MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF VERNON
HELD JANUARY 5, 1971 AT 'l'WO 0' CLOCK
P.M. IN THE COUNCIL CHAMBER OF THE
CITY HALL LOCATED AT 4305 SANTA FE

COUNCIL PRESENT: Anderson, Furlong, Mailliard, Malburg, Ybarra
COUNCIL ABSENT: None
The meeting was called to order by Mayor R..:t Furlong.
It was moved by Ybarra, seconded by Anderson, that
minutes of the meeting of December 15, 1970 be approved as written
and submitted. Motion carried.
Communication from C. H. McGovern, City Attorney, dated
December 16, 1970, with reference to certified check submitted by
Hi-Line Power, Inc. with their bid for five (5) 7000 H.P. diesel
engine generator assemblies, auxiliaries and spare parts, recom-
mending that the certified check in the amount of $27,500.00 be
deposited into the City Treasury and that whatever legal remedies
may be available be pursued to protect the City's interest, was

Mr. Mike Garoogian of Hi-Line Power, Inc. was in the
The City Attorney reported orally that he had discussed
this matter with Mr. Garoogian, and tbat it was his understanding
that on or before January 18, 1971 the funds for the purchase of
the five 7000 HP Generators and Assemblies as described in the
Notice Inviting Bids will be paid to the City of Vernon together
with executed contract previously delivered to Mr. Garoogian. The
City Attorney then made an oral recommendation that his communi-
cation, dated December 16, 1970, be laid over until the next regular
meeting of January 19t 1971.
It was moved by Mailliard, seconded by Malburg, that
communication from the City Attorney, dated December 16, 1970, with
reference to certified check submitted by Hi-Line Power, Inc., be
laid over until the next regular meeting of January 19, 1971.
Motion carried.
Claim fo~ wrongful death, dated December 7, 1970, filed
by Attorney Manuel Lope::; on behalf of Rose M,:try Rivero, and on
account of the death of Jesus David Rivero, ~as presented. (Copy

It was moved by Mailliard, seconded by Anderson, that
Claim for wrongful death, dated December 7, 1970, filed by Attorney
Manuel Lopez on behalf of Rose Mary Rivero, and on account of the
death of Jesus David Rivero, be denied and referred to the City
Attorney and the City's insurance carrier for necessary action.
Motion carried.
Summons ~'elative to Case Number 99.:867 in the Superior
Court of CaliforniF.2., County of Los Angeles, filed by Lester M. Husted
against the City of Vernon, a municipal corporation, and John Doe I
through XX, for unpaid wages, etc., was presented. (Copy to each

It was moved by Mailliard, seconded by Ybarra, that
Summons relative to Case Number 991867 filed in the Superior Court
of California, County of Los Angeles, by Lester M. Husted against
the City of Vernon, a municipal corporation, and John Doe I through
XX, be referred to the City Attorney and Special Counsel Keaton for
necessary action. Motion carried.
Communication from the State of California-Business and
Transportation Agency, Department of Public Works, dated December
18, 1970, with reference to TOPICS Funds, was presented. (Copy
to each member of the City Council)
It was moved by Ybarra, seconded by Anderson, that
communication from the State of California-Business and Transportadon
Agency, Department of Public Works, dated December 18, 1970, be
received and filed. Motion carried.
Copy of Resolution No. CS-6492 of the City Council of the
City of Culver City, California, urging the Los Angeles County
Division of the League of California Cities to investigate and
schedule a full and comprehensive investigation and report as to
the present advisability of the Los Angeles Basin Cities attempting
to work out a mutual assurance program for the purpose of providing
the necessary insurance coverage in all or part of the fields of
municipal liability, was presented. (Copy to each member of the
City Council)
It was moved by Mailliard, seconded by Ybarra, that copy
of Resolution No. CS-6492 of the City Council of the City of Culver
City, California be received and filed. Motion carried.
Copy of 'Resolution No. 2494 of the City Council of the City
~f Downey requesting the Congress of the United States to support
passage ot the Conference Committee report, calling for continued
funding of the Supersonic Transport Program during the current
fiscal year, was presented.
It was moved by Malburg, seconded by Ybarra, that copy of
Resolution No. 2494 of the City Council of the City of Downey be
received and filed. Motion carried.
Copy of Resolution No. 1922 of the City Council of the
City of Seal Beach, California, advocating the establishment of
environmental quality control boards in all cities within Los
Angeles and Orange Counties, 1:4'as presented.
It was moved by Mailliard, seconded by Anderson, that copy
of Resolution No. 1922 of the City Council of the City of Seal Beach,
California be received and filed. Motion carried.
Copy of Resolution No. 70-267 of the City Council of the
City of San Leandro urging State Legislature to enact mandatory
automobile safety flare legislation, was presented.
It was moved by Malburg, seconded by Anderson, that copy
of Resolution No. 70-267 of the City of San Leandro be received and
filed. Motion carried.

Communication from L. C. Husted, Fire Chief, dated December
18, 1970, advising that at noon Friday, December 18, 1970, the
attached directive was issued to the attention of all members of
the Vernon Fire Department, was presented. (Copy to each member of
the City Council)
It was moved by Mai1liard, seconded by Ybarra, that communi.
cation from the Fire Chief, dated December 18, 1970, together with
transmittal, be received and filed. Motion carried.
Communication from the Director of Public Works, dated
December 17, 1970, advising that it is desirable to obtain a
detailed cost estimate for the reconstruction of a damaged building
wall in its present location and for rebuilding the wall 7.5 feet
north of the present location outside the street setback area per
City of Verr..on Master Plan of Streets; and recommending that the
firm of Da1kom Inc. be retained to prepare the required estimates
for the lump sum of $150.00, was presented. (Copy to each member
of the City Council)
It was moved by Anderson, seconded by Mai11iard, that the
recommendation of the Director of Public Works, dated December 17,
1970, be approved. Motion carried.
Ccmmunication from R. H. King, Director of Public Works,
dated December 29, 1970, transmitting a letter from Pipe Linings,
Inc. stating that they will be merged into its parent company,
Ameron, Inc., and will function as the Pipe Lining Division; and
recommending that the Mayor be authorized to sign letter acknowledg-
ing its receipt and consenting to the assignment of Contract No.
355 as provided in Section 7, paragraph 7.5 of the specifications,
was presented.
It was moved by Malburg, seconded by Ybarra, that the
Mayor be author ized to sign letter fr01'n Pipe Linings, Inc., dated
December 21, 1970, acknowledging its receipt and consenting to the
assignment of Contract No. 355 as provided in Section 7, paragraph
7.5 of the specifications for Water Main Lining - Phase IV. Motion
carried.
Communication from L. S. Hauger, Director of Environmental
Health, dated December 23, 1970, advising that, pursuant to Section
459 of the California Health and Safety Code, the Vernon Jail was
inspected on December 23, 1970; and advising that this facility
is in excellent sanitary condition and fully complies with the
standards and requirements prescribed by the Board of Corrections
for the feedin.g and medical care of prisoners, was presented. (Copy
to each member of the City Council)
It was moved by Mail1iard, seconded by Ybarra, that
communica~ion from the Director of Environmental Health, dated
December 23, 1970, be received and filed. Motion carried.

Finance, dated Dec'2mber 29, 1970, requesting ~uthority for Brooks
Carden to attend the 54th An....lua1 Conference of the Cal iforni.~
Association of Public Purchasing Officers at Monterey, California,
frdfu January 27 to 29, 1971, inclusive, with an expense allowance
of $201.48, was pr~~sented.

It was moved by Mailliard, seconded by Anderson, that the
request of the City Clerk-Director of Finance, dated December 29,
1970, be approved and authority granted to issue warrant in the
amount of $201.4.8 to Brooks Carden. Motion carried.
Communication from R. H. Bockhacker, Police Chief, dated
December 21, 1970, with reference to permits for the storage of
explosives as provided in Senate Bill 1350, recommending that the
Fire Department continue the practice of issuing such permits as
provided for by Section 12007 of the Health and Safety Code, was
presented. (Copy to each member of the City Council)
It was moved by Mailliard, seconded by Ybarra, that the
recommendation of the Police Chief, dated December 21, 1970, be
approved. Motion carried.
Activity Log of the Police Department for the period
December 15 - 31, 1970 inclusive, was presented.
It was moved by Mailliard, seconded by Anderson, that
Activity Log of the Police Department be received and filed. Motion
carried.
Communication from State of California-Business and
Transportation Agency, Department of Public Works, dated December
18, 1970, advising that the California Division of Highways has
received notification from the Federal Highway Administration that
the revised draft of the "Manual of Uniform Traffic Control Devices"
has been approved; and advising that a revised standard in the new
manual is of major ~portance, was presented. (Copy to each member
of the City Council)
It was moved by Ybarra, seconded by Anderson, that communi-
cation from State of California-Business and Transportation Agency,
Department of Public Works, dated December 18, 1970, be received
and filed. Motion carried.
Communication from R. H. King, Director of Public Works,
dated December 30, 1970, with reference to communication from the
California Regional Water Quality Control Board, Los Angeles Region,
dated December 7, 1970, and its Resolution No. 70-68, was presented.

It was moved by Anderson, seconded by Malburg, that
communication from the Director of Public Works, dated December 30,
1970, be received and filed. Motion carried.
Communication from R. H. King, Director of Public Works,
dated December 30, 1970, requesting authority for A. E. Nelson, Jr.,
City Engineer, to attend a one day Seminar on Time Management at
Los Angeles on January 27, 1971, with an expense allowance of $28.00,
was presented.

request of the Director of Public Works, dated December 30, 1970,

'-Warrant Register No. 324" covering claims and demands
presented during the period December 16 to 31, which includes
Demands Nos. 70-3206 and 1-1 to 1-119 (both inclusive), drawn on
the United California Bank, totaling $185,133.19 (Light and Power
Warrants $2,493.70) (Accounting Period January 1971), was examined
and audited.
It was moved by Mai1liard, seconded by Ybarra, that
'-Warrant Register No. 324" be approved and payment authorized for
Demands Nos. 70-3206 and 1-1 to 1-119 (both inclusive), with no
exceptions. Motion carried.

Ordinance No. 824 - An Ordinance of the City of Vernon
granting a franchise to the Los Angeles Junction Railway Company,
their successors and assigns, to operate and maintain a spur track
across Seville Avenue in the City of Vernon, and repealing all
ordinances or resolutions in conflict herewith, was read by title
for a first reading.
It was moved by Anderson, seconded by Ybarra, that
Ordinance No. 824 receive and pass a first reading. Motion carried.

Absent: None
Copies of Resolution No. 4027 (A Resolution of the City
Council of the City of Vernon, relating to Employer-Employee
relations within the City of Vernon) were distributed to members
of the City Council and Mr. Stephen H. Silver, Attorney for the
Vernon Firemen's Association, for study and consideration at the
next regular meeting of the City Council to be held on January 19,
1971.
Mr. tonal Dean White, President of the Vernon Firemen's
Association, addressed the City Council with reference to directive
that was issued by the Fire Chief on December 18, 1970 to the
attention of all members of the Vernon Fire Department.
No action was taken as the communication relative to this
matter was received and filed earlier in the meeting.
There being no further business to come before the
meeting, it was moved by Anderson, seconded by Ybarra, that the
meeting adjourn. Motion carried.
