MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF VERNON
HELD JUNE 15, 1971 AT TI~O O'CLOCK
P.M. IN THE COUNCIL CHAMBER OF THE
CITY HALL LOCATED AT 4305 SANTA FE
AVENUE. VERNON. CALIFORNIA.
COUNCIL PRESENT: Anderson, Mailliard, Malburg, Ybarra
COUNCIL ABSENT: Furlong.
The meeting was called to order by Mayor Pro Tempore
Leonis C. Malburg.
It was moved by Ybarra, seconded by Mailliard, that minutes
of the meeting of June 1, 1971 be approved as written and submitted.
Motion carried.
Communication from R. H. King, Director of Public Works,
dated June 1, 1971, advising that C. T. & F. Incorporated has
completed the work of constructing traffic signals at Santa Fe
Avenue and 27th Street in accordance with Contract No. 358; and
recommending that the work be accepted and that authority be granted
to pay the contractor in accordance with the agreement, was presented.
Resolution No. 4056 - A Resolution of the City Council of
the City of Vernon, accepting the work of constructing traffic
signals at Santa Fe Avenue and 27th Street pursuant to Contract No.
358 of the City of Vernon, was presented.
It was moved by Anderson, seconded by Mailliard, that
Resolution No. 4056 be approved and adopted. Motion carried.

Communication from F. A. Ziemer, City Clerk-Directm.. of
Finance, dated June 2, 1971, recommending that Joseph A. Venezia
be advanced from Deputy City Clerk-Senior Public Utility Accountant
(Water), Grade 3 to Grade 2, effective July 1, 1971, was presented.
It was moved by Mai1liard, seconded by Anderson, that the
recommendation of the City Clerk-Director of Finance, dated June 2,
1971, be approved. Motion carried.
Communication from Policeman L. A. Espinoza, dated May 17,
1971, requesting permission to lease the city-owned apartment at
3384 E. 50th Street, was presented. (Copy to each member of the

It was moved by Anderson, seconded by Ybarra, that the
city-owned apartment at 3384 E. 50th Street be leased to Lo A.
Espinoza. Motion carried.
Communication from the Los Angeles County Board of Super~
visors, dated June 2, 1971, requesting that city councils in
municipalities with their own library services to consider consoli~
dation with the County library system, was presented. (Copy to each

It was moved by Anderson, seconded by Ybarra, that the
Los Angeles County Board of Supervisors be notified that the City of
Vernon is not interested in consolidating its library services with
the County library system. Motion carried.
Communication from the Finance Committee, dated June 3,
1971, making certain enumerated recommendations, was presented.

It was moved by Anderson, seconded by Ybarra, that the
recommendations as enumerated in communication from the Finance
Committee, dated June 3~{971, be approved. Motion carried.
Communication~}from L. C. Husted, Fire Chief, dated June 7,
1971, requesting that Firemen Dale L. Brittingham and James F. Smith
be granted a leave of absence with pay to attend annual military
training from June 12 through June 26, 1971, was presented.
It was moved by Ybarra, seconded by Anderson, that the
request of the Fire Chief, dated June 7, 1971, be approved. Motion
carried.
Communication from Sgt. G. W. Walter, dated June 8, 1971,
advising that he is making application for Disability Retirement,
effective as of July 1, 1972; and requesting that he be placed on
a Leave of Absence, with pay, not to exceed one (1) year, as provi.rled
for under Section 4850 of the Labor Code of the State of California,
was presented. (Copy to each member of the City Council)
Mayor Pro Tempore Malburg asked the City Attorney if the
City had to rely on the letter from the Public Employees' Retirement
System regarding Industrial Disability Retirement for Sgt. G. W.
Walter.
The City Attorney advised that the City does not have to
rely on the letter from the Public Employees' Retirement System
regarding Industrial Disability Retirement for Sgt. G. W. Walter.
It was moved by Ybarra, seconded by Anderson, that con~uni-
cation from Sgt. G. W. Walter, dated June 8, 1971, be referred to
the City Attorney for investigation and report. Motion carried~
Communication from R. H. King, Director of Public Works~
dated June 8, 1971, requesting authority to attend an Occupational
Safety and Health Act Symposium at the Proud Bird, Los Angeles on
June 23, 1971, with an expense allowance of $15.00, was presented.
It was moved by Anderson, seconded by Mailliard, that the
req".iest of the Director of Public Works, dated June 8, 1971, be
approved and authority granted to issue warrant in the amount of
$15.00 to R. H. King. Motion carried.
Communication from C. E. Nemethi, M.D., Health Officer,
dated June 8, 1971, requesting authority for Louis S. Hauger to
attend an Occupational Safety and Health Act Symposium at Los
Angeles on June 23, 1971, with an expense allowance of $15.00, was

It was moved by Anderson, seconded by Mailliard, that the
request of the Health Officer, dated June 8, 1971, be approved and
authority granted to issue warrant in the amount of $15.00 to
Louis S. Hauger. Motion carried.
Mr. Harry J. Keaton, Municipal Employee Relations Repre-
sentative, appeared before the City Council and advised that he had
met and conferred with representatives of the Vernon Firemen's
Association (Group of Recognition (1) and Group of Recognition (4).
Mr. Keaton further advised the City Council that in view of available
time, he had entered into two (2) Memoranda of Understanding, subject
to determination by the City Council, providing that the Association
would join in recommending the five (5) percent pay raise recommended
by the Finance Committee at the meeting of the City Council on June
1, 1971; to recommend that the Council authorize a PERS survey; and
to recommend that the Municipal Employee Relations Representative
be authorized to meet and confer with the Association on other
matters listed in the Memoranda and to submit any Memoranda of
Understanding reached as a result to the City Council for its deter-
mination during budget year 1971-72. (Mr. Keaton distributed copies
of each Memorandum of Understanding to each member of the City
Council)
It was moved by Mailliard, seconded by Anderson, that the
Memorandum of Understanding for each of said Groups be approved by
the City Council of the City of Vernon. Motion carried.
Communication from R. H. King, Director of Public Works,
dated June 9, 1971, requesting authority to advance certain employees
as listed, effective July 1, 1971, was presented. (Copy to each
member of the City Council)
It was moved by Anderson, seconded by Ybarra, that the
request of the Director of Public Works, dated June 9, 1971, be
approved. Motion carried.
''Warrant Register No. 335" covering claims and demands
presented during the period June 1 to 15, which includes Demands
Nos. 1-1484 to 1-1649 (both inclusive) drawn on the United Ca1iforn:ta
Bank, totaling $985,786.74 (Light and Power Warrants $943,218.77)
(Accounting Period June, 1971), was examined and audited.
It was moved by Mailliard, seconded by Ybarra, that
'''tvarrant Register No. 335" be approved and payment authorized for
Demands Nos. 1-1484 to 1-1649 (both inclusive), with no exceptions.

"Payroll It/arrant Register No. 167" covering claims and
demands presented during the period May 1 to 31, which includes
Demands Nos. 1794 to 1801 (both inclusive), dr$NTI on the Crocker-
Citizens National Bank, totaling $319,840.35 (Accounting Period
May, 1971), was examined and audited.
It was moved by Mai11iard, seconded by Ybarr.a, that
"Payroll Warrant Register No. 167" be approved and payment authorized
for Demands Nos. 1794 to 1801 (both inclusive), vlith no exceptions.
Motion carried.

Report of Health Department Activities for the month of
May, 1971, was presented. (Copy to each member of the City Council)
It was moved by Anderson, seconded by Ybarra, that Report
of Health Department Activities be received and filed. Motion
carried.
Activity Log of the Police Department for the period
June 1 - 14, 1971 inclusive, was presented.
It was moved by Ybarra, seconded by Anderson, that Activity
Log of the Police Department be received and filed. Motion carried.
Communication from V. R. Bush, Superintendent of Building,
dated June 10, 1971, recommending that Clougherty Packing Company
be ordered to vacate the main building complex at 3049 E. Vernon
Avenue; and not be permitted to reoccupy until all work of rehabi-
litation has been completed and approved by the Building and Fire
Departments, was presented. (Copy to each member of the City
Council)
Mr. Henry Himmelfarb, Attorney at Law, appeared before
the City Council and stated that he was representing the C1ougher.ty
Packing Company as Mr. V. R. Poxon, Attorney for Clougherty Packing
Company, was unable to be present at this meeting; and requested
that this matter be laid over until July 6, 1971 so Mr. Poxon could
be present.
Mr. E. L. Schroeder, Structural Engtneer employed by
Clougherty Packing Company, addressed the City Council relative to
work being done on the premises at 3049 E. Vernon Avenue.
Mr. Bush stated that he had no objection to the Clougherty
Packing Company matter being laid over until the next regular
meeting.
It was moved by Mail1iard, seconded by Ybarra, that
communication from V. R. Bush, Superintendent of Building, dated
June 10, 1971, be laid over until the meeting of July 6, 1971.
Motion carried.
Communication from R. H. King, Director of Public Works,
dated June 10, 1971, advising that the operations of the Carl
Wilson Laboratories will be taken over by the Bio-Technics
Laboratories; and recommending that the City continue to use this
laboratory under its new ownership for our chemical and bacterial
analysis of our ~~ater samples as required by the State of California
Department of Health, was presented.
It was moved by Anderson, seconded by Ybarra, that trv3
recommendation of the Director of Public Works, dated June 10, 1971,
be approved. Motion carried.
Communication from L. C. Husted, Fire Chief, dated June 9,
1971, requesting authority and funds in the amount of $90.00 to
enroll Administrative Assistant Chief Do W. Perkins in a home study
course entitled "Municipal Fire Administration" offered by the
International City Management Association, was presented.

It was moved by Mai1liard, seconded by Ybarra, that the
request of the Fire Chief, dated June 9, 1971, be approved and
authority granted to issue warrant in the amount of $90.00 to
D. W. Perkins. Motion carried.
Resolution No. 4060 - A Resolution of the City Council of
the City of Vernon fixing the compensation for certain employees of
said City as of July 1, 1971, authorizing certain expense allowances,
and repealing all resolutions in conflict herewith, was presented.
It was moved by Anderson, seconded by Ybarra, that
Resolution No. 4060 be approved and adopted. Motion carried.

Resolution No. 4061 - A Resolution of the City Council of
the City of Vernon, approving budget for the fiscal year 1971-72,
was presented. (Copy to each member of the City Council)
It was moved by Mai11iard, seconded by Ybarra, that
Resolution No. 4061 be approved and adopted. Motion carried.

Resolution No. 4057 - A Resolution of the City Council of
the City of Vernon, continuing the retention of Paul P. Hendricks
as Consulting Electrical Engineer of the City of Vernon, was
presented.
It was moved by Anderson, seconded by MailliardJ that
Resolution No. 4057 be approved and adopted. Motion carried.

"Amendment to Memorandum of Agreement" dated June 15, 1971,
between the City of Vernon and Charles H. McGovern, Attorney at Law,
to be effective July 1, 1971, was presented.
It was moved by Anderson, seconded by Ybarra, that the
Mayor and the City Clerk be authorized to execute "Amendment to
Hemorandum of Agreement", dated June 15, 1971, between the City of
Vernon and Charles H. McGovern, Attorney at Law, to be effective
July 1, 1971. Motion carried.
The City Attorney presented a communication from Underwriter,
Adjusting Company, dated June 11, 1971, with reference to the City's
claim in the amount of $6,527.77 against their insured, Anthony Banda,
offering a compromise settlement in the amount of $4,500.00 in view
of the insured limits~
It was moved by Ybarra, seconded by Mailliaro, that the
City accept the $4,500.00 compromise settlement and sign a release.

The City Attorney reported that the Fire and Police
Commission had received a communication from Fireman George F. Bass
asking for a hearing on certain personnel matters; and that the Fire
and Police Commission had recommended that this matter be referred
to the City Council with a suggestion that following the regular
meeting of July 6, 1971 that the City Council go into Executive
Session to hear from Mr. Bass since his contentions constitute a
personnel ~tter.
It was moved by Ybarra, seconded by Mai1liard, that
following the regular meeting of the City Council on July 6, 1971
that the City Council go into Executive Session to hear Fireman
George F. Bass. Motion carried.
Resolution No. 4058 .. A Resolution of the City Council of
the City of Vernon, conunending Lester C. Husted for his many years
of service to the City of Vernon, was presented.
It was moved by Anderson, seconded by Ybarra, that
Resolution No. 4058 be approved and adopted. Motion carried.

There being no further business to come before the meeting,
it was moved by Anderson. seconded by Ybarra, that the meeting
adjourn. Motion carried.
