19701209 Regular City Council Meeting - Minutes I I MINl1l'ES OF AN ADJOUR.NED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD DECEMBER 9, 1970 AT TWO O'CLOCK P.M. IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE. VERNON. CALIFORNIA. COUNCIL PRESENT: Anderson, Furlong, Mailliard, Malburg, Ybarra COUNCIL ABSENT: None The meeting was called to order by Mayor R. J. Furlong. Interested employee representatives as well as all Depart- ment Heads, or their authorized representatives, and Mr. Harry Keaton, Special Counsel for the City of Vernon in Employer-Employee relations matters, and Mr. Stephen H. Silver, Attorney for the Vernon Firemen's Association, were in attendance. Discussion was continued on the proposed Employer-Employee Relations Resolution suggested by Special Counsel Harry Keaton. It was moved by Ybarra, seconded by Mailliard, that six (6) separate Employee Groups for Recognization be established in Section 8B as follows: (1) All employees in the Fire Department except manage- ment and confidential employees; (2) Fire Department management and confidential employees; (3) All employees in the Police Department except manage- ment and confidential employees; (4) Police Department management and confidential employees; (5) All other employees except management and confidential employees; and (6) All other management and confidential employees. Motion carried. It was moved by Mailliard, seconded by Ybarra, that Fire Captains and above be considered management; that Lieutenants and above in the Police Department be considered management; and that employees in the Public Works Department in the classifications as listed below be considered management: City Engineer Civil Engineer Traffic Engineer Survey Party Chief Public Works Coordinator Foreman Motion carried. It was moved by Malburg, seconded by Ybarra, that Section 4E of Special Counsel Keaton's draft be amended to provide that management employees may represent themselves in the meeting and conferring process within management units. Motion carried. I I -2- 12 9 70 It was moved by Mai11iard, seconded by Anderson, that Section 11 of the proposed draft be amended to add thereto that rules and regulations relating to elections, sanctions or otherwise, after proposal by the Municipal Employees Relations Officer, be submitted to the City Council for approval. Motion carried. It was moved by Malburg, seconded by Mail1iard, that Section 12 be adopted as is and have added thereto the proviso that all meeting and conferring be completed on or before May 31st of each calendar year and any unresolved matters be referred at that time to the City Council. Motion carried. It was moved by Malburg, seconded by Mai11iard, that Section 9 be adopted as proposed with the addition that the petition for recognition be executed by any two authorized representatives of an employee organization. Motion carried. Section 13 of the proposed draft was discussed. Attorney Stephen H. Silver commented on this section. It was moved by Mailliard, seconded by Ybarra, that Section 13 of tbe proposal be adopted substantially in the same form as presented. Motion carried. It was moved by Malburg, seconded by Ybarra, that Section lOA be changed to provide that the City Clerk shall certify that an employee organization is recognized upon the recommendation of the Municipal Employee Relations representative; and that Section lOA-2 be amended to provide that the written evidence must indicate that the employee wishes the organization to represent him in matters regarding wages, hours and working conditions. Motion carried. It was moved by Ybarra, seconded by Mailliard, that Section lOC-l be changed to effect the determination by the City Council; and that Section lCC-2 be amended to provide that no competing petition may be filed within two years from the date of initial recognition and thereafter may only be filed during the month of February of each calendar year; and that regardless of the competing petition any memorandum of understanding previously agreed to will remain in full force and effect for its term. Motion carried. It was moved by Mai1liard, seconded by Ybarra, that the City Attorney and Special Counsel Keaton be instructed to draft an employer-employee resolution which incorporates the changes approved by the City Council and substantially in accordance with the other proposals suggested by Special Counsel Keaton, and that this resolution be presented to the City Council for consideration and adoption. Motion carried. There being no further business to come before the meeting, it was moved by Malburg, seconded by Ybarra, that the meeting adjourn. Motion carried.
