MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF VERNON
HELD SEPTEMBER 1, 1970 AT TWO O'CLOCK
P.M. IN THE COUNCIL CHAMBER OF THE
CITY HALL LOCATED AT 4305 SANTA FE
AVENUE. VERNON. CALIFORNIA.
COUNCIL PRESENT: Anderson, Furlong, Mai11iard, Malburg, Ybarra
COUNCIL ABSENT: None
The meeting was called to order by Mayor R. J. Furlong.
It was moved by Ybarra, seconded by Anderson, that
minutes of the meeting of August 18, 1970 be approved as written
and submitted. Motion carried.
Communication from R. H. King, Director of Public Works,
dated August 19, 1970, with reference to bids received for Well No.
16, Pump and Equipment, in accordance with Contract No. 356, recom-
mending that Schedule I, Pump and Motor, be awarded to Byron Jackson
Pump Division, Borg-Warner Corporation, on the basis of their bid
of $11,990.00; and recommending that Schedule II, Electrical,
Pumping, Vaults and Miscellaneous Construction, be awarded to Bovee
and Crail Construction Company, on the basis of their bid of
$15,460.00, was presented.
Resolution No. 4011 ... A Resolution of the City Council of
the City of Vernon, accepting the bids of Byron Jackson Pump
Division, Borg-Warner Corporation, and Bovee and Crail Construction
Company for Well No. 16 Pump and Equipment, in accordance with
Contract No. 356 of the City of Vernon, was presented.
It was moved by Malburg, seconded by Ybarra, that
Resolution No. 4011 be approved and adopted. Motion carried.

Communication frcm R. H. King, Director of Public Works,
dated August 19, 1970, advising that Pipe Linings, Inc. has complete'
the work of cleaning and cement lining of water mains in accordance
with Contract No. 352; and recommending that the work be accepted
and that authority be granted to pay the contractor in accordance
with the terms of the agreement, was presented.
Resolution Nos AOI0 ... A Resolution of the City Council
of the CitY-of Vernon, accePting the work of Pipe Linings, Inc. for
cleaning and cement lining of water mains in accordance with
Contract No. 352 of the City of Vernon, was presented.
It was moved by Mail1iard, seconded by Anderson, that
Resolution No. 4010 be approved and adopted. Motion carried.

CommuniCAtion from R. H. King, Director of Public ~"orks,
dated August 19, 1970, re.questing authority for Lewis R. Ada~s to
attend the 51st Annual Conference of the American Water Works
Association at San Francisco from September 30 to October 2, 1970,
with an expense allowance of $259.50, was presented.

It was moved by Mai11iard, seconded by Ybarra, that the
request of the Director of Public Works, dated August 19, 1970,
be approved and authority granted to issue warrant in the amount of
$259.50 to Lewis R. Adams. Motion carried.
Communication from the League of California Cities, dated
August 13, 1970, requesting that the City Council designate a voting
delegate and voting alternate at the business session of the Annual
League Conference in San Diego on October 25 - 28, 1970, was
presented.
It was moved by Ybarra, seconded by Mail1iard, that C. H.
McGovern, City Attorney, be designated as the voting delegate and
L. C. Husted, Fire Chief, as voting alternate at the business sessior
of the Annual League Conference in San Diego on October 25 - 28,
1970. Motion carried.
Communication from Mr. Daniel P. O'Shea, dated August 21,
1970, tendering his resignation as Deputy City Clerk-Accountant,
effective at the close of the business day on August 21, 1970, was
presented.
It was moved by Malburg, seconded by Anderson, that the
resignation of Mr. Daniel P. O'Shea be accepted. Motion carried.
Communication from J. T. Jenkins Co., dated August 21,
1970, requesting an extension of one year on their permit to use
the cabana to house their used truck sales office at 2757 Leonis
Boulevard, was presented.
It was moved by Anderson, seconded by Ybarra, that J. T.
Jenkins Company be authorized to use a cabana-type office at 2757
Leonis Boulevard on a temporary basis for an additional period of
one year, maxtmum ttme 1tmit shall be October 1, 1971, subject to
all other conditions established by the City Council at its meeting
held October 1, 1968. Motion carried.
Communication from V. R. Bush, Superintendent of Building
dated August 25, 1970, requesting authority for F. A. Tachovsky to
attend the IAEI, Southwestern Section, National Electrical Code &
Technical Conference, at Long Beach, from October 12 to 15, 1970,
inclusive, with an expense allowance of $98.00, was presented.
It was moved by Mail1iard, seconded by Ybarra, that the
request of the Superintendent of Building, dated August 25, 1970,
be approved and authority granted to issue warrant in the amount of
$98.00 to F. A. Tachovsky. Motion carried.
Communication from Kurlander, Solomon & Hart, Attorneys
at Law, dated August 24, 1970, on behalf of the Vernon Firemen's
Association, an employee organization, requesting that the City of
Vernon recognize the Vernon Firemen's Association as the employee
organization representing the firemen of the City of Vernon, within
the meaning of Sections 3500 et seq. of the California Government
Code, was presented. (Copy to each member of the City Council)
It was moved by Malburg, seconded by Mail1iard, that
communication from Kurlander, Solomon & Hart, dated August 24,
1970, be tabled for future consideration in view of the fact that
the City of Vernon has not yet adopted an ordinance or a resolution

setting forth rules and regulations for employee relations, and the
City Attorney be instructed to prepare a draft of an ordinance or
resolution, and to comply with the necessary requirements of public
hearings on the same in accordance with the Meyers-Mi1ias-Brown Act
of the State of California; that the City Attorney further be
instructed to conduct good faith consultation with representatives
of employee organizations prior to the adoption of said ordinance
or resolution. Motion carried.
Communication from Kurlander, Solomon & Hart, dated
August 21, 1970, with reference to mutual aid agreements and the
present labor dispute between the South Gate Fire Fighters Associ-
ation and the City of South Gate, was presented. (Copy to each
member of the City Council)
Communication from C. H. McGovern, City Attorney, dated
August 27, 1970, recommending that the Mutual Aid Agreement for
Area "E" is not affected by any strike of South Gate Fire Fighters,
was presented. (Copy to each member of the City Council)
It was moved by Mai11iard, seconded by Anderson, that
communication from Kurlander, Solomon & Hart, dated August 21, 1970,
and communication from C. H. McGovern, City Attorney, dated August
27, 1970, be received and filed. Motion carried.
Communication from R. H. Bockhacker, Police Chief, dated
August 26, 1970, transmitting a copy of a proposed contract between
the City of Los Angeles and the City of Vernon providing for parti.-
cipation in the City of Los Angeles electronic data processing
center's "Automated Want and Warrant System"; and requesting that
said contract be approved, was presented. (Copy to each member of
the City Council)
It was moved by Malburg, seconded by Ybarra, that the
Mayor and the City Clerk be authorized to execute contract between
the City of Los Angeles and the City of Vernon providing for
participation in the City of Los Angeles electronic data processing
center's "Automated Want and Warrant System". Motion carried.
Activity Log of the Police Department for the period
August 16 to 30, 1970 inclusive, was presented.
It was moved by Anderson, seconded by Ybarra, that
Activity Log of the Police Department be received and filed. MotiO'v.
carried.
Communication was presented from L. C. Husted, Fire Chief~
dated August 26, 1970, requesting that the following personnel be
reimbursed the amounts as listed from the Education and Training
Budget appropriation:

It was moved by Anderson, seconded by Ybarra, that the
request of the Fire Chief, dated August 26, 1970, be approved and
authority granted to issue warrants in the amounts as listed to

Communication from L. C. Husted, Fire Chief, dated August
26, 1970, advising that Fireman Lester M. Husted be deleted from the
City payroll October 13, 1970 due to a job-connected back injury,
was presented. (Copy to each member of the City Council)
It was moved by Mai11iard, seconded by Ybarra, that the
request of the Fire Chief, dated August 26, 1970, be approved.
Motion carried.
Summons in Case No. 984096 in the Superior Court of the
State of California for the County of Los Angeles, filed by Linda L.
Dyer; Francis H. Dyer, and Jonathan D. Dyer, minors, by Linda L.
Dyer, their Guardian ad Litem; Florence E. Mehan; and Susan M. Mehan,
a minor, by Florence E. Mehan, her Guardian ad Litem, vs. City of
Vernon, a public entity; County of Los Angeles, a public entity;
State of California; City of Whittier, a public entity; William G.
Miller; Alan J. Marshall; John E. Maeser; Robert A. Asendorf;
Frank E. Sweeney; and Does I through X, inclusive, was presented.
It was moved by Malburg, seconded by Ybarra, that Summons
in Case No. 984096 in the Superior Court of the State of California
for the County of Los Angeles, filed by Linda L. Dyer; Francis H.
Dyer, and Jonathan D. Dyer, minors, by Linda L. Dyer, their Guardian
ad Litem; Florence E. Mehan; and Susan M. Mehan, a minor, by
Florence E. Mehan, her Guardian ad Litem, vs. City of Vernon, a
public entity; County of Los Angeles, a public entity; State of
California; City of Whittier, a public entity; William G. Miller;
Alan J. Marshall; John E. Maeser; Robert A. Asendorf; Frank E.
Sweeney; and Does I through X, inclusive, be referred to the City
Attorney and the City's insurance carrier for necessary action.

attend the Seminar on Search and Seizure at the Institute for Police
Studies at the Department of Criminology, California State College,
Long Beach, from September 24 through September 26, 1970, with an
expense allowance of $100, was presented. (Copy to each member of
the City Council)
It was moved by Ybarra, seconded by Mai11iard, that the
request of the Police Chief, dated August 28, 1970, be approved and
authority granted to issue warrant in the amount of $100.00 to
Captain J. C. Jordan. Motion carried.
Communication from L. C. Husted, Fire Chief, dated August
24, 1970, requesting permission for Chief Husted and Captain J. E.
Muldown to be recognized as "Peace Officers" as defined in the
California Penal Code and as authorized in the City Fire Prevention
Code, was presented. (Copy to each member of the City Council)
It was moved by Mail1iard, seconded by Ybarra, that the
request of the Fire Chief, dated August 24, 1970, be approved.
Motion carried.
Communication from V. R. Bush, Superintendent of Building,
dated August 28, 1970, adviSing that the Building, Fire and Health
Departments recommend approval of the request of Timpte, Inc. to us.e

a mobile type office at 3631 Bandini Blvd. for a period of one year
subject to the usual conditions, was presented.
It was moved by Mailliard, seconded by Ybarra, that
Timpte, Inc. be authorized to use a mobile type office on the
property at 3631 Bandini Blvd., provided that said mobile type
office is used only for the purposes as outlined in their letter
dated August 14, 1970; provided that said mobile type office is not
used for sleeping and/or cooking purposes; provided that the
requirements of all City departments are complied with and that
all necessary City permits are obtained; and with a stipulation
that the maximum time limit said mobile type office may be used
shall be September 1, 1971. Motion carried.
''Warrant Register No. 316" covering claims and demands
presented during the period August 16 to 31, 1960, which includes
Demands Nos. 70-2101 to 70-2179 (both inclusive), drawn on the
United California Bank, totaling $22,381.19 (Light & Power Warrants
$4,211.44) (Accounting Period September 1970), was examined and
audited.
It was moved by Mailliard, seconded by Ybarra, that
''Warrant Register No. 316" be approved and payment authorized for
Demands Nos. 70-2101 to 70-2179 (both inclusive), with no exceptions.
Motion carried.

There being no further business to come before the meeting,
it was moved by Anderson, seconded by Ybarra, that the meeting
