates
for the sale of water in said City and repealing all ordinances in
conflict therewith, was read by title for a first reading.
It was moved by Anderson, seconded by Ybarra, that
Ordinance No. 814 receive and pass a first reading. Motion carried.

Communication from Vincent R. Poxon, Attorney at Law, dated
May IS, 1970, with reference to two communications received by the
Clougherty Packing Company from Mr. Vincent Bush, Superintendent of
Building; and requesting that the City Council grant a reasonable
extension of time for the Clougherty Packing Company to comply with
Mr. Bush's requirements, was presented. (Copies of Mr. Poxon's
letter and Mr. Bush's letters to each member of the City Council)

It was moved by Ybarra, seconded by Mail1iard, that the
Superintendent of BUilding be authorized to give notice to
Clougherty Packing Company to vacate the premises at 3049 E. Vernon
Avenue pursuant to Ordinance No. 769; and that the City Attorney be
instructed to proceed with whatever legal action may be necessary
to enforce compliance. Motion carried.
"Warrant Register No. 310" covering claims and demands
presented during the period May 16 to 31, which includes Demands Nos.
70-1327 to 70-1419 (both inclusive), drawn on the United California
Bank, totaling $195,091.34 (Light and Power Warrants $2,923.05)
(Accounting Period June, 1970), was examined and audited.
It was moved by Mailliard, seconded by Ybarra, that
"Warrant Register No. 310" be approved and payment authorized for
Demands Nos. 70-1327 to 70-1419 (both inclusive), with no exceptions.
Motion carried.
