19710119 Regular City Council Meeting - Minutes I I MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD JANUARY 19, 1971 AT TWO O'CLOCK P.M. IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE 9 VERNON. CALIFORNIA. COUNCIL PRESENT: Anderson, Furlong, Mail1iard, Ybarra COUNCIL ABSE~IT: Malburg The meeting was called to order by Mayor R. J. Furlong. It was moved by Mai1liard, seconded by Ybarra, that minutes of the meeting of January 5, 1971 be approved as written and submitted. Motion carried. Communication from C. H. McGovern, City Attorney, dated December 16, 1970, with reference to certified check submitted by Hi-Line Power, Inc. with their bid for five (5) 7000 H.P. diesel engine generator assemblies, auxiliaries and spare parts, recom- mending that the certified check in the amount of $27,500.00 be deposited into the City Treasury and that whatever legal remedies may be available be pursued to protect the City's interest, was presented. Mr. Mike Garoogian of Hi-Line Power, Inc. was in the The City Attorney reported orally that he had discussed this matter with Mr. Garoogian, and that Mr. Garoogian requested that this matter be laid over until the next regular meeting. The City Attorney made an oral recommendation that his communication, dated December 16, 1970, be laid over until the next regular meeting of February 2, 1971. It was moved by Anderson, seconded by Mai11iard, that communication from the City Attorney, dated December 16, 1970, with reference to certified check submitted by Hi-Line Power, Inc., be laid over until the next regular meeting of February 2, 1971. Motion carried. Resolution No. 4027 - A Resolution of the City Council of the City of Vernon, relating to Employer-Employee Relations within the City of Vernon, was presented. It was moved by Anderson, seconded by Ybarra, that Resolution No. 4027 be approved and adopted. Motion carried. It was moved by Mai11iard, seconded by Anderson, that Ordinance No. 824 receive a second reading by title. Motion carried. Ordinance No. 824 - An Ordinance of the City of Vernon granting a franchise to the Los Angeles Junction Railway Company, their successors and assigns, to operate and maintain a spur track I I -2- 1 19 71 across Seville Avenue in the City of Vernon, and repealing all ordinances or resolutions in conflict herewith, was read for a second reading by title. It was moved by Anderson, seconded by Ybarra, that Ordinance No. 824 receive and pass a second reading. Motion carried. Ayes: Anderson, Furlong, Mailliard, Ybarra Noes: None Absent: Malburg It was moved by Ybarra, seconded by Anderson, that in accordance with Government Code Section 36934, the reading of Ordinance No. 824 in full be waived; and that Ordinance No. 824 receive a third and final reading by title. It was moved by Mailliard, seconded by Anderson, that copy of Resolution No. 4258 of the City Council of the City of Hawthorne, California, be received and filed. Motion carried. Copy of Resolution No. 162 (1970) of the City Council of the City of San Mateo memorializing the California Legislature to provide meaningful tax relief for the homeowner by enacting legis- lation for tax reform which embodies a balanced revenue program to meet the ongoing needs of cities, was presented. (Copy to each member of the City Council) It was moved by Mailliard, seconded by Anderson, that copy of Resolution No. 162 (1970) of the City Council of the City of San Mateo be received and filed. Motion carried. Communication from the City of Huntington Park, dated January 7, 1971, with reference to mutual aid agreements signed by the City of Huntington Park for fire protection services, was presented. (Copy to each member of the City Council) It was moved by Mailliard, seconded by Ybarra, that communication from the City of Huntington Park, dated January 7, 1971, be received and filed. Motion carried. I I -3- 1 19 71 Communication from Crescent Transportation Company and Crescent Refining and Oil Company, dated January 8, 1971, putting the City of Vernon on notice pursuant to Section 910 of the Government Code relative to an accident which occurred on the morning of October 9, 1970 on Bandini Boulevard just west of Bonnie Beach, was presented. (Copy to each member of the City Council) It was moved by Anderson, seconded by Ybarra, that communication from Crescent Transportation Company and Crescent Refining and Oil Company, dated January 8, 1971, be received and filed. Motion carried. Communication from East-West Truck Terminal, dated January 8, 1971, putting the City of Vernon on notice pursuant to Section 910 of the Government Code relative to an accident which occurred on the morning of October 9, 1970 on Bandini Boulevard just west of Bonnie Beach, was presented. (Copy to each member of the City Council) It was moved by Anderson, seconded by Ybarra, that communi- cation from East-West Truck Terminal, dated January 8, 1971, be received and filed. Motion carried. Communication from L. C. Husted, Fire Chief, dated January 4, 1971, advising that Fireman Ronald A. Hoffman was suspended from duty without pay on December 24, 1970 for violation of the Rules and Regulations of the City of Vernon Fire Department, General Rules, Article 53, was presented. It was moved by Anderson, seconded by Mailliard, that communication from the Fire Chief, dated January 4, 1971, be laid over for discussion at an executive personnel session. Motion carried. Communication from L. C. Husted, Fire Chief, dated January 6, 1971, recommending that Probatlonary Hosemen, Grade 4, Ralph C. Emmons and Dickson H. Skalsky be terminated effective at the close of the working day January 31, 1971, as they failed to pass the final examination, was presented. It was moved by Anderson, seconded by Ybarra, that communi- cation from the Fire Chief, dated January 6, 1971, be laid over for discussion at an executive personnel session. Motion carried. Communication from F. A. Ziemer, City Clerk-Director of Finance, dated January 6, 1971, transmitting a list of records which are recommended for Dnmediate destruction; and recomnending that a resolution be adopted authorizing the destruction of these records, was presented. (Copy to each member of the City Council) Resolution No. 402g - A Resolution of the City Council of the City of Vernon, authorizing the destruction of cer:ta:i.n City records, documents, instruments, books and papers, pursuant to Government Code Section 34090, was presented. It was moved by Mailliard, seconded by Ybarra, that Resolution No. 4029 be approved and adopted. Motion carried. (Copy to each member of the City Council) It was moved by Anderson, seconded by Ybarra, that the recommendations of the Finance Committee be approved as enumerated in co~~unication dated January 11, 1971. Motion carried. Resolution No. 4028 - A Resolution of the City Council of the City of Vernon, restricting the employment of individuals related to other specified employees within the City of Vernon, was presented. It was moved by Ybarra, seconded by Mailliard, that Resolution No. 4028 be approved and adopted. Motion carried. Bush, Superintendent of Building, dated January 8, 1971, with reference to INFORMATION BULLETIN SHL 70-4, Department of Housing & Community Development, Division of Building and Housing Standards, was presented. (Copy to each member of the City Council) It was moved by Ybarra, seconded by Anderson, that communi- cation from the Superintendent of Building, dated January 8, 1971, be received and filed. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated January 11, 1971, recommending that Officers R. F. D'Alessandro and T. L. Miller be reimbursed the sum of $27.05 each from the Education and Training Budget appropriation for Police Science courses, was presented. It was moved by Anderson, seconded by Ybarra, that the recommendation of the Police Chief, dated January 11, 1971, be approved and authority granted to issue warrants in the amount of $27.05 each to R. F. D'Alessandro and T. L. Miller. Motion carried. Communication from R. H. King, Director of Public Works, dated January 12, 1971, requesting authority to add one 20,000 L.M.V. street light on 27th Street near the east end at an annual cost of $72.60, was presented. It was moved by Mailliard, seconded by Anderson, that the request of the Director of Public Works, dated January 12, 1971, be approved. Motion carried. Activity Log of the Police Department for the period January 1 - 15, 1971 inclusive, was presented. It was moved by Mailliard, seconded by Ybarra, that Activity Log of the Police Department be received and filed. Motion carried. "Warrant Register No. 325" covering claims and demands presented during the period January 1 to 15, which includes Demands Nos. 1-120 to 1-295 (both inclusive) drawn on the United California Bank, totaling $922,625.28 (Light and Power Warrants $840,429.55) (Accounting Period January, 1971), was examined and audited. It was moved by Mai11iard, seconded by Ybarra, that UVPayro1l Warrant Register No. 16211 be approved and payment authorized for Demands Nos. 1749 to 1758 (both inclusive), with no exceptions. Zerr, dated January 31, 1971, asking if there is some way to adjust his license fee for selling bakery products in the City of Vernon, was presented. (Copy to each member of the City Council) It was moved by Mailliard, seconded by Anderson, that communication from Mr. Donald J. Zerr, dated January 31, 1971, be referred to the City Attorney for a report. Motion carried. Communication from R. H. King, Director of Public Works, dated January 14, 1971, recommending that the cement lining of Ross Street water main be included in Contract No. 355, Water Main Lining - Phase IV, now in progress, at a cost of approximately $3,024.00 based on the unit prices under this contract, was presented. (Copy to each member of the City Council) It was moved by Mail1iard, seconded by Ybarra, that the Director of Public Works be authorized to issue Extra Work Order No. 1 to Contract No. 355 for cleaning and cement lining the 8-inch water main in Ross Street at an approximate cost of $3,024.00 based on the unit prices under this contract with Pipe Lining Division of Ameron, Inc. Motion carried. Communication from F. A. Ziemer, City Clerk-Director of Finance, dated January 15, 1971, with reference to proposed examination of the records of the State Board of Equalization at Sacramento pertaining to sales and use taxes collected by said Board for the City of Vernon, making certain recommendations in connection therewith, was presented. (Copy to each member of the City Council) It was moved by Mailliard, seconded by Anderson, that the recommendations of the City Clerk-Director of Finance be approved as outlined in communication dated January 15, 1971. Motion carried. Communication from L. C. Husted, Fire Chief, dated January 14, 1971, recommending that certain Fire Department personnel as listed be advanced to the grade indicated effective February 1, 1971, was presented. (Copy to each member of the City Council) I I -6- 1 19 71 It was moved by Anderson, seconded by Ybarra, that the recommendation of the Fire Chief, dated January 14, 1971, be approved. Motion carried. Communication from L. C. Husted, Fire Chief, dated January 15, 1971, recommending that Fireman Paul Pribble be granted a leave of absence without pay for two consecutive working shifts, namely January 30 and February 2, 1971, to attend a safety equipment meeting in Tokyo, Japan, was presented. It was moved by Anderson, seconded by Ybarra, that the recommendation of the Fire Chief, dated January 15, 1971, be approved. Motion carried. Communication from L. C. Husted, Fire Chief, dated January 15, 1971, requesting authority and funds to purchase one Ektagraphic Visual Maker Kit which includes instamstic type camera and equipment at an est~ated cost of $125.00 for the purpose of making visual aids necessary for training members of the Fire Department, was presented. It was moved by Mailliard, seconded by Anderson, that the request of the Fire Chief, dated January 15, 1971, be approved. Motion carried. Report of Health Department Activities for the month of December 1970, was presented. (Copy to each member of the City Council) It was moved by Anderson, seconded by Ybarra, that Report of Health Department Activities be received and filed. Motion carried. The City Attorney reported orally that he had been advised that the Vernon Firemen's Association was not contemplating on immediately filing pursuant to Resolution No. 4027, and for that reason the selection of the Municipal Employee Relations Repre- sentative could be deferred at this t~e. Mr. Lonal Dean White, President of the Vernon Firemen's Association, requested orally that a personnel meeting be held with the City Council to discuss certain personnel problems in the Fire Department. It was moved by Anderson, seconded by Ybarra, that the meeting adjourn until Thursday, January 21, 1971, at 9 o'clock a.m., in the Council Chamber of the City Hall located at 4305 Santa Fe Avenue, Vernon, California, for the purpose of holding an executive session pursuant to Section 54957 of the Government Code.
