19701104 Regular City Council Meeting - Minutes I I MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD NOVEMBER 4, 1970 AT TWO O'CLOCK P.M. IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE 9 VERNON. CALIFORNIA. COUNCIL PRESENT: Anderson, Furlong, Mailliard, Malburg, Ybarra COUNCIL ABSENT: None The meeting was called to order by Mayor R. J. Furlong. It was moved by Ybarra, seconded by Anderson, that minutes of the meeting of October 20, 1970 be approved as written and submitted. Motion carried. The City Clerk reported that this was the time and place for the hearing relating to the adoption of Ordinances Nos. 817, 818, 820 and 821 of the City of Vernon in accordance with notice dated October 6, 1970. Proof of Publication in the Los Angeles Daily Journal on October 9 and 16, 1970 of "Notice of Public Hearing" was duly acknowledged as being on file. The City Clerk reported that no written communication relative to this matter had been received. No one was in the audience to comment on this matter. Ordinance No. 817 - An Ordinance of the City of Vernon regulating the erection, construction, enlargement, alteration, repair, moving, removal, conversion, demolition, occupancy, equipment, use, height, area, and maintenance of buildings or structures in the City of Vernon, State of California, and providing for the issuance of permits and collection of fees therefor; declaring and establishing fire districts; providing penalties for the violation thereof and adopting, in part, the Uniform Building Code, 1970 Edition, promulgated by the International Conference of Building Officials, and repealing all ordinances and parts of ordinances in conflict therewith, was read for a second reading by t it Ie. He further advised that securities were available and regardless of the condition of the security market the balance would be forthcoming within thirty (30) days. Communication from The Pacific Telephone and Telegraph Company, dated October 15, 1970, transmitting claim in the amount of $214.82 for damages to their lOO-pair underground cable and four-inch sewer tile duct conduit on Bandini Blvd., was presented. (Copy to each member of the City Council) It was moved by Mailliard, seconded by Ybarra, that claim from The Pacific Telephone and Telegraph Company, dated October 15, 1970, in the amount of $214.82, be denied and referred to the City Attorney and the City's insurance carrier for necessary action. Motion carried. Claim for Damages submitted by James Geffner, Monteleone & McCrory, on behalf of George Miller Construction Company, for alleged "taking" and "damaging" of claimant's property without reasonable compensation therefor, was presented. (Copy to each member of the City Council) It was moved by Anderson, seconded by Ybarra, that Claim for Damages submitted by James Geffner, Monteleone & McCrory, on behalf of George Miller Construction Company, be denied and referred to the City Attorney and the City's insurance carrier for necessary action. Motion carried. Copy of Resolution No. C-208l2 of the City Council of the City of Long Beach, California, requesting the League of California Cities and the member cities thereof and state and national legis- lators to approve the program of utilizing surplus military aircraft in fighting forest fires, was presented. It was moved by Mailliard, seconded by Anderson, that copy of Resolution No. C-208l2 of the City Council of the City of Long Beach, California, be received and filed. Motion carried. Communication from Byron Jackson Pump Division, dated October 26, 1970, requesting permission to use the parking lot at 2323 E. Vernon Avenue on Sunday, November 15, 1970, between the hours of 9:00 a.m. and 4:00 p.m.; and transmitting an agreement signed by Byron Jackson Pump Division, Borg-Warner Corporation, setting forth terms and conditions for use of this property, was presented. I I -5- 11 4 70 It was moved by Ybarra, seconded by Malburg, that the request of Byron Jackson Pump Division, dated October 26, 1970, be approved; and that the Mayor and City Clerk be authorized to execute agreement signed by Byron Jackson Pump Division, Borg-Warner Corporation, setting forth terms and conditions for use of the parking lot at 2323 E. Vernon Avenue. Motion carried. Communication from L. C. Husted, Fire Chief, dated October 19, 1970, requesting authority for Louis C. Matteson to atterid the California Fire Chiefs' Association, Fire Prevention Officers' Section, Joint North-South Meeting, at San Luis Obispo on November 13 and 14, 1970, with an expense allowance of $66.12, was presented. It was moved by Malburg, seconded by Ybarra, that the request of the Fire Chief, dated October 19, 1970, be approved and authority granted to issue warrant in the amount of $66.12 to Louis C. Matteson. Motion carried. Communication from L. C. Husted, Fire Chief, dated October 22, 1970, requesting additional funds in the amount of $1,600.00 to purchase a Recording-Reproducing Unit at an approximate cost of $8,000.00 was presented. (Copy to each member of the City Council) It was moved by Anderson, seconded by Ybarra, that the request of the Fire Chief, dated October 22, 1970, be approved. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated October 21, 1970, transmitting specifications for a recording device to be attached to all Police Department telephone and radio communi- cation lines; and requesting that the Purchasing Agent be authorized to advertise for bids for this equipment, was presented. (Copy to each member of the City Council) It was moved by Malburg, seconded by Ybarra, that the specifications for a recording device to be attached to all Police Department telephone and radio communication lines, as submitted by the Police Chief, dated October 21, 1970, be approved; and that the City Clerk be directed to give notice inviting sealed bids for a recording device to be attached to all Police and Fire Department telephone and radio communication lines in accordance with the specifications submitted by the Police Chief under date of October 21, 1970. Motion carried. Communication from R. H. King, Director of Public Works, dated October 21, 1970, transmitting proposed application before the Public Utilities Commission of the State of California for the construction of 26th Street across The Atchison, Topeka and Santa Fe and Union Pacific tracks crossing No. 3A-3.2; and recommending that the City of Vernon make application to the Commission for the above mentioned crossing construction, was presented. It was moved by Malburg, seconded by Ybarra, that the recommendation of the Director of Public Works, dated October 21, 1970, be approved; and that the Mayor and the City Clerk be authorized to execute an application to the Public Utilities Commission of the State of California for the construction of 26th Street across The Atchison, Topeka and Santa Fe and Union Pacific tracks crossing No. 3A-3.2. King, Director of Public ltJ'orks, dated October 21, 1970, transmitting an engineering and traffic survey determining the speed limit to be posted on Bandini Boulevard and a portion of 37th Street between The Atchison, Topeka and Santa Fe Harbor Line tracks and Atlantic Boulevard; and recommending that a 45 MPH limit be established on this route by ordinance and that such limits be appropriately posted, was presented. (Copy to each member of the City Council) Ordinance No. 823 - An Ordinance of the City of Vernon regulating the speed on certain streets within the City of Vernon, was read by title for a first reading. King, Director of Public Works, dated October 29, 1970, with reference to bid received for Water Main Lining - Phase IV in accordance with Contract No. 355, recom- mending that the contract he awarded to Pipe Linings, Inc. on the basis of their bid of $134,974.15, was presented. Resolution No. 4017 - A Resolution of the City Council of the City of Vernon, accepting the hid of Pipe Linings, Inc., for Water Main Lining - Phase IV, in accordance with Contract No. 355 of the City of Vernon, was presented. It was moved by Mai11iard, seconded by Malburg, that Resolution No. 4017 be approved and adopted. Motion carried. King, Director of Public Works, dated October 29, 1970, tran~mitting a proposed License Agreement for the reconstruction of a sewer line in 49th Street by Theodore Hamm Brewing Company; and recommending that the agreement be approved, the usual license waived and that the Mayor and the City Clerk be authorized to execute the agreement on behalf of the City of Vernon, was presented. It was moved by Malburg, seconded by Ybarra, that the Mayor and the City Clerk be authorized to execute License Agreement between the City of Vernon and Theodore Hamm Brewing Company for the reconstruction of a sewer line in 49th Street; and that the usual license fee be waived. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated October 21, 1970, advising that he is suspending Officer R. D. Schultz for one day, without pay, October 31, 1970, for violation of Section 400.42 of the department's Manual of Policy and Ethics, was presented. Bockhacker, Police Chief, dated October 29, 1970, advising that Officer Paul Young Idom passed away at 7:00 o'clock p.m. on October 26, 1970; and recommending that he be dropped from the payroll as of the close of his tour of duty on October 26, 1970, was presented. (Copy to each member of the City Council) It was moved by Mai11iard, seconded by Ybarra, that the recommendation of the Police Chief, dated October 29, 1970, be approved. Motion carried. Activity Log of the Police Department for the period October 16 - 31, 1970 inclusive, was presented. It was moved by Malburg, seconded by Ybarra, that Activity Log of the Police Department be received and filed. Motion carried. "Warrant Register No. 320" covering claims and demands presented during the period October 16 to 31, which includes Demands Nos. 70-2662 to 70-2779 (both inclusive) drawn on the United California Bank, totaling $270,020.23 (Light and Power Warrants $4,979.33) (Accounting Period November, 1970), was examined and audited. It was moved by Mail1iard, seconded by Ybarra, that "t..Jarrant Register No. 320" be approved and payment authorized for Demands Nos. 70-2662 to 70-2779 (both inclusive), with no exceptions. It was moved by Anderson, seconded by Ybarra, that Resolution No. 4015 be approved and adopted. Motion carried. It was moved by Mailliard, seconded by Ybarra, that Resolution No. 4016 be approved and adopted. Motion carried.
