MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF VERNON
HELD SEPTEMBER 7, 1971 AT !VIO O'CLOCK

The meeting was called to order by Mayor R. J. Furlong.
It was moved by Mailliard, seconded by Ybarra, that
minutes of the meeting of August 17, 1971 be approved as written
and submitted. Motion carried.
Communication from R. H. King, Director of Public works,
dated August 16, 1971, transmitting proposed Ordinance No. 830
g't'anting a Franchise to the Los Angeles Junction Railway Company
to operate and maintain a spur track across Soto Street just south
of Vernon Avenue; and recommending that the Ordinance be adoptc~d~
was presented.
The City Clerk distributed copies of Ordinance No. 830
to the members of the City Council.
Ordinance No. 830 - An ordinance of the City of Vernon
granting a franchise to the Los Angeles Junction Railway Company,
their successors and assigns, to operate and maintain a spur track
across Soto Street in the City of Vernon, and repealing all or-
dinances or resolutions in conflict herewith, was read by title for
a first reading.
It was moved by Anderson, seconded by Mailliard, that
Ordinance No. 830 receive and pass a first reading. Motion carried.

Communication from Paul P. Hendricks, Consulting Electri-
cal Engineer, dated August 20, 1971, recommending that authority be
granted to sell certain accumulated material considered junk or
obsolete to Ekco Metals, the highest bidder, for the sum of $559.00
for the lot, was presented. (Copy to each member of the City
Council)
It was moved by Ybarra, seconded by Malburg, that the
recommendation of the Consulting Electrical Engineer, dated Al'gust
20, 1971, be approved; and that certain accumulated material con-
sidered junk or obsolete be sold to Ekco Metals for the sum of:
$559.00 for the lot. Motion carried.
Communication from V. R. Bush, Superintendent of Building,
dated August 10, 1971, requesting authority for R. H. Patnaude
to attend the 1971 Annual Meeting - International Association of
Plumbing and Mechanical Offi.cials at Sacramento, California from
September 27 to October 1, 1971, with an expense allowance of
$226.00, was presented.
It was moved by Ybarra, seconded by Anderson, that the
request of the Superintendent of Building, dated August 10, 1971,
be approved and authority granted to issue warrant in the amount of
$226.00 to R. H. Patnaude. Motion carried.

Communication from R. H. Bockhacker, Police Chief, dated
August 24, 1971, requesting that Sergeant S. E. Putman be authorized
to attend the "Criminal Investigation for Field Personnel" Seminar
which is being presented by the Department of Police Science and
Administration, California State College, Los Angeles, California,
from September 23 to 25, 1971, inclusive, with an expense allowance
of $35.00 for tuition fee, was presented.
It was moved by Malburg, seconded by Mail1iard, that the
request of the Police Chief, dated August 24, 1971, be approved and
authority granted to issue warrant in the amount of $35.00 to S4 Eo
Pt:itman. Motion carried.
Communication from R. H. King, Director of Public Works,
dated August 25, 1971, requesting that Lewis R. Adams be reimbursed
the sum of $37.95 for attending the Water System Control Committee
Meeting at Millbrea, California on August 17, 1971, was presented.
It was moved by Anderson, seconded by Ybarra, that the
request of the Director of Public Works, dated August 25, 1971,
be approved and authority granted to issue warrant in the amount of
$37.95 to Lewis R. Adams. Motion carried.
Communication from R. H. Bockhacker, Police Chief, dated
1971, requesting authority to appoint an additional
replace Officer A. G. Olhausen who has been absent from
April 11, 1971 because of a line of duty injury, wa.s

request of the Police Chief, dated August 31, 1971, be approved.

Communication from R. H. Bockhacker, Police Chief, dated
August 26, 1971, requesting authority for Sgt. F. E. Sweeney to
attend the State Narcotics Officers Training Conference at South
Lake Tahoe from October 20 to 22, 1971, inclusive, with an expense
allowance of $197.00, was presented.
It was moved by Malburg, seconded by Ybarra, that the
request of the Police Chief, dated August 26, 1971, be approved and
authority granted to issue warrant in the amount of $197.00 to
F. E. Sweeney. Motion carried.
Communication from R. H. Bockhacker, jPo1ice Chief, dated
August 31, 1971, requesting authority for Officer J. A. Miller to
attend the State Narcotics Officers Training Conference at Sou.th
Lake Tahoe from October 20 to 22, inclusive, with an expense allow-
ance of $197.00, was presented.
It was moved by Malburg, seconded by Ybarra, that the "l"(!'.

Communication from R. H. Bockhacker, Police Chief, dated
August 31, 1971, recommending that Officer G. G. Skalsky be reim-
bursed the sum of $56.00 from the Education and Training Budget
~ppropriation for Police Science courses at Rio Hondo College was
presented.

It was moved by Anderson, seconded by Ybarra, that the
recommendation of the Police Chief, dated August 31, 1971, be
approved and authority granted to issue warrant in the amount of
$56.00 to G. G. Skalsky. Motion carried.
"vlarrant Register No. 340" covering claims and demands
presented during the period August 16 to 31, which includes Demands
Nos. 1-2148 to 1-2258 (both inclusive) drawn on the United Califor-
nia Bank, totaling $127,733.69 (Light and Power Warrants $2,850.40)
(Accounting Period September, 1971), was examined and audited.
It was moved by Mailliard, seconded by Ybarra, that
"vJarrant Register No. 34011 be approved and payment authorized for
Demands Nos. l-2l48 to 1-2258 (both inclusive), with no exceptions.

examined and audited.
It was moved by Mailliard, seconded by Ybarra, that
"Payroll vTarrant Register No. 170" be approved and payment author-
ized for Demands Nos. 1820 to 1829 (both inclusive), with no ex-
ceptions. Motion carried.

Activity Log of the Police Department for the period
August 16 - 31, 1971, inclusive, was presented.
It was moved by Malburg, seconded by Ybarra, that Ac-
tivity Log of the Police Department be received and filed. Motion
carried.
Communication from R. H. Bockhacker, Police Chief, dated
September 1, 1971, advising that Lt. James L. Morrison has informed
him that his health will not permit him to continue with his duties
as a Police Lieutenant and that he is making application for Dis-
ability Retirement; and recommending, that in accordance with Labor
Code Section 4850, Lt. J. L. Morrison be retained on the payroll for
a period of twelve months, effective as of September 1, 1971, or
until his retirement is approved, but not to exceed September lj
1972, was presented. (Copy to each member of the City Council)
It was moved by Mailliard, seconded by Malburg, that
communication from the Police Chief, dated September 1, 1971, be
referred to the City Attorney for investigation and report.

commending the Vernon Fire Department on their excellent service,

Communication from D. W. Perkins, Acting Fire Chief, dated
September 3, 1971, requesting that certain personnel as listed be
reimbursed the amounts as indicated from the Education and Training
Budget appropriation for courses in Fire Science, was presented.

It was moved by Anderson, seconded by Ybarra, that the
request of the Acting Fire Chief, dated September 3, 1971, be
approved and authority granted to issue warrants in the amounts as
indicated. Motion carried.
Communication from D. W. Perkins, Acting Fire Chief, dated
August 31, 1971, advising that Fireman R. W. Leu was granted a six
month leave of absence commencing March 7, 1971; and recommending
that his name be deleted from the payroll as he has not returned to
duty, was presented.
It was moved by Anderson, seconded by Ybarra, that the
recommendation of the Acting Fire Chief, dated August 31, 1971, be
approved. Motion carried.
Communication from R. H. King, Director of Public Works,
dated September 3, 1971, transmitting an easement prepared by The
Atchison, Topeka and Santa Fe Railway Company relating to the widen-
ing of 37th Street across their property; and recommending that the
easement be accepted, was presented.
It was moved by Ybarra, seconded by Malburg, that Ease-
ment be accepted from The Atchison, Topeka and Santa Fe Railway
Company; and that the Mayor and the City Clerk be authorized to
execute Certificate of Acceptance. Motion carried.
At this time, 2:22 o'clock p.m., Mayor Furlong called the
City Council into executive session pursuant to Section 54957 of the
Government Code for the purpose of discussing the appointment of a
permanent Fire Chief and for the purpose of discussing other Fire
Department personnel problems. All persons, with the exception of
the City Clerk and the City Attorney, were excluded from the execu~
tive session.
After discussing and considering the qualifications of all
applicants, it was moved by Anderson, seconded by Malburg, that
Robert M. Eatherly be appointed Fire Chief, Step 4 , on a probation-
ary period of not to exceed one year, effective September 8, 1971;
and that he be granted the sum of $85.00 per month for using his own
motor vehicle in the service of the City. Motion carried.

It was moved by Malburg, seconded by Ybarra, that Acting
Chief D. W. Perkins be reclassified as Administrative Assistant
Chief, Grade 3, effective September 8, 1971; and that car allowance
previously authorized be rescinded,'. effective September 8, 1971.
Hotion carried.
It was moved by Malburg, seconded by Anderson, that Robert
M. Eatherly be authorized to attend the 73rd Annual Conference of the
League of California Cities to be held in San Francisco from Septem-
ber 26 to 29, 1971, with an expense allowance of $269.47. Motion
carried.

It was moved by Anderson, seconded by Ybarra, that Robert
M. Eatherly be authorized to attend the 76th Annual Conference of
the "Western Fire Chiefs" at Las Vegas, Nevada, with an expense
allowance of $169.00. Motion carried.
There being no further business to come before the meeting:
it was moved by Mailliard, seconded by Ybarra, that the meeting ad-
journ. Motion carried.
