MINUTES OF A REGUlAR MEETING OF THE
CITY COUNCIL OF THE CITY OF VERNON
HELD JULY 6, 1971 AT TWO O'CLOCK
P..M. IN THE COUNCIL CHAMBER OF THE
CITY HALL LOCATED AT 4305 SANTA FE
AVENUE~ VERNON, CALIFORNIA.
COUNCIL PRESENT: Anderson, Furlong, Mailliard, Malburg, Ybarra
COUNCIL ABSENT: None
The meeting was called to order by Mayor R. J. Furlong.
It was moved by Ybarra, seconded by Mailliard, that minutes
of the meeting of June 15, 1971 be approved as written and submitted.
Motion carried.
Communication from V. R. Bush, Superintendent of Building,
dated June 10, 1971, recommending that Clougherty Packing Company
be ordered to vacate the main building complex at 3049 E. Vernon
Avenue; and not be permitted to reoccupy until all work of rehabili-
tation has been completed and approved by the Building and Fire
Departments, was presented. (Copy to each member of the City Council)

Mr. Vincent R. Poxon, Attorney at Law, representing
Clougherty Packing Company, appeared before the City Council and
distributed copies of STATEMENT ON BEHALF OF CLOUGHERTY PACKING
COMPANY TOGETHER WITH SUPPORTING DATA, dated July 6, 1971. Mr.
Poxon commented on the supporting data submitted, and requested
that the City Council consider all facts before reaching a decision
in this matter.
V. R. Bush, Superintendent of Building, commented on the
statement and supporting data, dated July 6, 1971, as submitted by
Mr. Poxon.
Mr. Poxon submitted structural analysis reports to Mr.
Bush at the meeting.
Mr. J. J. Rodriguez, Executive Secretary for Butcher's
Union No. 563, representing approximately 1,000 employees of
Clougherty Packing Company, addressed the City Council, and appealed
to the City Council on behalf of the employees not to order the main
building complex at 3049 E. Vernon Avenue vacated.
It was moved by Anderson, seconded by Mai11iard, that the
deadline for bringing the main building complex at 3049 E. Vernon
Avenue into compliance with the requiremEnts of the Building and
Fire Departments be extended for six months from this date. Motion
carried.

Communication from R. H. Bockhacker, Police Chief, dated
June 16, 1971, requesting authority to advance D. J. Castellanos
to Policeman, Grade 2, and H. N. Sto1an to Policeman, Grade 3,
effective July 1, 1971, was presented.
It was moved by Anderson, seconded by Ybarra, that the
request of the Police Chief, dated June 16, 1971, be approved. Motion
carried.

Communication from the State of California, Division of
Highways, dated June 18, 1971, advising that tbe sum of $10,942.00
representing the City of Vernon's apportionment of TOPICS funds for
tbe 1969-1970 fiscal year has been reapportioned to the City of
Maywood in accordance with action taken by the Vernon City Council
at its meeting of March 2, 1971, was presented. (Copy to each member
of the City Council)
It was moved by Ybarra, seconded by Mai1liard, that communi-
cation from the State of California, Division of Highways, dated
June 18, 1971, be received and filed. Motion carried.
Communication from O. W. Perkins, Acting Fire Chief, dated
June 21, 1971, requesting that he be authorized an allowance of
$85.00 per month for use of his privately owned vehicle in City
service, effective July 1, 1971, was presented.
It was moved by Malburg, seconded by Ybarra, that the
request of the Acting Fire Chief, dated June 21, 1971, be approved.
Motion carried.
Communication from D. W. Perkins, Acting Fire Chief, dated
June 21, 1971, requesting that Sheldon W. Bardin be granted a
mtlitary leave of absence with pay from July 10 through 24, 1971
to participate in annual training, was presented.
It was moved by Anderson, seconded by Ybarra, that the
request of the Acting Fire Chief, dated June 21, 1971, be approved.
Motion carried.
Communication from R. H. King, Director of Public Works,
dated June 22, 1971, transmitting a proposed License Agreement
between the City of Vernon and Kal Kan Food Incorporated covering
wall sign on the north side of 45th Street and pipe bridge across
44th Street; and recommending that the Agreement be approved, that the
Mayor and City Clerk be authorized to execute on behalf of the City
and that the performance bond requirement be waived for the remainder
of the life of the agreements previously executed, was presented.

It was moved by Mailliard, seconded by Anderson, that the
recommendations of the Director of Public Works, dated June 22, 1971,
be approved; and that the Mayor and the City Clerk be authorized to
execute License Agreement between the City of Vernon and Kal Kan
Food Incorporated covering wall sign on the north side of 45th Street
and pipe bridge across 44th Street. Motion carried.
Communication from R. H. King, Director of Public Works,
dated June 23, 1971, transmitting a proposed License Agreement betweet7
the City and The Pep Boys - M: anny, Moe & Jack covering maintenanc(~
of footings in 45th Street and Seville Avenue in connection with
addition to their Vernon facility; and reconm:lending that the agreemenc
be approved and that the Mayor and the City Clerk be authorized
to execute on behalf of the City, ~1aS presented.
It was moved by Mailliard, seconded by Malburg, that the
recommendation of the Dir~ctor of Public Works, d~ted June 23, 1971,
be approved; and that the Mayor and the City Clerk be authorized to
execute License Agreement betw~cn the City of Vernon and The Pep Boys-
Manny, Moe & Jack covering maint~nance of footings in 45th Street and

Communication from F. A. Ziemer, City Clerk-Director of
Finance, dated June 24, 1971, with reference to the 73rd Annual
Conferet'.ce of the League of California Cities to be held in San
Francisco from September 26 to 29, 1971, inclusive, making certain
recommendations in connection therewith, was presented. (Copy to
each member of the City Council)
It was moved by Ybarra, seconded by Mai11iard, that the
recommendations of the City Clerk-Director of Finance with reference
to the 73rd Annual Conference of the League of California Cities be
approved as outlined in communication dated June 24, 1971. Motion
carr ied .
''Warrant Register No. 336" covering claims and demands
presented during the period June 16 to 30, which includes Demands
Nos. 1-1650 to 1-1741 (both inclusive) dr~~ on the United California
Bank, totaling $76,085.23 (Light and Power Warrants $8,189.81)
(Accounting Period June & July, 1971), was examined and audited.
It was moved by Mai1liard, seconded by Ybarra, that
"Warrant Register No. 336" be approved and payment authorized for
Demands Nos. 1-1650 to 1-1741 (both inclusive), with no exceptions.
Motion carried.

Activity Log of the Police Department for the period June
15 - 30, 1971 inclusive, was presented.
It was moved by Malburg, seconded by Anderson, that Activity
Log of the Police Department be received and filed. Motion carried.
Three Memorandums were presented from the League of
California Cities, Los Angeles County Division, dated June 24, 1971,
relative to the following subjects:
(1) Request for League Annual Conference Resolutions
from Cities
(2) Shoreline Legislation
(3) Provision of Law Enforcement Services by the
Sheriff in Los Angeles County
(Copy of each Memorandum to each member of the City Council)
It was moved by Mailliard, seconded by Malburg, that three
Memorandums from the League of California Cities, Los Angeles County
Division, dated June 24, 1971, be received and filed. Motion carried.
Communication from R. H. King, Director of Public Works,
dated June 25, 1971, with reference to proposed Slauson Freeway
(Route 90) alternate alignments, transmitting a summary of a study
conducted for determining the impact that the Fruitland Avenue
alignment will have on jobs within the City of Vernon, was prcsentedA

It was moved by Anderson, seconded by Mailliard, that
communication from R. H. King, Director of Public Works, dated June
25, 1971, be received and filed. Mot ion carried.

Communication from D. W. Perkinst Acting Fire Chieft dated
June 28, 1971, requesting that Fireman Howard T. Stubbins be
reimbursed the amount of $24.05 from the Education and Training
Appropriation budget for a Fire Service Hydraulics course at Los
Angeles Harbor College, was presented.
It was moved by Mailliard, seconded by Ybarra, that the
request of the Acting Fire Chief, dated June 28, 1971, be approved
and authority granted to issue warrant in the amount of $24.05 to
Howard T. Stubbins. Motion carried.
Communication from R. H. King, Director of Public Works,
dated June 29, 1971, requesting authority to install 61 new street
lights on Bandini Boulevard between Downey and Atlantic and to take
over 23 existing L.A. Junction Railway street lights at various
crossings within the City, was presented. (Copy to each member of
the City Council)
It was moved by Malburg, seconded by Anderson, that the
request of the Director of Public Works, dated June 29, 1971, be
approved. Motion carried.
Communication from the City of Half Moon Bay, dated June
24, 1971, requesting that the City of Vernon support Senate Bill No.
1354 relative to coastal legislation, was presented. (Copy to each
member of the City Council)
Resolution No. 4062 - A Resolution of the City Council of
the City of Vernon, recommending the adoption of Senate Bill 1354
as amended in the Senate May 20, 1971, was presented.
It was moved by Ybarra, seconded by Mai11iard, that
Resolution No. 4062 be approved and adopted. Motion carried.

Communication from C. H. McGovern, City Attorney, dated
June 29, 1971, with reference to the request of Sgt. G. W. Walter
for Leave of Absence, with pay, not to exceed one (1) year, as
provided for under Section 4850 of the Labor Code of the State of
California, was presented. (Copy to each member of the City Council)
It was moved by Mailliard, seconded by Anderson, that
communication from the City Attorney, dated June 29, 1971, be
received and filed. Motion carried.
Communication from the County of Los Angeles, Department of
Animal Control, dated June 24, 1971, with reference to City-County
contract for Animal Control, requesting the City Council to increase
the Dog License fee from the present fee of $4.00 to $5.00 to be
effective July 1, 1971, was presented. (Copy to each member of the

Ordinance No. 829 - An Ordinance of the City of Vernon,
amending S~~ct ion 3.23 of Chapter 3 of the Code of the City of Vernon,
California, 1959, was read by title for a first reading.

It was moved by Mai11iard, seconded by Malburg, that
Ordinance No. 829 receive and pass a first reading. Motion carried.

Communication from R. H. King, Director of Public Works,
dated June 29, 1971, transmitting Contract No. 362 for Water Main
Lining - Phase V; and recommending that the contract be approved
and that authority be granted to advertise for bids, was presented.
Resolution No. 4059 - A Resolution of the City Council of
the City of Vernon, approving Contract No. 362 for Water Main Lining-
Phase V, in accordance with Contract No. 362 of the City of Vernon,
was presented.
It was moved by Mail1iard, seconded by Ybarra, that
Resolution No. 4059 be approved and adopted. Motion carried.

Communication from V. R. Bush, Superintendent of Building,
dated July 2, 1971, requesting permission to attend the meeting of
Seismology Sub-committee of the International Conference of Building
Officials at Monterey, California on July 22 and 23, 1971, was
presented. (Expenses to be reimbursed by ICBO)
It was moved by Mai11iard, seconded by Anderson, that the
request of the Superintendent of Building, dated July 2, 1971, be
approved. Motion carried.
Ordinance No. 828 - An Ordinance of the City of Vernon,
fixing certain rates to be charged for electrical energy distributed
and supplied by said City of Vernon, within its boundaries, was read
by title for a first reading.
It was moved by Malburg, seconded by Ybarra, that Ordinance
No. 828 receive and pass a first reading. Motion carried.

Absent: None
At this time, 3:10 o'clock p.m., Mayor Furlong called the
City Council into executive session pursuant to Section 54957 of the
Government Code for the purpose of hearing Fireman George F. Bass
on certain personnel matters. All persons, with the exception of
the City Clerk, the City Attorney and Fireman Bass were excluded
from the executive session.
The City Council met in executive session with Fireman
Bass.
No action was taken.
Mayor Furlong ordered that communications to and from the
executive session were deemed private.

There being no further business to come before the meeting,
it was moved by Malburg, seconded by Anderson, that the meeting
adjourn. Motion carried.
