19710406 Regular City Council Meeting - Minutes I I MINUTES OF A REGUlAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD APRIL 6, 1971 AT TWO O'CLOCK P.M. IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE. VERNON. CALIFORNIA. COUNCIL PRESENT: Anderson, Furlong, Mai11iard, Malburg, Ybarra COUNCIL ABSENT: None The meeting was called to order by Mayor R. J. Furlong. It was moved by Mai11iard, seconded by Anderson, that minutes of the meeting of March 16, 1971 be approved as written and submitted. Motion carried. The City Attorney announced that an agreement with Hi-Line Power Inc. provided that unless payment was made for the purchase of the diesel plant within 60 days of February 2, 1971, a forfeiture of $37,500.00 was to be made as liquidated damages. Mr. Garoogian of Hi-Line Power Inc. indicated he did not have the funds due and in addition the check for $27,500.00, previously tendered, was not valid. The City Attorney then announced that the City had been restrained by the federal district court from forfeiting the sums set forth above and recommended that the matter be referred to the City Attorney. Mr. Edw.in Bloom, one of the petitioners in the involuntary bankruptcy action, appeared and expressed the desire that he may yet aid in the sale of the facility. It was moved by Malburg, seconded by Ybarra, that the restraining order be referred to the City Attorney for appropriate action. Motion carried. Communication from R. H. King, Director of Public Works, dated March 15, 1971, requesting authority for Raymond R. Rich to attend the Annual Conference of the California Water Pollution Control Association at Palm Springs, California, from April 21 - 23, 1971, with an expense allowance of $167.00, was presented. It was moved by Ybarra, seconded by Mai11iard, that the request of the Director of Public Works, dated March 15, 1971, be approved and authority granted to issue warrant in the amount of $167.00 to Raymond R. Rich. Motion carried. Communication from R. H. King, Director of Public Works, dated March 16, 1971, with reference to office wall on the northeast corner of 37th Street and Santa Fe Avenue damaged by earthquake, recommending that the firm of Da1kom Incorporated be retained for the lump sum of $200.00 to prepare a detailed cost estimate for reconstruction of this office wall 7.5 feet north of the present location; and recommending that the Director of Public Works be authorized to start negotiations for obtaining the necessary right- of-way for the reconstruction of 37th Street and Santa Fe Avenue intersection per City of Vernon Master Plan of Streets, was presented. King, Director of Public Works, dated March 17, 1971, transmitting ten copies of an agreement between the City of Vernon and Container Corporation of America and The Flintkote Company in connection with the 57th Street Relief Sewer; and recommending that this agreement be approved, was presented. (Copy of letter to each member of the City Council) It was moved by Ybarra, seconded by Malburg, that the recommendation of the Director of Public Works, dated March 17, 1971, be approved; and that the Mayor and the City Clerk be authorized to execute agreement between the City of Vernon and Container Corporation of America and The Flintkote Company in connection with the 57th Street Relief Sewer. Motion carried. Communication from R. H. King, Director of Public Works, dated March 30, 1971, transmitting an agreement form prepared by Southern Pacific Transportation Company, for license to install the 57th Street Sewer under its right-of-way in Alameda Street; and recommending, subject to approval by the City Attorney, that this agreement be executed by the City and processed according to instruction outlined in cover letter, dated March 26, 1971, from Southern Pacific Transportation Company, was presented. Resolution No. 4038 - A Resolution of the City Council of the City of Vernon, approving an agreement between the City of Vernon and Southern Pacific Transportation Company for a license to install the 57th Street Sewer, was presented. It was moved by Anderson, seconded by Ybarra, that Resolution No. 4038 be approved and adopted. Motion carried. King, Director of Public Works, dated March 31, 1971, transmitting a proposed agreement for the installation of railroad crossing protection devices at 52nd Street and Santa Fe Railway tracks west of Malabar Street; and recommending that this City-County-Railway agreement be executed by the City and that it be returned to the County for further processing with a certified copy of the minutes provided with each copy of the agreement, was presented. (Copy of agreement to each member of the City Council) It was moved by Mailliard, seconded by Ybarra, that the recommendation of the Director of Public Works, dated March 31, 1971, be approved; and that the Mayor and the City Clerk be authorized to execute agreement between the City of Vernon, County of Los Angeles and The Atchison, Topeka and Santa Fe Railway Company for the installation of railroad crossing protection devices at 52nd Street and Santa Fe Railway tracks west of Malabar Street. Motion carried. Communication from R. H. King, Director of Public Works, dated March 31, 1971, recommending that the City of Vernon make application to the Public Utilities Commission for an allocation of funds to assist in financing crossing protection work at Crossing No. 2H-l.6 on 52nd Street west of Malabar Street, was presented.,_, (Copy to each member of the City Council) :t':C:G . I I -3- 4 6 71 Resolution No. 4039 - A Resolution of the City Council of the City of Vernon, authorizing the submission of a request for the allocation of funds from the Public Utilities Commission of the State of California, was presented. It was moved by Malburg, seconded by Anderson, that Resolution No. 4039 be approved and adopted. Motion carried. Padilla to Captain, Grade 1, effective April 1, 1971, was presented. It was moved by Anderson, seconded by Ybarra, that the request of the Fire Chief, dated March 12, 1971, be approved. Motion carried. Communication from L. C. Husted, Fire Chief, dated March 24, 1971, requesting that R. F. Salisbury be reimbursed the sum of $23.32 and J. A. Wolcott the sum of $11.50 from the Education and Training Budget appropriation for Fire Science courses, was presented. It was moved by Mai11iard, seconded by Anderson, that the request of the Fire Chief, dated March 24, 1971, be approved and authority granted to issue warrants in the amounts as indicated. Motion carried. Communication from L. C. Husted, Fire Chief, dated March 25, 1971, advising that Firemen G. K. Lehrke and J. R. Winfrey were each suspended two shifts, without pay, for violation of the Rules and Regulations of the Vernon Fire Department, section entitled "General Rules, paragraph 13, was presented. It was moved by Mail1iard, seconded by Ybarra, that the action taken by the Fire Chief be approved. Motion carried. Communication from L. C. Husted, Fire Chief, dated March 24, 1971, requesting authority for L. M. Jackson to attend the Emergency Services Fitness Symposium at San Diego, California, from April 21 to 24, 1971, with an expense allowance of $135.20, was presented. It was moved by Mai1liard, seconded by Anderson, that the request of the Fire Chief, dated March 24, 1971, be approved and authority granted to issue warrant in the amount of $135.20 to L. M. Jackson. Motion carried. Copy of Resolution No. 7520 of the City Council of the City of Monterey Park urging state and federal legislation to provide all encompassing and adequate disaster relief fund, was presented. (Copy to each member of the City Council) It was moved by Mailliard, seconded by Malburg, that copy of Resolution No. 7520 of the City Council of the City of MOntprey Park be received and filed. Nemethi, M.D., Health Officer, dated March 17, 1971, requesting authority to attend the General Session of the California Conference of Local Health Officers at Sacramento, California, on April 15 and 16, 1971, with an expense allowance of $189.78, was presented. It was moved by Mail1iard, seconded by Ybarra, that the request of the Health Officer, dated March 17, 1971, be approved and authority granted to issue warrant in the amount of $189.78 to C. E. Nemethi, M.D. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated March 25, 1971, advising that Sergeant W. R. Gilcrease is resigning from the City of Vernon Police Department effective as of the end of his tour of duty, April 30, 1971, was presented. It was moved by Malburg, seconded by Mai11iard, that the resignation of Sergeant W. R. Gilcrease be accepted. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated March 25, 1971, requesting authority to employ Joseph H. Mooney as Policeman, Grade 2, effective as of April 16, 1971, was presented. It was moved by Ybarra, seconded by Anderson, that the request of the Police Chief, dated March 25, 1971, be approved. Motion carried. Activity Log of the Police Department for the period March 16 - 31, 1971 inclusive, was presented. It was moved by Malburg, seconded by Ybarra, that Activity Log of the Police Department be received and filed. Motion carried. "Warrant Register No. 330" covering claims and demands presented during the period March 16 to 31, which includes Demands Nos. 1-814 to 1-924 (both inclusive) drawn on the United California Bank, totaling $63,264.92 (Light and Power Warrants $2,820.75) (Accounting Period April, 1971), was presented. It was moved by Mai11iard, seconded by Ybarra, that ''Warrant Register No. 330" be approved and payment authorized for Demands Nos. 1-814 to 1-924 (both inclusive), with no exceptions. King, Director of Public Works, dated April 1, 1971, advising that Ameron, Incorporated, Pipe Linings Division, has completed the work of cleaning and cement lining of water mains in accordance with Contract No. 355; and recommending that the work be accepted and that authority be granted to pay the contractor in accordance with the agreement, was presented. Resolution No. 4041 .. A Resolution of the City Council of the City of Vernon, accepting the work of Ameron, Incorporated, Pipe Linings Division, for the work of cleaning and cement lining of water mains pursuant to Contract No. 355 of the City of Vernon. was presented. King, Director of Public Works, dated April I, 1971, with reference to bids received for the purchase of a Tractor-Backhoe-Loader Combination in accordance with Contract No. 359, recommending that the contract be awarded to Cook Tractors, Inc. on the basis of their bid of $9,251.00, plus taxes, was presented. ~esolution No. 4042 - A Resolution of the City Council of the City of Vernon, accepting the bid of Cook Tractors, Inc. for a Tractor-Backhoe-toader Combination in accordance with Contract No. 359 of the City of Vernon, was presented. It was moved by Anderson, seconded by Ybarra, that Resolution No. 4042 be approved and adopted. Motion carried. Lindsey without pay for one day, March 23, 1971, for violation of Section 400.17 of the Departmental Manual of Policy and Ethics, was presented. It was moved by Malburg, seconded by Anderson, that the action taken by the Police Chief be approved. Motion carried. Communication from R. H. King, Director of Public Works, dated April 2, 1971, transmitting a proposed License Agreement between the City of Vernon and Wells Fargo Bank covering maintenance of sign in teonis Boulevard; and recommending that, subject to delivery and approval of insurance certificates, the agreement be approved and that the Mayor and the City Clerk be authorized to execute same on behalf of the City of Vernon, was presented. It was moved by Mailliard, seconded by Ybarra, that the recommendation of the Director of Public Works, dated April 2, 1971, be approved; and that the Mayor and the City Clerk be authorized to execute License Agreement between the City of Vernon and Wells Fargo Bank covering maintenance of sign in Leonis Boulevard. Motion carried. Communication from L. S. Hauger, Director of Environmental Health, dated April 2, 1971, requesting that C. E. Nemethi, M.D., Health Officer, be reimbursed the amount($49.30) not reimbursed by the State of California for his attendance at the meeting of the Committee on Environmental Health, California Conference of Local Health Officers, at Berkeley, California on February 19, 1971, was presented. (Copy to each member of the City Council) It was moved by Mailliard, seconded by Ybarra, that the request of the Director of Environmental Health, dated April 2, 1971, be approved and authority granted to issue warrant in the amount of $49.30 to C. It was moved by Anderson, seconded by Ybarra, that the request of the Director of Public Works, dated Ap~il 2, 1971, be approved. Motion carried. Resolution No. 4037 - A Resolution of the City Council of the City of Vernon, opposing Assembly Bill No. 180, was presented. It was moved by Malburg, seconded by Ybarra, that Resolution No. 4037 be approved and adopted. Motion carried. It was moved by Malburg, seconded by Ybarra, that Ordinance No. 827 receive and pass a first reading. Motion carried. It was moved by Malburg, seconded by Anderson, that Resolution No. 4040 be approved and adopted. Motion carried.
